We filed DCF in London. Husband is USC but living in UK and had never filed US tax returns. Didn't know he needed to. He had to file 3 years tax returns as minimum before we had the interview. We were asked for them, even though all of our financial proof was on assets, rather than income. So my advice would be to file the missing returns late, just so you are up to date with all tax returns. That way, it won't come back to bite you.

I am getting my eveidence together for cr1 interview.
The only problem is my husband has only been out of prison, a year and a half..so we only have one tax return!
It states that you need 3, but dont know what to do as he doesnt have any, as he was in prison for 4 years.

Hello Me again,

I have another question about the I130 Visa Interview.

My husband has 2 felonys and got out of jail around 2 years ago.
He has been on the straight and narrow, however he has a bad past.
He has got in trouble for drugs, aggravated robbery etc.
I am quite worried, as Im scared i will not be approved as I was arrested as a minor around 3 years ago.
I recieved a warning for shop lifting, and have not ever got into trouble since.
I have been awake for nights on end, trying to find some reassurance.
I know that they do not take it to seriously, as I was only 17 at the time, and although it was a crime of moral turpitude, as it only happend once and i was underage t shouldnt be a problem. However it was not 5 years ago. It has been just over 3.
Im worried that the officer will look at my husbands past, and then see that i made a mistake at 17, and make judgement on that.

If anyone could help i would appreciate it.

My husband makes only $13,000 p/a
Thats what his tax returns say, as his boss pays part cash. So only around half goes on the tax return.
My husband is looking for a new job, before he puts in the I164.
So he will earn more money. However im assuming they will only be checking last years tax return.

So he needs someone to sponser
Cn this be anyone?
His mum says she will be happy to sponser?
I thnk this will be ok, just wanted to check if im right.
My husband thinks it has to be someone un related..
Cn anyone clarify?

Hi There
Up until today, my biggest fear was being denied because of my criminal record, now I have even more worry, and I hope someone can help.

I was arrested at 17 for shoplifting. I have to say how informa this was, hence the reason i never dreamed it would be on my record.
I got arrested once when I was 17 3 and a half years ago. Since then I have travelled 4 times on the Visa Waver Programme.

When filling out the bording card, I always ticked no, on the criminal history convictions question.

Maybe i was nieve and stupid, but i genrally thought i was right to tick that at the time.

Could any one please tell me if they have made a similar mistake, and the outcome.

My husband and I, have just recieved our I164 support form.
We are a bit confused.
My husband has worked for a landscape company for the last year.. and has come to the desision that he wants to leave his job.
He has already have a few job offerings..the only reason he hasnt taken them, is because we dont want to mess up on nvc records.
Does anyone know if this is true or not?
Will it matter if he swaps jobs, during the process?

Yes I am very exited to see him.
Im starting to think ive aged since starting this visa buisness..down to the stress and worry about seeing him.
As so far we have met in between in Barcelona and London.
Fortunatly he has his job back now. So all is ok there.
Secondly he dont have alot of money to bring. As he paid tons for the ticket.
However he reserve a hostel..and has a confirmation. Well of a deposit.
He is bringing his credit card. But i dont think it works..but if they ask hes gonna say he will pay for it on that.
Im just worrried there gonna raise an eyebrow. As he was only here in may. Stayed till July.
Now hes booked again..Do you think they may wonder why so often?
Hes bringing like £300 and travelling light.
I was wondering what he should say when asked why he was here for two months? I was going to say he ran into an old friend? and then his boss gave him time off as work was slow?? But then they may ask who? and cross question.
I guess the reason im so paronoid is because I was refused entry to the USA.
I didnt think he was marked when he left london. But apparently when leaving in July, they stamped him in shannon by US immigration. So it looks like they will know.

First of all I am writing for some advice.

My husband left his job today, as he hated it. We thought it would be best to leave now. Before we submit the I164.
He booked a tickit to London to come see me, this Friday as a anniversary surprise.
Im just a little worried. He only visited uk in may. Stayed 2 months. Now he is coming again. Do you think they will question him alot at the Uk port of entry? Has anyones spouse been refused here?
I told him not to say hes married..etc. The only thing than can get him on...is if they as if he has a criminal record. Which he does. I dont even know if you can visit the UK, with a criminal record? Im going to try to look that up now.

So im wondering would a co sponser be enough?? He has booked a return flight for 14 days time. But if a co sponser is enough I want him to stay.
What do you think guys?

Guess I am very fortunate as we were able to celebrate our 1st anniversary while she was here visiting me this past summer. We went to Las Vegas. I can't wait to see her agan next month. Does anyone know where to write to, in order to get court records for a Caution/Reprimand?

Ive been told by NVC, that they need court records even though ive never been to court? They want a letter from the court saying they have no record?
Anyone have any experience with this? Do I go to my local court or do I write to the disclosure people again?

Well first of all a big hi to everyone!

I have a few questions I could use some help with!!! Please!!!

1) I was cautioned not arrested, for a crime of moral turpitude. Stealing. However I was 17, but its been 4 years and not 5, as the petty offence law, usually allows it if its been 5. Anyone have any ideas? if ill be denied.

2) Made a mistake on the ds230, when asked if i was arrested i said yes, but recently found out i wasnt...got the police to write a letter, and sent that to nvc yesterday.

3) Medical, I had some depression a few years back, and got some kinda anti depressants, now do i admit it on the medical questionaire? Or will it cause all hell.

But there is a record of it, and I submitted it to NVC, with the letter from the officer stating the details. I am so worried, because I know all the rules..and what it falls down to, is that weather I was arrested or not. I commited the crime. I think thats what the US will screw me over with. The fact that yes I was under 18, however its only been 4 years to date. I mean there must have been someone on this site, who have been arrested before or during this visa prosess? Im thinking maybe I need a lawyer now. I did it right up till now, and my case is complete at the nvc. In that case was it dealt with by you being summons to appear before a court. If that was the case and you say it is on your record it is no different than being arrested and taken to court.



No, I was never summoned, nor did I go to court. The police officer said I was de arresred, and it doesnt count as an arrest?

I got denied in 2006. I didnt know I couldnt apply over there for i130.
They sent me home, after interrogating me.
Basically bring your proof of strong ties, and they will call your hubby too, so make sure he gets his story right.
Also dont lie if they question on you, coz if you do it will stay on record, and you will be denied on the basis of misrepresentation at your interview

I was never arrested, but its a complicated story. I commited a crime ( theft) about four years ago, for under £20 and now its on my record. I had an officer write me a statement, that i was never arrested, just a caution, plus I was 17 at the time..The only thing they got on me, was the fact it was 4 years ago, not 5. Had it been 5 years I would have been covered on the petty offence law.

Anyone got any advice on this matter, going through or been through this.

Hello Friends.

After a very fustrating appointment at the doctors, they agreed to right me a medical note in time for my medical next week. I told the doctor the note needed to include the following, as requested by consulate doctor.

How long my depression lasted?

What was the treatment, ie, type of medication either by name, or eg mild form of anti depressants blah blah blah.

Lastly what are the chances of it coming back?

This is what the guy wrote,

The patient has been at our practice since june 2006. Prior to this she has suffered episodes of depression. Her first episode was in 2001, when she was referred to councilling, and was started on anti depressants. She also had a further depressive episode in 2003, when she was refered to the mental health team. There are no none alcohol problems. She has not consulted us further, since being our patient.


NOW THE REALITY OF THIS SITUATION!

In 2001, I was 14 years old, and had just gone through a major crime, in which I was a victim. Dont know if it would benifit my case to get more info on the crime, to back up my case. Ie, a detailed account of what happened. Which happened to be that I was raped, and it all ended up at the old bailey, as I was one of many victims. So thats why i was refered to councilling, and stupidly put on antidepressents, which after 10 pills i didnt take, as was feeling worse. Then in 2003, I had to go to court, and my mum had kicked me out, so i was just really down and depressed with no money, at around 16 or 17. Which also led to me being cautioned for shoplifting in 2004, mostly for depression, as well as being broke, and hanging around with the wrong people. I dont consider myself to be a victim, and im not justifying my shoplifting. Just building up the situation.

I wouldnt really know how to get hold of the details of the court case etc, especially as my appoinment at the medical is this thursday. I do know a police officer so i will look into it.

I told the doctor surgery that it was unfair i had to pay for this letter, as the infomation, was 1, not what i asked for, and the fact i was reffered to the mental health team was there mistake. As when I got there, they had no idea why the doctor refered me, and told me they could not help.

Do you think this will effect my chances?

Hi Everyone,

I was just wondered if anyone had submitted a sponsor at the last moment.

My husbands tax return, doesnt reflect his earnings, as his old boss who was an ###, would pay him part cash and part cheque. Obviously for his own advantage.

So even though my husband has a letter from his new employer, stating how much he makes, etc. Will he need an extra sponsor? As the tax returns do not match povery guidelines, any ideas?

My husband and I are worried, as when we sent out our 1864, my husband was making enough money for 2 people, ie me and himself. However now I am pregnant, we are $2,000 under the poverty guideline for three people. My question is do they class pregnancy as the 3rd person? Also my husbands tax returns do not reflect his yearly income, as last year he spent 3 months in the uk, and his boss was paying part cash, part cheque. This year is the same, although he gets paid whole in cheque, he has a letter from his boss stating his position and gross income for the year. Is it possible to submit a sponsor at the last moment, at the interview. As our case has left the nvc, and our interview is on the 13th may.

Only if the baby is born before the visa interview and you are registering the birth so that child will be US Citizen. If baby is born in the USA after immigrating on the visa then this is not an issue.

Probably wont be questioned if marriage was before pregnancy.

I presume you're under 26 to have been told you need the HPV shot ? .... £100 for this is very expensive.
Were you told you had to bring a doctors note ? I didn't know about this, haven't seen my doctor in forever, what should I ask him to write on it?



Well I tried to be well prepared. I had a couple of casses of mild depression when I was under 16, and was prescribed anti depressants ( 1 course ) In which I didnt take. However when I printed out the medical questionaire, it asked about depression, so i thought id get the doctor to write me a note. I heard that if you have taken medication, sometimes they send you for phychiactric evaluation. However He didnt say much, so he just took my note, and my pregnancy note and that was all.

I hope it doesnt become a big deal, as on the report it says medical incomplete, may be eligible for a waiver as currently 10 weeks pregnant.

The best part of the day was realising id lost over 10 pounds. All down to morning sickness. Low point missing the sunbed real bad. : ( Especially since being pregnant, my skins all blemished, and the doctor said I cant use it. So much for pregnancy glow.

I just got back from having my medical in London. My advice to anyone who is useless with maps like me! ( Get A Cab!!) I walked around in the rain for 30 mins, and eventually got a cab from Bond St tube st, and it cost me £4. Got to the medical and they insisted that I had the new jab, Human PAPILLONAVIRUS, IN WHICH THEY WANTED OVER A £100. So get it done before hand. The only reason I got out of it, was because im 3 months pregnant. I also didnt have my x-ray because im pregnant. So basically I went in to see the doctor, and checked the following:

Height
Weight
eyesight
throat
ears
blood test
blood pressure
my feet??
Heartbeat

and thats it.

I thought I was gonna take my clothes off, and to be checked to make sure I was a women, but nothing?

Basically asked a few questions, was worried my depression was gonna effect me, however he just asked me a few questions, and took my medical note.

When it comes to exemptions clauses,

for example crimes of moral turpitude, do I have to be eligible for both or one or the other?


For example one part states that I can be eligible if I was under the age of 18, and 5 years had passed before applying for the visa.

Then it has part ii which says basically as long as the maximum sentence was no more then a year, and was not sentenced to prison for more then 6 months?

Both or just one?

I have my husband and a co sponsor.

They dont have this years tax returns, just the last two years. The only problem with my husbands is that he took 3 months off to see me in the UK so his tax return, doesnt reflect his income? Will this be a problem? Are photocopies of tax returns? acceotable for the interview?

When he enters the US, the visa will be stamped and will become his temporary green card for a year from entry until he gets his real one in the post (minus long delays). He is free to work. Just got to your local SSA office to get his a social security number. You will get that within 10 days.
