newbie just signing in, im in the same boat as a lot of you, mailed i-130 in way back in july, it was sent off to csc, transfered to tsc. have called uscis 6 times over the last month, keep getting told someone is looking into our case, but has not even ben touched since dec 8th, so just sitting here bored and waiting to see the wife for the first time this year, not knowing when is getting up my nose...

Hi, my husband and I are preparing to apply for me to move to the US and need advice on the best way to do it.

My husband is an American citzen and I am a British citizen, we were married last year in the UK and have been living here together since then. Due to circumstances, it is necessary that my husband return to the US and of course I need to go with him. It is most likely that he will return later this year and we will file early next year for my visa. In April we will have been married for two years, which I believe can make a difference as to whether or not I get a greencard on arrival to the US or have to file to have my status changed.

There are so many different forms to be filed and at different stages. Honestly, we just need a simple explaination as to how to apply. Whether to file the I-130 first and what follows after that? Whether we have to remain in different counties until the whole process is complete? On here it talks about K3 and IR-1 being an option but I'm not quite sure what the difference is? On the USCIS website I only see the otpion in regards to a K3 application.

Though I handled most of my husbands application to come to the UK, my journey to the US seems so much more complicated and I would really appreciate any assistance I can get.

My husband moved to the UK to be with me and he really doesn't like it. We're in a similar situation to you, my husband will be return to the US later this year and I can't bare the thought that we'll have to go through months of being apart. I thought about entering the US through the VWP and then filing to adjust my status but don't want to take the risk of being denied because I didn't follow the correct channels. From what I've been reading, if you have status to live in the UK, you can return with him and file from here directly to the consulate. Which has faster approval time. If I've read the website correctly. Like you, I'm new to UK to US immigration. US to UK seems so much easier in comparison. I really hope it works out for you xx

If you and your husband later choose to divorce, you are still responsible for him yes.

I think that the fact you are here asking strangers for advice is evidence enough that you think something is wrong. When you're living apart from your spouse and are in the middle of an immigration process, it is stressful and emotional. That being said, you absolutely have to be able to trust one another, that goes for any marriage, and if you don't trust your husband then it is necessary that you talk to one another.

Why would you suspect that we would marry you just to get a greencard, is his ex not able to provide one if they were to marry?

Unless you would be able to show that your husband entered into the marriage soley for the basis of immigration, once approved and in the US, there is not anything you could do to stop him being with his ex and remaining in the US. I suppose there is a great deal to think about. Just as a side question, why is he temporarily living in Australia? It is considered less of a "high risk" country than Brail and has a faster processing time so as advised, it might be a good idea to wait on supplying forms and documents until you are 100% sure.

Hi there guys

Im a British guy just starting to look into everything I have to do to get married to my lovely American girlfriend - thank god for this site is all I can say. Im popping the question in July but thought it best if I started getting the relavent info together now.
With regards to the police reports - I know I need one for Australia as I lived there for a year. Ive got the forms now but has anyone any idea how long it takes to recieve your report once youve sent them down under?
Im also wondering if i need a police report for Bulgaria (where I met my girlfriend, of all places!) - I stayed there for 3 months on a 3 month visa, but then stayed another 3 months by leaving Bulgaria each month for a day then returning and getting a 30 day visa stamp. Would I still need a police report or does this only count as a 3 month stay?
Any help much appreciated as Ive a feeling that getting a Bulgarian police report isnt going to be easy....!

Im not sure if this is a bit of a stupid question, but thats never stopped me before so here goes... Im planning to go visit my girlfriend in July to propose to her. Last time I visited her back in Feb I told the nice man at immigration that I was going to visit a 'friend'. Should I tell him the same thing this time round or confess that Im visiting the States to get engaged? I kind of get the impression that their not too keen on people doing that as they think your going to run off to Vegas or something! Anyone any experience with this?
And if I do pretend Im just visiting a friend again, has anyone any 'creative' places where I could hide the ring? Box included mind you!
Seriously though - any advice would be much appreciated as the whole 15 hour trip to the Deep South is stressful enough without expecting to be turned right back round when I get there!

so just to clarify on the whole backpacking thing - when I fill in my G-325A I should just put 'Travelling' under the street and number column, then fill in the dates 'from and 'to'? And the same with the gaps in my employment history?? I checked the example form on the K1 guide which was great, but it didnt really indicate how to detail this sort of thing. It would just my luck to incorrectly fill in the first form of this whole confusing process!

Cool - well I'll make sure I hold on to this boarding pass, though I foolishly threw the last one away. But I've still got a copy of the e-ticket so I'll print that out. As to proving that we've met in the last 2 years, is it considered taking the pee if my fiance-to-be and me have our picture taken holding a copy of that days newspaper?! Or is that a bit over the top? I was just trying to think of a way to prove when I last visted.

Jaylen - I was in Australia for 11 months myself (nice there isnt it :)) but Ive sent off for a police report from them already. Ah well - better safe than sorry.

Just a quick pick of your brains - Im flying over to the States next week, for 3 weeks, to finally get engaged! While Im out there we're going to get a start on the whole visa application and I was just wondering if there is anything I need to take (apart from the engagement ring of course). I know I should take the ring receipt, and maybe a few photos and things as proof of the relationship (though I think she has plenty over there!) but I was wondering if theres anything else I need? A copy of my birth certificate or something like that? I just dont want to get out there and find Ive left some essential document at home!

Im just starting to fill in my G-325A and wanted to clarify on the whole details about the 'last 5 years' thing - Ive spent alot of time travelling, so should I just put 'backpacking' under the street and number column, and then add the dates from and to in the date column? And the same under the employment details? Should I list which countries I visited or any other details, or do you think that just stating I was travelling will be sufficienct? Any advice would be most welcome as its not too clear from the example form.

Hi folks

Just a few quick questions about K1 visa restrictions on leaving the country. We've just sent off the I-129F pack a few weeks ago and are still awaiting our NOA 1 thingy.

1. My fiancee is coming over from the US to the UK for 5 weeks in October, then maybe again for the Christmas and New Year period. This is ok as far as the visa application is concerned, right? And she's living with her parents so they can send on any of the forms if she's out the country. Or would she need to stay in the US for any reason?

2. When she comes to visit in October we're thinking of visiting a few parts of Europe - as far are the States are concerned, they only have a problem if I go to the US right? They dont mind if I leave the UK and go elsewhere??!

3. Finally, thinking a bit more into the future.... When we've finally tied the knot and I move to the states, I know I cant leave the country till I get a green card. Roughly how long does this take? Just worried in case I need to go home or any reason, or if we choose to honeymoon somewhere otherwise than Hawaii or the Virgin Islands!

I know this was a long one so thanks for all your help - am suffering from visa burnout at the moment, and we've only just got started......

I can't believe it - my fiancee rung last night to say that she'd just recieved our NOA2 in the post! I can't believe how quick that was. At this rate Ill be over in the States in a few weeks (well, maybe not)! Anyhow we didn't recieve any notifications via email or anything so it was quite a surprise. I guess I better start sorting out what I need for the next step of the process!

Anyway good luck to everyone still waiting - I feel a bit guilty like I've jumped some sort of que or something.

Hi there

I was just wondering how long it takes to send your approved I-129F from the CSC on to the NVC? On the K1 flow chart it says that it should be about 2 weeks from when you recieve your NOA2, but we've still not heard anything and its been 3 and a half weeks. My fiancee called the NVC yesterday and they said to wait 90 days from when we recieved the NOA2 and if we've still not heard anything then chase it up then! Bit of a differnce between 2 weeks and 90 days so was just wondering how long we should expect to wait before it arrives there? I'm sure everything is fine but I'm trying to pencil in a rough wedding date and it's not easy when you haven't a clue when your visa will be issued!

Any help will, as ever, be gratefully recieved.

I am new to this forum and have been reading everyone's stories of their visa process. It's such a tough thing to go through!!

Adam and I too received our approval notice on 14th September, we managed to get an update from USCIS that our file was sent to NVC on Oct 5th but the NVC have yet to receive it. I'm expecting a package to be sent with forms etc to complete and then an interview scheduled. Does anyone know of the timeframes between NVC receivng a file, doing their processing and then sending documentation to us...and then eventual interivew?

this part of the process seems to be really random - I got my NOA2 over a month ago and still havent heard anything from the NVC. I dont know if its been shipped there from the CSC or if its waiting in a pile somewhere, or maybe if its even been forwarded to the embassey ove here in london.
The timeframe listed on the K1 timeline says 2 weeks, but it seems this can vary by a large amount. Good luck!

And even when the file does leave the service centre they dont tell you! My file should be with the embassey in London soon, but the only reason I know that is because we kept calling the NVC. Actually the only thing Ive recieved in this entire process is my NOA1 and NOA2 through the post - no emails, no letter from the NVC, nada.... I guess what Im trying to say is that it pays to keep chasing!

Hmm...I don't think this will be a problem.
Are the children coming to the U.S. with your fiance?
If they are, you will need a letter from the child/children's Mother stating she is allowing the children to come to America to live with your fiance.


My fiancee is the american who is filing the K1 he has the outstanding child support,I have no dependents and I am english,will there be any problems??

Being denied entry on a tourist visa should have zero effect on your K1 petition as long as there was not an overstay or something else illegal going on.
Many on VJ have been denied entry for a visit and have had no problems getting a K1 visa.

I suggest you look over the Guides here at VJ, read over all the information, everything you need to file on your own is there.

Lawyers can be quite pricey but considering I don't know the full extent of your situation I won't suggest you not get one. I believe that if two people have a pretty straight forward case (no overstays, no criminal records, etc. etc.) they are fully capable of doing it on their own without the assistance of a lawyer. It's your call though.

Can't see there being a problem if you didn't stay illegally. Did they put a ban on you when you were denied entry?


There was no ban I was told I was just not eligible for the visa waiver

We need more information so we can answer your question easier. Are you asking about the B2 visa or the VWP?

I am asking about the B2 I am not eligible for the VWP. I lived in the U.S for three years I never overstayed as I extended my visa legally.After I left when I tried to re-enter on the VWP I was refused entry at POE. They said I was in-eligible to use the VWP.I own a house in England, I pay bills,I have a bank account and I have my own income.

The USC does not need to supply a crimminal record only the intending immigrant.

I know I,m being dumb!!!!!so the only criminal report needed is mine in the uk???

he must send the police report if he has a criminal record on his police report !!

Ok, we need to be painfully accurate here. The US citizen may or may not need to supply any criminal records.

Since this is a K1 visa, the USC will need to carefully read the I-129F IMBRA related questions about specific criminal convictions. If they must answer yes to any of those questions, they supply court records. If they can answer no, then they simply answer no and get on with the process. Their criminal records will be checked by the FBI and the result will be whatever it is but unlikely to impact the visa process. Even those who answer yes to the IMBRA questions it's not reason for denial. It's just about informing the foreign fiance(e).

In which case will a criminal report ordered on line suffice to add to part3 of the I-129f
