On the 11th October will we back together again. We would like like to say thankyou to VisaJourney community for guides,forum responses and general support. We all need each on here,never forget that.
Will we continue our journey with CR-1 but for now at least we can live a normal life again.

Ok, so based on the replies here, we have:

- 2 votes for leaving it alone, and keeping "NONE"
- 2 votes for re-doing the form
- unanimous agreement that correction fluid is a no-no! (guess that answers THAT question!) :P

Combine this advice from another post suggesting we write "UNKNOWN" in the A-Number section, and I'm still confused...

I am inclined to go with the advice of those who suggest leaving it alone (saying "NONE"). Since the NOA-1 doesn't tell me what our A-Number is, then they can't expect me to know we've been assigned one, and can't possibly fault us for still thinking we don't have one! Right? Plus, if we leave it as is, that will save me another trip to print more forms. :thumbs:

If anyone else out there has input on this subject, we'll keep checking back!

Hi everyone (yet again),
Ooops, I just made a mistake on our G-325A that we're enclosing with the I-129F packet. I intended to write "UNKNOWN" where it asks for A-Number/File Number, as advised in a previous post today. Instead, I accidentally put "NONE!" The harder I concentrate on doing things correctly, the more I mess up... :blink:

Is it ok to use correction fluid (White-Out) to correct this error? I would normally just re-print the form and start over, but we don't have a printer at home and it's quite an ordeal getting to the place where we print. This application is important to us, so obviously, we'll go re-print and start again if we need to...but would it hurt to cut a teensy corner by using correction fluid? I imagine what the USCIS cares about most is that the information is there and that it's legible.

Thoughts?

Does anyone know if certain countries have a reputation for faster processing of the K3 visa/I-130 application than others?

My husband is British and I'm American. We were recently married in the UK and are now facing a move back to the US, as I have a job offer there. We're wondering realistically how long we'll have to be apart during this application process. Is Britain fairly quick? From reading the Guides and various information, 3 months looks about average.

On a related note, does anyone know if the American Consulate in London will agree to process our I-130 if I am not technically a legal resident? (I have been living with my husband in the UK for 7 months, but haven't been working...I've just been in and out of the UK on a tourist visa.)

I suppose temp employment is better than no employment! If the temp agency is technically your current employer, but the company itself intends to hire you as regular staff later, I would get that company to write you a letter that explains the terms (e.g. when they intend to hire you permanently, what conditions you have to meet for this to happen, salary/income level, your work performance, etc.)

As a back-up plan, you could also accept the temp job now while continuing to look for other full-time employment...can't hurt to switch jobs in a few weeks if you find something better/more premanent.

Hi Everyone,
I have a few questions on filling out form I-134, and hope you can help:

1) Since the form needs to be "sworn to before a notary public," does that mean I need to fill the form out in front of that person? Or can I fill it out in advance and just sign it in front of them? :blink: I feel silly for asking, but I'm not sure I understand how this works!

2) Can I use 401K and Roth IRA investments as "assets?" My income should be sufficient proof that I can support my husband, but just wondering.

3) Question 8 on the form is "The following persons are dependent upon me for support." Do I list my husband there? We don't have any children, so when he enters the US, he'll be my only dependent.

4) Question 10 asks about visa petitions I have already submitted for my husband and the date. Are they looking for the I-130 here, or the I-129F, or both?

It's a tricky question, huh?!? I also had to post a question about that. What most people told me was that it doesn't matter what you put as long as you leave it open ended, and don't say you are going to cut the person off. So I wrote: "I will provide my husband with food, shelter, clothing, transportation and all other reasonable living expenses for as long as necessary until his working rights are granted." I don't know if this is totally correct, but it's what I said based on the advice I got.

Just a quick enquiry guys, as I am a newbie. Got married to my sweetheart in Scotland (a USC) , last year, while i was a student. Still in the UK, and about to apply for my post study work visa, so we decided to go for the i-130, we have recieved approval
notice for this and we we are on the next stage and awaiting reciept for this stage. Question is about my eligibilty to apply from the UK, being a student (though switching to a 2 year work permit).
I am currently having visa issues, which i hope will soon be resolved or else, might go back to my country to continue the process. Second question is, if i go back to Nigeria, does this mean we have to start afresh?

Opinions will be appreciated.

I've got mine. It did take 40 days.

You go into your local Police Station and ask for the form. Fill it in with your address, any previous address if you have Criminal Convictions etc. They know exactly which form you need the WPC I spoke to was lovely asking where I was moving too and wishing me luck with the whole process

I took mine away to fill in. Then give it back to them with the cheque. They then send it off to Scotland Yard.

You have to file from your local police station and you can't get the form from anywhere else but there.

Well after the NVC assigned our case number about 4 weeks after it was approved. Also we recieved the bill around two weeks after the case number.

I was denied entry as a intended imigrant without a visa.
If ur partner comes. Make sure he can prove he has strong ties to his homeland.
Also if they ask him any questions be truthful.
As if they interogate him, and he lies.
The ###### will hit the fan, if they find out the truth.

Me and my wife recently got married in the UK (I'm British) and are considering either applying for my k-3 visa now and have her move back to america and sort out somewhere for us to live when I get there or apply for her further leave to remain in the uk in order for her to work until we go back to america. We have already decided that we would move back at the end of the year so it would only bring the date forward by a couple of months. Any advice would be very welcome on what we should do



As advised, if your wife is eligable, DCF is the fastest option. Once your I-130 is accepted, she doesn't have to remain in the UK until your approval. If you so wish, she can return to the US ahead of you and get things settled there. It's a pretty straightforward process if you do your research. My husband and I are currently in the CR1/IR1 process, check out US Embassy, London and British Expats Forums both of these have been my most visited pages!

Ientered the U.S in 2005 and stayed until 2008 I managed to extend my visas 5 times and on the 6th time was denied.I then left the country and returned to England.When I tried to re-enter the U.S two weeks later I was denied entry because I was not eligible for the visa wavier.
While I was in America I stayed with family and had my own income from the U.K so I was never a burden on the state.My fiance and I met two years ago and have a loving relation and would like to be together.We have now had to conflicting advise from two different attourneys, one says to apply for the K1 another advises the K3 because of my extensions.
My fiancee is a U.S citizen and I am a U.K citizen. Can anyone advise!!!!!!!!!!

Very confused. I am a US citizen and live in London and had to file the I-130 at the London embassy. I recently received back the approval of Form I-130. Am I supposed to wait to receive a packet to complete? (how long does that take) Or am I supposed to file form I-129.

Please help I am so confused and I just want to keep the process moving.

I'm not totally sure of the answer to your question, as I'm only halfway through the process myself. However, having read other posts, I think at this point you wouldn't want to file an I-129F (K-3 spouse visa) as filing for IR-1/CR-1 (immigrant visa) in London is quicker, cheaper, and less hassle. Although the complication may come if you put on the I-130 that you were going to file for an AOS (adjustment of status) in answer to Q22 on the I-130. If you put down that you were going to apply for the visa in London then that's fine. If, however, you put that you were going to file for an AOS in the States then that might change the situation. Do you remember what you put on the form?

Again from reading other posts, it appears that you receive your packet 3 a few days after your I-130 gets approved. So, I'd say hold on for a few days and see what comes in the post. Then you want to send back your DS-230-I as soon as possible, to start the visa processing. There's a bunch of information you have to collect for the interview (including police certificates -- have you already sent for these)?

I'd suggest re-posting this in the DCF (Direct consular filing) forum as the whole "K-3 or IR-1" is a common question and there are lots of people who understand the process much better than me, but I think you'll find that if you apply for an IR-1 then you'll have your visa within 2-3 months from now. If you apply for a K-3 then it'll probably take a lot longer.

Does anyone here have any experience of visiting the U.S. on a tourist visa or via the visa waiver program, while their K3 visa is still being processed? (with no intention to work - just visit)

If so, did you have much trouble with the immigration officer at the port of entry? What evidence did you take with you to convince them that you didn't plan to stay for good?

I think you're right, they got vsc and csc the wrong way round. I looked at some recent k3 timelines at csc, and they have taken about 70 days to get their NOA2. Shame. They really need to fix that!

my wife and i filed our paper work july 18th 2011 using a i130 form, we have contacted the INS several times to chase up whats going on with the paper work most of the time they say it will be done when its done. we contacted them again and was given an email address for them to chase it up. the reply we got was



A check of USCIS records indicates that this case is currently under extensive background check. You should receive a notice of action* within six months.

*A notice of action may be in a form of Approval Notice, Denial Notice, Transfer Notice, Request for Evidence or Notice of Intent to Deny.

in the mean time i have been back with my wife once on a vacation visa would that delay the visa going through.

I have a few questions regarding the I-864 and DS-230.

On the I-864, is it advised to send your three most recent tax returns or will the most recent (2011) be fine?

On the DS-230 it asks for the fathers current address. What if his current address is unknown? Should we just list his most recent address?

I am sort of confused on the whole picking and agent part. I was told to pick someone that is in the US. Myself and my wife are currently living in Japan. She lives with me. Should I name my parents that agent since they are in the states or can I just list myself?

Will I have to actually mail off anything to the NVC? From what I keep reading you can email almost everything.

I appreciate the assistance!


Just in case request with IRS the last 3 years Tax transcripts....What do you mean father's address? You are the petitioner? The agent will be the person that will receive from NVC all the packs and pay the IV fee and visa fee and send the support documents to NVC...are your parents able to do that?

Okay so you should have a PDA or a Priority Date for your visa to be available you should know that for not being a e Immediate relative of a USC such as a parent,spouse or son/daughter your visa stay in line until is available so your priority date you will find on the March/April Visa Bulletin...your Priority Date is the date that your I-130 was accepted by USCIS.Usually you go the whole process from USCIS to NVC and when NVC close you case you seat and wait until your PDA is available.

No one can tell you how long you have to wait because you have not told us if your Priority Date (PD) is current or not. Once your PD becomes current, it should be fairly quick; 2-3 months after your PD becomes current. The US Embassy will schedule an interview for you AFTER your PD becomes current if all your paperwork was sent into the NVC.

On the website where your husband paid the $88, he needs to go back to that website to download the bar coded cover sheet and Form I-864, Affidavit of Support (AOS). He files this form with his most recent tax return. He must make at least 125% of the poverty level to meet the financial obligation to bring you to the US.

On the same website where your husband paid the $88, he should also pay for the fee (approximately $400) to process your immigration visa application (DS-230). There is a bar coded cover page.

You must send in the DS-230 and I-864 before the NVC will forward your case to the US Embassy.

Hello there, a FA2 depends on your priority date or PDA now your PDA is the date when your I-130 was accepted by USCIS...so from there if you look on the VB= Visa Bulletin that is out every month you should see what PDA is available for a visa...Remember that because your husband is not a USC but a LPR you need to wait for a visa to be available and right now is running around 2 to 3 years for a FA2 get a visa!

Maybe just a simple affidavit could sort it the problem or even is not a problem at all!

If she didn't file because she made no money, you are fine.
If she didn't file herself because she files jointly with an ex, she can get transcripts.
If she is behind in taxes, but has made payment arrangements, she'll be fine.
If she just didn't file, you need someone else.
