K-1 Fiance(e) Visa Process & Procedureshow about the wedding?
My advise to you is not to plan anything till at least you have NOA2 and know that NVC has sent it to the Embassy

You cant tell how long this will take so to save dissapointment I would wait

Good luck with your journey

K-1 Fiance(e) Visa Process & ProceduresPassport style photos?
You will need american size passport pics and there are a few other rules as well
Your best bet is to go to your local Snappy Snaps they do the american size passport pics, also Kodak Express. You can even find on the internet places where you download your picutre and they send it back to you in the correct size.

Good luck

As soon as you get your noa1 you will have your case number. I would suggest that you regisiter with the USCIS site for e-mail notifications but these sometimes do not work, but you can go on and check the status of your petition any time.

You will be able to see if they have looked at your case which is refered to as a touch, this is when the date on the site has changed

Good luck with your journey

K-1 Fiance(e) Visa Process & Proceduresnew passport size photos needed?
You will need 2 USA size passport photos for the interview that should not be more that 6 months old

I dont know how it works in Russia, but I also had to have a photo for the medical and the police report but I would imagine that you can get them to the Russian size

K-1 Fiance(e) Visa Process & ProceduresPre-interview visit?
well I had received my packet 3 and already had a flight booked to go to Texas for Christmas so we delayed sending packet 3 back until after my visit.

I sent packet 3 back on the 7th Jan and got my interview date back and have an interview date for the 6th March, so I think that you will have time for a visit. You can call DOS while in the states and check your status and if an interview date has been given, you can always ask to reschedule it.

You will have proof of your intention to return as you will be able to show your return ticket, take any other informaiton that you have to show your ties to the UK, all I have ever taken is a letter from my boss to show I am coming back and they have only ever asked to see my return flight.

If you do go dont forget to register with Esta it shows that you are eligable to fly on VWP but POE still has the final say.

Some states in the US will let you clear customs in Dublin before you land, so you can check that out if your state is one of them.

Congratulations on the birth of your baby

If I was in your shoes I would go, it is not guaranteed that you will get in but I have never been turned back luckily. If the worst comes to the worst then so be it but it will not effect you getting a visa

Good luck with whatever you decide

We plan on getting married very quitley as soon as I get there so that I can file my aos. Then I will have plenty of time to organise a party while waiting for my EAD, however knowing us, we probably wont get round to it hahahaha

plus they are much nicer at DOS

nuber is 202 663 1225 then press options 1 then 0 straight away

It works out cheaper calling them than the embassy over here.........

You just need your LND number

K-1 Fiance(e) Visa Process & ProceduresI'm ready to send this but....
You do not send the affidavit of support with the 129 petition. This is required at the interview so you have plenty of time. Just check the guides they tell you exactly what is required at each stage.

Good luck with the journey,

K-1 Fiance(e) Visa Process & ProceduresPossible minimum time?
I hope that it all works out as planned, and that you both get on as well in person as you go over the phone and net.

You can not send in the petition until after you have met to meet ther requirements of having met in the last 2 years

The petition only requires proof of actually meeting, so make sure you keep your boarding cards, and take some photos, all of the chat logs etc are great but this is more for the interview to show on going relationship, it is not required for the petition.

I'm so excited as I just found out I can take xmas off from work so I get to go visit Hal kicking.gif

I just have one question... Do I say I'm there to visit my fiance or just family/friends? I was following the thread and saw the "less is more" suggestion but to what extent? I don't want to lie but then again, I want to be sure I get in!

Thanks!!

I fly out christmas eve and I am going to say I am visiting my boyfriend for the holdays, I wont be nervous Jack Daniels has an amazing calming effect on me ha ha

I'm going xmas eve too! Ok, will try boyfriend. I always get so nervous going through, they're always so mean to me...

hey what time and what airport, we might be there at the same time and can meet up and stress together dont start drinking till just before I land ha ha

I usually start drinking as soon as I get on the plane, that way I sleep (pass out) the whole flight.. Maybe that's why I get all the questions as I'm so zoned out when I arrive!!
Not booked flight yet, but will definitely fly from Heathrow probably around 4ish as I have to work in the morning...You?

Heathrow think I have to be there around 10 in the morning, shame would have been nice to meet up, if your plans change let me know

shame, that would've been good! will keep you posted, not booked yet so it might all change!!

Gemmie, Russell's poe from NZ was always LAX but Logan has a pretty good rep from what I have gathered over the years.

He was actually denied entry in Dublin, IRE where they have US immigration before you enter the plane...sent through London and onto Auckland.

It does make a lot of sense that they would scrutinize places that are not known vacation spots here in the US. I think even moreso, they look at previous travel dates and length of stay. With ESTA now in place I would hope there would be less worry for those like us.

I always used to fly into Chicago before I found out it was one of the worst places for questioning supposedly.... But last time I went, when I told the guy I was going to Columbus, he just laughed and waved me through... Wasn't quite sure how to take that!

I'm from Spain and my fiance is from USA. We haven't started with the VISA stuff yet and i've not been searching a lot of info about the question ima ask you guys. During the process i'm not allowed to travel to USA using the VWP (visa waiver) or another tourist visa? and if the answer is no...can my fiance travel to my country to visit me?

As you got experience in that i think is a fast and sure way to get this info...I just was wondering.

Thanks so much to all of you!

Pz

You can visit, just make sure if you are going to the US, that you have plenty of documents to show you have ties to your home country (letter from work, rental agreement etc) I went over xmas and it was fine, not one question even though I told them I was visiting my fiance. they didn't ask to see anything and I had a lot of stuff with me as I was a little paranoid they'd put me on the next plane home!

It takes 20 seconds to track a package. Go to the courier's website eg. USPS, UPS and enter the tracking number. See if it is in transit or if it has been signed for yet.

If you are this eager about sending the petition, you are going to love the 140 day waiting period between NOA1 and NOA2. It's dead silence from USCIS's end, and you simply bide your time.

So I was off doing some work for the guvmint and came home to find this little gem from the Kingdom of the Absurd:

Current Status: DOCUMENT OTHER THAN CARD OR TRAVEL DOCUMENT BEING HELD FOR 180 DAYS SINCE RETURNED AS UNDELIVERABLE

On October 22, 2008, the post office returned your document I129F, PETITION FOR FIANCE(E) as undeliverable. We will hold it for 180 days from October 22, 2008 to allow you time to contact us. If you do not contact us at 1-800-375-5283 within 180 days, this document will be destroyed and you will need to file a new application or application for replacement with fee.

Destroyed? File a new application? This demands action. I consulted the level 6 wizard with cloaking powers and decided the signs were favorable.

Foolishly I called the number thinking, nay, BELIEVING that somebody could explain this to me. What is undeliverable, did they return the whole packet, is it the fabled NOA1?, Come man tell us what it is!!!

NO. Apparently the customer service oracle who lives at the end of a 30 minute expedition to press a new number now street is not permitted to answer or even access the mysteries of the Realm. The maiden says I must seek an audience with the nearest immgration office. This tribe dwells beyond the mountains in the mythic city of Anchorage, a full days journey.

Perhaps some wizened sage may be able to decipher this.

well this sounds very similar to what we are going through.....we mailed our I129F on 29th oct...the cheque hasnt been cashed and we have had no word that its been received in California!!
upon trying to track our package we discovered the idiot at the post office we mailed it from didnt log our tracking number.....so who knows what weird postal universe our application is living in!!!

QUOTE (Dave_n_Genna @ Nov 8 2008, 04:07 AM) <{POST_SNAPBACK}>
Well, my Fiancee comes next week on the 12th, and I'm suddenly having doubts about her gaining entry to the US. After reading as many posts as I could about the PoE experiences etc, I'm pretty sure she will be turned away.

She is going to have a letter from her Landlord stating that her room is being held for her with all her belongings. She is going to have a letter from her mother stating that she expects her back, as well as bank statements, credit card statements, and of course her Return Flight information.

However, she spent the summer with me (80 some days), returning to NZ 3 months ago, and this visit is for 80 days (the entire holiday season.) Also, she has no job. From what I can gather, those two things will cause her to be denied entry.

Is there anyone out there who made two 3-month visits to their loved one in the same year?
I hope I am wrong, but my confidence is broken.

(Also, will it hurt our K1 process if she is denied?)

Hey...

both of you try not to worry about it, looking nervous going through the POE will definately rouse suspision, even if you have nothing to hide.

I went over to see my boy in Vegas for last christmas, returned in march, went back in may through til august. POE was fine, both times i just showed my return ticket and answered "my boyfriend" when they asked whom i was staying with. But as many of us know, it really does depend on how much of a s@%t day the officer on the POE you go through is having.

I have always tried to get as near to the front as i can on the POE line, believing in my head that if they look up and see a full flight of approx 400 people waiting in line, they will ask fewer questions to get the line moving...ha ha!

good luck to you guys...happy holidays!! good.gif

QUOTE (Dave and Jess @ Jul 15 2008, 11:34 AM) <{POST_SNAPBACK}>
Hi Folks,

Our K1 petition was mailed off by our lawyers on 10th July. They have informed us it takes 20-30 days for a case number. Is this case number part of NOA1? If so this seems like a long time for NOA1 based on other peoples timelines. Could this just be our lawyers covering themselves? or am I mixing myself up?

Also can somebody please tell me if the the NOA1 and NOA2 will go to the lawyers or to us if they are handling the case for us? I dont want to be negative about the lawyers but they are known to drag their heels frmo time to time and I want to ensure that we ar ejust as much int he looop as they are..

I know we have a good few months ahead of us but this is so exciting!!! does anybody know if there is a July filers thread.

Thanks..

Dave.

Hi I dont know about how long lawyers take as we have done it ourselves thanks to all the help you can get from VJ.
It does seem a long time though, as our application arrived in Vermont on the 30th June, the check was cashed a few days later, and in the states you can view the back of the cashed check online and it will give you the case number, so we tracked it ourselves on the USCIS site, set ourselves up for e-mail notification as well, and we received the NOA1 in the post on the 5th July which was even quicker than expected due to the 4th July holidays. So in total 8 days from us sending it.

Hope this helps, but it was a lot quicker than the time quoted by your lawyer

Good luck

I did not send in any e-mail copies or evidence of drawing out money in the States
Hopefully we wont get a RFE on any of it, but we did get out NOA1 in under a week
Good luck with yours and welcome to VJ, there are so many great people here who are willing to help and it is great being able to talk to people in the same boat
