i have seen so many denials with india embassy. especially where an indian is marrying a white man/woman. that they say the indian fiance or spouse is taking advantage of USC and just want to go to america. its so sad! for your case i dont know why the denied him am sure there is something u can do so dont u ever give up. maybe he can go back iraq and u guys get married and apply spousal visa

if u didnt send a letter of intent to marry indicating within 90 days of entering US definately they can not approve you. affidavit of support is for interview stage not there. i think you are not telling everything and its hard for us VJ members to help you. all the same good luck to you

I can relate to the homesickness too; I'm the USC, but I lived most of my life in Michigan, and am now in Kentucky. KY isn't too bad, and even tho I don't ever want to live in MI again, I always get that little twinge of happy every time I see a "Welcome to Michigan" sign...Pretty much my entire family lives there, so it is hard being so far away...

I don't think that my DH has any of those feelings about Canada - he was very happy to come to the US, but oddly enough I also get very excited every time we're in Canada! I really like it there! :) I do want the chance to get my citizenship and maybe to live there for a while. Now that DH is in boot camp and will be doing a job that gives him a lot of choices, there's a chance of maybe getting a post in Canada, which I'm pretty psyched for! :)

It doesn't seem odd to me at all to be so homesick - it's perfectly normal. I've never been happier to be with my DH, but our plan was always for him to join the military and we kept getting held up. I was miserable with my job and feeling stuck, and I always felt guilty for that, but one always has expectations and it sucks when they don't measure up... :) Its *awesome* that your husband is so supportive of your desire to go back to Canada - and if you both get dual citizenship, you can always come back :)

So....apparently I spoke too soon....

Just heard from DH - he was told that,while some members of his platoon will be naturalized tomorrow, he won't be! #######????????? I'm pretty pissed off about this, but also in a huge panic because he's *livid* and has talked about quitting now at the last minute!!!! I think I got him as calmed down as I could while I was on the phone, but I really hope he doesn't keep thinking about it and do something stupid...

Please, please, please, can everyone pray that he'll be able to calm down and we can address this problem tomorrow with cooler heads....*sigh* Really don't know what to do...of course there's not much I can do except pray and panic... :'(

Just heard from my DH - he passed his interview and will be naturalized the day before his Basic training graduation!!! I'm sooooo pumped to have this whole thing done and over with!! All these frustrations with USCIS and all those idiots - *never* have to talk to them *again*!!!! :D :D :D :D :D

Now hopefully the next time I do anything with any immigration, it will be the process for my Canadian citizenship!!! :D

Our lives have been pretty crazy. DH went off to the Army in May, graduated Basic and the end of July, will be at AIT until December and then I *finally* get to leave Kentucky! His service also made him eligible for citizenship, and he was told that he'd be naturalized on Family Day...then the stupid idiots revoked it at the last second - he'd already passed their interview, but they said his background check wasn't done :angry:

When I got home from seeing him graduate there was an oath ceremony notice waiting for me, of course! :bonk: Still haven't heard anything about it, but I have contacted our Senator...hopefully that will all be done and over with soon. *sigh*

I sure hope so :/ But I haven't really heard from him since he told me about this, so hopefully everything is all right.

 

I did get some good news about the birth certificate, though! In Quebec, the parents can apply for their child's birth certificate - it doesn't matter how old the child is, and they don't need any of the child's ID. I had called this morning to check that the ID I had would be accepted, and the guy I spoke to (who of course didn't speak much English) kept telling me that my power of attorney might not be accepted :/ It would be really awful to send in all that money only to have them tell me, "tough luck." But the guy did say that it would be much easier if my in-laws applied. So my mother-in-law is going to send in the form and then send the birth certificate to me. Hopefully that doesn't take too long! *knock on wood*

It would be great for him to just turn in his passport and sign something...but when I talked to my husband he did mention a certificate of renunciation, so I suspect they actually want him to go through with the whole thing :/ I haven't been able to talk to my husband much in the past few days, but I've been talking to the FRG and I think they're doing some research for me. Hopefully I can get some answers soon!

I doubt the US government would be asking for his Canadian passport...doesn;t sound legal.

 

I would think though that once renounced the Canadian government will provide some sort of documentation which would then suffice.

 

The US Government is just asking him to renounce his citizenship, and if the renunciation is accepted he'll get a certificate.

 

We've got everything we need...its just this birth certificate debacle that' holding things up :/

Your husband may already have one of the new birth certificates around somewhere because the Government of Canada (including Passport Canada) has not been accepting them for many years.  If I recall correctly there was even someone on the forum here who had to get a new one for US Immigration.

 

Do you know what it looks like? The one we have now is a laminated card with info on both sides. If I had a picture or a description, I could check with his parents and see if they have something.

The thread I remember was that they wanted him to renounce to the US Gov and handover his passport.

 

Do not assume that what they ask for is logical.

 

 

 

Ugh, ain't that the truth :/ This whole Immigration process is so far from logical!!

 

When my husband first mentioned this, he asked me to send the certificate of renunciation...which we don't have, of course. So I think they won't be satisfied unless he completely renounces everything :/

 

Now I have to try to find as much of my hubby's documentation as I can...I'm very doubtful that I'll be able to weasel a birth certificate out of the Quebec government...

I was just re-reading the instructions to make sure I didn't miss anything....and I found this little gem:

 

Baptismal certificates, birth certificates, and marriage certificates issued by the government of Quebec before January 1, 1994, are no longer accepted. If you have one of these certificates, you must obtain a new document. This can be done by contacting the office of the Directeur de l?état civil du Québec by visiting their website at: www.etatcivil.gouv.qc.ca.

And, of course, we fall into that category :/ So I had to literally tear my house apart trying to find some of my husband's old identification - of course, we figured he wouldn't need that anymore! I do have Power of Attorney, but dealing with the Quebec government is soooooooo frustrating!

I tried to call the number on the immigration page, but wouldn't go through. But then I managed to get a hold of a really nice lady at the Canadian Consulate in Dallas and she explained the whole process to me. Turns out that there is a consulate near where he is, so he can go and apply in person. That would be a whole lot easier! Hopefully he can get that done soon.

 

I am a little disappointed though because I didn't want him to have to renounce his citizenship. It's not like he's from a hostile country or anything...plus there does seem to be a double standard, since a guy he went to Basic with who's from South Africa didn't have to :/ But considering how hard it is for veterans to find jobs in this economy, I want him to stay in the Army as long as possible, so it will be worth it if he can become an officer...I just hope this isn't all for nothing :/
