All I can say is I would definitley NOT being going through all of this if I wasnt totally smitten by my boy and convinced that no matter how great my life is on its own, it is so much better when shared with him! I dont have the guts to take such a big risk!

My man was the one who initially took the big risk of coming to London for 8months (we'd only been together for 3 months in India prior to that) to see if a holiday romance was something more.....and I am SOOOO glad he took that risk! I was in love with him when we were first together but the K1 wasnt an option back then because I WASNT sure if we'd be in 'love' in an 'everyday' setting dealing with normal life! So the risk you are taking is definitley bigger!!

And when he first moved here, he was different, not the confident cocky man I was used to, but a bit scared, unsure - having no job, friends or bearings does that to you! It almost broke us though, until he got his act together and did more than I ever thought he could and I got to see him shine, and his strength and fell for him even more! We both grew from the experience, and dealing with the toughness/winter of London together has made us sure that living together in a huge place in sunny America is going to be EASY! And confidant that no matter what life throws at us we can handle it together, and nothing is worth more than our love.

All I can recommend is this- if you really do feel for her and want her in your future, then be very kind and patient when she moves there. Help her as much as you can- introduce her to people/social networking forums etc, and facilitate her- the first few months WILL be hard, they ALWAYS are when moving to a new country or even back to an old country! (and even harder with the 'just married' and AOS things etc!!)
If things do get rough- try go on a mini holiday somewhere in the states together- eg Hawai!! to try remember that 'holiday' feeling (and sometimes you BOTH need a break from real life! My man and I went to the canary islands while he was here and it is my FAVOURITE memory!)
It will be hard, but bear with it, and you will both be deeper in love and more strongly connected when SHE is the one suggesting places to go and making YOU wonder where she is when shes out with friends!

Yes, go for it. There is a good chance that the missing document will be in by the time of your interview, and if it isn't, then go to your interview regardless. They will give you an RFE for the missing document and reserve making a decision on your application until they receive it. Once you submit it, then they will make their decision. I'm still waiting on my police clearance to come through from Australia and it could take a month to come in....but should I just send in my packet 3 as it seems that, going by other people's timelines, it takes about a month to get an interview anyways? Its a bit risky in case I DONT get it in the mail but if I wait another month it just makes everything so much longer....I do have a 'name' clearance from Australia (and I have a very unique name!) but am waiting on the fingerprint clearance I only found out about a few weeks ago!
I will write a covering letter saying Im on holiday until mid September so not to give me an interview date until then- do you think that its a good idea??
Risk it or be patient and wait??

There is no requirement but providing an explanation as to exactly what story this evidence is providing is good practice

No..you're not correct - the I-134 will be taken to the interview by the foreign fiancé at the consulate/embassy. Check the guides for a better understanding. good.gif

One thing about I-134, the directions included with I-134 are very old, USCIS has no reason to update them since USCIS has no application for that form.

The consulates tend to treat the I-134 like a mini-I-864 as so prefer the same financial evidence as the I-864.

In our case this what the I-134 (FOR K-Visa) included.
  • I-134 signed and notarized.
  • SIMPLE Tax transcripts from the IRS for past 3 years, (Redundant for the (1040,W2,1099) but are free from the IRS http://www.irs.gov/faqs/faq1-6.html
  • Photo copy of IRS form 1040, and W2s for past 3 years (Not necessary if you provide the transcripts)
  • Letter from my employer stating annual salary, job responsibility, and that is full time, on company letterhead.
  • Photo copies of past month or so of pay stubs up to a few weeks before the interview.
My income was well above the povertyline so I did not include any asset data (LIKE BANK STATEMENTS or property values).

Keep in mind Petitioner still needs to provide an I-134.

In 2005 I traveled to the US I am a UK citizen, I stayed in New York with family for three months and then moved to Florida.I extended my visa and was staying with family again.My fiance and I met in March 2006 and were in sepreble from then on.I lived with my cousin but stayed with my fiance more often then not.He even put me on the lease to the apartment as it was a gated community to be honest we rarely spent a night apart ,but I kept my place with my cousin and always extended my visas from his address. I have always had my own income as I rented my house in London.In march 2008 my latest extention was denied and stupidly I left returning to England, truly unaware that I had just deported my self.When I tried to return to the states in April I was denied entry based on that I was not eligible for the VWP.I then returned to London and made an appointment with the US embassy,the earliest appointment was July 9th where they refused my application due to not being in my own country long enough but did not excude me from re-applying.We are now about to send in the K1 visa as all we want to be is together we have phone records, pictures, lease from the apartment,records of my extentions. I suppose what I am asking do we tick the right boxes,I am so nervous that we will never be together again.Please give some advise

As long as you were in the US legally, yes, I would use the extensions but not the lease. Leasing is residing and you wouldn't have had a visa allowing you to reside in the USA.

I am only on the lease as an occupant,because it was a gated community it gave me easier access,should I still not include it,I thought it would show prove of our relationship

Your K1 should not have affect due to no overstay..but we need more info. Why was you denied at POE and US embassy? On what circumstances?

I returned to the us only two weeks after I left and tried to enter on the vwp which poe said I was not eligible,one I returned to london the first avalable appointment was three months away in july. I don't think they can photocopy it. Since all the sheets are numbered at the bottom and are for the records of different people it seems.

you can call up USCIS and tell them you'll be mailing out the G235A again. we only photocopied continuing sheets and I think we attached one sheet to each form sheet.


Personally I would wait for an RFE as if it is sent now it is likely it will just be stuck in a pile of paperwork at USCIS.

I have just spoken with my fiance in San Francisco and he says that he sent off the I-129F and received confirmation and therefore feels like there shouldn't be any further problems and it's also been over 3 months now so if there was a problem, wouldn't they have noticed by now??
He sent with it - $455, his birth certificate, a copy of his passport, social security number and all my contact details and story of how we met. He hasn't heard anything about any requests for secondary evidence (I forget the proper terminology!) We are obviously still in the very early stages but it has been over 3 months now and I am getting nervous. I'm also getting sick of people asking me when I'm going and boy does it suck not knowing. I just checked our online status and all it says is - case received and pending.
Any other helpful knowledge would be greatly appreciated. Maybe we are doing the right thing but I'm just getting scared that I'll still be in the UK come Christmas. Not what I had planned.

you were not the only couple to not send everything they needed we also forgot to send in all four copies of the G325a and we still waiting for a RFE, we filled end of may 08 and had are NOA1 back on 6th june so hope it not to many days now to wait for RFE. I just hope they send back the G325a copy i send so i can re-do the imformation as it was last time.

I called the passport office about the same thing last week we are just about to file for K1 status, so fingers crossed I will be there the begining of next year and therefore my passport will run out whilst in the States. They said to apply at the consulate and they will issue a new one, however you must advise them not to cancel the K1 visa in the passport that has expired and you will have to travel when allowed with the new passport and the expired one with the K1 visa in it.

I had mine taken last week, I went to a photo place that I found on the internet that stated they did these photos.
They made me put my hair back so they could see my ears, also they mentioned that your teeth should not be showing. I did ask how they met all the requirements and they said they just took the photo and it goes through a computer programme to make sure that all the requirements are met. Whilst looking for where to go there are places where you can just e-mail them a suitable picture and they will send you back the completed american size passport pics.

You can actually get the number before you receive the NOA1 in the mail
Once the check is cashed in the states you can view the cashed check online and the number you require is written on the back, so we actually regisistered for e-mail notification and checked our status online before we received the NOA1 in the post.

Now I can go online 100 times a day to check that nothing has happened yet ha ha

She has no right of legal representation at the POE.

To clarify the lawyer question: I realize there isn't a "right" to have one, but I was curious as to whether it's possible for someone who runs into trouble at the POE to ask for assistance. I mean, can she at least give them my cell number? Her English is excellent, but obviously the situation might be a bit intimidating for her as someone who is not yet American...

To me, a filed K-1 application seems like evidence that a person isn't trying to sneak in: why blow the whole thing just to get married a little earlier? But maybe that's just me; I don't work for INS (I guess you noticed!)

Truffles: good point on the return tickets! I guess I was taking this for granted...

Here's what comes to mind, not an exhaustive list, but what is fairly easy for us to get:
- return tickets
- letter from her university explaining that she is one semester from graduation
- papers describing her employment

She has an apartment, but it's owned by her family, so I don't think this would necessarily help. Same for the car -- they share it since it's more of a luxury than a necessity in metro Helsinki. Um... she'll be bringing her dog when she comes over for good; do you think INS cares?

I'm thinking the letter from the university is the strongest evidence right now, eh?



I was told that after filing for a visa, I was more likely than not to be refused entry as they assume immigrant intent unless you can prove otherwise. I was also told I could try if I could provide very strong evidence of ties to the UK, but that if they had any doubts, not only would they turn me back, but they would not let me call anyone or speak to anyone before being put on a plane again. I would not be able to speak to a lawyer, and more than that, even though I would be travelling with my husband, I wouldn't even be able to speak to him as they would be interviewing me on my own.

All said and done, that just scared me too much to even try.... :blink: :blink:

Hi there. We DCF'd in London. My SO (USC) has never lived in the US so we put our UK address for everything except the questions regarding where you intend to live in the UK. As for domicile, we answered "Current: UK, Intended: USA" and that satisfied them. Since they know already, it is always best to be completely honest and say this is what we are and this is what we intend to do....

Oh, and the other thing, I'm not sure if this applies to K1, as we did the IR1/CR1, but because SO is dual citizen, they needed to see every page of his UK passport, but only the biographic page of his US passport.
