For example, is it a medicial or a military reason?

We just recently got our petition granted to be expedited. Reason being is that my fiancee has brain cancer. All she did was speak to the USCIS over the phone, they asked a few questions and eventually expedited it.

However, all situations are different. I remembering reading one post stating that his fiancee was from Afganistan and his fiance was in danger of being kidnapped for ransom, and another was because he was going to be deployed for his military services.

So my point is (before I waffle on even more) what is your reason? :)

So yes, there MAY be a small chance that it will be approved, but as our experience goes on this site, they have only seem to be approved for life or death situations. If you do get approved that's great :) It will be good knowledge for VJ too to see a case like this approved.


I have to agree with you on this one. My fiancee who is the USC has Stage 2 Brain cancer and was approved of the petition being expedited. For some reason when it was at Stage 1 they denied it. Guess they have a set standard at what life or death situations are.

Any case, don't get disheartened if you do not get it approved. You love him right? Of course you do, why would you file this petition if you didnt? You are on the start of this brand new advneture with your partner. Sure it maybe a long round, but in the end it will be worth it.

Hi guys,

Just thought I'd keep you posted. Maria had to go into the ER. According to her 'doctor' the drugs he was giving her was 'experimental'. I say that loosely because he never told us that is was experimental!!!

It has had an adverse affect on her and instead of reducing the fluid from her system it has increased! She was in hospital last weekend as they were draining the fluid out of her brain and testing the enzymes to see if there is another tumour growing again.

She has another appointment this weekend, so I have decided to fly over this Friday (21st) until the new year so I can look after her and be there for Christmas and my birthday (1st time for both yay!)

I will try and keep everyone posted, but if I don't I hope y'all (trying to be Southern!!) have a Merry Christmas and a Happy New Year!!

Congrats on those who have made it this far!! It does bring me a little joy and hope that my comrades are getting through this process! I am hoping to get my packet when I come home (YEAH RIGHT!!!!)

Hello my VJ family,

It has been a while since I posted on here. I mean, on this post. I have been on other posts here and there but haven't really explained what has been going on. Id thought I would keep you guys updated.

So I did go over there to see her for about a month. I was really vervous at the POE (Atlanta). When I told the officer my reason, she did sympathise with my situation, but made it clear that I had to return to the UK. I was polite, but my mind being else where it was hard dot consentrate.

Borded my flight to Chattanooga, TN. Got into a taxi and opened her door (she gave me a copy of her house key). I have enver seen her so happy before...well, appart from the day I proposed to her. She was crying, I was crying, happy not sad mind you. We just laid there in bed, telling her that everything will be ok and she will get through this.

For 4 weeks, I took her to the chemothrapy 4 days a week. Thats it. We didnt go out, we didnt go anywhere. I made sure that I looked after her. I went grocery shopping, checked up on her godmother, cut her grass, feed our cats. But you know, I didnt mind it. It felt great that I was there, being there for her and doing all this so that she would get better.

More and more appointments came and gone, showing signs of improvment. Unfortunately, she still needed surgery and her surgery was scheduled a few weeks after I had to go home. I was really upset, but she understood, and she was very proud and happy that I came over for 4 weeks just to look after her. She said she would pay me back, but Iam like hey, we are in this together, money doesnt matter.

Sure enough her surgery is this week. I hae been leaving my webcam on all day and night just to make sure she is safe and I am looking after her as much as I can. Doctors are confident that after this, she will be in remission (cancer free).

However, the expedited petition did not go through. Apparntly they 'lost' the confirmation so I am still waiting for the NOA2 with the rest of the May VSC filers. Hopefully we will hear soon. My work hasnt been so supportive of my situation to say the least. I requested to go part time so I can look after my fiancee, they declined. I requested that I have no lunch break so I can gome home early (I work 12 hour shifts), they declined. Heck, I asked if I could bring my own laptop so I can monitor her (lol no not like a stalker!), but again. They declined.

Nevertheless, I guess I wanted to thank you guys for convincing me to go. It broke my heart that I couldnt stay for the surgery, but being there and helping her through the chemothrapy really made a difference. I know she will pull though this, put this behind us and look forward to our future of becoming husband and wife.

Got my plane tickets booked for next week. Going to be by her side for three weeks during when she will have chemo. She watns to thank everyone here for helping me and supporting us during these dire times!!

In other news, she called the USCIS to see where abouts our petition is in the queue (we are at VSC).

The petition has been expedited!

We should receive the NOA2 within the next 2 weeks!!!

Just really happy, thought I would spread some good news to people!

That is actually the reason they might not let you through the POE... you have no idea how many people are fed up with all the wait and decide to go to the US to get married and adjust the status from there...

Yes a letter from the employer plus a contract if you have, a letter from your landlord with a lease contract, bank statement won't do any harm either. That's what I always have while traveling to the US :)

well I am not sure if you can trust what they say unless you have it in writing. What I would do is go there to see her and you two should try to expedite your petition while you are there... or while you are there find a lawyer and see what are your options... but remember! when you fly to the USA while you have a pending K1 , you have to show ties to your country like job, lease etc


What would be good proof of ties to my country? Letter from my employer? Bank statements? Letter from my landlord etc?

Surely the fact that I applied for the K1 Visa would be a good enough reason to return to my country? Lol!

That's a good idea, see if we can both get our petition expedited as soon as we can. If we stand united it would make our reasoning stronger...

Damn it! It won't let me edit my posts lol! I think it is a maximum of 90 days. With that in mind I'll book my tickets as soon as I get paid. Better get a return ticket so it seems I am going back to my country, even though I really dont want to.

She did manage to call the USCIS last night. Strange thing is, is that they said that they are preparing the documents to be sent to te US Embassay in London. Why is it strange? Because she has yet to recieve the NOA2 nor NVC. Its great news if it is true, but we only filed the petition at the end of May...

I am sorry to hear this Brock. If I were you, I would go for a visit to be with her. While there, I would work on getting an expedite based on her medical condition. The USC needs to be the one to request this process. I am not sure if this would be a good time to get married though, because you would want you both the remember the day for a long time and be fully aware of what is happening. I think the most important thing is that you go to her, now.


Oh if only it was that simple Harpa. Her chemo is in a few weeks so I am going to go there for a few weeks to be there by her side. I cant afford to spend too long there otherwise it will go against me with regards to the K1 Visa.

I will call the TN governor and senate to see what advise they can give me or to see if the can inquire about my case.

first of all read this USCIS about expedite

I don't think it will harm your case if you try, I would if I was you :)

The only thing is, it looks like it has to come from your fiancee... You can contact your congress person or a senator but I am not quite sure how can they help... it is usually that the USC wants to expedite the case rather than the other way around... I haven't read anything similar to your case to be honest so it might not be easy... As I said I am not too familiar but you might need to get a lawyer involved...

Hi guys,

You probably haven't seen me on here for a while. A lot has happened and I could really need your help and support.

I've been bottling this up for a while so here goes pouring my heart out:

Her condition has gotten so much worse. Her tumours she had in January were benign and were being shrunk with some medicaitons she has been taking. However a lot of stressful things have happened to her (family members dying, criminial accusations, (you name it it probably happened!)).

Because of this the tumours have come back. One benign, two cancerous. All three lodged at the back of her head, spreading and growing quite rapidly. It was diagnosed only 10 days ago and beleive me it got so bad that for three days she couldnt even recognise me. She thought I was this stranger just staring at her on webcam. Seriously, we have known each other for 9 going on 10 years and she couldnt remember me?! It was deverstating for both of us.

Luckily our engagement video gradually made her remember. But you can see how bad this situation is. I mean what if this happens again and she cant remember me and she aborts our petition or something? I tried to contact the USCIS but they were incredibiily rude and inseneitive and can only speak to the petitioner (i.e. my fiancee).

She is in no state of mind to call them, she has enough on her plate. The only thing is what do I do? I mean, is there a way I can get them to understand the situation? Afterall when she was declared officially disabled by the state of TN, they appointed me as her carer. Surely that would carry some weight in this situation?

I just need some advice and some help. Anything would be appreciated!

Awwww thanks Evylin! I ain't nothing special; I'm doing what any other guy would do to ensure his fiancee is well and looked after.

My social life has sure taken a beaten, but its the least I can do to make sure that she is well until I be her husband. But thank you that is very sweet of you to say so! :blush:

There is a K-1 flow char somewhere that should explain, but briefly...

Your fiance filed a petition that establishes a familial relationship (well in this case a promise to become family). That will take about 5-6 months to be approved. Nothing happens in that time really, some background checks. Mostly it is in a line waiting. When the petition gets approved, she will get a notice that it has been approved. This is the NOA2 (The second notice of action you get). 1 is "hey we got your package." 2 is "hey we approved your petition."

Because that is approved, then YOU will be able to apply for a visa. Your petition flies through the National Visa Center (for a case number and to log it or something) and then it goes to London. Then you submit more info on yourself and get a medical and the submit the I-134 etc. You have plenty of time to bone up on the London-specific order of things.


That's the exact answer I needed thank you! Yeah sure people say OMG I got my NOA1 or NOA2...but not being the petitioner I'm not entirely sure what exactly IS an NOA1 or NOA2. You have nailed it right on the head thank you so much.

So for now I guess the best thing to do is to play the waiting game until she gets the NOA2 and then work on her I-34F. We both spoke last night and agreed that we will also use the co-sponsor just in case and it will look better on our peition to have someone to back us up financially.

A co-sponsor can't hurt. If you can line one up, absolutely have one.

You'll want the I-134 from your fiancee (and the co-sponsor if you choose) to be fairly recent at the time of the interview. I'd wait until you've received your NOA2. No harm in getting some supporting evidence now, though, such as tax transcripts and pay stubs. Though you'll want to get a few more recent ones closer to the interview date.

So I am guessing the NOA2 will go to my US fiance. Couple of things (sorry to be a pain in the ####### but just asking out of curiosity...):

  • What exactly is in the NOA2? Is it instructions on what my fiancee should do next etc..?
  • What should I hear from the American Embassay in the UK? Is it instructions on when my medical exam is, or is there something before that I have to do?

you need I-134 to be filled in and presented on the interview day! If she gets money above the poverty line, you do not need a co sponsor.

And btw you won't know if you get RFE or not until someone gets into your petition in a few months time... so I wouldn't rely 100% on what this lady told your fiancee.

Hey guys!

It's been a while so I thought I might update you. Plus I have a few more questions that I need assistance with :bonk:

Well as you can tell by my timeline, we have still yet to receive the NOA1, despite the petition being sent by FedEx on 29th May! Seeing how other people get their's in like 10 days after sending it, and that we only got a text confirmation and not an email one, last night I asked my fiancee to call the USCIS and ask them for an update.

So she did while we were on webcam (our usualy daily date!). I could only hear what my fiancee had to say while I was IMing her questions to ask! Apparntly they did get the petition fine, cashed the money order successfully and she said that we have more than enough evidence so we wont be getting an RFE (even though I thought the Texas centre does not deal with that, the California or Vermont Centre decides that...?). Apparntly she said that last week alone she had to send RFEs to 20 petitions!

Sorry Im waffling on here! Anyways she said that the email address was written on their database incorrectly, and will ammend it as soon as she can (their fault not ours). The petition will be sent to the Vermont centre today and according to her now is the best time because petitions are going through between 2-3 months (persoanally I think thats BS, so don't worry im not getting that excited!). She said that the reason we have yet to receive our NOA1 was because of the Memorial Day holiday; apparntly it really screws up the USPS service (bet it ain't as bad as our Royal Mail! :P )but we should be getting it soon so we can use the reference number to track our petition (FINALLY!)

But here is the thing that really confused me (and her, but tats because she was completely clueless in what I was asking her to ask the operator, bless her! :luv: ). My fiancee finally got approved of her disability allowance and has started to get it plus backpay from 5 years (alot of money to say the least) and actually placed the letter of the ammount confirmed in the I-129F petition. (which I didnt know about until yesterday!). Because of this, she is way above the poverty line, so I am thinking we don't need a co-sponsor now, but would it help our case if we did anyway. So I asked my fiancee to ask the operator. The lady said that we DO NOT NEED to fill in an I-34 form as she is earning more than enough to support me!

But surely they need some sort of confirmation and evidence about who will be financially supporting me (co-sponsor or not). Should I call them again and ask about it, tell my fiancee to fill in the form anyway (as well as the co-sponsor's so it looks better on us) or just go ahead and not fill in anything until I hear from the US Embassay in London?

Apart from that I cannot wait to fill in my timeline! Oh and by the way I did not get an RFCS (Request for Correct Stationary :D ), so for people wanting to know you can use A4 sheets to fill in the petition! WOO HOO!

Brock! I was thinking about you the other day! I was filling out the form for the Social Security and, somewhere, it said that the form could be printed on A4 paper..... so I took this as a reassurance of what we talked about the other day. The guy who posted that information, was probably blaming another mishap on the paper size Posted Image

You mean the I-134. The I-130 is a completely different document. :)

That won't be needed until the interview stage, so no need to fill it out for a few months.
