Hi,

I have a question about the travelling evidence.

we travelled to Chicago few months ago together, I was going to attach that as an evidence. My question is we booked our tickets online, and we dont get the regular tickets excpet half of the checking receipt, I was wondering what shoulde we submit, is that half check in receipt enough? (it has name, dates, city, gates, time and seat number)

do we also have to show the tickets order confirmation printed from internet?

Hi everyone,

I filed in January to Nebraska Service Center. On April 1 we moved from Oregon to California. I changed our address online, got the confirmation letter in the mail about a week later.

Does anyone know what happens to the actual petition? Does it get sent to California for processing or does it stay in Nebraska? When I check the case status online it still has the same LIN-number. I am wondering since CSC seems to be very fast compared to Nebraska.

Why don't you call USCIS to find out? No matter where your petition is at, you'll get your green card.

Removing Conditions on Residency General DiscussionI-751 approved but approval never received!

Hi all,

I am the husband of a US citizen, with conditional permanent residence obtained through Direct Consular Filing (Sydney, Australia). After I submitted the I-751 and an additional I-797 (request for evidence) to the CSC in August 2006, I heard nothing at all from USCIS. In March 2007, I called the USCIS expressing concern at the prolonged silence and they told me that I would hear from the CSC within 40 days.

Sure enough, I received a letter today from the CSC saying that my case was approved and an approval notice was sent on September 15, 2006. Whilst that is great news, I did not receive the approval. I can only assume it was sent, but I certainly did not receive it. Apparently I can request a duplicate by submitting an I-824 (Application for Action on an Approved Application or Petition) but there is a $200 (!) filing fee. This seems exorbitant...

But do I need the approval notice at all? I assume the approval notice included the information I need to get a new green card. Is this approval letter the same for all applicants? Or is it "personal"? And would I need to include a copy of the approval notice, or a receipt number, on my green card application?

Or should I resign myself to forking out $200?

Did you get a letter for your biometrics appointment? If you did and you were approved on Sept 2006, you should've gotten your green card before 2007.

I will need to remove my conditional residency next Apr. By then,my USC husband and I have been married for 3 years.

But since we were met 5 years ago, we were residing in China most of the time. Would it be a problem since most of our evidences of being together are overseas?

We do have joint rental contact with landlord,monthly untiltity bill with both of names, same address in the US. Joint tax return filling. Joint Bank account. Take the same flight to travel with seats next to each other, stay at the same hotel when we travel. Lots of pictures being together, being with family, taking trips. Mails from his mother and uncles to both of us.

Would these be enough evidence?

How long will it take to approve and how long will I receive my 10 year green card?

Hi fellow members,

I am a conditional permanent resident (CPR) card holder. I got my CPR card in June 2006. Due to some personal family reasons I am planning to go to my home country next month. Due to some personal resposibilities I need to attend to while I am there, I am not sure how long I will have to stay overseas. There is a very likely chance that my overseas stay will be for more than 6 months. My CPR status will be expiring in June 2008. I will be definitely returning to the US by April/May 2008 and file I-751 along with my husband to remove conditional status.

Do I need to apply for a re-entry permit? I looked at the instructions for I-131 form and it says

"If you are in the US as a permanent resident or conditional permanent resident, you may apply for a reentry permit. If you stay outside the US for less than one year, you are not required to apply for a reentry permit. You may reenter the US on your permanent resident card (Form I-551)".

Has anyone been in my situation? Please help! :help:

I got my conditional green card in September 2006. I was just wondering, since you have to apply for the 10-year green card 3 months before the conditional one expires, how long does it normally take to get the permananet resident card? Do you normally get it within the 90 day period? What happens if you don't? I will lose my driving license since this expires the same day as my conditional green card.... :unsure:

Also, this summer I am planning to travel for the first time out of the USA since arriving here on the K1....I'm kinda nervous! What do I need to take with me - just the passport and green card, or all the other visa documents too?

When you apply for a 10 year green card within the 90 days before your conditional green card expires. Since your green card will expire on Sept 2008, you would file sometime in between June 2008 to Sept. You probably will receive the green card in about 2-4 months.

When you send off the I-751 package to USCIS, just like any other petitions, you will get a NOA. This NOA is a special document (which extends your current green card for 1 year) will allow you to work or continue working and traveling.

There is another NOA which is the biometrics appt letter (in about a week later). You must appear for finger printing and photo.

We have a child together and this is the evidence we are filing. Any ideas on whether it is enough?
• Copies of the passport and green card of alien resident;
• Copies of our daughter’s birth certificate,XX;
• Two original letters written and notarized by U.S. citizen friends, attesting to our relationship and marriage;
• Copy of joint tax returns that were filed for for 2005 and 2006;
• Copy of joint bank statements from 2005, 2006 and 2007;
• Copies of our joint car insurance policy.
• Copy of the title of our car, showing joint ownership.
• Copy of our American Express Card showing a joint account.
• A copy of our itinerary for a vacation that we took in December 2006.

Anywhere from 2-4 weeks or longer depend on how far you live from CSC or other service centers and on what method you send your I-751 package. If you send by regular mail, expect the letter around 4 weeks.

We received a letter from the Vermont Service Center stating that a review of my wife’s immigration record shows that the marriage through which she gained conditional residence status was entered into more than twenty-four months prior to her admission or adjustment as a permanent resident. She should therefore have been admitted as a permanent resident without conditions. Our request for removal of conditions was terminated and we were instructed to send an I-90 form marked “D” to the Texas Service Center for further processing.

As per these instructions we completed the form and sent it to Texas. We included a copy of the letter from Vermont. We then received a reply informing us that we need to supply additional proof than an error was made. This proof includes an explanation of the error, other supporting documents, and the original incorrect I-551 card.

I followed these instructions and sent in everything except the original Resident Card, as this is really my wife's only form of valid US photo ID. My documents were returned to me again instructing me to send in the original I-551 card.

Has anyone been through anything like this? As silly as it sounds, I'd like to know if it's okay for me to send it to them. And also, do you happen to know how long the Texas center processes issues like this?

When you're a permanent resident (green card holder) of the US, you must apply for a visa. Only US citizens do not need a visa unless he/she is planning to stay for more than 90 days.

Me and my wife didn't have to attend the Pre-marriage seminar because we did not get married in Catholic church. We got married in the Civil Registry before a judge. Had we gotten married in the church, then we would be required to attend the seminar.

This is a quick update. I was just able to reach the NVC and they said the AOS fee bill (I think thats right? 380 Dollars I believe) has been generated so we are waiting on that. Also they said they are waiting to receive my AOS forms. I wrote my lawyer because I wanted to know if we should send those in. Still no reply. Should I send in all my AOS paperwork now? Even before I send in this fee? Any issues with any of this?

The AOS fee is $70. The IV fee is $380. When you pay the $70, you'll get your AOS forms. After that, send the AOS forms back, after that, you get your IV fee bill ($380). After you paid that, they will send you the DS-230 forms.

At this point, for I-130/CR/IR, about 4-6 months depend on how your husband handles the NVC paperwork quick enough. For K-3 at this point, about 4-9 months.

To use the filing status Single you have to be unmarried as of Dec 31st 2006, to file Head of Household you have to be divorced or hold a legally binding separation agreement and have a qualifying dependent...

The correct filling status for someone married to a non-resident alien should be Married filing separate or Married filling jointly... you can reduce your tax liability by filing married jointly all you need to do is request a ITIN from IRS for your foreign spouse at the time of filling or before....

You don't need to do a thing about the NVC. Don't send any more correspondance or fees to NVC. Your wife is here on a K-3 so what you need to do is send a copy of the I-130 NOA-2 (Approval notice) and send it with the adjustment of status package (I-485).

The I30 has my name as the petitioner and my wifes name as the beneficiary.

But... the I29 has my name as both petitioner AND beneficiary.

Back in my days when I sent the K-3 package, I mailed it to the MSC. It's ok, the MSC is the home to mostly K-3 applications, EADs, Advanced Paroles, etc.

From the instructions for form 1040:

If your spouse is a nonresident alien and you file a joint or separate return, your spouse must have either an SSN or an ITIN

It's normal. Those are for persons who are going on a ASC biometrics appt. It has a unique barcode on it.

No I'm not Filipino. Yeah go check them out. It's better than so you won't have to search too much. We even have an immigration expert on board.

If you had lived for more than 6 months in another country, then a police certificate is needed.

Hi. This is a really nice site. I've been looking at the Processing Times and Timelines for the K visas. It seems to me that the times for each are about the same and what really makes the difference is the time of application, the fiance's country and to which service center it is sent to. Am I right? If so, would it be just as well to marry in the fiance's country? It won't take much longer, would it? I think marrying first would be nicer.

Most of the petitioner's petitions get transferred to California Service Center except for the eastern part of the US stays at Vermont Service Center. Plus, it depends on if your fiance will file petition right away. K-1 route usually between 6-9 months, K-3 around the same or more and CR route around 12 to 14 months.

Just a little update. I was able to walk into my satelitte center without an infopass, but there were signs everywhere saying that infopass had priority. I don't know if it was that no one was there, if I just got lucky, or if my center is just small. The person I spoke with though didn't really know what to tell me. She told me she would e-mail Vermont about my case, and they'd get back to me. I'm gonna hold my breath starting now........

Thanks for all the insights..just some clarifications in here and I hope the consul will also take into considerations the following;

first, If my only reason to go to the US is to be an LPR, then why on earth I married someone who was still in college and was not financially stable and who can't even afford to petition me right away?why didn't I chose to find a financially stable USC, have him petition me as a fiancee, get married out there, adjust my status then maybe divorce him after i get the permanent greencard?...why wait for 5 years for someone who can't even afford to buy a plane ticket to visit me as often as what other people see as the way should be?..long absence may not be the normal way of things specially in a relationship but then somehow what's REAL (REAL love and REAL commitment) seems to appear as beyond what is normal.

second, I have a good banking career here..why would i be so giddy to jump on a plane to fly to the US knowing that my husband is not yet financially stable out there and can't afford to support the 2 of us? Why would i demand him of things he cant afford and beyond his control? Isn't it sticking with each other and understanding each of our own limitations and flaws all through these years enough to prove that what we have is a genuine marriage?

third, I dont understand what immigration laws you're talking about that we're trying to "circumvent" in here..as far as we know we married in good faith.

Bottomline is: my husband wasnt ready financially in the past..he is now and we're giving it our best to make things work at the immigration..and with all the prayers and good intentions, nothing is impossible.
