Now you feel jealous, because I am so much smarter than you.

Awwwww......I feel sorry for you.

Yeah....we were unable to meet the requirements of the k-1 due to family emergency.

....but we will not be defeated....

You don't have to educate me about k-1....I have filed both for my wife.

I already went through the entire k-1 process with my wife.

Mate I'm not here to educate you at all...actually can't care less what you have done or not!!
benukMaleUnited Kingdom2012-09-05 11:15:00
National Visa Center (Dept of State)AUGUST CASES...ANYBODY WITH A INTERVIEW YET?

So, with your logic.....If every month k-1 applicants fill all the interview seats, then an IR-1/CR-1 applicant will NEVER get an interview seat.

I don't really know how they work their interviews slot but that is all that I can say that NVC have nothing to do with K1 interviews....and actually their cases reach the Embassies quicker than our IR cases! Let's keep the faith is coming soon hopefully! Cheer up.
benukMaleUnited Kingdom2012-09-05 10:53:00

WELL, if that will be the case....I will become VERY upset.

Because many k-1 applicants who passed through NVC after me were able to get September and October interviews.

K1s interviews are schedule by the Embassy not NVC so nothing to blame the poor guys there!!!

I don't mind who is getting interviews as long somebody is getting I know that mine will come soon!! :help:

National Visa Center (Dept of State)just received case number

Hi, I just called and received the case number and IIN, they have our e-mails, but have not heard from them yet. Has anyone done the DS-261 choice of agent online? I need to use this. My wife is in Lima, Peru. Can the petitioner fill out the form online? I see nothing about the DS-261 choice of agent form, when I log in, only the AOS bill and IV bill says not invoiced.

My wife speaks mostly spanish, and some English. The form is English.....Any help is appriciated.

Are you talking about the DS 3032? Choice of Agent!Look here on VJ on the WIKI pages and you will find what to do even a email format to send to NVC.

Thanks to all of you who've replied! As I'm sure many of you can relate, we were a bit shocked yesterday to learn that we would be separated for 3-5 months due to this lengthy immigration process, so we were up literally the entire night scouring this site and the web for any information we could get! I suppose we can't expect a lot of replies at the wee hours of the morning! :) We were so worried that our account wasn't working...LOL.

Anyway, thanks so much for your helpful advice. The Guides recommended by one of you above definitely helped, and the person who suggested that the London consulate wouldn't be able to process our I-130 was right. I called them today, and because I'm not legally living in the UK (just in and out as a tourist), I do not qualify as a "resident." Grr. Snail mail, here we come.

Our one consolation in all of this is that now we know there are SO many people like us out there in the same situation. Good luck to all!

K-3 Spouse Visa Process & ProceduresProcessing Times by Country
Does anyone know if certain countries have a reputation for faster processing of the K3 visa/I-130 application than others?

My husband is British and I'm American. We were recently married in the UK and are now facing a move back to the US, as I have a job offer there. We're wondering realistically how long we'll have to be apart during this application process. Is Britain fairly quick? From reading the Guides and various information, 3 months looks about average.

On a related note, does anyone know if the American Consulate in London will agree to process our I-130 if I am not technically a legal resident? (I have been living with my husband in the UK for 7 months, but haven't been working...I've just been in and out of the UK on a tourist visa.)

Thanks in advance for any advice!

K-3 Spouse Visa Process & ProceduresWage slips for Form I-864 - Help!

I was just reading the "Step by Step Guide" on how to file for a K3 visa, and I noticed that under the instructions for I-864 Affidavit of Support, it requires the inclusion of at least 3 recent pay stubs to accompany the application. My problem is this: I have just been offered a job back home in the US, and would have to work for at least 6 weeks before getting these wage slips. (I have not been working here in the UK, hence the reason we are moving!)

We'd like to file this form as soon as possible, but I won't start my job for at least another month, and obviously, we don't want to add another 6 weeks to the already long process while I wait to get these pay slips. Is there any way around this? In this case, would an employment letter and/or proof of employment contract suffice? :help:

Also, will the fact that I haven't worked in the past 7 months (due to a lack of working rights in the UK) hurt my ability to prove I can support my husband financially? I know I will meet the poverty level requirements, but worry about employment/financial history.

We would really appreciate any guidance you can offer!
Thanks,
Mariel and Vern[/u]

What exactly do you want to file for? K-3 or CR-1/IR-1? At the petition stage you don't need the affidavit of support. And if you file for a K-3, you will need the I-134 not the I-864. If you haven't worked for the past year, most likely you will need a co-sponsor.

We are just about to start filing our I-130, so we're in early stages. It's just that we are looking ahead to the K3 application and the last step (after I-130 and I-129F). I was under the impression that I needed to file both the I-134 and I-1864....where did you get that information? I'm sure you're probably right, but would love to know...I have probably mis-read/mis-understood something somewhere along the lines! Thanks for your help!

K-3 Spouse Visa Process & ProceduresQuestions about "other names used" for I-130
Here's a weird situation I could use some help with...

I was adopted by my ex-stepdad at the age of 12 when my mother got re-married. Even though they are now divorced, I have always kept and used his surname, and it is listed on my birth certificate. (A stupid, stupid situation since I have NO contact with this man whatsoever...but I digress.) The only name I have used my entire adult life since age 12 has been that surname...I don't even know if any records exist anywhere with my original (biological father's) surname on them anymore!! I guess I don't know whether to flag this name change on form I-130 or not, since my birth certificate and all legal documents in my adult life do match. Will the Dept. of Homeland Security even care about a name I only used until age 12??

This leads me to my specific questions on form I-130:
1) Under section B. 7. "Other Names Used - Including Maiden Name," is it important to call out my name as it appeared until age 12?

2) Do I need to include my married surname in that space, too? I have been using my married name on emails, my resume, etc., but we've only been married 3 weeks and I have NOT legally changed it yet.

3) If I do need to explain my adopted name change on the form, how do you recommend that I document this in the application? Should I include a separate letter as an attachment in the application packet to clarify that this name was changed due to adoption and not a previous marriage? I can produce an adoption decree along with the application.

Maybe I am over-thinking this, but it is a weird situation. I feel strange calling out a name that hasn't been used since childhood. Any tips based on your experience?
Thanks!

K-3 Spouse Visa Process & ProceduresWhat address should I state on form I-130?
Ok, just so that I'm clear...to change my address at any point during this application process (packets 1-3 for the K3) will be a huge PITA, and my best bet is to use ONE stable address throughout. Yes?

I get what you all are saying, but am ultra-paranoid about delays (as you all can relate)! My husband and I were thinking that we would complete packets 1 and 2 using our London address only, since I'll be here long enough for that, and changing over to my Chicago address for packet 3. But based on your postings, this sounds like a bad idea now...am I right?

Thanks!

K-3 Spouse Visa Process & ProceduresWhat address should I state on form I-130?

My husband and I are going to send in our I-130 this week, and I'm not sure what address to list for myself.

I currently reside with my husband in the U.K. However, I will be moving back to the U.S. to start a new job within 4-6 weeks, while the application is still processing. Should I list my London address in section B. "Information About You"? OR should I give an address in the U.S., even though I am not there yet? (I will probably stay with a friend until my husband is allowed to enter the country, and she says I can list her address if needed.)

I do NOT want to slow down this application process, so please advise which option will prevent delays!

Thanks for any advice.

Yeah, I'm sure she'd be willing to send that off. So it sounds like I will need to put my friend's U.S. home phone number on the form at the bottom, too. (My only phone number is in the UK and will be defunct by the time the application gets that far!) Thanks for your help...you've been great!
