They will not consider future offers of employment. When is your interview?

at any rate, they are not offering you "employment" they are hiring you as a contractor. You are self employed. You can claim to be self employed right now and use last year's tax return as evidence. You do not need anything form this company if you claim to be self employed.

I presume they send you a 1099 form at the end of the year, correct? Make sure that is attached to last years income tax return.



My fiancee`s interview is on the 21st. The guy who owns the company is self employed and I will be working for his company. Yes he did give me a 1099 for 2010. So for now on the I-134 I should only put full time student and just show them the 1099 and the future employement letter he gave me correct? So I assume that on the income I should put 0 as I am currently not working for anyone right now. As for the 1099 he handed it to me late so therefore I will be declaring that 1099 for next year`s return.

Here`s my situation. I have been employed with a video company from Nov 1, 2010 until June 13 , 2011. I then went to work for a temporary summer job until September. Now my boss from the video company wrote me a letter to give to the consulate as my guaranteed placement of employment for December. This is what he wrote


To whom it may concern:

This letter serves as a confirmation of employment for Mr. XXXXX

Mr. XXXXX worked as a freelancer/contractor with our company from November 1, 2010 to June 13, 2011. His role within the company was to manage videography work and was paid a salary of XX per hour.

Mr. XXX was asked to return to his position on or about the first week of December 2011.

Now I noticed that on Question 7 it says to state the job that you are employed or engaged in the business of.. Would it be ok for me to add the video company on question 7 since the letter will prove that I will be employed in December? I assume that`s what the engagement part of the question means. I would also like to know what do I put under income in case its ok for me to disclose the video company? I am currently a full time student at a community college and will continue to be so within the next year. In case I`m not able to disclose the video company what do I put on the affidavit since I`m a student?

There is no need for you to worry my fiancee passed the interview and the CO told us that she would get her visa within 7-10 business days. When I called DOS on Friday the operator told me that my fiancee was on AP. The only difference is that our CO kept her passport. Don`t lose hope! Most AP cases result in approval. The only downside is the waiting.

Talking out of experience when my fiancee told the CO that my mom was present his expression changed and said "Oh wow" with a big smile on his face. He asked for both me and my mom`s passport and said "Very well this will be a short one". No proof of evidence and financial docs were found. I assume that he didn`t ask for financial docs since he knew that if I wasn`t making much money my mother`s presence proved as a major support. In the end I feel that if my mom wasn`t there my fiancee would`ve been questioned more.

If the DNA test for the USC father (the ex-bf) is negative, or even if it is positive and she has no proof of it, and he refuses to acknowledge the baby and file for its passport, then the baby will not be able to claim USC at birth. If the DNA test is actually negative then that guy is not the father, so I am confused why she is pursuing this. The mother can try to work this out in the courts if she wants if she thinks he is the father but this will all take time.

What to do with the birth certificate, as stated above, is country-specific. She should contact someone there familiar with the laws for a child born out of wedlock.

I am a bit worried about your friend, though. This woman seems to be jumping from USC to USC pretty fast, with infant in tow.

FWIW, the petitioner's kids are generally USCs by birth, and do not need visas.


Yea the father is a U.S Citizen but he hasn`t claimed the child as his. He took the DNA Test which came out negative but refuses to hand his ex g/f a copy of the test. She is going to apply for a Birth Certificate for her child would it still be necessary for her to put the real father`s name and claim it as his on the Birth Certificate? If so what if she doesn`t have proof of the DNA test?

The baby is related to the foreign fiance, right? He simply files for a K-2 visa. He should not try to defraud anyone and pretend the baby is his. They will do DNA tests.

Hey guys! I have a friend who just got engaged in the Dominican Republic with his fiancee. He has consulted with 3 different lawyers but they all gave him 3 different answers which has confused him even more. The situation is that his fiancee has a 6 month old baby girl. The baby doesn`t belong to my friend but to his fiancee`s ex boyfriend who resides in New York. The ex claims that the baby is not his and that he already took the DNA test and the results came out negative but that he refuses to give her a copy of the test. The baby has not been registered nor does she have a birth certificate. What are the steps on bringing a fiancee with a baby whom is not blood related with the petitioner to the U.S? Would it be wise for her to register the baby and claim him as the father although he is not? Thanks in advance!

Any investigation of her would come at the embassy stage. You can list all her addresses on her G-325A but you can list this new address also. If they really check up on her at that level, which I somehow doubt, they will have to check all her addresses.

In any case, if she ever needs it, she has a valid reason why she used this new address, you just explained it.

Right I'm talking about the packet she will recieve:

You can check your embassy website, I think, to see which forms they require. Those are mostly what her packet from the embassy will tell her to fill out.


Thanks again I`ll go ahead and list out her best friend`s address as she proves to be the most reliable. So I assume that all of the forms from the embassy as well as the NOA2 will be sent to her friend`s address that I list on the K1/G325-A applications instead of her previous address correct? I wouldn`t want the packets to be sent to her previous address. Sorry for all the questions its my first time being involved with immigration paperwork. As far as the DS form I didn`t know about this when will we need to fill out the DS forms?

It wouldn't delay your application but I question the reliability of USCIS to do it. There have been posts here where the case still went to the emabassy with the wrong address. So the embassy sent the packet to the wrong address.

If you can, I would suggest use the address of one of her relatives, grandparents etc. Once it gets to the embassy you can later inform them that her address has changed, like on the DS forms.

Pay stubs apply to sponsors. You don't "state" anybody on the I-134. He provides a signed I-134 with supporting documentation and so do you. You document his income and he documents his. Tax returns document past income. Pay stubs document current income.

Yes, provide complete copies of tax returns. Generally, a complete copy will indicate which portions of income were earned by which individual but tax returns reflect past income. You also need to document current income. That's where the pay stubs and/or employer letter fit in.

Your assumption is incorrect. For a K visa, you can use only one "additional sponsor", (We commonly use the term "co-sponsor".). Joint sponsor is the correct term for later when using the I-864 in the adjustment of status process. In your case, use the parent whose individual income is sufficient, then provide an I-134 from you and one from that parent. On the parent's affidavit, state only their personal income and provide a pay stub or employment letter to document the current income. For tax return, use a complete copy instead of a tax transcript. That lets the CO see which income belongs to the signing sponsor.

The sponsor's household size will include sponsor, spouse, and dependents plus the sponsored immigrant. If the sponsor previously sponsored any other immigrant or immigrants, they count to. You only count if you are your parent's dependent.


Ohh ok so just to make sure I got all of this down, I will use my father`s income and only state him in the I-134 and in order to provide the amount he makes I will have to provide a pay stub and employment letter since the tax form shows that he filed jointly. So in this case I will still have to provide the CO a copy of the jointed 1040 tax form correct? This is the first year that my parents filed jointly so I guess that it would be a good idea to provide tax income from 2009 and 2008.

I will be using my parents as my co-sponsors. My parents filed their 2010 taxes jointly making about 64k. The only dependent they have is my sister. When 2 individuals file their taxes jointly are they considered as 1 person that made the gross income for 2010? The guideline for the I-864P poverty minimum requirement only states the requirements for a sponsor but I`m not sure how they handle people that file their taxes jointly.

He had been deported, according to the Consular that we did our interview with. We have been married 5 yrs. We lived in the US for 2 yrs and we did not remove the conditions on the green card because we were moving back to his country. He's never been in any legal trouble or anything like that, but apparently the US Embassy that he turned his green card in at, did not follow through on the process, so he came up in the system as being in the US illegal-I guess. We now know that the govt "deported him" even though we were overseas and knew nothing about this process against him. The Consular was confused by the whole mess as well and told us that they would have to research the case and get back to me. Everyone was saying that it would take a while, so 5 days is such a great feeling! It does suck that we have to spend quite a bit more money to go back to the Embassy to drop off his passport, especially when it was a govt error in the first place, but we'll do what we've got to do.


Wow what huge mistake on their part. The good thing is that everything has been cleared and your husband will be getting his visa. I wish you guys the best!!

hi 'Djstorm yea you are right the exact cost of urgent pakistani passport is PKR 4000 only but there is a lot of agent around there in passoprt office if you bypass the agent and do your process with yourself your passport goverment cost is only PKR 4000 only the passport process is very very simple and easy collect your original document your original nic indentity card your previous passport if any your mother and father identity card photo copy and your father passport photo copy go to passport office take a bank deposit slip form fill the form with your complete detail with cash amount then go to the national bank of pakistan which is near the passport office deposit your slip form with 4000 cash to the counter office take a bank stamp reciept copy then again go to the passport office again take the token number and wait for the process they fill your data in the computer and take your photo and in the end they gave you the computerized form attested the form to govt officer and then sumit this form in the passport office and then officer gave you the reciept and wait for 20 to 25 day to collect your passport

Omg you are right on point! My friends have told me to convert here but its just not the same feeling as converting in a Islamic country where the azan can be heard everyday,everywhere, 5 times a day. The feeling that you get over there once you`ve converted is extraordinarily let alone the vast amount of happy muslims whom I didn`t even know of congratulating me for my conversion while I was staying at the hotel.

Yea your right I`ll just write down a letter stating my conversion by explaining to them that this was from my own free will and not part of the marriage process. I`m well aware that I wont be able to face the interviewer so i`ll go ahead and give it to my fiance and she can show it to him/her if they ever ask about it.

My wife was converted few years ago, and she didn't changed her name that time, all she did after getting married, she changed her last name, so now she has muslim name too. i would suggest you to file with your orginal name as you are doing K1 visa, at the time of interview CO only asked me when & where she is converted.

Same here with me. I actually worked in a church setting and because the youth were getting ready to study about islam and judiasm i thought it best to read evthing about both in depth...so my research had begun before my husband and i became friends. When we did I asked him more questions and talked to him more and decided to convert. But his family had already accepted me as a christian wife to him before then...he proposed with their blessing long before i converted.

Fast forward...i flew to him to be married and while i was there i told them i wanted to convert...they reminded me that they loved me jjust as i am but i explained why i wanted to convert. So the same day we did our nikah at the Masjid...i also converted. I actually received a certification of this with my new muslim name.

We included this withour ds230 and i gave him a letter explaining simply why i chose to convert and that i knew i was accepted as a christian wife to him before my decision.

Im not sure if your situation would be the same as mine or different since as a muslim man he can marry women from the book ..ie christian and jews.... and the muslim woman is required to marry only a muslim man.



Thank you what a interesting story maybe if I would`ve gone over there to marry her and have a nikah ceremony things would`ve been easier makes me wonder why I haven`t thought of it in the first place :bonk: I understand that it may raise some eyebrows as far as them mistaking her for wanting to marry a "catholic or a christian" which is one of the main reasons why I`m planning on flying over there in hopes of showing some evidence
