I would like to praise God for Windchaser who started the Manila Embassy Thread long before I became a member of VJ and for all those who joined in to make it a wonderful place to share and grow. Kudos! My heart was heavy a lot during the Petition Stage and Visa Stage of the process, while I was separated from my love, and I always had a place to share my thoughts and feelings with those who understood and would lend a word of encouragement and love. I truly appreciated that more than many of you will ever know. For that, I wanted to find a way to give back and leave a legacy worthwhile for others to successfully navigate through the hectic K1 visa process of the Manila Embassy. My lovely wife has now been in the States for a year now and our first year anniversary is coming up very soon. Time flies when you are having fun. Unlike the time we spent waiting for our visa approval to occur. I am experiencing the greatest times of my life and I wish you all the same gratification and extreme happiness that comes from successfully completing this heart-wrenching process. I just want to make sure that I'm on the same page as you are... Your beloved has completed the Guidance and Counseling Seminar and should have received the Guidance and Counseling Certificate. However, she still can not travel abroad until she takes the Guidance and Counseling Certificate to the CFO along with her visa to obtain the CFO sticker within the visa/passport, after it's delivered by USE via Delbros. Besides getting this done, she is free and clear to travel abroad to begin her new and wonderful life with you.

There is no waiting period after the visa is delivered. HOWEVER, the beneficiary must complete the CFO requirement to attend the guidance and counseling seminar AND receive the CFO sticker within the visa/passport before traveling abroad as fiancé(e)s and spouses of a foreign national. Please reference Section 6.2 of the Manila Embassy K1 Visa Guide.

Below is an email that I have passed on to a few of our Phil-Am families that have recently received their NOA2s. Do you think it's way off base? What could be added to improve this information?

(1). The National Visa Center (NVC) number is within my signature. NVC assigns your case number once your case is approved (NOA2). They also may perform a preliminary background check from what I’ve read then forwards your package/case to the Manila Embassy. This process usually takes anywhere from 14 – 30 days.
(2). Packet 4 (Manila Embassy) link is within my signature (acquired from the Manila Embassy website which gives directions on what documents are required by the beneficiary for the visa interview). The Manila Embassy number is within my signature. NOTE: If you dial 0 for the operator, ask for the Immigrant Visa Unit. The average interview is assigned approximately 120 – 150 days from the receipt of your package from the NVC.
(3).The Department of State (DOS) number is within my signature. After your case is approved (NOA2) and reaches the Manila Embassy, you may call DOS instead on the Manila Embassy to obtain status of your case and make inquiries concerning your interview date. NOTE: DOS has no direct participation in the K1 process.
(4). St. Luke’s Extension Clinic (SLEC) information is within my signature. SLEC is where the beneficiary goes to take the medical exam and vaccination. The process takes two days. Day 1 is the medical exam and Day 2 is the vaccination.
(5). The I-94 Arrival / Departure Form is within my signature. Foreigners (beneficiaries) complete the I-94 and the Customs and Border Protection (CBP) officer stamps the applicant’s arrival and departure portions at the Port of Entry (POE) when entering the States. You will need this for the Adjustment of Status process.

You don't! Visa interview dates are assigned to beneficiaries of K1 petitions, and the current wait time is approximately 120 - 150 days from the receipt of your package by the USE from NVC. Mabuhay!

We have been waiting for an interview date since 08 Aug 06. This hurry up and wait thing is getting real old… real FAST! If I am not mistaken, the interview dates are not set further than 90 days out. I'm going to double check that, but in the mean time... Is this true?

Also, I keep getting conflicting information concerning when our interview date will be issued. The Department of State rep said that interview dates for Nov are eminent and to call back every week. However, the Manila Embassy staff, who at first told me that we will be issued an interview date sometime within the last week of August and the first week of Sept, have now told me that they anticipate interview dates for November will be set by the end of this month. Has anyone waiting for an interview date heard anything different?

My fiancée and I simply want to have a date to work against… How hard is it to issue a freakin’ interview date!!!

You are not missing anything. Who knows why that individual filled in their timeline like that, but the Manila Embassy does NOT issue packet 3... ONLY PACKET 4.

Q - Does my fiancee complete the forms and mail back to Embassy in Manila, or does she just get one packet (#4) with an interview date and take all the forms with her to the interview?

Complete the forms, gather the required documents, and take them to the embassy on the interview date. The link for the Manila Embassy Packet 4 is within my signature.

Q - What is best way to find out and keep track of file reaching and then leaving NVC. arriving Manila?

You can call the National Visa Center (NVC) at (603) 334-0700 press 1, then 5.... to obtain status of when your file arrives and departs from the NVC. However you will have to call the Manila Embassy at 011-63-2-528-6300 ext 5184 or dial 0 for the operator and ask for the Immigrant Visa Unit to inquire whether they have received the package for your case from the NVC. Some folks have been attempting to track the packages via whatever carrier they use, but it's a waste of time. IMO! However, for all those who do know how it's done... Please chime in.

Q - How long is it currently taking Manila to send out Packet 4?

According to the Manila Embassy staff, they are sending out packet 4 approximately a month before the interview date. You may call them using the number listed above.

I have good and unexpected news! First, getting the capacity to marriage certificate from the embassy was a breeze, and we were even finished and out of the embassy before they opened at 8am. :P

But even better, Fely and I visited a priest today to obtain our marriage license. The priest was a real joker and kept asking embarrasing questions about our sex life. I guess that was the marriage seminar. Then he filled out a marriage certificate, had us sign it, and then he signed it, and we were married, just like that. No 10 day waiting period or even a ceremony. Just $100 and we were married. It seems to be legal enough. Now, we have 2 weeks to wait before our honeymoon. :whistle:

That is some of the best news that I've heard, read, or seen all week. May your marriage be blessed. Enjoy the honeymoon stud. LOL! Cheers!!!

I have read elsewhere that you should answer no to the questions about work and school in the U.S. because those might be reasons for the consular to think that you are trying to use the fiancee visa as a means to get to the U.S. The consular might think you should be applying for a work or student visa instead of a fiancee visa.

Anyone's thoughts?

Goodman - I also thought the same and I could have sworn that I also read that somewhere, which is why we answered no to both questions and NONE in the boxes. Don't they seem like trick questions because of the wording "Do you INTEND…" However the DS-156 is the Nonimmigrant Visa Application and I'm betting (have not research this yet... just my presumption) that all the nonimmigrant categories complete this form. Therefore those who are coming on work visas and for school more than likely complete this form. In my simple mind, the intent of the K1 is to marry and it should be left as such, which is why we are afforded the option of applying for an EAD. This is a good question for a skilled immigration lawyer.

I don't have any answers, just a questions. Not that it's of any consequence, but I'm sure readers (including myself) are wondering why your friend has not filed for AOS seven months out, especially when I'm sure they were informed of what was required. What's their story... are they procrastinators, they had other things to do, they hate the bureaucratic nonsense, they ran out of money, they didn't feel like it, they like the extra drama, planned on going back to the beneficiary's country to live and change their minds, they hate filling out forms, they thought the beneficiary would automatically receive citizenship, they didn't care, they wanted to wait to test the knowledge of VJ members, they didn't know, or what? Give us the juicy details!

p.s. - At least they married within 90 days, I've read where folks have filed after 90 days with no repercussions, but not after the visa expired. I'm sure there are a few seasoned VJers that can provide some guidance.
