Filing your Income Tax returns might be a problem if the debts go into collection. The creditor can put a lein on any refunds you may or may not receive. Since I have never been in this situation, I am not sure collections on your ITR would be annotated or if it would affect your petition.
$20K a year is not much in most states, you might have a tough time meeting the poverty guidelines. On a side note, if you are successful in getting an approved petition and getting your financee to the U.S. it will be difficult to establish any credit to get a car, house...etc if your debts are in collections. Just a thought, have you tried one of the debt consolidation programs? Ken

I have searched and searched, but can't seem to find an answer anywhere to my questions. I am planning to apply for a Fiancee visa for my fiancee in Peru in a year or two from now. But, I have been worried because of some credit card debts and unsecured loans which I had from a previous marriage.The debts and loans now amount to about $45,000. I haven't paid anything on these debts for about a year or two now since i know i can't afford to pay them. I don't plan to pay them off. Since I don't own any property of my own there is nothing my creditors can do to get me to pay. Instead i just get harrassing mail and phone calls from collector agencies which I ignore. I need some advice... Should I be worried about whether or not this debt will cause problems for me when we apply for the visa? Will I be questioned any about the debts or not? I make above the minimum income requirement on the affidavit of support, but just barely. I should make about $20000 annually for the next few years. It concerns me since i never read anything about it on the forums. Can anyone give me some advice?

As already stated, if you legally get married in the Philippines, you are no longer eligible for the K1 and will have to start the K3 process from the beginning. If you are having a ceremoney only and no marriage license in the Philippines you should be ok. Suggest you go the foreign embassy forum and look at the manila embassy interview thread. Ken

Hi All,

My fiancee Hydy and I got engaged a month ago and now we're trying to decide whether to go the K-1 or K-3 route. We don't have really strong preferences about whether to get married in the U.S. or the Philippines. Basically we want to go with whichever option would get Hydy to the U.S. the fastest and with the best chances for approval of the visa. We have heard that the K-1 is no longer a very good option for the Philippines, that it takes longer and has lower rates of approval than the K-3, but we haven't really seen clear evidence showing that one visa is faster or more likely to be approved than the other. Can anyone out there point us to some info or resources that would help? Thank you.

Eviee, It differs depending on your locatin in the PI. We received the letter about 3 weeks after the Embassy received our NOA2 and then got our Packet 4 on 26 Dec, here is the time line from our signature:
11 Oct 06 - Case MNL783xxx received by Manila Embassy.
31 Oct 06 - Fiancee received letter from Manila Embassy confirming receipt of case from NVC
26 Dec 06 - Received Packet 4

You NBI statement if one of the statement not requiring a letter of explaination, just make sure it is not more than a year old. Go to the Foreign Embassy section and join us in the Manila Embassy Interview thread. Ken & Maria

Yesterday I just got my pre interview letter from The US Embassy. I just wanted to know how long it takes for you ladies to recieve your packet 4 since the time you recieved your pre interview letter.I understand that we have all different lenght of time, at least an idea will help :) And one more inguiry, I have with me my NBI clearance already and I got the notations stated "NO RECORDS ON FILE" I'm totally confuse if I need to obtain an official letter of explaination from the NBI, it said only on thier requirements that you only need to provide them the official letter of explaination if you have any of this notation in your clearance "NO CRIMINAL RECORDS", NO CRIMINAL CONVICTION", " NO PENDING CASE", or DEROGATORY RECORDS.

I hope to get some help here.

This is my first posted question, but I have been looking at all the information that has been given for quite a while. I must say, this is an amazing site!

Anyhow, on to my question.

Where do I send the I-129 form?


Information:

- I am filing the I-129 (hopefully on Jan. 25th)
- I currently live in Thailand and have been living here for approx. 2 1/2 years.
- My last place of residence in the US was in California.
- However, I plan on living in Michigan when I return to the US with my Fiance.

Note: The instructions for the I-129 form state the following:

"If you live outside the United States, mail your petition to USCIS Service Center listed above that has jurisdiction over the last place you lived in the United States. NOTE: Your petition cannot be adjucated at a USCIS office abroad."

So, do I send the I-129 to:

California (since this was the last place I lived in the United States)?

or

Nebraska (since I will be moving to Michigan which is under their jurisdiction)?


According to this statement, I would think that the forms would go to California. However, it really does not make sense if I am going to be living in Michigan when I return.

If anyone can clarify this matter, I would greatly appreciate it.

If you are still waiting on the NOA2 to go to the NVC form the CSC, the estimate is exactly that. The CSC can screw up the estimate in one day. Our estimated timline for NOA2 was Nov 06 but it was approved and sent to the NVC in Sept. It is afte the NOA2 gets to NVC when it sits with no action or atleast no notification of any actions being taken for a month. Suggest you go to the Foreign Embassy section and compare time lines in the Manila Embassy Interview Thread. That might give you a better idea or try this CSC_Philippines Timelines Ken and Maria

I was wondering how accurate have the estimated timeline dates been? Mine has moved closer, it was feb 3rd, then feb 1st, today it moved up to january 31st. I know these are only estimates based on recent cases. Please share, if you can, how close was the estimated date to the actual date that you recieved your NOA2.

Yea we have seen this before with travel agencies for what ever reason. Have you tried booking the flight for her online? Try booking online with Kayak, I have never tried it for your locations, but they are pretty good at finding the cheapest fares. Good luck, Ken & Maria

Lena is in Russia and had her embassy interview last Tuesday in Moscow. They told her that she is approved and to expect her visa soon. It is currently on the way to her via DHL (it's showing in their tracking system) as of this posting.

She visited a local travel agency today to book her tickets to come here, but the agent refused to sell her tickets based on the following reasons:

1) Claims that she needs to see Lena's actual passport (her local passport - essentially a government issued ID - was not good enough apparently)
2) Claims that she needs to have the Visa #
3) Claims that Lena needs to buy a round-trip ticket regardless of the visa type

Is this agent crazy, or is there any legitimacy to her claims? I know that I could book this ticket on Expedia.com - it'd cost about $100 more after all of the courier costs to expedite getting it to Lena, but they wouldn't stop me from buying her a ticket... but after these claims from the travel agent, I'm concerned about the claim about needing a round-trip ticket. She would be flying in via Aeroflot to NYC and then taking a local Delta flight to get to Tampa if we get the tickets we want. Anyone have any ideas about who's 'rules' these are and who I have to call to get confirmation or denial of this?

If you are going the K1 route and not the K3, yes you will have to use an address in the U.S. If you are going to get married there and go the K3 route, there has been some recent changes as to what agency handles the I-130s for the K3. If both you and your fiance can travel to the states, I suggest getting married in the U.S. then applying for AOS for your fiance after marriage. Since both of you are engineers, finding a job should not be a problem. Good luck, ken

I am a US citizen, born and raised in Venezuela. My mother, a US citizen married to a Venezuelan citizen, reported my birth at the consulate, (consular report of birth abroad). Although I have never lived in the US, I have spent almost all of my vacations there, visiting our family.

I am an engineer and although I am working in Venezuela I am planning to go to the States and raise a family. I am engaged to marry soon with my fiancé, a Venezuelan engineer, who has been my boyfriend for the last four years.

Since I don’t have any financial means; my brother, who lives and works in the US, volunteered to be my affidavit of support co-sponsor. Do I need to declare a domicile in the US before applying for the visa? Since I don’t have one, may I use my brother's address as my domicile?

Your time line is similar to ours at CSC. You should have received your NOA2 between Sept and Oct. Start calling today. The touch in Oct may have been when it was forwarded to the NVC then the Embassy in Australia. Call the USCIS, the NVC and the AMEMBASSY in Australia. Ken & Maria

I am new to this site, found it out of desperation...trying to find answers to some of my questions.

I am a US citizen and my fiance is coming over from Australia. We filed our petition back in June, 06 and our first notice date was on July 17, 2006. (Ours is at the California Service Center) We were assured by our immigration lawyer that we should have all this taken care of in no more than 6 months and he would be here in the states with me. So with that information, we thought an April wedding would be perfect. We have planned for a pretty big wedding on April 21, 2007. Yet, we have heard nothing! I have not received the second notice and once we do, we will still need to wait on everything to be done in Australia. Paperwork, interview, etc. I check the USCIS site daily for some updated info. The last 'touch' date shows Oct. 2006.

I have read several timelines on this site from different members and it sure doesn't seem that any of the others have taken this long. Can anyone tell me if this timing seems a bit abnormal (we can not seem to get any info out of our lawyer, either)? Has anyone else had to wait this long?

My biggest fear is that I will be standing at the altar without a groom. We have talked about rescheduling our wedding plans but we will loose a lot of money from venders with deposits and so much work will be lost. (Or if we just move the date back with all of our venders, they are so booked up now, it would be the end of 2007 or even 2008) I do feel we are close since the date for the I-129F on the USCIS site is July 17 (our date). But even if we are notified and things are sent to the American Embassy in Sydney in the next couple of weeks, I still don't know if we will have enough time to get him here by April.

This has been the most stressful thing ever. If anyone has any suggestions for me, words of wisdom, or comments, I would love to hear from you.

Canada will be the only place that we will meet.. nearer to him.. but we have a problem because i dont have any friend or relatives that lives in canada..

Excuse me for being skeptical, but why is he not helping you with this? Fear of flying is not enough to convince USCIS or NVC or the Department of Homeland Security, that you are not just doing this to get into the US.

If you want to meet in Canada, why is he not helping you, does he know any friends there that could invite you, or maybe he could go there, make friends there and have them invite you.

Again sorry for the skepticism but it is in your interest to find out what he really wants.

I have been inside a submarine tour when it hit her and no wway should she ever get on a plane. i ti s totally mental but it attacks her central nervous system and she stops breathing. She has tried hypnosis and there ar eno medications for this desease.
Like you said, with out proof of relationship, might as well buy a lottery ticket. Ken & Maria

According to you timeline you are already in te states and married? If so you should have updated your passport with your married name. Withthe new requirements for everyone traveling to carry a passport, i suggest you turn it in now for renewal or at least at the 6 month point and make a photo copy of the current passport. ken

I posted this question last night but only one replied. Probably a lot was watching the superbowl hehehe.

I mailed my AOS/EAD application today. It seems that it takes USCIS 6 or more months to process such application. However, my passport will expire on Sept. 2007. My questions are : how soon do i need to renew my passport and would i need a passport once the EAD/AOS arrives. Thanks in advance. :help:

After the NOA2, ur fiance should receive a letter confirming receipt of the NOA. Then a packet 4 with ur medical and interview schedule dates plus instructions on what forms to complete. She is going to need her NBI, BC fresh from NSO, CEMONAR, CFO, Police certicficate...etc
You are going to need to provide the 134 Affidavit of support (notarized), letter of intent to marry (both of u), Letter from your bank... etc. Just look at the K-1 Guidelines and FAQ, it shoudl help you. Ken

hi everyone!
I Need help. we got our noa2 last december 8,2006 thru email and also the hard copy of it few days after. As far as we know the next step that we need to do is wait for the packet to be sent to philippines and wait for the medical and interview schedule which will be provided by US embassy in Manila. We tried checking on the visa appointment schedule online and it is still not showing our schedule. ( But ive read here that they update it every 15th of the month so i understand that part.) So, anyway, we called the number for US (i believe its call center) and asked them if they already have a schedule for us for the interview and medical and i was surprised by what the lady said coz she told me that my fiance needs to call the embassy in manila for her to make an appointed for the interview.
So now im confused coz i thought the US embassy in manila will be the one to provide you with the interview date and all that.
CAn you please shed some light over this matter...
Also, what do we really need to do now??

We did not copy anything personal except for letrters and cards. Emails and chat logs, I just did a screen capture while chattig with my fiance on cam so her pic is in the capture also. I did this once a month as only about 30 days of archives will fit on one peice of paper.
Airline boarding passes, passport stamps, hotel and ATM receipts are better proof that he actually went to the Philipines. Picture of you two in the PI is needed also. Just follow the guidelines and examples, they are pretty simple to figure out. Ken

Try reading the K-1 Guidelines and the example forms. We used them and we have ouyr interview on 15 Feb. You relly need to go to the Foreign Embassy forum and read the 350 pages of the Manila Embassy interview thread. Ken

Gracy_Byron, This has been discussed many times in the Manila Embassy Thread without a definite answer. The best I can make of it, is an electronic copy goes to the Embassy/Consulate the same time the hard copy goes to the NVC. The NVC then packages up all the petitions for each Embassy and sends them out in bulk. Just look at my timesline and others in the Manila Embassy thread.... it will give you some idea of the time you will wait. There is no correct answer as the USCIS and NVC have both been changing so much over the last 2 years, I am sure they do not even know the process anymore.
I received notification from the USCIS in Sept, NVC in Oct and the Embassy confirmation letter in Oct. Good luck, Ken & Maria

The guy that I talked to said they didnt send it to NVC but directly to the embassy here, Im kinda confuse here, who will assign a case number for our petition over here then? I thought its suppose to pass NVC before the consulate.

The menstural cycle has no bearing on the physical at St Lukes. My fiancee just went throught the medical and there is no examination involving the privates parts. The Medical is a generic physical... it may be different in Thailand, so this is probably better answered by one of the Thai members, good luck, Ken & Maria

Or if she have her period that time, the doctor will advise her to come back if she is clear already.

My fiancee was denied 2xTourist Visas and cancelled a K1 petition couple of years ago. We selected yes and wrote an explaination letter for each denial. The Tourist visa is a different process and should not affect your current K1 unless you were denied for some criminal issues.
You can only be denied entry into the U.S. is you have arrived at a POE and were sent back. So, unless you have actully flown ot he U.S. and were sent back by Immigrations, the answer is "no". Hope this helps, ken & Maria

Last year I've applied for an Nonimmigrant Visa, but didn't grand it for some reason. Is it going to affect me getting my immigration visa? There is a question on DS-156 form, asking if I have ever been refused for a visa, should I put yes?

And also, below it on part 38...."Have you ever been refused admission to the U.S., or been the subject of a deportation hearing or sought to obtain or assist others to obtain a visa, entry into the U.S., or any other U.S. immigration benefit by fraud or willful misrepresentation or other unlawful means? Have you attended a U.S. public elementary school on student (F) status or a public secondary school after November 30, 1996 without reimbursing the school?", if I put "yes" then I may be required to personally appear before a consular officer.

What should I do? Anyone has the same experience?

On the forms there are boxes that all of the information does not fit, for example: my fiancees middle name does not fit in the appropriate box. What do I do? Am I overlooking something simple? I am using latest version of Adobe and the new I-129F form from this site. Thanks.

Many questions are asked over and over, and this may be one... But no one is forced to answer. :whistle: Basically for the K-1 you should go with whichever is cheaper, round trip or one way makes no difference.

The Frequently Asked Questions (FAQs) has this exact question. This has been discussed many times on VJ, the search function does work. You are only required a one-way ticket since you are immigrating to the U.S. The round trip ticket is for non-immigrants and tourist to show Immigrations they have a return flight out of the country. Thanks all for having some understanding and just to let you all know I didn't rush in to this ether. it was fairly long term adn i visited her quite a few times too. I just didn't notice the warning signs. Maybe they were a bit hidden with the language barrier and also I was blinded by love too. Long distance relationships are tough becasue its so hard to know everything about a person.

I just couldn't take the chance with my kids being involved though. My kids and I have had past dealings with mental issues too....My kids mother took off on us and it was because of mental issues. The issues with my x-fiancee are much more harmful then my X-wife's depression though.

So anyway it looks like I will be filing a waiver when and if the time comes.

I wish I had to go through a medical with my first wife (American). She was bi-polar and OCD but refused medication or treatment. I took the kids and ran. Good luck with the next relationship. Payato

Hi everyone,

My fiancé is Swedish and I am American. For at least the next 2 years, I will be living in Sweden because of his job. We want to get married in the U.S. and also for him to get his American citizenship (eventually).

My question is, can we still apply for the K1 Visa while I am living in another country?

Also, after we are married, is it possible for us to both reside in Sweden while his citizenship processes?

Please, if anyone can answer these questions for me, I would greatly appreciate it!

Depends, we need more information. If you are a military or Government employee with and APO/FPO address, that is considered a U.S. address and for filing puroses the center nearest your home of record should be used. Good luck, Payato

Yep, completely understand. The CO can be as picky as they want to be even though the requirements do not require a certified copy. This is an ongoing problem with the K1/3 process. If you can get a certifed copy, go ahead and get one just in case. Ken

People have been RFE'd for official records not being certified. Just so you know what has happened anecdotally.

Ok there is a lot of discussion (borderline arguing) about multiple divorce decrees. The second marriage is proof that he was legally able to marry the second time, however the Embassy still request proof of termination of all marriages. I do not know whay the latest divorce decree is not sufficient?
To dispell the myth, it does not have to be a certified copy of the divorce decree, just a copy. Copies can be obtained from the county court house the divorce was finalized in. Some have websites that you can order them online for a fee of course but others do not. I had to send a money order to the court hosue and pay not only for the copy, but for the return envelope.

hi guys! i wanna ask something.

my fiance had two marriages before. the problem is he could no longer locate the divorce papers of his first marriage. he said he didn't know where to get another certified divorce papers. how and where can he get another certified divorce papers since the termination of his first marriage was 1998?

is it ok if we just mention in the forms his second marriage since we cannot provide the certified copies of the divorce of his first marriage? will the center know that he has two marriages before?

In the Manila Embassy Thread, it has been recommended that everyone make a copy of their passport prior to their Medical at St Lukes. St Lukes takes the passport and forwards it back to the Embassy for the interview, hence the medical appointment one week prior to the appointment. Other forms of IDF are the voter's ID, NBI clearance has her photo on it as well, school IDs...ect. Any photo ID with a her appointment letter will get her in the embassy annex grounds. Ken & Maria

Question again..... I've read in this forum that the APPOINTMENT LETTER and a VALID ID are needed in order to enter the US embassy.

What are examples of these VALID IDs?

My wife and I just got married and she does not have an ID that bears my last name. Anyone there who has experienced this, and what was done?

Any information will be greatly appreciated.

I am just gonna file as is. Who knows how long they will take to approve the new draft or new procedures? If they require the new form when/if it is approved, they will request the additional information. Payato
