Hey, I just noticed an error in the K1 Packet. LOL! Number 1 (Proof of Payment) states, "The bank will validate your payment on the DS-156 Nonimmigrant Visa Application Form..." I paid my visa fee in Philippine Pesos ($100 x the prevailing exchage rate) and I was not asked to present the embassy letter or NOA2 (but I brought it with me just in case). I presented my filled up DS 157 form but BPI did not accept that. They provided me with their own blank DS form and printed the transaction at the back plus they gave me a transaction slip.

Someone asked a few pages back about recalled IMBRA petitions and interviews.... I was one of the recalls, and I just received my fiancee's interview date (November 2) online. Which is pretty quick considering NVC sent our reapproved petition back to Manila on August 30. So any recalls who have their petitions back in Manila shouldn't worry about any further delays... it seems maybe they really did put a priority on our petitions to get us back in the queue! No packet yet of course...I'm hoping the relatively fast turnaround of the petition won't interfere with the packet arriving promptly, since my fiancee's medical is only 5 weeks away.

hi guys maybe someone can help me. i guess at this point im kinda lost and would like to know peoples experiences with regards to having their children follow later on in the future (not as a derivatory status).

in filling out one of the forms, i cant remember which i think it is DS156K, there is a question there asking to name the children of the fiance. the following questions are "accompanying you?" (which i answered no to since there are still things that we have to fix with regards to childs b/c) then there is that question which asks whether the "child to follow"...

my question is, well we are planning to have the child follow here if he wills it that way but right now, we have decided to wait a couple of years. What will be my answer to the question that asks "to follow?"

I hope someone can help me... thanks guys, you have always been of great help to us... :D

YYB - You can put none for the question #34 "Name and Relationship of persons Traveling With You." Per the Department of State (DOS), "The child may travel with (accompany) the K-1 parent/fiancé(e) or travel later (follow-to-join) within one year from the date of issuance of the K-1 visa to his/her parent. A separate petition is not required if the children accompany or follow the alien fiancé(e) within one year from the date of issuance of the K-1 visa. If it is long than one year from the date of visa issuance, a separate immigrant visa petition is required." CLICK HERE for more information.

I really don't understand why my case is so far behind. If they have updated the website, and even November is filled up already (since my case isn't coming up at the URL http://203.177.135.1...tment/login.asp ) I must be looking at a time sometime next year!

I was one of the last who finally got their IMBRA forms, but one of the ones closest to the March 6th deadline when I originaly filed it took 2 days to get NOA1. I don't understand how people later than me got their RFE's sooner (by about a month) and now their interviews?

This is just very upsetting.

That is very odd and upsetting. Have you called the Manila Embassy to inquire about your case?

PW - We have a Nov 14 Visa Interview date and our Medical Exam is scheduled for Nov 7. We still have not received packet 4 from the Embassy, but they usually don't mail that until close to a month before the interview.

Yes! At least that is what the Manila Embassy staff told me, but they also said that we would be issued an interview date somewhere between the end of Aug to early Sep. It seems that if there is not a law or guideline stating how things will be a particular aspect of the drawn out process, then it's a ####### shoot on whether the information given is credible or not.

That is a very good question. I don't know the answer, but for some odd reason I'm thinking they will put you poor souls back on the waiting list. Just because this process sucks, and nobody really gives a dahamn! Please call the Manila Embassy and inquire because I'm very interested in their response. I still have to follow up on whether interview dates are schedule a maximum of 90 days out, which could be the rational for the prolonged period of inactivity as far as assigning interview dates. They are sippin margaritas on the beach watching the sunset. We are going on a month and a half of waiting for an interview date to be assigned. If I'm not mistakened, USE does not set the interview dates for K1s. At any rate, we are on ice until somebody gets on the ball. Pick up a hobby. LOL!!!

(1). The National Visa Center (NVC) number is within my signature. NVC assigns your case number once your case is approved (NOA2). They also may perform a preliminary background check from what I’ve read then forwards your package/case to the Manila Embassy. This process usually takes anywhere from 14 – 30 days.

(2). Packet 4 (Manila Embassy) link is within my signature (acquired from the Manila Embassy website which gives directions on what documents are required by the beneficiary for the visa interview). The Manila Embassy number is within my signature. NOTE: If you dial 0 for the operator, ask for the Immigrant Visa Unit. The average interview is assigned approximately 120 – 150 days from the receipt of your package from the NVC.

(3).The Department of State (DOS) number is within my signature. After your case is approved (NOA2) and reaches the Manila Embassy, you may call DOS instead on the Manila Embassy to obtain status of your case and make inquiries concerning your interview date. NOTE: DOS has no direct participation in the K1 process.

(4). St. Luke’s Extension Clinic (SLEC) information is within my signature. SLEC is where the beneficiary goes to take the medical exam and vaccination. The process takes two days. Day 1 is the medical exam and Day 2 is the vaccination.

(5). CFO Guidance and Counseling Seminars are held in Manila and Cebu, with the corresponding links within my signature. The beneficiary may attend whichever location is more convenient. "Per Republic Act 8239 and Department of Foreign Affairs (DFA) Order 28-94, Filipinos proceeding abroad as fiancé(e)s and spouses of foreign nationals are required to attend the CFO's guidance and counseling programs... " For more info (CLICK HERE). NOTE: As far as I know, this requirement is not stated within the K1 packet. However, the beneficiary can NOT travel without receiving the Guidance and Counseling Certificate and subsequent CFO stamp on the visa.

(6). The I-94 Arrival / Departure Form is within my signature. Foreigners (beneficiaries) complete the I-94 and the Customs and Border Protection (CBP) officer stamps the applicant’s arrival and departure portions at the Port of Entry (POE) when entering the States. You will need this for the Adjustment of Status process. NOTE: Even though it’s simple, I have supplied this so you will know what it looks like and what is required to be filled out.

Are you saying that the DS 156 must be completed on line? my fianceee in the Philippines just received her packet 4 information, which includes the DS 156 156k and 157 so are you saying that she still needs to fill out the 156 on the website. Also do you know which form is required when she goes to the bank to pay her $100 consular fee. thanks for your help

Hey Steve...

A: Yes! The DS-156 must be completed online to be assigned a specific barcode number, which is shown on page 1 and page 3. Even though the process has changed, the Embassy still sends out the obsolete DS-156 form, which does NOT have the barcodes one it. That is partially why the DS-156 must now be completed online (the other reason is for paper reduction but they continue to send out an obsolete DS-156 form wasting more paper... Go figure... LOL!). The Manilla Embassy has also threatened to reschedule the interview appointment if the beneficiary shows up without a completed online DS-156 form that has the barcodes on it.

A: The DS-157 is the form that is validated by the bank when you pay the visa application fee. The bank has the form but you can complete the form, take it to the bank, and request that they validate your form. Or you can take the blank form the bank validates and gives to you (however they have an older version, but it looks exactly like the one issued to your fiancee)...

(Case Status) - Once you have filed your case and recieved your case number, please register on the U.S. Citizenship and Immigration Services (USCIS) website using the Case Status Online Tool to receive emailed updates concerning your case (CLICK HERE)

Post NOA2

NOTE: Packet 4 can be acquired from the Manila Embassy website which gives directions on what documents are required by the beneficiary for the visa interview. Starting 01 November 2006, ALL nonimmigrant visa applicants must use the online Electronic Visa Application Form (EVAF) to complete the DS-156 (Nonimmigrant Visa Application). To date, only the DS-156 has the barcode (on the first and last page) and is the ONLY form available online at http://evisaforms.state.gov. You may complete the DS-156K (Nonimmigrant Fiance(e) Visa Application) and the DS-157 (Supplemental Nonimmigrant Visa Application) (this is the form the bank validates when you pay the visa application fee) via the computer, type-writter, or handwritten. Hopefully the Manila Embassy will update their packet 4 information to clearly indicate the instructions. If you need to call the Manila Embassy, dial 0 for the operator, and ask for the Immigrant Visa Unit. The average interview appointment is assigned approximately 100 – 150 days from the receipt of your package from the NVC. Beneficiaries are now sent an letter of receipt from the USE once their physical files are received. (7). CFO Guidance and Counseling Seminars are held in Manila and Cebu, with the corresponding links within my signature. The beneficiary may attend whichever location is more convenient. "Per Republic Act 8239 and Department of Foreign Affairs (DFA) Order 28-94, Filipinos proceeding abroad as fiancé(e)s and spouses of foreign nationals are required to attend the CFO's guidance and counseling programs... " For more info (CLICK HERE). NOTE: As far as I know, this requirement is not stated within the K1 packet. However, the beneficiary can NOT travel without receiving the Guidance and Counseling Certificate and subsequent CFO stamp on the visa. (8). The I-94 Arrival / Departure Form is within my signature. Foreigners (beneficiaries) complete the I-94 and the Customs and Border Protection (CBP) officer stamps the applicant’s arrival and departure portions at the Port of Entry (POE) when entering the States. You will need this for the Adjustment of Status process. NOTE: Even though it’s simple, I have supplied this so you will know what it looks like and what is required to be filled out.

I called the Philippine Consulate (PC) in Los Angeles, California and they have no idea how to update my Baby's Passport/Visa with her married name. We're getting married next Friday. The PC recommended that I call the USE (yes.. in Manila). Who's on first? No, third base... LOL!

LOL! Very cool! Oh, during our SSA visit yesterday. They told us that immigration misspelled my Baby's last name. Maybe the C/O should have paid more attention to the screen instead of checking out my fiancee. LOL! Honestly, I don't know who inputs that information, but I thank them because I now have something else to make fun with my Baby.

BJZags - Congrats once again my brotha! What's funny is that the Customs Officer asked three times more questions than the pre-interviewer and the consular officer combined. LOL! The Customes Officer even asked Jhen if her pearl necklace was real, and read through the POE packet given by the USE asking random questions. He was bored and had nobody to talk too. LOL! The questions were easy of course because we were prepared and Jhen knows me very well.

ALL - Oh, we went to the SSA yesterday and had no problem applying for my Baby's SS Card. All we needed was Jhen's Passport/Visa. I've read that some folks have problems applying because the employees don't know the rules.

That's funny. BTW, Jenalyn recognized your fiancee at the CFO seminar thing, but whe she asked her if she was "Uling's" fiancee, she didn't say anything. I guess my gal comes on a little strong and scares people!

LOL! Sometimes my Baby is a little bingi (deaf... LOL!!!) or Jhen was focused on something else!!! Darn... I'm going to ask her because it would have been cool if they would have connected.
