I already did contact my senator and the response i got back is on my original post. We received a yellow slip not white or blue. Unfortunately my whole issue with applying again is that its going to take the same amount of time as if i just let USCIS review it. Economically right now, I can't take another trip and do a wedding right away so its going to be a few months anyways before I'm able to do that. If anyone has had my same experience and had a positive outcome after USCIS reviewed the case please let me know.


Just for the record....I applied for the K3. They were going to process it as a CR1 but the K3 was going faster so they went that route. All together this will have taken me about 5 months in total. The only difference between K3 and CR1 is - with K3 you need to married 2 years and then the spouse can apply for an adjustment of status, which will cost $1000, and then they are a permanent resident.

With the CR1, you wait longer and you pay $500 in the beginning instead of 2 years after.

Either way you'd have to be married so I'd say just get married and decide which visa is better for your situation.

I had my documents translated/notarized in one office that did both (also Spanish to English). And no, not a government certified translator. A professional can translate the papers and that is more than sufficient. Some people say that notarization is not necessary but I think that it may be beneficial if the cost is not too much. I paid $20.00 for the translation and notarization was free.

VSC is doing great right now as far as processing so you may actually see that NOA2 sooner then November. I only waited 45 days or something like that...also through VSC. Also, I've been seeing on here a lot of people going thru VSC have received their NOA's much sooner than the other centers.

yes...the visa specialists have the right answers. My husbands interview is in 3 weeks and they are still saying they dont have information in the computer....and there's a few others on here saying the same thing....but they sent me the interview letter so the information is there somewhere. They just don't do a good job at organizing things. The visa specialists will tell you if you have an interview or the status.

Hi,

I just recently became a member of this forum. I think this is a great place to share some information and support about K-1 visa etc, so I thought I should give
it a try.

We recently filed our petition for K-1 visa. We got the first NOA1, on which it said that beneficiary country of origin is unknown. Anyways we called the USCIS office about it and they said they will fix it in 15 days.

Anyways, my concern is getting the NOA2. We are under the Vermont office, and they are still processing applications from March 2011.What does it mean? Will ours get processed after all of those applications get processed? Does anyone have more information about how the processing work?

VSC is has the best turn around time in processing now. Some people have waited 3 months but compared to CSC this is great. I would trust that USCIS will remedy their mistake but nonetheless, follow up frequently with them, as I hear they've been slacking lately.

Ok so recive my appt letter for my fiance about a week ago for Nov.28 .Im so nervous that im sick to my stomach and this is just the start amagine that day how Im going to be . I understand how sick you feel. . My husband has his interview in DR on Nov 23 and I also have heard all of the horror stories. I'm very nervous but I think of it like this....we only hear about a small portion of these interviews. There are dozens every day that we get no information about that could go very well. So don't rely on what you see on here....everyones situation is different and what will is suppose to happen will happen.

You are going to the interview right?

From what I've seen on here, they return the documents when the visa is delivered. And as far as the POE, I would suggest a direct flight, especially if your fiance is traveling alone, for less stress and issues. When they send the visa, they send a package, sealed, that cannot be opened until immigration at the airport opens and reviews. SO make sure that is there and not tampered with. I myself am not at this stage yet but very close and have been reading a lot about it. But I"m sure someone else that has alredy gone through it can give you better info!

Straight answer NO.

BUT

If he has a IRS tax lien then it MAY pose a problem if his Income Tax Return is bordering the 125% poverty level, because the CO during the visa interview MAY or MAY NOT consider the IRS tax lien and deduct it from spouse's tax return.

If it's bad credit due to credit cards, late payments, etc. No they won't affect anything. They don't care about your debt. They care only what you report to the IRS on your tax returns and if you have a IRS tax lien on you.

We ended up going to the health department here in chicago after the civil surgeons tried scamming us.they had the civil surgeon there sign everything gave the vaccines all for 40 or 60 having trouble remembering right now. so try the local health dept 1st.

When filing for AOS, you can get the vaccinations he needs through your insurance at your own doctor, at the public health clinic, etc. You just need to find a civil surgeon to transcribe the vaccinations onto the I-693 for you. You will need Part 1, Part 2-vaccinations section only, and Part 5. You will need to call around until you find a civil surgeon that will do just the transcription for you. See Section III FAQ, #2 of the I-693 instructions. http://www.uscis.gov.../i-693instr.pdf

Do a search here for a thread called 'Civil Surgeons that don't rip you off' to see if there are any from your area listed there.

Ok, so......my genius husband (sarcastic of course) had his medical done today in DR. No thanks to the people there, they informed him he could have his vaccines here instead of there, thus leaving him with the money ($360) he would have had to spend. I would have preferred he had it there and it be done with but.................................my question is..............................IF he gets his visa and comes here, since we're married I plan to add him to my health insurance plan. Can those vaccines be done at our primary care doctors office, or will we have to self pay at a government mandated money robbing facility?

maybe some of you know of my situation, fiance in new delhi, had his interview august 3rd and was denied saying our relationship not bonafide. I have sought much help and emailed all over creation for help in getting second chance. We got senators involved . yet they told my sentor office we were denined still. NOW after application has expired and all hope drained.. they email me at midnite 9/1/2011 (today) we have a second interview, BUT they want me in NEw Delhi by 10am tomorrow, IMPOSSIBLE. No flight I have checked will get me there in time. I emailed them this info and am waiting, i called the embassy and got nowhere they said allow this hard fought for interview to pass then come and pay them to reactivate a nos how interview. What? i call the senators office and told them everything , they agree its not right and they dont like that the embassy lied to them about our case only to come back and give us an IMPOSSIBLE 2nd interview date. For now we wait to see what will happen as the senator office will again contact embassy. Has anyone ever dealth with this before? I have talked to a lawyer to see abt what else we can do. There is no flight that is able to get me to India that fast.. we had only a few hours notice? thats ridiculous. any other ideas?

I, just got my interview date on the 23 of this month, How long it takes for my fiance to get packet 4 with all the form to fill out , since the medical form is inside the package.


As Newbie said...the packet comes at different times and for many, never arrives. Your bet would be to wait a week and if nothing, call the consulate and ask them to generate a new packet. You will have to pick it up but at least you know you have it an the info is in the system, For many of us, the info was never in.

But my best advice to you is.....if you are ever doubtful about something like sending a paper or submitting something or calling somewhere....as us first because one wrong move can delay or screw up your journey. These people in the the visa offices are not forgiving and they are like worker bee's.....no sympathy, no emotion....never think they will be understanding because they won't.

I wouldn't worry about the hard copy of the NOA1 as long as you have confirmation via text/email, that is enough. I'm sure you also verified with with USCIS that it, in fact, was approved.

As others said, you should request a hardcopy, for your files, but the more important hard copy would be the NOA2. As you know, the wait right now seems like forever for the NOA2. But don't get discouraged. When I started my process I received mine in 42 days. At that time there was a 3 month wait. Those timelines change once they are caught up but right now there is an overload so just be patient and expect to wait long, that way if you are lucky enough to get it sooner, you wouldn't have had your hopes up.

And yea, make sure to keep the timeline up to date so we can help you out. ;)

BTW...no question is stupid. I've asked many and it was probably the millionth time that same question was asked.....;)

Definitely check it out. Again, the father of my kids (who I have been separated from for 10 years) married his DR wife 5 years ago. She was pregnant during the process and had the baby by the time the interview came around. I remember them telling me the process for the baby was not as extensive as the mothers. And it took a very short time before he had his pretty blue passport...;)

I WAS going to do that, but seeing as it is a different process, they (Mother & Daughter) wont be getting their documents on the same date. One will get her's first, and then the other. So my plan was to just have my daughter hop on the K-2 Visa becuase this way (im guessing) they will recieve their Visas on the same date, and will be on a plane with me back to the US. Then while my daughter is here, i would work on her US passport, since she should be entitled to apply for her quick USC status. - correct me if im wrong please.


I don't think this is correct. I could be wrong but I think they "merge" the two petitions together so they are done on the same day. It's best to research this a little more. I would hate to give you wrong info. But the people I know who have been in that situation...they went the CRBA route. I think its wayyyy cheaper also.

Just to make sure. I am the petitioner, which means i DON'T have to fill out any of these; DS 156, 156K, 157, 230, Only my Fiancee and daughter need to, correct? Also, since they are NOT male, neither of them have to fill out the DS 157, correct?

Even though my daughter is only a year and half old, i would still have to pay full price for her Visa ($210) and the Banco Popular Visa Application fee ($140)?

On another note, i heard it goes easier if you child/children are present at the interview since it is strong evidence of the relatioship. Any thoughts on that?


Welllll....I did all of my husbands because they were in English and I wanted them done correctly...jejeje. If you do them, scan and email them to your fiance. Then they can be printed and signed.

The child should absolutely be present. If the interview is regarding them then I would say its mandatory. And bring tons of pictures of family and the baby's bday party / baptism, etc....

1. All of those documents will be mailed to the beneficiary and/or petitioner by the embassy. Also, there is a link with very detailed info here on VJ. I used both links for my entire process and they are current and detailed. If it's not here, you won't find it anywhere. Also, you or your spouse may never receive an interview letter because of the horrible postal service system in DR. This is normal and you should not worry, but if that happens, it will be necessary for you to call the embassy to retrieve the information you need. That number is located in the first link. Starts with 877 and cost $7.00 dollars each call - credit card only.

2. The Banco Popular fee should be paid when you find out the interview date or basically any time before the interview. Do not pay on the day of. But be sure to pay the correct amount. Some Banco Popular employees are unfamiliar with all of the fees and have told many of us the wrong amount, causing us to pay the fee last minute. They did this with my husband and we had to leave and return to the interview after paying the correct amount. Pay the amount you on the interview letter or the amount mentioned on these links above. I am not familiar with the K1 fee but it is in the above link. Do Not let them tell you otherwise. The $210 fee is for the interview. That i separate and you pay this on the day of the interview.

3. As far as the interview letter, if you do not receive this, again you must call the embassy and ask them when the interview is and ask them to resend the letter. There are circumstances where they do not have the information in the system. This causes a problem but that is what we have the Visa Specialists here for. Call them and they will tell you everything you need to know, but they cannot send the interview letter. This is the job of the embassy. For example, after your documents are sent to the embassy, wait about 2 weeks and if you have not received a letter, call the embassy. If they have no info, call the Visa Specialists and if they tell you there is an interview date, you need to call the embassy again and inform them of this. Tell them your fiance needs the letter for the medical exam, they will input the information and you can pick this up.

4. As far as the K2 visa...that information is also in the link above. You should have began this petition when you started the fiance one. Look into this from now. And yes, the child would have to be there on the interview date. I have not petitioned for a child so that I am unfamiliar with, but again, the link above is the bible for this process.

5. Domex: After the visa is approved they give you a ticket to pay at the Domex desk. I have never heard about it being able to be expedited but maybe it's possible. I personally have seen that picking up the visa works much faster. Some areas in DR are difficult to deliver to, thus prolonging the process. If the fiance lives in the capi, its better to pick it up.

No pictures? May be difficult....they'll want proof that you actually have met in person and seen each other. You never emailed any pictures of each other? Any Skype pictures? I personally post pics on Facebook so I have a bunch on the internet.....do you have anything like this?

Other proof is necessary also such as travel proof (passport stamps, airline receipts, etc...) You could get affidavits from friends/relatives stating you have known each other for as long as you say...but that will only go so far.

I'm already suspect, upon initial review of your petition. So, I'm going to send some RFE's your way. I wouldn't expect an easy ride, now... until they are satisfied that your past is clear. (or, ... is it???)


I would agree with you on this 100% only if, after they do the background check, there is something fishy. That being said, I also agree that not answering that question would raise a red flag but not something that will follow them through the entire process. Hopefully when they see the revision and the background checks are complete, they'll be in the clear.

BTW, I wonder how an RFE looks like. We got an Action of Notice exactly on our 4th month of waiting and asking for my fiance's first divorce decree, but he didn't see it's an RFE. He didn't also get a notification email or text messages saying an RFE will be coming by mail. Neither the USCIS website says we're still on initial review.

I dunno our current position as of the moment.



So you didn't get an RFE in the mail? But you know they want the divorce decree? That notice of action is telling you that they need that divorce decree in order to move forward. If you haven't already, get this in quickly because it will just delay the processing. Don't trust the website because it is rarely accurate. My updates were never there but I did receive the email notifications. Although I never received a Notice of Action of RFE....these things probably do not apply to the update via text/email.
