If the USC is the agent then the USC gets the initial appointment letter, my question was whether or not my wife and step daughter will recieve anything from the embassy. If you are the agent you get the first response from the NVC about the interview with the cr visa.

I didn't received anything from NVC about the interview date. I had to call NVC to find out about about it. I did however received a letter that my case was sent to the US Embassy (not interview date). From there, my wife received the appt letter & packet. I guess we all have procedures run a little differently now days.

What is the procedure for getting the actual green card after entering USA? Is it only a matter of immgration officials at your point of entry putting your date of entry into a computer somewhere and having it sent in the mail? How long does it take? Is it possible to travel out of USA before getting green card? I ask this because my wife's mother is seriously ill. My wife wants to be able to return to Ukraine at a moment's notice.

She can travel on her CR/IR visa (it serves as temporary I-551 evidencing permanent resident for 1 year). It varies around 1-4 weeks to receive green card.

Hey everyone. My I-129F was just approved. From what I understand now it goes to NVC and then to the embassy which takes really very little time, maybe less than a month. We are also waiting for the DS-230 to arrive, it hasnt yet. Both CR1 and K3 processes are going on at once here. Is there anything I need to be concerned about? Is it possible they will generate 2 interview dates or how does that all work? I am thinking that the K3 paperwork (I-129F) will reach the embassy here before we receive and submit the DS-230. How does that affect our case?

I am also thinking that if we can can save at least a couple months time by the K3 finishing up quicker, we are just going to go for it because we really want to get back to the US.

I may have read the guide wrong, but it appears at even this stage in the game, the K3 will get done faster. Anyones input on all this would be great! Thanks all!

After I-129F approved, it will be stuck at NVC for about 2-4 weeks then sends it to US Embassy in Manila where it can be stuck there for 2-3 months just to schedule an interview date.

After you submitted the DS-230, it will take about a month for case to be completed then interview date 3-4 months later.

If you should have two interview dates, take the CR/IR interview.

3 months before the end of the 2 year mark, you'll need to apply for removal of conditions. The CR1 visa (green card) is conditional for 2 years, after you successfully remove the conditions your wife will get a 10 year greencard

After you submit your I-751 package, you'll get the I-797 document stating that her green card has been extended 1 year until she receives her 10 year green card.

My I-864 has cleared and the IV Fee check should be getting cashed this week. So I'm getting the DS-230 ready to send in and I plan on using the shortcut method to speed things up. Can anyone confirm just exactly what needs to be sent in to the NVC for this? Our consulate is Guangzhou in China.

Will I just be sending in Part I of the DS-230 with my wife's passport biographic copy? Or does China get Part I and Part II (no sig on part II)? Anything else besides this?

You need to send in DS-230 Part I -only-. You can submit a photocopy of the biographic page of the passport if you'd like, though this isn't necessary. Don't send in DS-230 Part II to NVC.

ITR? Not sure what that is. How does one prove an "official" declairs it genuine? Wouldnt that just be a notary with his\her notary seal? Still confused.

its only been less than 2 weeks (10 days to be specific) since the day they received my ds-230...My question is..does it mean my case is complete @ the NVC and anytime they gonna forward it to the US embassy in manila? this might be a stupid question and i may be skeptical but i dont want to put my hopes high. im expecting a message like Your case has been forwarded to the US embassy of your country or the likes.....or maybe something like Your documents have been reviewed and appoved.i called the NVC but the automated system is not updated yet.i will only be able to talk to an operator on monday..im confused. :unsure:

Back in late 2004, my case was completed and I had the interview date in about a couple of weeks later. This time around, it's taking 2-3 months just to get an interview date. (possibly back logged) When you do find out about the interview date, that's the time your case is sent to the US embassy.

My wife and 20 year old step-daughter got their K-3 visa. Now USCIS has denied I-130 for my step-daughter because she did not become my step-daughter before she was 18 years old. So other in words, she can come in the country but she can not become a resident. Is there any way around this??

There is nothing you can do.

Here is the scenario:

1. You are lucky that you got your stepdaughter in the country, because she was eligible for a derivative K4 visa.
2. You cannot petition her as an immigrant because she turned 18 before you married her mom.
3. The K4 visa is good for 2 years, renewable up to 10 years. During that 10 years, her mom can petition her daughter after her mom gets a Green Card, but the quota wait will be a few years. In the meantime your stepdaughter needs to get a U.S. citizen husband.

Hey there boo, yes u can go to st lukes without a packet 4 yet!!! I think u have to call either US EMBASSY call center or St LUKES and let them know that u are planning to pick up ur packet 4 at st lukes. Im just done with my medical (eventhough my schedule is on april 10th) everything went all well... thank god!!! just prepare ur passport and passport/visa pictures. and of course ur $96. =)

Just to add...you can bring a copy of your NOA-2. Some did get in with or without appt letter or NOA-2. My wife witnessed 3 girls being turned away because the lack of appt letter or NOA-2. St. Luke's only accept peso equivalent of $95.

I have the same Medical and Interview schedule (April 20). I will have my medical exam early, I am planning to have it either on the 3rd or 4th week of this month. Don't want to do it after Holy Week (maybe they will be busy because of the holidays and backlogs) and I need to time it before/after my period (red flag days). If you still don't have your packet and would want an early medical, you can call St. Lukes for a packet pick-up and schedule with them your medical. But if you're not in a hurry, you can wait for your packet to arrive.

Story so far - we are both resident in the UK
Filed at Carolyn's last place of residence (Nebraska office covering Wisconsin) per USCIS London instructions.
They sent it to California who sent it back to us in The UK saying file in London

We file again in London and they send it to Nebraska who send it to California
The application has our UK address on it but with a covering letter saying it has to go to Nebraska but the house in Wisconsin is sold and please do not send ANY correspondence there - send it all to the UK
Ok now we wait a month eagerly greeting the mailman to get NOA1

Yesterday Carolyn called California - a chap answered who was the supervisor but could hardly speak English.
He said the USCIS cannot send NOA1 to an address outside the US so they had sent it to the Wisconsin address even though they knew the house was sold and had new occupiers. It bounced from the US post office and they have put our case on hold. He can't send us a NOA1. If she had not phoned the application would have stayed on hold until it expired and nobody would have contacted us !

NVC accepts the DS-230 as is, whether it's signed or not, or signed by the immigrant or the agent or the petitioner. Since the document will be at the interview, I assume the immigrant could sign it there in front of the consular officer.

The DS-230 Part I has to be signed by the applicant not the agent, not the petitioner. The DS-230 Part II must be signed in front of the consul at the US Embassy so leave part II unsigned. You don't want the risk of signature fraud.

NVC won't accept a faxed copy, photocopy, etc. You must send the original. They will be looking for fresh signature pressed through the document.

My question is : do I have to take the medical exam AGAIN? (blood test, lung x-ray, vaccinations...) because I've already done all these just before I took the K-3 interview in October!! (I was issued the 221(g). Up to now, K-3 is still pending due to A/P in Washington DC)...

I plan on marrying my fiancée in the Philippines and file an I-130. My income here in the US was $10,000 for 2006. Will the US embassy in Manila accept my real estate assets as meeting my income requirements? I have no mortgage and own it free and clear with a value above $210,000. I am wondering if the US embassy in PH is stricter about accepting assets.

I will file the I-130 in July and my 2007 income will meet the requirements but will be partly capital gain income. How will capital gain income be treated if it is half the income to meet the income requirement?

Equity in a home, for the I-864 Affidavit of Support, is hard to support and document. Just providing an appraisal to show value of an asset will not persuade the reviewer that you have the cash available to support your wife.

Capital gain income, if from sold investments, is a legitimate income source on both the tax return and for sponsorship income qualifying.

my husb did pay for the i-864 after it was generated he called up nvc and found out that

1 ) my question is which i-864 form should he fill

we have paid our all taxes up to date and above povert line

he is leaving for india to see me within 10 days we dont want to slpw the process howeveer

can he send the downloaded and filled up i-864 as soon as the 70 dollar fee is received ?

2) does he need to put barcode sheet or what above the form ?

3) does he need to send the xerox of tax returns ?

4) what else is required ?

1. Click here: http://www.uscis.gov.../form/I-864.pdf he can use the download I-864 but he needs the barcode sheet. Might as well wait for it or you could use James short cuts.

2. Yep, he needs the barcode sheet from NVC. If not submitted, it can cause delays.

3. Yep, his 2006 ITR

4. Also, he needs to fill & return the federal tax data sheet that came with the AOS packet.

Thank you so much for all the assistance.... my wife got her visa approved today after her interview at the Manila US Embassy. Our appointment time was 630AM and we were finished by 930AM.... the pre-interviewer was very nice and helpful, and the US consulate was extremely friendly.

Two things that might happen:

1. As others said, it will be transferred to Chicago address

Technically, the consul just want to see if the petitioner files taxes. What you really need is employment letter and recent paystubs to determine your income.

When it comes to PI, there is a 90% denial rate. Back then when they were issued tourist visas, most of them never came back home. US embassy is very strict this time around.

Ok. Both the CR1 and the K3 are filed. Once either or both are accepted, do you get to choose which one you want, how does that work. Which one gets them here the fastest is really the one we want. We don't mind waiting on a greencard, as long as she waits here.

So what steps are taken once they are both approved.

If you want to bring your wife to the US faster, K-3 is the way to go.

K-3 process takes 6-9 months or even longer.

CR process takes 12-15 months or even longer as 24 months. (depending on how you respond to NVC correspondance)

Hello, My husband and I got married last September in the U.S. and he submitted I-130 in late February. We have received NOA-1.
I am not living in the U.S. nor in my native country (where I have my passport from), but living in a third country due to my work.
It seems like it would be difficult to time my flight to go back to my native country for the interview. It would be much easier if I could just go to the capital city of the country that I work in now and be interviewed there.
My questions are:
1. Is it possible to be interviewed in a third country? Any delays, difficulties, additional forms expected if I decide to go this route?
2. I think I put my correspondence address as my parents' house in my native country. Whom should we contact and any forms we should send so they will know to mail all correspondence to my current address (in a third country) and so NVC will send my materials to the embassy in the third country? Any trouble that can be foreseen from making this change?
3. If I decide to be interviewed in my native country -- but don't want to wait until the last minute to purchase the flight (since it'll be more expensive), but don't want to delay the interview date much, when would be a good time to start looking for flights? For example, when I receive packet 3, or when I get NOA-2, etc. etc.?

That's another question I have. Has anyone had any problems getting their SS card in the mail if you checked the box on the DS-230? Is this advisable to do or should the beneficiary apply for a SS# here in the States?

If the beneficiary does not receive the SS card, follow up with the SS office.

My Wife rein arrived on a CR-1 Visa on April 10th, We applied for a Social Security number on the 14t at the local office, but now we dont know what to do. What do we have to do next, we were very sure of ourselves with visa journeys and assawa sites help but now we are very confused. and calling uscis didnt help much, the operator sounded more confused then us. From what i gleaned we need to file a I751, but talking to Uscis makes me think we need to file a I-485 first for a green card, then wait for the green card to nearly expire(ninety days before) and file a I-751.


PLease help, Rein is here on CR_1 visa which she entered USA on April 10th, we filed for SSN# at local office, and now we need to know what move to make.

Don't you know that you'll get your green card after your arrival in the US? When you do receive your green card, look at the expiration date. 3 months before your green card expires, you'll file the I-751 for the 10 year green card.

have ur hubby prepare the affidavit of support and the required docs as early as now and send it to ur MIL
and also on ur part, prepare the DS-230 and the required docs and send it to ur MIL
so when time comes that ur Agent has to send it, she can send it right away :thumbs:



regarding the AOS, we really want to do that, preparing the package as early as possible so that my hubby can send it now to my MIL, but our concern is the Authorization for Release of Federal Tax Data that my hubby has to sign which is included in the AOS package. Do u think he can download and print it and just delete the barcode and then when the orgininal form arrives, my MIL will jst cut it off (barcode ) and paste it to the one my hubby previously downloaded and printed?Do u think it's ok for us to do that?

This is why the paperwork gets so chop-suey, especially when your husband is on military deployment. The federal tax data is required from NVC. Have your mom-in-law send it to him. It's better to be patient than to get an RFE.

My hubby is currently on deployment...
We are waiting for the AOS bill to come...
My mother-in-law will take care of everything...
My question is, if the bill arrives, is it ok if my mother-in-law signs the money order? Or is it necessary or is it "a must" that the petitioner signs the money order? We have also acquired a power of attorney. Do u think it will help?

Tell your mother-in-law to use US postal money orders. It doesn't require to sign. Just to fill name & address.

ANyone do an IR-1 through Manila? I have a friend in CDO that wants to come back to the U.S. and bring his wife. If you can give me assistance on what he needs it would be greatly appreciated.

Even though, DCF is not available in the Philippines, he should contact the US embassy to see if they will accept DCF. If not, he'll have to file I-130 at one of four service centers (depending where the US citizen's home is). He'll have to prove his domicile in the US.

Hi everyone! My wife has already passed the interview, and we got her visa already. I would just like to know is the envelope supposed to be cut at the top right corner exposing the documents? I am so careful about this "envelope" but I would just like to know if it does arrive like this for everyone else as well.... especially for the ones in Manila. The envelope itself is SEALED, but again - the right corner part is EXPOSED...I sure hope that's intentional.
