ok guys n dolls, any help would be greatly appreciqated, the wife got the hard copy notification that we had been transfered back to CSC from TSC today, we were told that by the mighty badger last week via email, so, she calls CSC and the customer service person just told her to wait 60 ( sixty ) days.
is this some sort of joke?

so, is it my understanding that of the 36,000 of us that were sent to TSC from CSC,AND THEN THE CERTAIN PERCENTAGE OF US THAT WERE RETURNED TO csc, DO WE COUNT IN THE TSC percentage that they have told us they have reduced, or what !!!!!i would love to know, and im also just wondering how many of us in the VJ family here are left from each service center,,,are there more aprovals getting out of CSC or tsc,
and most of all, why are we still waiting to be approved..

i was just talking to the wife online,she says she is going to call CSC tomorrow after work,but im wondering if thats the way to go, we have had some action this week and yall know we had a reply from cheif badger, who said he was REACHING OUT to those at CSC from TSC,.... So,who do we contact there? or do we go automated with the phone helpline, or ask for a tier two officer, or email,

I think this was meant in reference of showing ties to return to the US with the foreign spouse. When the US petitioner is living overseas (and in a different country to the foreign national) they must show an intent to domicile. A US address or a job in the US are two ways of showing that intent to re-establish domicile. Also, returning to the US.

Is your friends ultimate goal to marry and return to the US with her husband? If so, it might help her to return there now. If they just wish to get married so he can avoid the military and then live separately or in the UK, then it is a different story. I do think it would be best for your friend to join the site because more information would be needed if she wanted to get detailed help.

Hi, sorry to jump in here, but I'm at my last nerve with this stuff too..

Admittedly my husband and I sort of bucked the system without realizing it, and it made things a royal pain. Because of family pressure (from my side, US) we rushed our wedding date and eloped... while he was on WVP here in the US. Can of course guess what happened next, jext time he tried to fly in they turned him at the border and put him on the next plane back to London (without even letting us see each other).

Then of course instead I sneak into England. Admittedly we've had it easier as so far we've spent more of our time together than apart jetsetting, but we're also at the 130 is approved stage now, and looking over all the websites is making my eyes boggle.

I'm *guessing* it is the Affadafit of support (filed by me) and the CR1 (filed by him, as there are no children involved) ? Will the people who contact him in England (for the NVC case number and whatnot) be of any actual help in telling us what's the next step? i'm hoping for him to be able to get here in the fall of this year (the pragmatic side of me says, hey they took 9 months for our 130, and may as well not fly for $1400 in the summer and wait till the off-season).

Do we need the NVC case number before anything can be filed? Should I find a laywer? Get my head examined? Maybe both of us fly to, like, Menorca and hide out from both governments? :) This is getting insane.

Maybe I just need a hug. Not trying to hijack the original poster, but I guess I'm saying I can empathize. :)


Are you DCF too? The process is slightly different depending on whether your petition was filed in London or the US. You said you sneaked into England so I'm assuming you weren't living here for the required time to be eligable for DCF? What happens after the I-130 is approved is slightly different depending on where you filed.
Either way you are required to complete I-864, if filed in London he takes the documents to the interview, if filed in the US it's all sent in ahead of time.

Don't stress about the situation. It's pretty straightforward but only you would know if there might be complications in your situation which might require extra guidance from an immigration lawyer.

I feel your frustration baylily! :bonk:

I am a dual citizen, and to move over to the UK to be with my fiance is just a matter of flying over...then we can be together without waiting, but we decided to take the US fiance visa route and HATE this time apart! We are doing this long and unbearable process for my daughter who cannot move to the UK. Before filing for the fiance visa, there were plans for us to move to the UK, so UK Yankee was so helpful....then to have plans squashed.

I wish you luck in this long process (I-130)!


Are you expecting to wait much longer? I really hate being apart from my husband, even though we did long distance for 5 years before we got married, going back to it now is horrible. Not to mention the fact that we'll be missing our wedding anniversay which is later this month. It's nice to know that there are people online who know exactly what you're going through.

Do you know what the chances of a hold up because of a criminal record? Silly boy got into a bar fight when he was 20 (15 years ago), and got charged with actual bodily harm (a broken nose for the other guy, eep!). We have the copy of the police record, but just wondering if this would sting us in the process?

DCF = Direct Consular Filing. What happens nexts depends on whether the I-130 was filed in London or the US. I assume, since you've been living in the UK on your spousal visa, then you filed in London?

I don't know what they look for in regards to the police certificate, perhaps have a search on the forums to see if anyone else has an experience of filing with a criminal record. He needs to apply for a police certificate, £35 for one copy. I recommend getting two (just in case) for only £5 more. Go here to get the information. And he'll need to take a photocopy for the medical.
I can't say for sure but it was a long time ago so it might not matter too much...do some research.

The interview isn't as intense as one would imagine. From what I've read its more of a conversation about when and how you met. At the top of the page there is a reviews section, you can read others interview experiences. Be sure to look for people doing CR1/IR1.

How long were you living in England for and why did you guys choose to move stateside?
My husband came over here in 09 but didn't like it. He had a tough time getting a job and got assulted. We eventually reached our limit. So after two years, we decided that we would give life of there a chance. Mind you, if I don't like the US, I don't know where we'll end up! lol! xx

Oh I wish there was an agreement! It was so straightforward when my husband moved to the UK, a very quick process.

So I'm assuming you guys are DCF?

There will be an interview unlike when USC move to the UK but only the UKC need attend, if you're not able to travel with your husband, no problem.

Make sure you have all your documents ready; Police cert. Long form birth cert. Vaccination records. Completed I-864. I think that's everything but I can't remember.
Next step will be receiving your case number, booking the medical and then the interview.

Since you filed in London (DCF) then there is no requirement to send photographs. It is always a good idea to photocopy whatever you send to them so you can reference it later if need be but of course, that doesn't help you now.

Your wife would need to complete it since she filed the I-130 but if you want to complete one too, you can (not sure why since you would say the same things).

I would recommend having people from the UK and US write one. It is all about showing that you have a relationship, ask people who have knowledge of life together since marriage.

Did you and your wife share a bank account? Were there any other bills that she paid, for example, did she pay a gym membership that you both used? or pay for the groceries?

Make a copy of your wife's entry visa from her passport. Show the date she entered and that she lived there continuously for most of your marriage. Write them a letter explaining that an error must have been made somewhere, in as simple a language as possible.

After you submit your RFE they continue with your case, you do not get shoved to the back of the pile.

You don't need a tonne of proof at the first stage. Marriage certificate, I guess you could include the airline tickets/itineraries from the two trips you took together, and then as you don't have any other concrete documents also include at least 3 affidavits from people who know you. For the I-130 petition they're more concerned about proving that you are legally married and eligible to apply than anything else.

The Embassy stage is where it's more about proving that your marriage is bona fide. However, for the UK you won't need much beyond the key documents they request. So you can take your photos and chat logs and the like to the interview, but it's highly unlikely anyone will want to see them :-)



Couldn't agree more. When she files the I-130 they will have a list of documents they require. Just stick to the list. If they want any extra evidence (unlikely) they will ask for it. At the interview stage you can bring documents to support your relationship but again, it is unlikely they will ask for it.
I'm in the middle of the CR1/IR1 process currently and you just have to stick to what they ask for. The process looks scary and complicated at first but once you familiarise yourself with the terminology, you'll be fine. It is pretty straightforward in fact. The wait will be the most difficult to deal with!

Hi. I'm a DCF Jan filer. My husband and I filed Jan 21st. I-130 approved on June 20th. Medical booked for July 29th. When we filed everything was moving pretty slow and our application was sent to Rome for processing. Everything seems to be moving much faster now, your I-130 will be approved in no time! Good luck.

I arrived at the embassy this Morning at 08:00 for a appointment at 08:30, seen at 09:15 by a officer, handed over all the documents and copies requested. Paid the $404 fee then told to wait to be interviewed by another officer. Interviewed at 10:00. Interview took all of 10 minutes.

I was asked where I would stay in Miami, when I got married and one other question about assets and funds available.

That was it, visa granted. Passport and visa will be sent by courier in 10 - 15 days.

Job Done.

Just an update. My fiancee waited for me to get back from work and we beleive we got to the bottom of this.

Before we called USCIS I called the NVC to see if they have out case. They do not. Therefore, USCIS must still have it.

My faincee then called them, spoke to another agent who said they will be sending the NOA2 notification next week. As you can probably understand our frustrastion and lies, we did not beleive any of this, so we asked the agent if we can speak to the supervisor.

After 15min of waiting, we finally got hold of a supervisior. Very nice and articulate person. This is what they had to say about our case:

  • The reason why we having misleading information from other agents is because they have been outsourcing their workload and thus a line of miscommuncation has occured with our case, which he did apologise for.
  • Our case was delayed because they needed to have some police background checks on my fiancee (long story short, both parents in prison and now adopted)
  • Should get the NOA2 around end of December or beginning of January. If not then call back around 3rd January.
  • They charge my fiancee $170 not because of resending my packet 3 letter, because the agents thought she wanted a copy of the police check (?!?!?!). She will be given a full refund.
  • The WAC/EAC number the agent gave us was incorrect. Should be getting another copy of our NOA1 soon.

Well, at least this story kinda makes sense. Not the good news we were expecting, but hey at least we know where we stand if this story doesn't turn out to be yet another lie. So just have to continue playing the waiting game.

In other news got some more bad news. The chemothrapy fluid in her brain has not gone down enough for the doctors to aloow her to fly over. My family are giving me the emotional blackmail of spending the last xmas with my family (and my sister is gonna give birth to another child on Christmas Day), so really torn on flying over there. I think I will in the end, they have to realise that I have my responsbilities now. She is my family too. Besides I have not seen her for 7 months now, and she will probably need surgery to remove this fluid.

Finally NOA2!!!! Just when I was starting to lose hope finally some good news :-)
Early Christmas present and definitely the best one!

Brock - that all sounds a bit weird, since when did they send the NOA2 to the beneficiary, and why would they have given you a CSC (WAC) number when it was at VSC (EAC), you could try using EAC and enter the numbers - see if that works for you. Its possible they did something different to usual, but I suggest you get in touch with the embassy in the UK ASAP to find out if your interview is really in December.


Yeah I know this is all strange and they seem to be processing this unusally without anyone of their personnel knowing what is going on and giving us difference stories.

OMG you are right, I thought WAC was for VSC!! I did replace the WAC with EAC and it still didnt register on the USCIS tracking website.

All of this is so strange. Bring on Friday so I can go on a massive rampage and get to the bottom of this. It is bulls**t that USCIS cannot give the beneficiary any update just the petitioner!

What a mess :( It sounds all over the place like things are being done out of the usual order :/ Maybe contact the NVC and ask if they have any knowledge of your case? Or if you have an interview at the London embassy, contact them and see what they know about it? If the NVC or London have no knowledge of your case then at least you know it's still definitely a USCIS problem and maybe your fiancee can get someone involved from a higher level like a congressman? Although I really don't know about that side of things, just trying to think of possible avenues to go down :/ I'm really sorry this is happening to you guys.


Wow thats alot of advice thank you. How do I go about in contacting the NVC? I wil try and call the London Embassay today and see if they have heard of my name!
