IR-1 / CR-1 Spouse Visa Process & ProceduresLetter from Employer?

I didn't realize there was a requiremnet on who writes the letter..Why do you need 2 letters?? I think they are looking for current employmment just to verify you are working...

HR department will write my letter, but I don't see why a supervisor can't write it..Just make sure you have a company letterhead....if this is at all possible..

I assumed we needed two because I have my husband as a sponsor (so he needs one from his work), and my father in law as a co-sponsor (which would also mean he needs one0...

my father in law is going to try and request again when his company he works for opens on Tuesday. I'm just worried about what to do if they say no again.

IR-1 / CR-1 Spouse Visa Process & ProceduresLetter from Employer?
We are so frustrated!

We sent out my IV Package this morning, and have been waiting on his AOS to get his 2008 info from the IRS. It came in the mail today so he is finishing assembling the AOS packet to mail out. Our question is this, it says "Original letter of employment" on required documents for the AOS packet. He's pretty sure he can get one from his Boss no problem, but his father's company isnt being very cooperative. His father is our co-sponsor. Is it something we absolutely need? What should we do if he asks again and they refuse?

thanks!

IR-1 / CR-1 Spouse Visa Process & ProceduresCase Complete!
So I decided to try and sign in, just to see if we would get our SIF.. and we did. Excitedly I called NVC (of course in the middle of lunch when its busy as all get out) and waited.. and waited. And when the operator got on the line, I asked to check the status and got the magical words "your case was completed on May 6th!" We are just waiting for our interview date to be assigned!! SO excited!

Congratulations!!! Wonderful news! I added you to the list of June Interviews thread. No help on the hotel front yet since I, myself, am just starting to look. I'll be interested to see where you end up! I know if you read through embassey reviews, a lot of people mention where they stay in their review. might be helpful!

IR-1 / CR-1 Spouse Visa Process & ProceduresPregnant...
So my husband and I just found out we are pregnant yesterday. surprise! ha ha. Ive already talked to the dr office for me immigration medical and figured out what I need to do for that. My question isnt actually immigration related... per se. My husband just got medical through work. We cant add me until I have my ssn.. and even then because I was pregnant before I was added, any birthing/pregnancy costs, to our knowledge, wont be covered by his medical. So here is my question...

if I were to have the baby in Canada, what steps would we need to take to bring our child into the US? I know there is something about birth abroad, but Im not really sure how that plays into things. We just dont really know what our options are right now and are overwhelmed. We can provide for a baby alright once we have it, but the medical expenses are astronomical here. I didnt realize exactly how different the medical system is here versus Canada.

Anyway.. other than worry about that, we are absolutely thrilled!

Hi there,

so a few weeks ago I signed up with DHL to register which location I wanted my visa shipped to for pick up. I followed the instructions and now when I sign in it shows it all set up. However, it says I do not have an interview date. Is this normal? My interview date is June 27th.. and was assigned a month ago.. so Im not sure if I should be worried about this or not? it says something like you do not have an interview scheduled. please schedule one using the link below.. but I dont know if I should click on that or not because I already have one set up and dont want to mess anything up?

thanks!

these were skype to skype :/ not paid. I have a paid subscription now but we didnt get one until December when I was visiting for a few months because then I could call home to canada. Im so frustrated. but they can see that we chatted every day for the past 3 months... its not like that would be a sudden occurrence over a 2.5 year relationship.

IR-1 / CR-1 Spouse Visa Process & Proceduresskype records issue?

Just curious; why so much emphasis on the Skype records? We don't Skype very much but have phone calls, emails, visits, pictures, cards, plus more to document our journey together.... just wondering.....?

for me its because that is what we use the most. we hardly ever email unless hes forwarding me something, and since we got smartphones we use IM instead of text because texting was costing so much on his end... and I dont have a land line so the long distance was a killer too. Its just frustrating. My hubby isnt a tech-capable guy. I dont think he could hook his old drive up to retrieve the info :( and I leave tomorrow and hes working until midnight so.. hopefully 3 months will be enough and I can explain what happened to the other 2 years of skype records.

IR-1 / CR-1 Spouse Visa Process & Proceduresskype records issue?
hey guys so my interview is Monday.. and last week I had a nasty nasty computer virus that decided to wipe out random things on my pc (I have missing short cuts, missing files, you name it).. so I have no way to get back 2.5 years of call logs. SO.. crafty me, I thought ok Ill get hubby to export and save HIS call history. sounds great, right? nope. His only goes back to March 3rd of this year. I was visiting him from November 16 - March 3rd and in January his computer motherboard died. So we bought a new computer for him. Since I was there, he had no reason to call me on skype.. I went home the 3rd.. thats when calls began again. All our other 2 years of call logs are on the old hard drive which he has no external HD enclosure to copy them off with.. Do you think the consulate will be ok with 3 months worth of calls? It didnt even occur to me that our history would be on the old drive. ugh!

IR-1 / CR-1 Spouse Visa Process & ProceduresAOS Question: USC dependents?

First realize that this form is designed for the majority, which live and work in the US. IT's not going to fit your situation like a glove. The children aren't being sponsored by you on the form. The only immigrant you are sponsoring is your spouse. They are part of your household (21d) and yes you report a household size of 5. You have a joint sponsor so it doesn't really matter if you make enough. If your UK income will not continue in the US, then for the purpose of this form, you make zero because they are looking for US income to know you can provide support.

Your joint sponsor is only supporting the one immigrant on the form. If your Mom has a spouse or younger children at home dependent on her, then they are part of her household count. Example
Mom, Dad, +your immigrant wife means Mom must make enough to support 3
Mom, Dad, your two young brothers +your immigrant wife means Mom must make enough to support 5

You and your US citizen kids do not require support. You are free to go on welfare, food stamps, etc. It's the immigrant they want sponsored.

Thank you so much. You have no idea how much that clears things up for me!

IR-1 / CR-1 Spouse Visa Process & ProceduresAOS Question: USC dependents?
Hi everyone,
I am running around in circles on this!

Here's my situation:
I am a USC living in UK. I am filing for my UKC husband. We have three children, all with CRBA/US passports, so they are all USCs.

I am filing DCF, as I reside in UK, so I have a joint sponsor in US (my mom). My income in UK is not enough to support us (and my income in US is nil).

Here's what I'm asking.

How do I list the children on the AOS? It doesn't seem right to list them in #9 because they are not immigrants (and #10 refers to all people listed in #8 and #9 as immigrants). But if I list them in Household size (#21d) it is too many dependents for me to financially support (it makes a household of 5).

If I list them in that section (which only seems correct), then what does my joint sponsor do? Does she list the Immigrant (my husband) and then the four of us (the petitioner and 3 children) as #21e 'Other dependents'?

I hope this makes sense. And I hope my children being USCs means we don't need to file immigration petitions for each of them.....!

Thanks, and please help!

IR-1 / CR-1 Spouse Visa Process & ProceduresAffidavit of Support using Co-sponsor

Hello all,

I don't have tax records or steady employment for the last few years. I have been traveling and working odd jobs, and am going to rely on a co-sponsor to fill out the Affidavit of Support I-864.

My question is, if my co-sponsor is providing all of the paperwork (tax returns, letter on company letterhead, tax transcripts, etc), do I still have to provide that paperwork? Or does it become unnecessary for me to do so? Will it be a problem that I don't have tax or employment history for the last few years?

Sincere Thanks,
Mike

If you are the sponsor, then yes, you have to fill out an AOS too as the petitioner. Your application is incomplete without you filling one out. Your co-sponsor will fill out a separate AOS as the joint sponsor.

Even if you haven't been working, you are still required to file income tax returns. I don't know your specific situation, but because I was living abroad, I didn't bother, but to immigrate back to the US you must backfile at least 3 years. So that's what I did, putting mostly zeros in all the blanks (because of my Foreign Income Exclusion, but that also meant filling in a different form too). It shouldn't take you too long to backfile, but it is required for this.

US Embassy and Consulate DiscussionManila Embassy Interview

St. Lukes discovered that she had active TB! She is undergoing treatment and will not be eligible for her interview in 6 months. No one knew of her aliment until she went to the medical exam, about a week early. St Lukes told her that they canceled the interview, for now.

Ok, what do they mean active TB? Did she test postive for exposure (most common) or did they run labs and xrays to determine if she has TB? The treatment is 9 months not 6... my daughter and I both tested postive for exposure. If she has active TB, make sure she gets the proper treatment and medications.

I would think all you would have to do is contact the Embassy and reschedule the interview since you have a medical justification for delaying it and her missing the interview. Good Luck, Payato

Hey guys. The CFO lady at the seminar told my gal that she would not be allowed to use her knockoff L. Viton luggage to travel to the US since they are banned by the US govt. Anybody heard of this, and which agency would be implementing the policy. My quick scan of the regs found nothing.

What, you mean they sell knock-off goods in the RP?

I have been through both Terminal 1 and 2, five times this year alone and many more times with friends wearing the knock off watches from the PI and Thailand, clothes from Korea...etc. None of them have ever even been questioned. I think what they are referring to to is the mass quanities OSWs try to bring back to the states or wherever they are working for profit.
Dress normally, pack with 70lbs or less in your bags, no more than 2 check bags, one carry-on and mail the rest through UPS/FEDEX/LBC or leave it for friends and family. LBC is the cheapest and one price reguardless of weight. Good luck, Payato

Hello VJ family,
I have a question regarding plane tickets. My fiancé is coming to attend my visa interview and wants to pick me up once i get my visa. My question is, can he buy my ticket in the U.S. so we will for sure be on the same flight back? will it cause any problems? Do I have to wait and buy my flight in Manila and pay taxes to the Philippines? Or can my fiancé just go ahead and buy a round trip ticket for both of us, and I just use the part of the ticket that takes me to the U.S. with him? That way he can save some money and get the tickets now.
Please give us an idea on if you had done the same thing before. Thanks a lot.
Any inputs would be highly appreciated. :D

You are going to paty taxes either way you go. He can purchase a one-way ticket for you to return with him from one of many agencies in the states but the one way ticket is usually cheaper if you purchase it there in the PI (it does not have to be Manila). There is a post in this thread severl pages back that list several online agencies to book flight through. Good luck, Payato

Congrats Uling!!!

I have some questions.
Since Luz hasn't heard anything yet from the Embassy I called the DOS and asked them for the status of my case. They said that Packet 3 was sent on Oct 23. I told them that Luz hasn't gotten it yet. They said for Luz to call the embassy and request they send it again. The number they gave me is different from the one in Ulings signature. They gave me:(63) 2-528-6300 Ulings number is (63) 538-6300. Which one is right?
Is this the number that they charge $18 to use? If so I guess I should be the one to call.
Thanks guys!!

Gary are you referring to the letter that the Embassy sends to confirm receipt of you case? There is no packet 3 for Manila as I understand it, just the packet 4. It took almost 3 weeks for us to get our letter but my fiancee lives near the old Clark Air Base, not sure how far Luz lives from Manila and the usualy mail delivery time. Good luck, Ken (Payato)

How long should it take from the time Manila gets our case until Luz gets the welcome letter? And what part of the month do they update the interview dates? I.E. when should we find out our interview date?

Gary looking at your timeline, how do you know the Embassy received your case on 15 Oct? We had no idea when they received our until we got the letter on 30 Oct and they had received the case on 11 Oct. So, it takes between 2-3 weeks after they get the case. We also have to remember all the holidays they have had recently, Ramadan, All Hallows Week, All Saints Day, not Vets Day. Good luck, Ken

Payato (is your name supposed to be “Payatot” meaning thin to the bones?) Anyway, regarding your request, Manila beneficiaries do not get packet 1. We go straight to packet 4. However, Manila Embassy now sends out a one-page letter advising beneficiaries the date they received the physical file from NVC. Is this what your fiancee received? Packet 4 is very thick, it contains more than 10 sheets of instructions and forms and your fiancee does not receive this until her interview is scheduled. You are now number 55, up from 57 because your case number is lower. Hmm, I just realized that I have the power to promote and demote people here  hehehe

PW, Yes my nickname is short for Payatot. When I lived in the Philippines we had a pool team and the last "T" fell off my shirt and it kinda of stuck after that. I understand the Leter versus packet 1, just didn't know what to call it. The letter did get the blood pumping though.
Congrats on your fiancee' arrival and enjoy. Payato

How long does it take for Luz to get the "We have your petition" letter from the embassy? Our case got to them on Oct 15. Thanks!

Gary, They receicved our package on 11 Oct, sent to us on the 13th and we received the letter (not the packet) on 30 Oct via snail mail. Payato

When you go in for the interview I know that Luz has to have proof of her annullment. She has the NCO marriage contract with the annotations. Will she need to bring anything else? What do they usually ask for?

I submitted CERTIFIED TRUE COPIES of following to prove annulment:

1) Decision
2) Certificate of Finality
3) Certifificate of Registration
4) Original annotated marriage contract issued by NSO

Guys, the embassy will be closed on October 24 as the Philippine govt. has declared it a holiday in observance of Ramadan. So save your $$$ and don't call the embassy next Tuesday.

Peace to our muslim brothers and sisters.

PW, Not sure how many timlines are being maintained by VJ members but we do not show up on your timeline. Gary, Our informations is outdated on your timeline trackers also. We are at the waiting for interview stage. I wonder why it takes them an average of 4 months to set an interview? Payato

Does anyone know about methods of payment for St. Lukes Medical, do they accept credit card or is it cash only? And I'm assuming that since the visa fee is paid at the BPI bank, it can be paid by credit card or cash?

BJ, Not sure if your bank will allow it, but I acquired an ATM card for my Fiancee from my bank. I tis much like a Teen Pre-paid card where I decide how much is on the card and add money when I want or need to. My fiancee just goes to the ATM when she needs money and there are no transfer fees because the card is in my bank and it is an internal bank transfer which I do online. Much less pain and no fees. Depending n what state and city you are in, if there is a BPI near you, that works too. Good luck, Payato

To speed the application process for a non-immigrant visa to the United States, the U.S. Embassy will require all visa applicants after November 1, 2006, to use an electronic application form available for free on the Internet. This form must be completed and presented to the Embassy on the date of your visa interview.

For the full story (Manila Embassy Website) - CLICK HERE

I am curious if this applies to K-1's and K-3's, which are technically non-immigrant visa's but handled by the immigrant visa section. In the last part of the posting, it seems to describe the procedures that non-immigrant visa applicants can use, like calling to schedule an appointment and visa-point that K-1's and K-3's cannot use. If this is the case, then people who have November interview dates should be provided this information in the K-packets and not blank copies of the forms.

My instincts say this procedure applies to K1 and K3 visa petitions, and they will make the DS-156K and DS-157 electronic applications sometime in the future. However, I am speculating, but time will tell. I will call the Manila Embassy because I want to know (if someone beats me to this action then please ask on our behalf). I do wonder if the Manila Embassy will cease and desist in sending the DS-156 form within the visa packet and direct folks to the weblink. However, we may be expecting too much... too fast. LOL!
[/quote]

It already applies to tourist VISAs so I assume it will take affect immediately for K1 VISAs too. My Fiancee had to fill out the online forms and they would not accept any other form for her tourist visa application. If someone finds out for let us know. Payato

US Embassy and Consulate DiscussionQuick I-134 question...
If your parents ares still claiming you as a dependent on thier ITR, that means they are claiming they are responsible for more than 50% of your support. Read the rules on the back of the form, I think you need to check partially dependent but the 50% rule may require you to check wholly.
On a side note, if you are still living with your parents and do not have a full times job, even with a co-sponsor, this may cause issues with your petition as you are supposed to be 12% of the proverty line. Mabe China is different then the Philippines. Good luck, Ken

This pertains to the co-sponsor's AOS form. For question #8, what is the difference between wholly & partially dependent? My father is my co-sponsor as I am a grad student who does not enough income, yet I still live with my parents and work part-time. I do not think I can claim independent as they still file jointly as a family (parents & siblings) in taxes, I believe. Therefore my father's I-134 will have me listed as still dependent on support, but I am unsure of what is wholly & partially. Any suggestions? Thanks!

US Embassy and Consulate DiscussionSt. Lukes Medical in Manila
Coco, here are my comment for someone who works at the Embassy (not immigrations) and who has already been through the process:
Going in early does you no good. Wait your turn like everyone else. Once inside, they will arrange you in the waiting areas by appointment time and not take you before your scheduled time.

- If a guard outside tells you to wait on the side first and you can't get in the "Waiting Shed" area, don't believe him. I dropped my fiance off to park the car and found her waiting on the side (where the vendors and fixers are). I went to the line and asked another guard and he said I could go in. Just tell them you're for immigrant visa. We were there around 5:40AM and our appointment was 7:30AM.

Unless you did your medical less than 7 days prior to your interview, SLE will forward your required photos and the sealed medical results to the Embassy. I think these folks went after their scheduled medical appointment and SLE did not have time to get it to the Embassy. If you gave SLE 2xpassport photos, no need to get more but if you have extras, no harm in bringing them with you.

- Make sure you have 2 extra passport photos and your complete forms. The person in front of us didn't and so they asked him to go back outside and have passport photos taken, gave him missing forms and had them complete it frist.

The guidelines, Sheriff Ulings and SillyGirls examples tells you to bring actual photos for the screener, not photo copies.

- I prepared a new set of pictures and copies of boarding passes, receipts, etc. to present as an ongoing relationship. The pre-screener Just took the pictures gave us back all the other photocopies.

These are only required if you worked outside the Philippines after the age of 16. This is also in the NBI webpage and Visa guidelines.

- Here's another thing that surprised me. They didn't ask for her Police Clearance or Barranggay Clearance or CENOMAR. Just NBI and Birth Certificate is what we handed over.

US Embassy and Consulate DiscussionManila Interview - some tips
The sealed envelope is typically sent directly to the Embassy along with your Passport and the 2 passport photos your are supposed to bring to SLE. In this case maybe SLE gave them the envelope but not in ours and we did not need 2 additional passport photos. Ken & Maria

Hi everyone! We just finished our Visa Interview in Manila today and it went without a hitch or problem. Here are some tips I can give:

- Someone had a guide here with layout of the place. Print that out and follow it.
- DO NOT BRING YOUR X-RAY films. I saw a lot of people with it - it's not necessary. Just make sure you brought the sealed envelope St. Luke's gave you. It's a hassle carrying that large envelope around anyhow.
-Arnold & Joan

May i ask what is "sealed envelop from St.Luke's?...i didn't know this, they just gave me my xray and vaccinations record.
thanks

US Embassy and Consulate DiscussionQuestions re: Manila CFO Guidance Counseling
CFO requires a Letter for Permission to Marry between the ages of 18-21 and a Letter of Advisement for 22-25. My now wife was asked for the letter of advisement at the CFO as well as a copy of my divorce decree. The letter does not need to be notarized, just signed by one of the parents listed on her BC and you will require a photo copy of the person's ID that signed the doccument

- She's 23 y.o. does she need a notarized approval letter from her mom? If so just notarized is fine? I read somewhere here about some special lawyer can only do this etc.

They did not ask about her father when she went?

- Her biological father is not part of her life now. Do they need to explain that in case they want a letter from her dad's approval too? Would letters from her grandmother help? or her other guardians?

The other things have already been answered, good luck. Ken & Maria
