I'm thinking the OP was admitted by another method than the VWP. If not, there is an overstay involved. Which is why I ask about what might be in the passport.no overstay I entered on an indefinet visa and stayed on extentions

Hi guys,

we had exactly the same response on our first call and were told to wait another 2 weeks. We gave them a week and when we called back we explained that this was yet was another call after 5 months waiting and we really would like someone to investigate why it was taking so long. The operator said she would send an official request, with an expected answer within the month.

After this second call we were approved 2 days later. We then also got an email confirming the investigation (although we received this after our approval).

It seems that it really does depend on who you speak to,but I don't think it hurts to call at least weekly until you get an answer or they file an official request.

So sorry you are dealing with this....

125% above poverty, i have looked through the figures and i am coming up with about $12.5k? so if i have this much in my bank at time of application, then my GF wont need to put a co sponsor down?

im sorry if i sound stupid right now, im terribly exauhsted.

Would it be wise for her once the ball is rolling, to go back to the US and start working so she wouldnt need a co spnosor?

Does anyone have any links to info on the sponsorship level? i am looking on the USCIS website and cant seem to locate this specific information.

Hi my name is Russell,

i am in desperate need for some information. I met my GF in Hawaii whilst travelling 6 months ago, i left to go home after a month then flew back to see her in Ohio (where her family is from, she was schooled in hawaii) i stayed with her for two weeks and decided this was the girl for me. So we planned on her to come and live with me in England, so she did and has been living with me in England for the past month. She has found many jobs but the work permit application process in the UK is ridiculous! She dosent have a college degree as she dropped out after one year, it makes things hard. Im a part qualified accountant working for the NHS and have decidded that i want to spend the rest of my life with this girl. Not just because that way she can stay, because i love her unconditionally. We have spoken alot recently about the future, as she is getting more and more frustrated being sat at my flat whilst i work. She is thinking of going back to Ohio to work again. Im going to propose. However i need to know some things before i do. I dont want to be one of those people that propse and never get married, she feels the same. So can we apply for a Fiance Visa K1, for the US from the UK? can we send the relevant forms from here? or does she need to be in the US? does she need to be working in the US? and finally, if all of this isnt possible, what if we pay a attorney? can we get away with her not going back to the US till her visa is up? (FEB).

I would appreciate any input.

You're right! You only have to send a copy of each of your passport photos in place of your birth certificate, if it isn't available.

Can you submit a form to coincide with your work history...i went travelling and stuff so big gaps in unemplyment...so need another sheet to explain is this ok?

firstly thanks for all your help so far, we are finally putting all the forms together to send off. I have read through all the guides and most of the posts on here (lets hope my work dont check net usage!)

i have one little issue that i cant find answered on any other posts, and this applies to me...

sooo..

i went travelling last year, for around 9 months. Worked in Oz, on a travelling work visa, and lived in a hostel. Is this something i should tell. I still had my house in England etc etc. Just went away for a break, on the end leg of the trip i met my fiance, so i guess some questions will be asked about it. i just wonder if this will complicate my application?

im just looking for some guidance.

i was just going to put unemployed in the work bit and put my house in the address section, or would it be wise to put travelling then the hostel name....and the place i worked?

once i have this cleared up im ready to send off! slightly nervous, and dont want to make any mistakes!

lat night was going through all all the guidance and forms with the missus. She mentioned that on her Birth certificate is says Pacific islander/American...she was born in Hawaii to a hawaiin mother and american father...

does this change anything? i mean she is still american right? when it asks for nationality on the forms, do i put american or pcific islander?

has anyone had any experience with this?

Hope you all had a fantastic christmas and best of luck with everything in the new year.

I am finally (3months on) ready to submit the pack to the Missus so she can send on. A few last things i just need to clear up...So i can have complete piece of mind and wont die of Rfeworrydeath.

1) included in pack: proof of ongoing relationship...i have printed off pictures (a medioka high res colour printer! works ofc!) like 6 orso pics at different times, firstly are these ok to be printed? i have also included our phone bills and a few bday cards etc..should i include more? i have read alot of posts where people clearly go overboard..and sometimes less is more, i know i wudnt want to sift through a load of ####### if i was an employee. So my Q is phone bills/pics/bday cards and our boarding pass stubs from aall our flights, is this enough? what else shud i include.

2) Address list, i have lived in so many houses over the past five years and 2 of them (i spent less than 2 months in each) i cant for the life of me remember the full address, i tried googling it etc but i cant remember the postcode..is this a huge problem if i just leave the address as the old one to make sure there is no gap, i mean do they check with the electra roll or tax office? it was about 4 yrs ago orso...

3) so submitting immenently, then will be visiting Dakotah (in Ohio) around Febuary, will i still need a letter from work etc? are they still hot on that if im English? im worried about booking the ticket and gettign turned away, i cant believe its really luck of who u get whether u get in or not, she will kill me if i dont see her on her Bday...so what would be best for me to take? and i dont have tenancy agreement or anything as just sold house..so living back with my mother.

I think thats it, we are ready to rock and roll.

Yeh i also need some advice with this, i fly on 2nd Feb, flying to CVG, but got a stop in detroit, only for one hour...so kinda worried if i get grilled in Detroit i wont make connecting flight!

So i think im just gonna respond with.."visiting friends and family" as i have read somewhere that the Databases arent linked so they cant tell you have applied for a K1 visa...i read that on this site, this site is my bible..sooo kinda just gonna lie!!

i only submitted on 18th Jan, so even if it was linked i think it wudnt show as the rate at which the California office works at..it wont show till after im married.

However this said, im still worrying like mad, got a letter from my employer (NHS) on headed paper and also rent agreement, however this runs out in March...so maybe not the best thing to take, and gonna take an operation letter dated for 29th Feb...

so would love someone to respond who has "lied" at POE and got away with it...to test this theory...

Morning you beautiful people.

Right so i am about to send off my Packet 3 checklist without actually having the I-134 in my hands yet as Dakotah promises me she will be sending within the week. However we are now using her father as a sponsor, i have looked into the poverty lines on the HHS website etc and i beleive he is above the limit..but its close. Now he has 2 children who live with him under the age of 18, does this make it a 3 person household, i can find anywhere what the requirments are of age limit etc. I mean Dakotah still lives with him but is 21 and working so surely she cant be his resonsobility can she? or is it for everyone that resides in the house. I promise i have come here as a last resort and have looked for this information! google hates me!

this is mildly urgent as if it is based on residents in the household i will need to find new sponsor, which wont be the easiest thing in the world!

I am new to this forum and have been reading everyone's stories of their visa process. It's such a tough thing to go through!!

Adam and I too received our approval notice on 14th September, we managed to get an update from USCIS that our file was sent to NVC on Oct 5th but the NVC have yet to receive it. I'm expecting a package to be sent with forms etc to complete and then an interview scheduled. Does anyone know of the timeframes between NVC receivng a file, doing their processing and then sending documentation to us...and then eventual interivew?

I did this in January this year when I tried to skip out to Canada and then re-enter the US. I wont go into the path I tried to take...long and short of it, I'm in London, so my attempt was not a success...but I did talk to a really helpful US Customs official who explained that all I needed to do was skip out to Canada for a couple of weeks, though he advised the longer the better, so 3 or 4 weeks are best and then you're free to get straight back in. He was also one of the officials who sits at customs letting people in and out and he said he lets people through if they've been out for a couple of weeks (again, dependent on how often the person has been in) Of course it becomes more and more difficult the greater number of times you re-enter. But for the first few times...your fine! :) Good luck!!!

Hi,

I asked the same thing to the lawyer that Adam and I have hired and he said though legally you can enter the states while having a K1 petition in progress, he advised NOT to enter as it is a risk that you will be denied and so you'll waste money on a flight and they may also suspect you will not leave. He said that it is best to wait out the K1 application.

I know it's frustrating as I wanted to go to Adam's brother's wedding but couldnt...it's the waiting game unfortunately.

I wish this guy hadn't posted this kind of information. First of all this, I am just in the first stages of my visa, but I know that this site is the best thing I could have found! As many ppl have said, the rules are not easy to follow by themselves, but I think he is misleading everyone by saying that it is worthless to try and get a stamp at the POE. I guess he also hasn't read some of the nightmare stories that people have had with immigration lawyers. A lawyer is necessary MAYBE if you have a complicated situation but really... As I understand it from the flowchart on this site. The stamp is valid for 90 days, as long as the visa, a k-1 visa can be used just once, but just because you get married that wouldn't make the stamp invalid...Like other people have mentioned this is a grey area, but I wouldn't go around telling people it's worthless to try and get this stamp. As people have mentioned in other topics, this process is expensive, nothing can be for free, but it's worth it, whatever it takes, as far as I'm concerned. Almost everything he wrote is misleading, and not based on facts, as far as I can tell. We haven't been through AOS yet, but we plan on doing everything as soon as possible after arrival, just to lessen the waiting time...



Then I shall await your retraction and apology when you have actually gone through this yourself, until then if you dont like just read on till you find something that does satiate your appetite for good news.

Firstly hats off to visa journey for being an invaluable source of information to those (like us) who weren’t smart enough to appoint an immigration attorney.

Secondly enjoy your sigh of relief when your visa arrives as it will be a short-lived respite from the joys of dealing with the exceedingly knowledgeable (sorry what year is it again) chaps at USCIS

I guess the first thing to mention is do not bother doing what I did and flying a 3 hop (terribly expensive) journey to the mid west just so I could go via JFK in hope of getting I94 stamped work authorized for 90 days.

I did easily get a work stamp by the way which lasted until I invalidated it 6 days later.

Here’s what they don’t tell you.

You can’t apply for a work permit (1 year) until at the same time (or after) as you apply for adjustment of status.

You cant apply for adjustment of status until after you are married (obvious)

What they don’t tell you however is that as soon as you get married you nullify your visa and any temporary work authorization you might have.

There will therefore be a 1 to 3 month period (depending on processing times for status adjustment) when you don’t have any work authorization irrespective of whether you obtain a temporary work visa.

Also worthy of noting is that when you arrive apply for a social security number before you get married. Some states allow marriage without an SSN however you cant get an SSN after marriage without going via USCIS

Yes it is advisable to wait for two after arrival to ensure you appear on the “save” database however you cannot apply for a social security number after marrying unless your status has been adjusted.

Hence in short follow this time line

1. Don’t bother going via JFK to get work permit
2. Wait 2 weeks after arrival
3. Apply for social security number (this takes about two weeks) via local social security office. Go to their website www.socialsecurity.gov to download the form for New Social Security Card
4. Marry (If you haven’t already just gone home)
5. Send file of forms to USCIS being
a. I765 Employment Authorization ($180 for this baby)
b. I485 Adjust Status to LPR ($325 thank you very much)
c. G325a Biometric Services ($70 that’s for taking your fingerprints again even though they reside on immigration computer already)
d. I864 Affidavit of Support ($0 yes really, although you may recognize this as being almost identical to I134 Affidavit of Support) Still needs to be filled out again though in new format
e. Photocopy of Visa from Passport
f. Photocopy of I94 (arrival/departure card)
g. 4 x color photographs 2 each for 765 & 485
h. Copy of birth certificate
i. Separate Checks for processing fee’s is advisable so $180 for 765 & $395 for 485 & 325a
j. Medical Info (see below)
k. Copy of Wedding Certificate
6. Send package to address on I485 assuming you send all forms in one go

Form 485 clearly states that as a K1 you do not need a full medical only proof of vaccinations
This needs to be on a specific form of course only available from USCIS doctors (list on website) and of course every doctor I spoke to would not transfer Vaccination info from form they use at London medical onto correct sheet without of course you undergoing another full medical.

If you shop around you can get some doctors willing to transfer the data from your UK records although if not expect another $150 fee
I phoned a dozen and eventually found an emrgicare willing to do it for $36 while I waited

Don’t bother getting the vaccinations done at the London medical center as their paperwork doesn’t have any effect here either.

Being one of the 10.000 petioners currently on hold for K1 in CSC, and now, after yesterdays news, waiting for an RFE, I'd like to do something instead of waiting days (possibly weeks) for the new request for evidence to arrive in the mail.

According to a broad interpretation of the new IMBRA requirements by other fellow members of this site, I should expect to provide USCIS further evidence about my background.
So I am thinking mainly at Federal, Statewide and Citywide criminal records. The FBI criminal record check costs $18 and requires to send in the fingerprint card. Processing time is usually under 30 days. State and city is faster.
What else could be asked for in the RFE?

Please share your opinion and suggestions.

I got a question for you then: Somebody on a different forum concerning the same exact subject told me that they had tried to contact the USCIS rep and that's what they were told: their petition was not lost, it was being worked on and most likely it would get approved sometime in August. THe petion was dated 10 April
I tried to call teh USCIS 20 min ago and all I got was that automated system answering my questions in teh most stupid way ever possible - by me hitting buttons on my phone choosing from the offered options. Please, People, tell me what to do to get an alive person on the phone :crying:

For speaking with a live person, you have to play with the machine answering that it has been more than 90 days since your application and more than 30 days since your last inquiry, any other answer will cancel the option of speaking to a live person. I know it is a lie, but if you want to speak with somebody you have to have a good reason for complaining to them when they already informed you on NOA1 that it could take up to 90 days for processing it, and your timeframe will not be expired untill the 10th of July.
Then before it will fall under the "SIGNIFICANTLY OUT OF PROCESSING TIME REVIEW" the application must be over 90 days older of the actual processing time.
An example: lets say that you filed 1JULY2005 and a processing center TODAY is at 15SEPT2005, before you may appeal and request an investigation for "SIGNIFICANTLY OUT OF PROCESSING TIME REVIEW" you will have to wait that the particular processing center will star processing dates older than 2OCT2005.

I used to think that Italian burocracy was crazy, but compared to what I have witnessed in the last 10 years of my American journey, it really put things into perspective and made me realize how good instead is my mother country 2000 years old burocratic system....

I keep reading from people who filled in May elsewhere but CSC that they are moving along. But nobody from CSC has even received the RFE !
July will be here in 5 days folks !!!

CSC UNITE !!! LET'S FLOOD THEM WITH CALLS, EMAILS AND LETTERS!!!!

Not only might a DCF be faster than a K1, but it gets a better visa. You'd need to get married first, of course, but then your (future) wife would get a CR-1, which confers immediate permanent residency upon her arrival in the USA.

I'm the USC. I've been living and working abroad(file taxes as an expat) for many years. We're abroad now, but I'm currently not working(by choice, new well paying job in the US shouldnt be a problem). If I want to start a K-1 visa process at which points in the process do I have to physically be in the US? Ideally I would stay abroad with my fiancee in her country or better yet travelling around. Only head back to the US at the very end. Does anyone have experience with this? I see from one line on the 129f process that you can mail your forms from abroad, but no further detials on where we are allowed/should be in the meantime..

It may be a really stupid question but I keep reading about people having their cases 'touched'. We filed with VSC on 30th January and when I log onto to check the status it simply says that the case is pending. How do I know when someone has 'touched' my case?
