Did not include the W2 with both 2007 and 2008 tax returns. We had other financial information they could have used to establish comingling assets, but they focused on that piece. No worries because we in turn cut down a tree and provided a lot of other stuff. Within two weeks after the receipt of the RFE with all kinda back-up, they sent us the green card. :-) No questions asked. I was trying to avoid throwing the kitchen sink to prove a point, but I guess it would have been better to do that upfront. It delayed the receipt of the green card by almost two months... However, no interview was required, which is always an added bonus because had one for the Adjustment of Status.

Please review the "K1 Visa Immigration Stages", which is a simplified and theoretical overview of the five (5) stages involved in the K1 Visa process, according to Sheriff Uling [CLICK HERE]. The "K1 Visa Immigration Stages" will help you explain to your fiancee what's upcoming in the immigration process from a general prospective. The next bit of information below covers the Adjustment of Status (AOS) forms and tips.

Adjustment of Status - Forms and Tips for K1 Visa Recipients

Adjustment of Status Forms:

The forms are:

I-485, Application To Register Permanent Residence or Adjust Status (REQUIRED)
I-864, Affidavit of Support (REQUIRED)
G-325A, Biographic Information (REQUIRED)
I-765, Application for Employment Authorization (OPTIONAL)
I-131, Application for Travel Document (OPTIONAL)

NOTE - The optional forms I-765 and I-131 are not required for the AOS submission. Since most AOS applications are being approved within 2 - 5 months, it may or may not be worth applying for the I-765 and/or the I-131. However, the happy newlyweds will have to decide whether applying form the I-765 and/or I-131 is worth applying for based upon their own situations and needs. Once the AOS is approved, the beneficiary ("Permanant Resident") may work and travel outside of the US. However, if you do not file the I-765 and I-131 and your case is delayed due to an RFE or other reasons, you will have to wait for the AOS to be approved before the beneficiary can LEGALLY work in the US or travel outside the US without being denied re-entry. The forms are pretty straight forward and indicate everyting that you need to supply along with your forms, unlike the visa application forms. Adjustment of Status Tips:

Tip # 1 - Get married within 90 days of arriving into the US

Tip # 2 - Get any required shots that are not available in the beneficiary's country (for example the TD shot is not available in the Philippines but is a required to complete the vaccination report for the AOS process) then have your DS-3025 transferred to the I-693A Supplemental Vaccination Record before 90 days after arriving into the US. NOTE: If you go to your own doctor to receive a vaccination shot. Have the doctor write you a note indicating that you have received the specific vaccination shot and make sure the doctor signs and dates that note. Take the note along with your DS-3025 to the civil surgeon who will transfer the information to the I-693A (the civil surgeons have the form so you don't have to supply it). Remember, you came to the US on a K1 Visa whereas a medical exam was manditory and expires one year from the date of the examination. In other words, do NOT let the civil surgeon talk you into getting another medical exam. If you have a problem, show the civil surgeon the I-485 instructions that state that K1 Visa recipients are NOT required to take another medical exam, except for if it's been a year since the last examination.

Tip # 3 - Apply for a certified marriage license and supply a copy along with the AOS application within 90 days of arriving into the US.

Tip # 4 - Submit your AOS application within 90 days of arriving into the US. (I recommend applying for the AOS before 90 days as stated on the AOS application (I-485) and per the K1 Visa application (DS-156K), but you may file your AOS after 90 days. However, you better be married before 90 days.)

Tip # 5 - Apply for you social security (SS) card 10 -14 days after your arrival and no later than 21 days before the I-94 expires (in other words, do this before 90 days of arriving within the US). If you wait to close to the expiration of the I-94, the application may be rejected, which means the beneficiary will have to wait until the AOS is approved before applying for a social security number). (NOTE: This part is not required to be completed for the AOS submission).

Tip # 6 - State ID or Driver's License. Same as the SS card. The beneficiary can apply 10 - 14 days after arriving to the US, but no later than 21 days before the I-94 expires (in other words, do this within 90 days of arriving into the US). If you wait apply cose to the expiration of the I-94, the application may be rejected, which means the beneficiary will have to wait until the AOS is approved before applying for a State ID or Driver's License. (NOTE: This part is not required to be completed for the AOS submission).

Life does have a bit of irony mixed in with unexpected events that we hardly ever see for ourselves. However, I am very happy that all has worked for the best. I love the Phils and hope to someday live a similar life as your own, but that's in the distant future. I have no idea how to accomplish what you are doing, but it would be great if you could share your experience with us. I'm sure there are others who would love to know.

Technically, Joan won't be needing a copy of NOA2 during her interview, however, you will need that in doing the Adjustment of Status in the future. Keep on calling CSC and inform them that you haven't received the hardcopy.

That's exactly what I was going to say. Have you checked your I-130 status online? Our status is still, 'Current Status: Case received and pending', yet I've got the hard copy I-197C NOA approval notice sitting at home.

Make sure you keep on the CSC as you will need that I-130 notice for AOS. Good luck!

That's probably the best thing that you can do knowing that direct contact with CSC is virtually impossible. Your senator's office should be able to resolve this for you and get CSC to send your NOA2.

All of the visa interviews are held at the US Embassy in Manila. The only option between Cebu and Manila that the beneficiary has is where he/she attendances the Guidance and Counceling Seminar for the Commission of Filipinos Overseas (CFO), which is a requirement POST receipt of the approved visa in order to travel outside of the Phils for spouses and fiance(e)s of US Citizens.

My fiance took her CFO seminar in Cebu and she has the documentation proving that. Does anyone know if she can get her sticker in Manila after she receives her visa? I sure hope she doesn't have to go back to Cebu but it would really suprise me if she did!

I concur with RonMay. Since your beloved has the G&C Certificate, it theoretically/logically should not matter which CFO location applies the "sticker" to her passport/visa. However, you should call the CFO in Manila to verify. We all know that logic and theory are sometimes out the window when it comes to some policies, procedures, or practices.

I have seen so many post about the NBI Clearance and the letter of explanation if certain remarks are on the clearnce and they seem to vary with explanations from the board here.

My question is why is a letter needed if there is no criminal record? Example, say someone has nothing on record with the police, or case, or whatever, just a clear background. What do they put on the clearance for this? I already had to send my fiance to Manila to the Bureau of Immigration and now another possible return for this. I guess they think i have a private jet for my fiance to fly around the Philippines in.

If anyone knows for sure thanks for your response.

My wife took samples (page 1) of our emails, instant messages (IM), and call logs for that very same reason. If you have a lot of evidence, you might consider doing what we did, which was to supply samples of the first few months, the midway point before the interview, and a few months of evidence before the interview in order to illustrate the continued relationship.

NOTE: The CO's love pictures, and the pre-screeners pratically demand them...

you can call the Embassy and request to have the packet picked up at St Lukes. beleive the number is 011 63 2 528 6300.

your fiancee can download the Fiancee Appointment Package.only thing she'll be missing is the appointment letter. to attend the medical, she can bring copy of NOA2 or appointment printed out from the Embassy website. I've heard some same they just told the guard they were there to pick up their packet and were let inside. Medical can be done before the scheduled date.

Yes! If the beneficiary has not received the appointment letter then taking a copy of the NOA2 along with the appointment printout, as Roy stated, is absolutely appropriate and acceptable. However, the beneficiary should not take the medical exam beyond a month of the visa interview because there is a risk that the results could be void.

The online forms for the CFO / PRISM in Manila are not the ones they used and are not available online (go figure). I know because I completed both of the forms that could be applicable online for my wife and she took them with her only to discover that those forms are not used. Now, I can not comment on the CFO in Cebu.

Yes! The USE logs that information into a database in which the DOS can see. However, I'm not sure if they track the packages through the carrier as well. Hmmm!

The Consular Officer (CO) at the USE will automatically extend the expiration date (if necessary) for each case as they are reviewed. No actions on your part are required.

* Proof of meeting prior to relationship, per Packet 4 consists of: "A few photographs of the applicant and petitioner together during the specified time may serve as evidence of this requirement."

* Proof of genuine relationship, per Packet 4 consists of: "Letters, e-mails, phone records, bank records, photographs, or other evidence of a genuine fiancé(e) relationship..."

In practice, all of the evidence that the beneficiary presents/supplies illustrating the nature of the relationship for the visa interview is considered proof of relationship (letters, phone records and etc...) and is one and the same to the USE (proof of meeting prior to relationship and her packet for proof of genuine relationship) even though they call them out separately in Packet 4. In fact there is a great possibility that the pre-screeners may only ask for the beneficiary's documents (BC, NBI Clearance and etc) and only pictures as proof of relationship evidence. However, be prepared for whatever they request, which your beloved definitely will be.

The way in which you proposed to display the work history seems reasonable to me. At least, I would have asked my wife to do the same. By the by, it's not unusual for companies to send workers in the Philippines to training to other countries (especially if the company originated in another land). The CO will probably touch on that conversation briefly, or may not. However, it seems interesting enough to cover if I were the CO. One last thing, you did not correlate the title of this thread to your questions/statements. So, I will presume that your lady's work history was not completely listed on the G-325, during the Petition Stage, and it will vary a tad on the DS-157, during the K1 Visa Stage.
