K-1 Fiance(e) Visa Process & ProceduresI-129F ~ Proof of having met in person!

Boarding passes In both directions, matching pages of passports with stamps (plus the bio page) and photos of us together. Suitable photos of us together with date and locations written on back.

These guys must see lots of pictures of couples standing in front of very identifiable monuments. From memory we included the Golden Gate Bridge, Eiffel Tower, Washington Monument and probably Big Ben :-)

Best of luck.

K-1 Fiance(e) Visa Process & ProceduresAffidavit of Support
Read the whole thing here http://london.usemba...faffidavit.html and book mark that because it's impossible to find unless you knew about it before the website got changed up a bit.

How true that is ! I've spent quite some time trying to find it myself and only finally found it via searching and following threads on here. As beneficiary I will have housing equity assets enough (whatever that might be) but my petitioner who only recently graduated may not have a job paying enough by the time of my interview. There again given the speed of CSC perhaps their plan will be to give us a fighting chance by making us hang on as long as possible idea9dv.gif

I also remember reading somewhere how they value liquid assets and use it to offset against the poverty level/family size money needed ratios. But thinking of it I may be getting confused with the petitioner/sponsor using cash to top up their income requirements.

K-1 Fiance(e) Visa Process & ProceduresK-1 visa, to fill by ourselves or by attorney?

Also if you're thinking about paying for legal support it won't stop with the K1 process . Once you've arrived it's AOS/AP/EAD time and then after a couple of years it's ROC time.

Yep - lots of jargon but it's not that legalish  if you take the time to read all the documents and get to understand the process. That's what it is - a process (somewhat flawed) and there are things to do at each stage, forms to fill in and of course money to pay. But get your head round the process and be methodical and (unless there's something unusual) you'll find it straightforward and there are plenty on here that have done it  already .

K-1 Fiance(e) Visa Process & ProceduresIt's not meant to be rude. Just a general observation.

I think the general point - if you don't want to answer the question , move on is probably best. I read up on the process here first and then asked some dumb questions - they're all dumb to *someone* else . People have been kind enough to answer them and I'll tut quietly and then answer other's questions when I know the answer is in the FAQs.

As to the command of English - this is a valid point and just because there's a USC petitioner it's not safe to presume anything about their command of English (like wot it is spoke in the US) so some questions are really one of comprehension of the USCIS requests. And of course those of us from the mother country <ducks> can still be caught out by what what the USCIS *mean* rather than what they say.

And finally - there is the issue of time. Time passes and facts change. One of the things I do on Google is set search time scales to as recently as I can get away with when searching on some matters. Same goes for VJ.

Now if we could just limit overquoting <mutter mutter mutter>

K-1 Fiance(e) Visa Process & ProceduresIt's not meant to be rude. Just a general observation.

It has been like that since before smartphones.

It's been like that before the www and it applies to all areas online where expertise gathers. There will always be people who are either unwilling or unable to either search existing FAQ's or use the search function. Sometimes the search function is so clueless that there's an excuse but often it's just laziness and the lack of foresight to that there one question has indeed been asked before, many times before.

Oh that and excessive quoting which is my real bug bear.protest6wz.gif

K-1 Fiance(e) Visa Process & ProceduresHow much is too much..?

We only used passports stamps and photos. Never bothered with any secondary evidence. London Embassy will not be interested in it at the interview stage either..

I can only repeat what has been said above - USCIS want primary evidence that you've met in person and I would suggest secondary (comms) when the primary is a bit weak e.g evidence of only one visit.

I think you need not stress about many of the more insignificant errors.

If you were going through a higher fraud post it might be more fuel for the fire at the Embassy stage of the process.

I really like Kim and Russ. They keep all of their answers real and seem so humble. Thanks for helping me including everyone on this site. [applauds] I hope everything is working out for u guys smile.gif

Did you send them anything further? They need concrete evidence that you have been together in person within the last two years... things like passport stamps, boarding passes..etc. Photos and things of that nature are merely secondary evidence.

Good luck

we sent all this in the first time... passport stamps, tickets, photos, all that kind of all stuff! i think they must've lost it....

Hello Everyone!

We just received the RFE letter today at 4PM Las Vegas time (4days after Case Updated).

Whew! My fiance called me and we opened the letter together. We were so excited to see what was our RFE.
A good grief!!!

Here it is:

1. FORM G325 - Write NONE to questions and informations that don't apply to you. N/A is not an appropriate response. Don't leave any blank unanswered. (What the HECK??? This is the only reason for our 2-3 weeks delay. OMG!!!)

2. Translate in English all foreign documents to be submitted. (GOODNESS! All Submitted documents were in English language already. We called the uscis and clarify the second statement. No worries, just an additional info to be mindful with in case of any tagalog or foreign documents to be submitted.)
---------Nothing Follows------

Guys, you better watch out for this simple mistakes. Our case might help some filers here.

Have a nice day!!!

We've just be notified of our RFE... Haven't recieved it yet. I have no idea what on earth they could want. We provided passport copies, photos, engagement ring receipt, plane tickets, literally EVERYTHING! We've had so many visits in the last couple of years I've lost count. What could they want from us??

Hello Zoe and Hal.

We received RFE because they lost passport style photos that we provided with our original petition.....
So, it could be really really simple stuff that they want.

Good Luck

Hey Anne..... Ask the gp receptionist to fax the info to knightsbridge instead of sending it through the mail...... I had to have a ct scan and the hospital faxed it through for me.... The embassy got the results today and 10 minutes after my case status date changed (from them logging my results) I received a call from the London Embassy telling me they had a couple of cancellations and could I make it to my interview tomorrow morning at 08.30...... I jumped at the chance, I still can't believe it! I am just packing my overnight bag then off to hotel in Oxford for the night for a 5am bus journey to London ........ I'm so excited!!!
Good luck with your gp, I hope they will get it to knightsbridge fast for you....??

K-1 Fiance(e) Visa Process & ProceduresSo confused- DS230/DS160?
That's what's confusing....the fact that it keeps changing, I was in the middle of a change and filled out DS160 AND DS260........ (Der me)....... I had my interview and the DS260 wasn't even mentioned..... I think they know that it is confusing some people so as long as you have the DS160 when you go for the interview it will be fine, that's what they ask for before you get inside the embassy so they can check you off the list, then you'll be asked for it again inside the embassy....... Good luck

K-1 Fiance(e) Visa Process & ProceduresYes, you can visit!

My visits have gone like this:

Adam lives in Derby, England. I, Michele, live in Detroit MI. We filed our I-129F April 12, 2007.

November 3, 2006 - November 13, 2006:
Adam visits me for the first time. He entered at the Detroit Metropolitan Airport, and was asked simply his reason for visit (visit a friend), where he was staying (hotel), length of visit (ten days), and to see his itinerary showing his flight back home. No proof of ties to England requested. Welcome to America.

January 3, 2007 - January 22, 2007
Adam visits for second time, entering again at Detroit, MI. Asked same questions, answered 'reason for visit' this time as 'to be with my girlfriend' and was told he can't marry me while he's here, that would be a violation. Adam assures officer he won't. Asked how he could afford to visit again so soon, replied 'using student loan money'. No proof of ties to England requested. Welcome to America.

February 13, 2007 - February 20, 2007.
Michele goes to England. Depart Detroit, arrive at Gatwick, UK. Asked reason for visit (visit boyfriend), length of visit (one week), and where I'd be staying (hotel). I too was told sternly I couldn't marry Adam while I was there. Promised I wouldn't. No proof of anything requested. Welcome to England!

February 21, 2007 - Current (Adam will leave May 20, 2007)
Adam arrives at Detroit MI. Was asked usual 'reason for visit, length of visit' questions. Answered 'to see girlfriend, 3 months'. Was asked about his employment and housing in England, answered that he left his job but it was being held for when he gets back, and that he lives with his mother. Officer apparently thinks something fishy, converses with several other officers, Adam ends up in 'interview room'. Was asked same questions, answered same truthfully. Was asked to describe Michele, how we met, what Michele does for a living. Customs calls Michele at work and asks if Michele knows Adam, what is relationship to him, etc. Answered yes, he's my boyfriend. Call ends. Luggage searched, and laptop plugged in to read emails we've sent back and forth. Officers satisifed we knew each other. Passport stamped, approved for full three month visit. Was advised again not to get married while here (yeah, we know!) Side note, as Adam was leaving, one guard asked the other "so that guy is okay?" Other guard answers, "yeah, he's just in love." No "proof" of ties was requested. Questions were asked, but no paper produced. Welcome to America.

Hey, thanks so much for this post. I'm visiting my husband in May he is a USC and im from London. I can't believe they searched his laptop!!!
And read his emails!!! Can i ask, did they force him to sign into his email and then read them or they just looked through the laptop without any permission?
Any advice please!

K-1 Fiance(e) Visa Process & ProceduresShould I stay or should I go?!

Hi jj80,

This K-1 is for your fiance to come to the States, right (sorry if that sounds dumb; trying to get the gist of your question)? If so, his unemployment is irrelevant (my now-husband left his job just prior to coming to the States), but you'll need to secure a sponsor for the Affidavit if you cannot sponsor the petition yourself, and that sponsor would need to provide the paystubs and other supporting documents. As you are a dual citizen, you should have no problem resuming your old job in Florida (entering the country with your US passport).

Your fiance, the beneficiary, would remain in England to do the medical and interview. I think some fiance(e)s do come to the US on tourist visas/VWP to sit out some of the process and return to their countries for the rest, but others here are more knowledgeable in that area than I am. My hubby and I spent four months apart from filing to visa.

Good luck, hun. Welcome to Visa Journey! x

Yep, this is for him to come to the States. Thanks for all your feedback. We are just in the middle of deciding when to end our contract with our current landlord for our flat. We were thinking of having myself, heading back to Florida to get back to my old job and US life (its been 3 and a half years) and he can live with his parents till he can get to Florida. What exactly does he need again to get to the US?

Jobs in the UK are ####### at the moment and we just want to work and live together and make money and be happy! :P

K-1 Fiance(e) Visa Process & ProceduresShould I stay or should I go?!
So, I am a dual citizen by birth of the US and UK. I currently live in England with my fiance who is British. We would like to get married back in my homestate of Florida and live and work there. My I129 F was filed and I got this message:On December 13, 2012, your Alien Registration Number was changed relating to your I129F, PETITION FOR FIANCE.

So, my dilemma is that my fiance has been unemployed since July 2011 and my last job was temporary and they ended my contract at the end of December. So, we are both out of work and I am dying to go back to Florida to get my old job back and start working again!

We are just waiting to hear back about the visa, but I am wondering if I can go back to Florida during this? Am I needed here in the UK for any interview or anything? I feel like we are wasting precious time and this is tough not being able to work and make any money.

Any advice, thoughts on this?!?!?!

ok, finally spoke with someone. She did say to bring along evidence to prove that he is not intending to work over in the states, and he is just on holiday and looking for future prospects of work. Maybe 2 months is too long? Shall he stay a month? We feel like any time spent there is better than waiting here, especially since he has been unemployed since July 2012! Its a risk we have to take I guess!

grrr I just spoke with someone on the phone from the UK/USA Embassy and he said that by my fiance visiting the states for 2 months, it may jeopardise his chances for his visa. He did tell me to call another number, which I did, but they are too busy at the moment! He has every right to leave England, as long as its not over 90 days right? He is unemployed and there is NO work here at the moment. Does he really have to sit and wait for a response? :help:

So, my fiance and I applied for the K-1 Fiance Visa in December. We are both unemployed in England at the moment and I would like to go back to the States to start working ( I can get my old job back right away). We are now thinking of having him come as well for 2 months, while we wait to hear about the visa. Jobs are non existent in England and we feel he is better off networking and spending time in his *hopefully* soon to be new country. Would it look bad on his part for doing this? After all, he has 90 days to stay using his passport. No point in wasting time here in dreary grey England!

K-1 Fiance(e) Visa Process & ProceduresProof of Employment...but no job

You can stall your K1 while you see who gets a job and make your decision before continuing or abandoning. It's not that easy to find work in the US either. He would be several months before he could accept a job on a K1 visa because he would have to apply for a greencard and work authorization after the marriage.

Thats what we have been thinking. I am thinking of having a cut off date and then decide if I should stay or go back. At least in England I would get dole money and some assistance. Its been so hard here living off nothing and putting a burden on my parents. And I was also thinking he would need a car here as well. Fingers crossed this job of his is good enough and then I can head back. What a crazy roller coaster this has been....as is life! :) At least I can go between England and the US as I please.

jj80FemaleUnited Kingdom2013-06-07 13:10:00
K-1 Fiance(e) Visa Process & ProceduresProof of Employment...but no job

Hey all! So, my fiance' is in England, and I am in America, well we just got approved (for the I129F Petition for Fiance'). Its now being sent as a case to the NVC.

Well....I am a dual citizen of England (from my British father) and US( I was born in America) and I was living in England until I lost my job in December. He has been unemployed for over a year  so we decided to make a move to America. I came back here in March thinking I would get a job again...I lived in England for 4 years...and I thought I could easily get another job here in America. Well...3 months later....and I am still looking for work. I am concerned now since I have to show proof of employment for his visa. I am a teacher and I am looking for work for the next school year but I cant apply for jobs till next month. And to top it off, he just recieved news that he may get his old job back in England, and its a professional permanent job.

Hmmm..decisions decisions! Do I stay here and worry about finding a job to support him and have him come here and look for work, or do I go back to England and have him work and I try to find work? His parents paid for the petition and did give his money for living here, but I dont want that to be a burden. I was thinking we could eventually be married in England and then apply for a different visa right? Would that be an easier visa to obtain (if thats even possible?)

Thoughts....advice....ideas?!!  smile.png

K-1 Fiance(e) Visa Process & ProceduresInterview letter not received after 6 weeks
Hi everyone
As soon as we emailed the embassy about the date we plan to get married they gave us an interview in two weeks by replying to our email! I really suggest to anyone else to give them a wedding date when applying. The date can be a few or couple of weeks after you actually plan to leave the UK. thanks

Thanks for everyone's hints and comments. We called the DoS twice over the past two weeks and once they said "they have your stuff, but they're waiting for the first available interview date to assign it to you", the second time they said "it's under administrative process". Now about a week after the last call, I called the paid phone number for the London embassy and they said nothing has appeared in their system yet. We also emailed the embassy and said that we are in a kind of hurry because my fiancee's UK visa (the American citizen) is about to expire and we should leave soon. No responds to that email yet though. I'm wondering NORMALLY how much longer this might take for to have my interview letter and then receive my visa. thanks

I had a question abou the fiance visa; im not sure if this is the right place to ask it, but i ll give it a shot and someone will hopefully tell me where the right place is at least!
Im applying for the visa from London, uk. I received embassy's letter regarding uscis's apporval on november 15th, which asked me to send some additional forms & do my medical test. The embassy has received my filled forms on november 22nd and medical results on november 29th. However i haven't got my interview letter yet. Any ideas why it's taking too long and what's gonna happen? Im sort of stressed now!
Many thanks :)

K-1 Fiance(e) Visa Process & ProceduresWill being rejected a 6 month travel visa hurt my chances?

A couple of years ago I applied for a 6 month travel visa to America and was denied as they felt I didn't have enough keeping me in the UK and felt I might try and move to the states by getting a working visa... now I'm ACTUALLY moving to america to be with my fiancé on a k1 visa. Will they see this as suspicious and will it reflect badly on me?
