HELP! My English fiance got to the interview in London, UK today, and they suspended our petition pending that they receive my tax return from last year. They had never asked for it, and we did not know we had to give it to them.
1) Has this happened to anyone else?
2) Is this just procedural or a major problem?
3) How long do they take then to issue the visa, if they choose to grant it?

We have a wedding planned over here in the states for November 24th, so we are very worried about how this is going to unfold! Any help, suggestions, advice, or comments from anyone who dealt with something similar would be very appreciated!!

I don't know the procedure for the K1 so apologies. For the IR1/CR1, last year's tax return must be attached to the Affidavit of Support even if you are using assets to prove finance requirements. We filed late returns in London at the Embassy earlier this year before our interview and it could not have been easier.

I'm sure someone else on the forum will be able to give you a K1 specific answer, but Good Luck. :thumbs: I am sure it will be sorted out quickly.

Hi

So we just got our NOA2 today kicking.gif and now I have so many questions... Mainly, what happens next?

I know the file goes to the NVC, but how do I know when it gets there and then when it leaves and gets to London? Is there a site I can check? Someone I can call?

Also, what can I get ready for Packet 3? So far I have my birth certificate, police certificate, passport photos, vaccinations list... Is there anything I am missing that is going to take a while? We've been waiting so long for the NOA2 I don't want to hold it up anymore!

I'd really appreciate any help! I don't know where to start!

I went over to the USA on a B2 visitor visa for 6 months. This was due to run out Mar 2005. I was told that it was possible to extend your stay so I spoke to California Service centre and they told me to write asking for an extension and it shouldn't be problem.

Sent the request in January 2005 well before the visa ran out. They wrote back at end of April 2005 saying my request was denied. I had already booked my flight back by then, so I flew back 6 June 2005 meaning I overstayed my visa by 3 months.

I haven't been back to the USA since then as Jonathan has visited me in UK. Will this be a problem at interview?

Also when I went for the interview at the US Embassy in London to apply for B2 Visa I never mentioned that I would be staying with Jonathan in USA. Will they ask me at the interview why I did not disclose at that interview that I had a boyfriend in the USA?

I do have copies of the letter I sent requesting the extension and the post office receipt to show that the request was made 2 months before the visa ran out. I also have the letter they sent saying that as my reason for requesting my overstay was that I wanted to travel and see more of America that they felt that 6 months was sufficient for me to have done this. I also sent bank statement showing I had £15,000 in my bank so more than enough to support myself for a further 3 months.

Any help here would be much appreciated as I'm worried that the overstay will course a big problem even though I left a month after having my request denied.

On the London website it tells you that people between 19 - 60 need an MMR and TD jab.

I would have thought it would be cheaper just to get these two jabs done than pay for blood tests to be done.

Go to your countries US Embassy Website and search for innoculations.

Sorry I don't think I made myself clear. I'm the one in London waiting for p.3

He is in the USA and moving address this weekend.

Does he need to let anyone in the USA know this or are they finished with him from that end and as the case is now at the London Embassy it won't make any difference as they only are interested in me at this end.

When I have to fill his address in on the forms for P3 and P4 will it make any difference that he has a change of address?

The NVC say that they forwarded our Docs to the London Embassy last Thursday 28 September. So I am now just waiting for my Packet 3

My Fiancee is moving to a new apartment This Saturday 7 October.

Is this going to be a problem. Does he need to let anyone know?

Fwaguy. Thanks for the response I really appreciate it.

My fiance thinks that the copies are all that I will need, as it is the London Embassy, he says they are only interested in proving that I am eligible for marriage and that if I had been married I would need to supply my original copies. However he thinks I won't need his originials as he thinks he would have had an RFE back at the beginning of the process if they had any queries regarding his divorce.

He is not very keen to send the originals in the post to me just in case they get lost. That is why I am trying to find out if it could be a problem if I only have copies?

If I need to have his original documents then he will have to send them, but I would really appreciate if someone could give me a definitive answer on this.

I was dreading having to list all the countries I had visited in the last 10 years as I had to travel a lot for my job a few years back and I had visions of forgetting a couple and them bringing up the missing trips at the interview and me getting a big red denied stamped accross my application!!!

DS-157, Required of all male K visa applicants aged 16 or over

It says the same thing on the London Embassy Website so I wasn't sure if that meant that only men needed to fill this form out?

I didn't send off one of the forms which only needed to be filled in by men over 16. The K 157 I think.

Has anyone who sent packet 3 back in October had an interview date yet? I sent my back Oct 12 and looking at Time Line histories it seems to take between 6 -8 weeks from sending it off it the interview date.

My dilemma is that I would like to fly to the USA 2nd Jan. I am going to rent my house out and I need a month I think to sort the house to look it's best for renters, pack my stuff to have it shipped, catch up with people, plan my wedding and also Xmas falls in the middle.

Therefore I need to finish work on 2nd December and I have to give a months notice, which means I need to resign this Friday.

I'm just paranoid that I resign and then my interview doesn't come through until January, which means can't leave 2nd January so I could have worked longer and saved some more money.

What does everyone think. If I take the risk and resign do you all think my interview will be before January?

Opinions greatly appreciated.

Also my Wedding is planned for Vegas 17 Jan 2007. Deposit has been put down but the date can be moved if needed. A lot of my family and friends have surprised me by saying that they would like to attend. I've told everyone not to book anything until I know when my interview date is. Do you think once I know when it is, it would be safe for them to book their flights?

I know it all depends on me passing the interview, but I really can't see any reason why I won't. Had my Medical yesterday which was fine - At the new Medical place on Bentinck Street. First day they opened. Also just to let everyone going through London know. The blood it tested for HIV and Syphilis only. Nothing else at all is tested for.

Drugs, other diseases etc they just rely on you being honest on the questionnaire as they can't ask for your Doctors records either. Very chatty Doctor I had. I'm not sure he should have told me all of that but might make some of you feel better about the Medical.

Or are you planning on not living in the same home as her?

Perhaps put her in a trailer, so she doesn't see your real house and divorce you for half of that as well!

When I read things like this it makes my blood boil.

If you don't trust her then don't get married... end of. Go to her country and get to know her a little.

If my fiancee refused to show me his financial details no way would I give up my job, friends and home and move half way across the world for him.

Had my interview this morning and passed!

Must say if you are going to London be prepared to wait in the cold outside though.

My interview was at 8.30 this morning. Got there at 8.25 but didn't even get sent through to the Security Gate until 9.40 and didn't get into the actual Embassy until 10am

Got quite a grilling as to why I had overstayed on my B2 visitor visa by 3 months. Explained that I wrote to CSC in January 2005 requesting an extension as my visa was due to expire in March 2005.

They wrote to me in April 2005 denying the extension. I then left the US in June 2005

I had to show copies of the letter I sent requesting the extension. The letter they sent to me denying the extension. A copy of my boarding card showing I did leave in June 2005 and also email confirmation showing the booking date of my ticket. If I hadn't had all of these details I really think he would have denied me. He was questioning me for about 20 minutes and I honestly thought it was going to be a denial.

Anyway I passed and will be leaving at the end of December. Hurrah! :dance:

while reading through the site I saw this 'Evidence of Support: An applicant for a fiancé(e) visa is not required to file an affidavit of support, form I-864 at the time he or she applies for a fiancé(e) visa.'
So after we get our co-sponsors to notraize the I134's etc, do we need to do it all AGAIN when filing for AOS but with the I864??

Yes to the OP. Get everything done now. The police certificate is good for 12 months and you have to get photos signed before you can mail it off. Your DS forms are all online so fill out and print asap.

I noticed on the site about the support form it says this 'Once the form is affirmed, it should be mailed to the same USCIS office where the application was filed' - I was under the impression that the forms should be sent to ME and I take them to the interview, why would they be sent to Vermont??
