Our 'amended notice' was mailed on thursday 10th september, but still nothing has arrived. When they say 'mailed', does that actually mean mailed on that day? Maybe it goes into a huge stack of stuff to be mailed - eventually!

The whole K-1 process has driven me and my fiancee to near insanity. It is littered with unclear instructions and ambiguity. I had my interview in London on Feb 3rd. We started the process back in May 2009. I checked the guideline notes for the interview and nowhere is it stated that you need to take tax return paperwork for your fiancee, nor does it say you have to file an I-134. The US Embassy website specifically states that K-1 visa applicants DO NOT need to supply an I-134, but to supply 'evidence of support', which I did.

When it comes to the interview day, it really is a shot in the dark and depends on who looks at your papers/file on the day. They have the power to decide on the day that they need to see specific information, even if you have not been asked to supply it in the interview guidance notes! So even if you have everything that you need (according to the embassy guidance notes), there is still a chance they may want something else on the day (which defeats the object of guidance notes).

Tax returns are certainly not required for K-1 visa applicants, but the embassy decided on the day of my interview that they wanted to see tax returns!

My interview was on Feb 3rd, and I supplied final requested documents to the embassy by courier on February 9th. I am still waiting for a visa!

I wouldnt feel safe posting my passport anywhere! Cant you apply for a passport through the Indian Embassy here in the UK? When I get the states, I'll need a new passport within 2 years and rather than getting my parents to apply for one at home in the UK, I'll do it through the UK Embassy in Washington DC.



I wish I could do that, as its a change of DOB UK Indian embassy can not do anything I have to contact the local office in India who issued my passport. Its not a good situation to be in. in india I have to get a affidavite from a high court judge to be able to change my DOB :bonk:

Moreover according to the Law in India sending passport by post passport is illegal. I am so upset.

so here I am my K1 is approved, so happy but the US embassy called to let me know I have to get a new passport as my DOB is wrong.
we did make our lawyers aware about this but they didn't really take this seriously. anyways I have to send my passport to India so my family can get a new one issued for me. :crying: :crying: :crying: :crying: :crying: :crying:

Will I be able to send my passport by post from London to India, if yes which is the best way? and will it be a issue for my family to send me the passport back.

I landed on the 25th in DC dulles Int airport, the ques for non us citizen was long so we were moved to us citizen. It was easy and the immigration officer was nice too. Dont forget to make sure you get the I 194 in your passport.

My fiancee' sent off her application for the police certificate to ACRO a couple weeks ago, then set her medical interview date for Aug 5th. But, Saturday, she received a letter from Royal Mail notifying her of damaged/opened mail and it only contained her uncancelled check! Don't know if the personal information requested has been lost/stolen, or if made it to ACRO without the check! It appears that the Post Offices run in the UK are privately operated, versus the U.S. Govt run P.O. here, so ANYTHING could happen. HINDSIGHT says, she should have sent it registered mail! We'll see what happens and hoping identity theft is not involved. :unsure:


Was the cheque filled out correctly? I would send all the documentation back again and pay the extra to have it rushed through. You can also call them to find out what went wrong, whether they even received her details.

you do not have to prove wedding plans,as you can not tell when your I-129f will be approved. You must have proof of an on going relationship.

Actually I had the same worry. When we got engaged we didn't publicize it to the world right away. We had only two weeks to get all the paperwork ready until he flew back to the US. We were so concerned with completing all the paperwork and getting all the evidence together we didn't even think about the fact our pages said 'In a Relationship' and not 'Engaged' until after we had sent in the documents! If you haven't already submitted I would leave out the page that defines your relationship and just submit wall posts etc. I think on VJ from what I have read people tend to worry quite a lot about the smaller details - I would tend to agree with the people above who say USCIS wouldn't deny a petition based on your relationship status.I'm hoping in our case since the relationship is genuine they won't question it too much and if they do we have a good reason! As with regards to the monitoring by the looks of it only those in a fraudulent relationship need to worry :) Good luck!

Same boat, we got approved June 14th and only left NVC July 22nd, took almost 6 weeks!!! What I did was follow the instructions on the NoA2 document, I emailed all our details e.g. name, DOB for both petitioner and beneficiary with the document number (from NOA2) in the subject title, hey presto the next day we received our notification. I only wished I had not waited and tried after 30 days as it may even have been approved earlier! I think they are just backlogged at the moment, good luck hope yours comes soon!

Do you really think they would conduct a background check on a bank account? I doubt they really have the resources to do that unless it was really suspicious - I was more under the impression that any large recent deposits had to be 'explained' so therefore as long as you have a legitimate reason for a large deposit i.e. recently acquiring inheritance money or money from parents that is say a 'wedding gift' for example and can prove it by form of a letter or other evidence then its ok. This of course completely depends on your situation however I think all consulates are different and I think they look at the whole situation. I think getting the parents to act as co-sponsor is the safest bet, good luck!!!

I went on holiday to visit my fiance while filing, when the guy said 'what's the purpose of your visit?' I said 'visiting my boyfriend' with a big fat smile on my face. I had with me a work contract, travel insurance to cover the two week holiday period, my return ticket home and evidence of savings but the guy didn't want to see any of it he just smiled and waved me through. I did arrive into San Francisco though and I've heard they are more chilled compared to the East. Generally they are ok with you if you are from a VWP country and can prove you intend to return home if asked. Good luck and enjoy your trip!

We will have approx the same timeline as I sent off my packet 3 on 29th July. I've been watching the timelines and it looks like the interviews are held approx. 7-8 weeks after you send in packet 3. I am predicting that given my timeline my interview will be the week 19th - 23rd September however this is just a guess and if any of the documentation is missing or deficient or there is a problem with the medical results I think this can hold up the interview. I read somewhere that buying a two way ticket and not travelling on the return is in 'violation' of airline ticket rules. This made me a bit nervous as of course if its cheaper you are going to buy a return rather than a one way!!! I am planning on doing the same myself but maybe keep quiet and don't mention to the people who are checking you in that you are in fact moving to the US and not planning on returning!

Guidance on the link provided by anh map above outlines:

An applicant for K-1 or K-3 visa may generally satisfy the requirement of the law by the presentation of documentary evidence establishing that
1. the applicant has, or will have in the U.S. personal funds sufficient to provide support for the applicant and dependent family members, if any, or sufficient to provide support until suitable employment is located.

That implies that you basically need to prove you will have enough income to cover you whilst you cannot work (for first 3 months). If you are lucky enough to have your AOS interview 6 months after you are living together you are allowed to count your income in the US towards the I-864. That however cannot be absolutely guaranteed since you don't know when your interview will be exactly.

Also the US Embassy London is not like other consulates and they do offer a self-sponsorship option. I have read reports from a few years ago of people getting through the K-1 visa with a few thousand pounds savings. On another forum someone had written to the US embassy London asking if they could self-sponsor and if so what an acceptable amount would be. The reply they got was: 'anything upwards from £1000 should be sufficient'. Now a couple things to bear in mind this was a few years ago and things could have changes by now and also the I-864 which comes after you are married during AOS has tougher requirements so you will need to co-sponsor for that however for the K-1 visa the requirements are a lot less stringent.

Try not to worry to much and have another word with the family member interested in sponsoring you. If asking family is too difficult do you have any friends you could ask as it doesn't have to be a family member? Good luck!

I sent in all the packet 3 documents on 29th July and I had my medical 3rd August. We are now 4 weeks on and haven't heard anything. I said in a cover letter that we wanted to get married 21st October (which SO is not going to happen now!) but I said that we hadn't made any definite travel arrangements I guess that may have been the problem. When I called DOS today they said that they were still in the 'processing' stage so hopefully this means we are close but perhaps I might call the really expensive operator assisted number tomorrow just to check they received everything. I guess it doesn't help we just had a bank holiday yesterday and its Labour day on Monday. Thanks for all the advice anyways I will try to be more patient :)

Is anyone else frustratedly waiting for an interview in London? I've managed to stay quite calm thoughout this process so far but this seriosuly seems to be taking forever. Its been 2 1/2 months since our NoA2 approval and I called the DOS line and my paperwork is still pending and I have not yet got an interview date. I was told that the embassy part was the fast part of the process but it certainly doesn't seem this way. Sorry to rant its just really difficult being in limbo. We cant start really planning anything until we've got the approval so it makes organising a wedding almost impossible!! Please hurry up UK Embassy London!!! Put me out of my misery!!!

I know the feeling, I have been anxiously waiting for my interview date for weeks, it finally got issued on Friday for Oct 4th. You can look at my timeline too but just to summarise I had my medical 3rd August, got issued interview date Sept 2nd and the interview is October 4th so I would bet on approximately 2 months between sending in packet 3/attending medical and the actual interview date. If there is any way to reschedule your wedding I would, you don't want that kind of stress on you when your trying to organise a wedding, trying to immigrate and trying to get everyone family and friends over to the US for the actual event etc. Me and my fiance are getting married by ourselves as soon as the visa process is over and we are organising our Wedding for friends and family next year which means that we avoid the stress of not knowing if you will be approved in time for the wedding. It might not work for your situation but just an idea. USICS certainly don't make it easy for us! Best of luck!

The K-1 timelines are so unpredictable I got my NoA1 6 months ago and my interview is still almost a month away! Personally I think it just isn't worth the stress of trying to make definite plans before you have your visa in hand. Plus with the state of US Healthcare I think its preferable to have the baby in the UK, wait a few months and then travel over to the US. At least you won't end up with a big dent in your wallet if you can't get covered by insurance. Good luck to you!

OK first, breathe! So I know how I felt when I saw the packet 3 documents all very confusing and overwhelming........so despite what it says you don't have to attach birth certificate, police certificate, proof of engagement and evidence of financial support along with the packet 3, you just need to make sure you bring all that evidence to the interview with you. Download all the forms they say in the letter, complete and send back to the embassy. They also say to attach a cover letter stating when your medical is booked for, this is also an opportunity to include any wedding details if you have any.

You can schedule your medical as soon as you have a case number with Knightsbridge doctors here is some info: http://london.usemba...xamination.html - Just one thing to note that they don't mention on the website they want your police certificate numbers at the time of booking the medical so if you haven't already first thing to do is order the police certificate from ACPO: http://www.acpo.poli...rtificates.aspx

After you've gone for your medical the results get forwarded to the embassy within 5 working days. Once they log all your documents and receive medical results they schedule your interview date.Hope this helps!

Exactly 7 months after we started this process and now I have my interview tomorrow at 8am...............I am feeling excited and a little nervous although I am sure by tomorrow morning that my stomach will be churning! I have all my documents ready and together and I'm going in with $69,968.51 in savings praying they will accept this for self-sponsorship through the London embassy (Dam exchange rate means I have way less than I did a month ago)! I will make sure I post the result so anyone in a similar situation to me can get some more info about this option. There isn't an awful lot of information out there and I'm sure this is an interesting topic for those from the UK who are in fact the principal provider in the relationship rather than the US-Citizen (my husband-to-be is a student and supports himself with a mixture of grants, loans, parents outside the US and me but we are not able to include any of those on the I-134). Please note that this won't apply to you if you are from a different embassy as far as I know the UK is the only embassy that allows this. Anyway it has been a long tough journey and hopefully it is almost complete. Keep your fingers crossed for me fellow VJ-ers!!!

They want basic biographic information on you and your fiance and they also want proof that you've met in person in the last 2 years. That's all the first package is, really. Proof of citizenship, proof of ability to marry, and proof of relationship.

Once USCIS approves your petition, it will be first sent to NVC and then to the embassy in the beneficiary's country. Packet 3 is something the embassy sends the beneficiary, asking for some more forms. Each embassy is different, so I can't tell you exactly what will be included in the Packet 3.

After Packet 3, there will be an interview at the embassy. That is where you will provide them with some original documents such as the I-134 (and supporting evidence), police certificates, birth certificate, your passport, proof of ongoing relationship, etc.

That was very helpful. Thanks. Yes it is just the 2 of us. The only reason i was thinking of a lawyer was to go through all our papers before we send them off ... i just want everything to be perfect. These things can take so long from what i can see from others timelines.

It's the petitioner's finances that they want information on. Does his full time job earn him enough money to meet the I-134 requirements? If so, no savings or assets are needed on the form.

Does your fiance's full time job put him over the poverty line though? if it does you won't need to use any assets or savings on the affidavit.
