I-134 Affidavit Support Questions

I am about to prepare my I-134 and am planning on attending the embassy trip with my fiancee. I am a full time student with a I.T summer job in a private school with the possibility of being promoted to work there permanently if approved by HR. I wont know the answer to that until next month. I have only been employed at this current job for 3 weeks and before this current job I was employed at the same school but as a summer camp counselor. I have worked as a camp counselor at the school for the past 5 years every summer. The list of supporting documents that I am planning on taking from both affidavits (me and my dad) are the W2s,Tax Transcripts, my dad`s letter of employment, my future letter of employment (if rehired) and our 1040s. I have a couple of questions in regards to this matter.

-My father has agreed to be my co-sponsor but he has filed jointly with my mom do I only list my father`s income? Is he required to list his assets?

-As many of you know a student doesn`t have much assets only ones I could think of is my computer,laptop,clothes and my car then again I am not dependent from my father. Am I required to list my assets even though I am using a co-sponsor? If so am I required to provide proofs of the assets such as receipts? I`m not sure if I still have the receipts only one that I may be able to show is my payment history from my car.

-My boss has told me that if HR hires me they will wait for me to start work until after I get back from Pakistan. Would a letter stating that I will be employed on the date that I get back be equivalent as a letter of employment?

-Before the 2011 summer season started I was working with a private video company since September 2010. If I don`t get rehired at this current job would a letter stating my wage and position from the video company be necessary?

-Is it necessary to show my previous paychecks as well as my father`s paychecks? How about bank statements?

No combining of incomes with the I-134. One parent completes the I-134 and supports their individual income claim with recent paystubs and an employer letter.

I would focus on dad if his income will cover his household plus the immigrant. For mom being self employed is going to take more work to separate her income on their 2010 tax return.

Only one is required. But if parents signed one Income Tax Return then the supporting documents for both parents have to be sent. But just incase, let each parent fill out a I-134 form to be on the safe side. After my I-134 was rejected, I sent 2 affidavits of support, my dad's (including supporting documents from my mom) and my counsin's. (whichever works best for the embassy, but they take into consideration only 1 income). But let me give you a tip: find one co-sponsor with income no less than $50000 per year with household size of no more than 2. Mine was way more than poverty level and it was rejected.

Yea my parents tax returns have been filed jointly so I assume I will be needing both of their affidavits as well as their supporting documents. My dad works for a private school but my mother is self employed. What documents are needed for someone that`s self employed?

The Islamabad Consulate info page on VJ states there is a 'parental information form' to be submitted as part of Packet 3.

Does anyone have a copy of this form or is it available online?

Visa refused - Blue form with 221g given - Update

Since they have the passport I would recommend for her to submit it via courier service. Its a good thing that I checked your thread because I will be going through the same thing where my father will be co-sponsoring me but he filed jointly with my mother. Many have said here that its not necessary to provide documentation from the person that filed jointly with your main sponsor but based on your thread it seems that things have changed. I wonder if they will be needing the supporting documentation such as the joint sponsor (sponsor`s spouse) tax transcripts and W2s.

I-864, Affidavit of Support

Consulates usually want an I-134 affidavit of support for a K1 visa. The primary sponsor (you) has to submit one, and the joint sponsor also has to submit one. The I-864 is generally only for immigrant visas. Only submit an I-864 if the consulate specifically asks for it.

The I-864A is only for a household member who is combining income with a sponsor to help the sponsor qualify. If a sponsor is submitting an I-864, and has another person who is a dependent on their tax return OR is a qualifying relative living in the same household, then that other person could submit an I-864A to join income with the sponsor. The I-864A can't be used with a sponsor who is submitting an I-134.

Your friend is confused because the requirements for a spousal visa are different from the requirements for a fiancee visa. He probably had a qualifying household member who could submit an I-864A to help him qualify as a sponsor. But someone who signs an I-864A is not a joint sponsor. The I-864A is a contract between the sponsor and the household member.

For someone who has a father that filed his taxes jointly with his mother would a I-864A be more suitable than a I-134?

Birth certificate has minor mistakes

Hi guys

So far we have made progress. My fiancee just got her police and new birth certificate. The problem is that the agent misspelled her father`s first name in her Birth Certificate. Its very minor since he misspelled it by 1 letter. Her name in Urdu is also misspelled by one character. Will there any problems? Her full name in English and her date of birth is correct. She will be sending packet 3.5 on Monday morning.

Noticed on DS-156K a birth cert. is required. However, i think a copy would suffice..

I thought that too but when I emailed the embassy about it they said that the original was required and that they will give it back once the interview is done. You can go ahead and call the embassy to double check but we went ahead and sent it anyways as we didn`t want to delay our case any longer. The good news is that they received it and are currently processing it. There has been cases where they sent the packet back for missing documents from the email cover letter.

All of the evidence and financial support can be presented on the day of the interview. Packet 3.5 is the main process to apply for the K1 visa. Packet 4 is just a letter giving your fiance(e) the interview date as well as giving the OK on scheduling the medical exam.

They will give you the original back with your fiance(e) passport after the interview. Your fiance(e) has the choice of sending the affidavit of support with packet 3.5 or at the interview. We decided to hold off on the affidavit until the interview.

Hey Workaholic here`s what I was told to send..

-DS 156 (2 copies)
-DS 156K
-DS 157
-DS 230 (Only complete part 1)
-Parental Information Form
-Original Police character certificate from all the cities from where your fiance(e) has lived for more than 6 months after reaching the age of 16 (provide a photo copy as well)
-Original Birth Certificate (provide a photocopy as well)
-2 passport photos (2x2)
-Copy of the first 2 pages of your fiance(e) passport

The Birth and Police certificate must be in English if they aren`t then a translated copy is required to be sent

Update: I called DOS again and the agent gave me a much more thorough answer. She stated that on the system it shows that they received form 230 part 1 and since that was sent with packet 3.5 they already must of gotten it.

Got interview date but no record of receiving packet 3.5 from Islamabad?

Good morning everyone

On Tuesday very early in the morning I sent a email to the embassy asking to see if they received my fiancees packet 3.5 as well as set up a interview date for us. Several hours later I called DOS and a agent told me that we have a interview date of Nov 18 2011 and that my fiancees packet 4 has already been delivered. Later that day I called again to reconfirm and a different agent told me the same answer.Now this morning I received a email replying back to my previous email that I sent on Tuesday stating that they haven`t received packet 3.5. I called DOS right after I received the email and it still showed up with the interview date of Nov 18. The agent recommended me to call the embassy as well as to email them the tracking number. Has this happened to anyone?

Even in Peru the legal age for a non minor to date a minor is 18. USCIS may not say much but I can see the consulate asking you a lot of questions. Check with a lawyer before you proceed

Mohsin like how I stated in the email the proof of engagement as well as the financial documents that goes along with your I-134 will need to be shown at the interview. There is no need for you to submit any proof of engagement or any of the I-134 related documents with packet 3.5.

dj- I see you have a wedding planned for February 2012. I don't have the cajones to do that. It's one disappointment that I could handle if things got extended for many months, but the idea of having to cancel a wedding, etc... brutal in my book.

Now that we`re on the same subject I`m sure me and the OP would be interested in knowing what packets to have ready while our application is processing. Now that my summer break is here I want to try to get as far as getting the interview packets ready. How do I accomplish this? I`m hearing a lot about DS forms where do I get that and how do I know which DS forms I`ll need for the Pakistani embassy? I`ve heard obtaining a police record takes about 3-4 months to get would it be wise for me to tell my fiance to request a copy of her police record now or is it best to wait?

I was told that flight itineraries are not proof of having met in the last 2 years. I was going to send in all my flight itineraries over the last 2 years... about 40 itineraries in all and I was advised here that it's not proof. Boarding passes and flight itineraries are not the same. Flight itineraries don't prove you got on the plane. Passport stamps should do the trick for you. Just passing along the advice I was given when I was putting together my packet.

Alright I have checked several (approved visa) VJ Pakistan timelines, especially the most recent 11.

Good news for the folks applying, no need to worry at least 4 or 5 got their Visa within a 3 days of the interview and the average looked like it was 200 days or less from NOA1. The others got their Visa within a month or 2 after interview. I flew thru the others and there were a couple that waited nearly 2 years.

But looking at it I would say for recent petitions anyway, it doesn't look like mandatory APs, more like what you would expect out of any embassy.

Well I guess I couldn't leave this one alone cause the Cyprus embassy is just south of Turkey and if there was even a possibility of something like a mandatory AP it would annoy the heck out of me!

You are awesome thanks for researching the info for us. So just to clarify people have gotten their visas 200 days after NOA 1 was sent correct? Hopefully my fiance wont be the one getting her visa within a month or 2 after the interview :hehe:

Anyways this deff looks like great news since I`m hoping to have my fiance here by January or February if all goes well.

OP- I just sent mine off in the last 2 days as well (fiance in Colombia). Mine was close to 300 pages also. You should be fine as you mentioned sending passport stamps. But 7-8 months? Doubtful. It's taking 6 to 6.5 or 7 months now for NOA2's at VSC, which means at least 9-12 months total, no? I assume by the time they get to the April filers it will take 9 maybe 10 months for the NOA2s? At least that is the trend. I'm planning on at least a 12 month process from the day I get the NOA1

Djstorm... is that all you sent? I read on here that itineraries mean very little. Passport stamps, boarding passes, hotel invoices... that's what they're looking for in the "havving met in last 2 years." Gathering from what I have read... itineraries and Visa, not sure I'd say that's going to work based on what I've read.

Flight Itineraries can be used as the equivalent of a boarding pass. Visas are proof that you`ve entered the country. Anything that validates that you`ve spent time at your beneficiaries country are items that can be served as proof that you`ve met each other within the last 2 years. I forgot to mention that I`ve included Passport Stamps but no hotel confirmation since I stayed over at my friends uncle`s house. Good luck to you too!

Seems like me and you will be on the same boat since I sent my petition on April 26th as well. They received it on April 27 and am awaiting for my NOA1. I agree with the above although I`m the type that believes that the more you send the better chances you may get but you wont really be needing all that until the interview. Its best to record everything you do now until the date so you can show them new evidence as they may be interested in that too. I only sent them my copy of itinerary,Pakistani visa, phone card bill of this year,facebook convos of this year,8 pictures,letter of intent,engagement receipt and a 1 pg letter on how we met and became engaged.

Medical Examination

Your fiance will take her medical results to the interview with her on November 21. When the visa is approved the medical and petition documents will be placed in a envelope that your fiance will be instructed not to open.

When she reaches the POE, CBP will open her envelope, tell her to keep the X-Ray CD and process her visa.

No other documents are needed until it is time for AOS.

No - there are no doctors at the airport!

Medical Examination

Hi everyone

My fiancee was just recently given her results in a sealed packet along with a CD that`s filled with X-Ray results. She was obviously told not to open any of the items that were given to her. The doctor told her that the doctors in POE would open it (didn`t know they had doctors in the airport). Anyways when does my fiancee start filling out these forms? Are these forms not required for the interview?
