how is it fair that people can file priority dates on there I-130 an some dont have reason to, for those who are in hardship, ill or extreme circumstances this does not apply to you, me an my husband have 2 small kids 1 he missed the birth of because of this visa proces an we filed may 24th, we be lucky if he makes christmas or even easter, we couldnt get a priority date for ours, i think the system needs looked at, those with children should get it done lil faster its not right to make moms deal with kids by themselves for nearly a year an to split familys apart like this, sorry for the rant, miss my hubby so much an i no the boys need him :( hopes fading pretty fast


Everyone when you file gets a 'priority date' When your at NVC stage it will appear on your paperwork. I think your priority date is the day you file. We sent off our I-130 start of dec, and on our paperwork it says "priority date december 5th". Think what you mean though is how some people can get an expedite. I agree it annoys me seeing people get granted them for no apparent reasons other than they miss their spouse, well we all do. I tried to get one as FIL is scheduled for major 50/50 spinal surgery but his doctor wouldn't give them a note with the date on, so NVC said without proof i couldn't be expedited :(

I personally don't feel anyone should be given priority over anyone else unless they have a Really good reason I.E spouse deploying, bad illness, about to give birth. Yes people with children need to be together, but then its almost punishing those who don't have kids. We want kids one day yes, but decided to wait till this is all done with, so I think on the basis of children we should all be the same. Im sure its tough being alone with the kids, but even for those who dont have kids there are issues. We will all get there in the end, and it sucks to be apart, but hey military families have to do it all the time so we can do it just once, thats the way i see it:P

We have 2 doggies who I joke are our kids for now, and I miss hubby and them soooo much. we've been apart since june 2010 because i initially filed UK visa but it was denied because i couldnt find work, then we filed CR1 in dec. Granted ive visited twice, but by the time I get there (hopefully aug) it will have been over a year weve been apart. We have spent more of our married life apart, than together so far, but im sure its like that for alot of us.

So keep on trucking, and we'll all get to be with our loved ones soon

Then several years ago, I got married to an Indian guy. But sadly, there was an issue where he cheated on me! So I quickly got the marriage was annulled, it was very short.

So anyway, right now, there is another Indian guy I have started a relationship with. I put the story down below. I plan to stay in his country for a few months before we get married. Then come back to the USA and file for him.

But... I guess I'm just paranoid it might look bad, or strange, that I was already married to another Indian guy a few years ago... Does immigration even look at the U.S. citizen's past marriages, or ask about them? Do I even have to tell them? Will they find out, and question me about it? I guess what I'm really asking is... How deep can I expect them to dig on ME? lol.

I'm clean of course, I've never been in trouble with the law or anything like that. I just don't want them jumping to conclusions about me, that's all. Like thinking I'm just marrying foreigners for green cards, or something! lol.


Unfortunately yes they do care and you cannot and should not lie or conceal anything about your past if they ask. You will have to submit a copy of your divorce/annulment certificate I think also, however as long as it was a good faith marriage you should have nothing to worry about. We all have 'a type' so to speak so dont be worried about that :) They wont dig as far back as your high school or college, and certainly wont go calling old boyfriends hehe, but they will need your divorce certificate and your new marriage one if you file a CR1.

If youve only been married once, and it ended in divorce you dont look like a serial green card'er so i wouldnt worry :)

I don't think it really should be a question of whether it turned out fine for some or not. I'm a tax analyst and can say that if you are married you should be filing as married. You can choose to file separately or jointly, but you should be filing as married. Requesting an ITIN is very simple and only delays your federal return by a couple of weeks. Well worth the hassle to comply with the law!


mine took 6 weeks to arrive :( But eventually it did :P

Well worth filing married if you can, hubby got back like an extra $1000 !

Ive heard of loads of people filing single though, even when married and its not an issue in most cases. They are more worried about whether you filed your taxes overall :D

I'm so happy! I received my NOA2 letter today in the mail. I could not believe it! my wife and I are so happy and grateful!
My NOA2 was approved 40 days after my NOA1.
I did send an expedite request but was denied.
I checked my account on the USCIS website but my account has not been updated and no touches - is this normal?

I am filing a "heavily front loaded" I-130 with lots of bona-fide marriage material. The total is about 300 pages. I have read in some places that all this information will be scanned and eventually make it to the embassy (China). Others have said that all of it will NOT go.

After NOA2 I will do electronic processing. Will it be necessary for me to scan all this bona-fide relationship documentation and send it again to assure that it makes to to the embassy?

I think aside from the forms themselves we sent in maybe 10-20 extra sheets/documents lol.

I too believe in not sending too much, because the more you send, the more they have to go through, plus higher chance for questions popping up. But on the otherhand i guess if you dont send enough you might get an RFE.

Read what others have sent, dont overload the USCIS folks though heheh.

you schedule your own medical. Once you have your case number you call up your assigned doctor and book it :) Then once you pass it, the doctors send your info to the embassy for you.

Unless its different in georgia , but I think its like that everywhere

Hey there !!

Yes as soon as you have your case number you can book it. Once NVC receive your case you'll have to wait upto 15 business days for your case number though. Mine was about 9, but it can vary. Just keep calling them everyday to see if you have your case number yet.

I booked mine 2 days after I received it, you cant book it for more than a month in advance though, so have a date in mind you want it :)

NVC will take into account the expedite, however NVC is mostly upto you. How quickly you pay the fees, send in paperwork etc. If you get an RFE you'll get held up a bit, so check over everything multiple times.

If your fast and have no RFE's you can clear NVC in under a month :) Also it seems if they are aware of an approved expedite they will assign you a slightly earlier interview date. Most of us have to wait 4-6 weeks after CC for one, but if you have an expedite you will probably get one within 2-3 weeks of case complete.

its been a month since my CC, but US embassy jakarta still haven't received my file. My CC is June 9, and I got an email from NVC on June 29 for the interview date. I want to reschedule it. So my husband sent an email last week to US Embassy, but got a reply that said that they haven't received my file. I try to call them today, but they said they still haven't received my file. Is it normal? what should I do? should I call NVC to ask? :help:


I had CC the same date you did, and had my interview scheduled for july 29th

Anyway... i checked DHL tracking info and my file left NVC on the 11th and arrived at London embassy on the 13th. I emailed london to request an earlier date but they said they didnt have my file yet. I queried this and said well " it shows my file has been signed for at the embassy, so surely it is there somewhere?" . after this, they assigned me a new interview date, the 25th, so only 4 days sooner but hey every little counts :D

So you could try check the DHL log to see if it is there or not. chances are it is but just hasnt been put in the system yet, often this is done 2 weeks before interview, only you request it sooner.

I think it is just the way the society is there. My fiancee found out that should you have tatooes or an anullment, you also have to go thru the evaluation.
When they looked at my fiancee's anullment and realized she had been away from the ex over 11 years, and also worked overseas in Kuwait for 7 years, they figured she was sound enough to not go thru the exam and gave her a pass.

Hope it all works out, I really think it is nothing to worry about at this point..


whattttt this is crazy. Glad london is not this way, I have loads of tattoos and the doctor didn't say anything to me :P Crazy how a tattoo can deem you psychologically off?

Yeah it is usually within a week, but can be longer. Like another poster said, medical issues take longer, and you normally have to send them proof did you do this? I know you mentioned you had surgery, if you included proof of this with an explanation as to why you need expedite you might be lucky :)

1. Mine was CC on june 9th 2011... I have my interview july 25th 2011, so approximately 6 weeks after. However atm it seems to be 4-5 weeks after.

2. They have been going quicker recently, so perhaps you might be lucky and get a 3 or 4 month approval :)

3. I dont think so, basically if they say no it means no. You could try asking again but they do look over things thoroughly, so if you included evidence with your expedite you may be lucky, if not, you'll just have to wait like normal.

4. The Expedite sticks with the case right through, however really it is down to YOU both how quick it moves at NVC. How fast you pay fees, how fast you send in your documents ( and providing there are no errors) If everything is complete and done properly you shouldnt get any RFE's and can be out of NVC within a month. Then once you have CC you will probably be given an interview within 2 weeks time instead of the usual 5-6 weeks.

The reason i ask is because they both do connecting flights to where my hubbys heading, and he wants to know because of the wait in customs till his next flight, Houston is 2hours Chicago is 2hours 30


If he misses his connection the airline will rebook him for free :)

Im flying RDU but connecting in atlanta and only have one hour 50 mins, but im not worried. If immigration takes a while delta rebook me for free and there are normally always seats free :)

yeah its def more of a common practice there. Over here Ive never needed anything notarized, so wouldnt even know where to go :(

One of my hobbies is entering online competitions and over there for big prizes (over $100) they send you an affidavit to get notarized before they send you the prize, whereas over here when ive won expensive prizes they just either send it to you or get you to fill out a simple form, no notary necessary :P

Well from what i've found so far it'll cost me close to £80 if not more to have a 2 page affidavit notarized. I just got back from 8 weeks in California so it'll have to wait a few weeks.lol

Thats crazy. You should have had them done in america, banks over there do them free if your spouse is with them. You could inquire maybe at the banks in this country if they'd do it too? I dunno. would depends on if they had a registered notary i guess :(

I was told i didnt need to bring any evidence with me to London, but was so worried about it, that I did , then turned out they didnt ask for it anyway so i should have listened lol, but at the end of the day better to do certain things, than not do them, so if it will make you feel better go ahead and notarize :)

England is a very low fraud country so we are lucky about this :)

The affidavits are mainly just to add in some extra voices to your case and show that other people can vouch for the fact your a true couple and have met. Simply write their full name and address and phone number on them, so that if USCIS or NVC wish to contact them, they can do :)

The ones our families did followed this format, it went something like this....

"Name- address- phone number"
"Citizenship status and country of bith, relation to petitioner and beneficiary"

"To whom it may concern,

I am the father of ...... and am signing this affidavit to hereby swear that the parties listed below entered into their marriage in good faith and have a legitimate, honest and legal relationship. I first met .... (hubbys name) in 2005, and have met him 5 times since. My wife and I were also present at their marriage on .... (date).

Signed on ...(date) then signature.



Thats kinda how we wrote ours. And did not get any of them notarized :)

Thanks for the reply British. Was there anything you both had to get notarized? From what i understood my wife and i have to draw up an affidavit that we both needed to sign and have notarized stating our relationship history and because we as yet haven't lived together and don't have any bills or such with our names on them, affidavits of a bona fide marriage from some friends or family which i thought also needed to be notarized.

Obviously your marriage cert will already be notarized and officially stamped, and the other originals etc.

I have heard of people getting things notarized but honestly I dont believe it says anywhere in the rules too, so dont do the extra legwork if you dont have to.

They wont expect you to have lived together yet probably anyway so joint bills arent a worry, that bit comes when you remove conditions after 2 year GC expires :) Thats when you send off all your 'joint' proof such as bills/leases etc.

In this bit just send the proof your a true couple, such as what is asked for i.e affidavits written and signed by people knowing you both, and mentioning how they know, if they were present at your wedding etc. We had one from my parents, one from hubbys parents, and one from our mutual friend :D

We didnt write anything about our relationship history and get it notarized. Obviously the paperwork asks when you were married, and the affidavits mention how and where you met normally, but the whole 'history' doesnt really come up. I went to interview loaded with photo's, flight ticket stubs, and 'proof' of our 5 year relationship but NONE of it was asked for. To be honest it seemed the guy paid more attention to my I-864EZ and where hubby worked than he did to asking our relationship lol

Unless they changed things I dont think it being notarized is needed. We filed our I-130 last December and had no RFE's and was approved at interview yesterday. Some countries may require it, but i dont think england does :)

I should clarify that this is for an affidavit of support from third parties for mine and my wifes relationship.

"Affidavits sworn to or affirmed by third parties having personal knowledge of the bona fides of the marital relationship. (Each affidavit must contain the full name and address, date and place of birth of the person making the affidavit, his or her relationship to the petitioner or beneficiary, if any, and complete information and details explaining how the person acquired his or her knowledge of your marriage)"

Do such affidavits require notarizing?


we didnt. Ours were just typed up, and signed by the people lol. no notarizing or anything

we didn't notarize them either. Just wrote something basic LOL.... and they were approved with no RFE's. I think as long as u have their contact info if USCIS or NVC wants to contact them, they can :)

In the I-130 instructions it doesnt mention that they have to be notarized :)

I'm in the process of doing all the NVC paperwork and hope to have it complete in a fortnight or so. My question is, do I need to schedule the medical off my own back or is this something that is booked for me? I can't find anything about it on here.

Also, is there somewhere I can look at average times of NVC case completes to interview in London? I miss hubs so bad, it's getting to the point where all I can think about is being with him, it's affecting my job!!!

Big screw up on my part on my affidavit forms.

Instead of writing [FIRST NAME] [MIDDLE] [PATERNAL LAST NAME] [MATERNAL LAST NAME]

I SWITCHED the paternal and maternal around...

Are they going to look at this and say, "No way, RFE!" ?

Can I just write them a note and attach it to the documents with this error pointing it out?

Fortunately only happened to my family members' affidavits.


May be wrong, but affidavits have no 'official' order, we create them ourselves, so if you haven't sent them yet, then can you edit them? Or yes just add a post it note to each maybe saying that the surnames are the wrong way around :)

Here are my questions (sorry if they're obvious, I'm probably being dumb here):

1) I don't really understand the guidelines, who is included in household size?
2) Can the sponsor be currently unemployed? What if he meets the poverty guideline in previous jobs?
3) What if the sponsor is moving, but doesn't have the new address yet?
4) How long does it take to request the tax documents?

Ugh, for me this is the worst bit so far.

yes the sponsor can be unemployed, you will just need another sponsor also. Nope, the income must be CURRENT and provable (i.e wage slips) . If the sponsor moves simply updates the NVC with the new address, or wait to send the paperwork until they have moved and u have the confirmed address.

Tax transcripts can take anything from 5 days to a few weeks, but they usually arrive within 10 days time :) Or you can send in a copy of the full tax return plus any 1040's or W'2's. You can send in either only the most recent years or the previous 3, we only sent in one and it was accepted no problems :)

I am totally confused about it! All I know is they are saying that my case can not have a service request fulfilled until after it leaves Phoenix. I never imagined I would be at another Lockbox this is crazy! thank you for your replies and time!


heh your welcome, Im just sorry I can be more helpful, But it is very weird, never heard of it getting to the service center then re-routed, all I can think is perhaps they are busy which I know CSC IS the busiest center.

It may be important to mention that in 2007 I brought over my ex wife from Cuba on a K-3. We divorced May 2010. Do you think she may have tried to adjust status and that is why they are doing this to my case?

Hmmm well surely they wouldn't know that until it had actually ARRIVED at the CSC, As that is when they start reviewing everything. If you haven't had NOA1 yet, that means its still probably in its envelope and on route the service center.

Oh wait just read ur timeline, you HAVE had NOA1, so it must have got to CSC, and is now in phoenix.... hmmm maybe its being sent to another service center then. not sure :(

Yes, it has left from Chicago to Phoenix but why would two lockboxes have it and why all the touches?


Only thing I can guess is perhaps a bit of a backlog. Maybe chicago was so busy, that before sending it onto CSC, they sent some to phoenix? Not sure really. If you called and found out its there, could you cheekily ask them why maybe? :)

But I wouldnt worry too much, Im sure CSC will get it soon :)
