what was the hold-up? any ideas why it took that long?

my fiance is about to send off our I-129F, so we've still got most of the journey ahead of us... but I've got 6 - 8 months (ie start to finish) in my head, not 12 or more :s

I wasn't TOO concerned, as it wasn't listed in the I-129F checklist here (which is exhaustive in all ways), but you know how it is; you double check, you triple check, you read VJ, you read the VJ forums, you send links for pertinent threads to your fiance, you check again, you think you're hot to trot but then someone posts something you've never heard of before and you get a trifle fluttery ;)

the K-1 is to bring a FIANCE/E to the States; if you're already married you'll be bringing a spouse, and you'll need the K-3... trying to do otherwise can be seen as fraud

it's pretty startling to find this out, isn't it... I wanted to be married in Australia; I've been living in London for the past three years and my family hasn't even MET my fiance, and as I'm the one agreeing to uproot and move we thought it was more than fair... but when we found that the only way to do that was a K-3 and an average wait of 9 months (during which I wouldn't be allowed to enter the States), we quickly changed our minds :s

it's daft... if we didn't want to do something special and family-centred, it would actually be EASIER; how can they not see this?

yes; with a bit of care you can manage all sorts of things... my fiance's coming to visit (finally!) in September; by taking days off work around a public holiday and flying straight after the working day is finished on a Friday he'll be here for nine days, and only lose four days' holiday :D

thank you for the reply, but I don't think I made my question clear - I know the petitioner's birth certificate is required, and intend to take the original; as you say, why mess about and give them more opportunity to delay us? my question was about needing the birth certificate of the beneficiary, which I haven't seen mentioned anywhere other than this thread - and yes, I checked the guides again before posting this!
if this is in fact needed, of course I will take steps to get it sent to me, but then this should also be added to the checklists here because it seems to be missing... perhaps this is less of a big deal for most, who will attend interviews in their home countries, but I know I'm not the only one living abroad, so this would be useful information to more than just me : )
or perhaps I've misunderstood the guides, and they only show what the petitioner needs to send the beneficiary before the interview, but then in that case perhaps a more comprehensive list could be published?

but why? this is the first suggestion I've seen that I'd even need one; why go to that trouble if it's not necessary? I've read the guides a few times and never seen it mentioned

come to that, I can't even think why they would need it for the beneficiary... to prove nationality? passport would do that... to prove name? ditto... it just doesn't make sense

Unless the consulate or embassy asks for it specifically, you may not need to provide it at all. They usually only require the BC of the beneficiary.

Is this right? it's not what seems to be indicated in the guides... any mention of a birth certificate I've seen has been for the petitioner, to verify citizenship. Anyone able to clarify? if I need my birth certificate, someone's going to have to find it in Australia, and send it to me here in London, and I'd like to get onto it quickly; if I don't need it though, I think I'd rather not bother!

if you mean everything that's still coming up - no; you'll be charged the new fees for everything after this point; you'll pay the old fees for the I-129F because it was postmarked before the changes

Vermont has traditionally been the 'good' service centre - if you check the timelines (links at the top of the page) you'll see that the processing times have been quite a bit quicker than the other three places - but it seems to have been slowing down a little recently, for whatever reason(s)

I'd have some sort of answer ready though... when I went to the US last year (POE Detroit), I was asked the purpose of my visit... I answered 'I'm visiting my boyfriend' (he wasn't my fiance then), and the guy said, very pleasantly, 'You wouldn't be thinking of marrying him would you?'
having no iDEA about all this stuff I have since learned, I thought he was just being a bit cheeky, and I laughed, and said something like 'oh, he'd like that, but no', and the guy laughed again and said 'oh, you holding out on him, are you?'
it all seemed innocent to me, but of course now I know he was looking for that 'intent to marry' which is so important... I was fortunate it went no further

I mean I can just imagine their offices and where they process these things and I just can't get the idea of warehouses of paper, dot matrix printers, punch in and out time clocks, 1970's lime green furniture and paint, rows of desks with piles and piles of petitions, and countless employees who process 5-7 a day and when they process 10-14 they feel overworked and need raises.

James, the point you make is very sound... it shouldn't be a big deal to have electronic payment at the very least, and the 'sheer numbers' argument just doesn't wash; MANY other organisations deal with similar or greater numbers and manage... and the fees should be MORE than covered by the price hike, as you say, and even if not, surely it could then be optional, like when you buy an airline ticket online - who wouldn't pay an extra $3 or whatever to have such convenience?
anyway, they already issue tracking numbers so part of the system must be computerised... no, face it; it's not a priority because they have us over a barrel; if there was a private company which was able to do the same thing and give them some competition there'd be swift changes, I just bet ;)

and Rika, be VERY careful about advising someone to marry immediately; if they do so, and are deemed to be in any way in violation of their current visa, they could be done for visa fraud...

I'd say play it very carefully, OP; don't do anything rash :)
doesn't SOUND like the DUI convictions are going to be a long-term worry (except that you may have second thoughts about being a passenger in his car), but you'd do well to look into that carefully too :yes:

nathanp, while a few people have mentioned it you don't seem to have realised yet -

there is no way you can get the K-1 BEFORE you meet in person

you seem to be thinking that the K-1 is your fiancee's way into the country, but there is a requirement within it that the two people petitioning have met, in person, somewhere in the world, within the last two years, and can prove it (they want passport stamps, boarding passes, photos and so on)

so you're going to need to arrange a meeting before you start the process

we did it ourselves for precisely that reason... all the photos I could get taken here in the UK were the 'wrong' size, so I got a friend to take some at work, and we cropped them down to the correct size and printed them on photographic paper :)

not really a massively important issue, but over and over again these past few days I've seen people in here talking about 'calling every day' 'calling til I get an answer' and so on; obviously sometimes this is necessary (in the case of paperwork having gone astray, or similar), but I can't believe it always is; many of the comments seemed to relate just to checking the status of a case... so I thought I'd see what others thought:
is there any possibility that these calls are slowing the process even further? are the people who answer the phones - not necessarily the first person, who's probably a receptionist, but the one(s) the calls get passed to via the 'RFE trick' or whatever - also the ones who process our cases? and if there's even a remote possibility - can we minimise unnecessary calls please?!

not meaning to target anyone with this... it's a genuine question that I thought I'd open up to discussion :)
it may well be that the process would be exactly as slow if no one called at all... just been wondering

You know absolutely nothing about us, or our particular situation.If you have a problem with overly fexible immigration laws (with "no teeth") perhaps you should get into politics, then you can really do something useful to combat those who "lack conscience" instead of dishing out insults here. Expecting completely 'withheld judgement' when discussing such a situation on a public board is pushing it, in my opinion. What you do is completely up to you, of course, but I think YOU should certainly vacate the 'high moral pulpit' before trying to lecture from it; it's rank hypocrisy to do so.

yes; both anecdotal evidence and the stats in here show no July rush... as was said somewhere else: it's not really the sort of thing you CAN rush, in most cases; you're either ready to file or you're not... sure; I bet there were a few people who were planning to wait for some reason and then changed their minds because of the fee increase, but I can't imagine it would be many; how many of us were planning to wait to file? most of us just got engaged and started making plans and filed when we had our stuff together
and certainly the VJ stats indicate a pretty standard month

so the VSC slowdown remains a mystery...
