K-1 Fiance(e) Visa Process & ProceduresLetter of Intent Questions
When writting a letter of Intent . The example at the top says (petitioner’s / beneficiary’s address) Are they asking for both names and address at the same time on both letters ? I just want to know if I need to put both of our names at the top of each letter or just my fiances name and address . This is how I did it so far. I made two letters of intent, one for her and one for me.`But I put both our names and addresses on the two letters. Is this wrong ? Can someone please advise me in the right direction ? I also have one last question on this subject. When it ask for Embassy address do i put the philippines address there that is Immigrant Visa Branch,United States Embassy 1201 Roxas Blvd., Ermita 1000, Manila
or do i use From outside the Philippines: Immigrant Visa Branch, PSC 500 Box 26 FPO AP 96515-1000 USA ?????
Anyones suggestions would help thank you

Recently, I sent out the first package to the california service center. With all docs. needed. As you all must feel the same as kirsteen and I (exceited) to start our lives together. I am being pressed by her everyday with questions about this k1 process and trying to do my best not to screw things up. I would also like to know to. Could anyone tell me from past experiance "IF THE SERVICE CENTER CASHIES MY CHECK" does that mean it has been approved for the first part ? Or am i getting ahead of myself. If it is going tobe sent back to me because of an RFE do they usally cash the check anyway?

Hi everyone,

VJ has been the most helpful site, I can't imagine what it would be like to go through this process without you guys. Thanks in advance to everyone for their advice and help.

We are fast approaching our projected NOA2 date of mid-July (no RFE's) and may have hit an untimely roadblock. Dani (petitioner) has been let go from the job she had, and is scrambling to find work with no luck. Unfortunately the area of FL she is in is very hard hit with the reession and has seriously affected her line of work. She is unemployed and if we are correct the next step in the K1 process is to look at her finances. We are both quite concerned and worried.

Here are a few questions and various ideas we have;

-If she is unable to secure employment how will this affect our application?
-Would it still help if we got a co-sponser even if she is unemployed?
-Is it possible if the petitioner has funds in savings sufficient to cover us through the AOS period will this help?
-Will it help that her tax years for 2004 thru 2007 are very good stable income years?
-My father is a US citizen residing in the US, can he co-sponser my fiancee?

We would both appreciate feedback on these thoughts and ideas. Thanks for any and all help!

Todd & Dani

1. No money, no Honey.
2. Yes
3. Yes, but it must be 3x the shortfall amount. If her current income is -0-, then she needs about $60,000 in the bank or other assets for two people
4. Yes. But will not put you over the top
5. Yes, any citizen or LPR can be YOUR sponsor. Your fiancee is a US citizen, she does not need a sponsor, YOU do.

A co-sponsor fills out the I-134 just like the petitioner and provides support documentation just like the peitioner. The petitioner MUST fill out an I-134 even if her income is -0-

So alla, what you are saying is that if I have no co-sponser i will need 60,000 in my bank account and that will be ok ? Is that what you mean by 3x the short fall amount ? Hope to hear from you and thank you

Hello peoples,

I was just wondering how you know when you have been "touched" (sounds dirty)..... Anywho, I signed up on the USCIS cris. Will they updated this on the part where it reads "On June 9th 2009 we received you petition for... yadda, yadda, yadda"? Will they send an e-mail? Should I wait 3 days to call them after the first date? Do they think I am cute? Will John and Kate reconcile?????? AHHHHHHHHHHH. Actually, I could care less about the 3 last questions. But seriously, how do I know I've been "touched"?

Thats some funny stuff. (jon and kate) rofl.gif , I hope someone has an answer for you soon because i was wondering about that too. Glade you posted this topic , just wish i could help

I thought I was supposed to receive a large package with instructions?? blink.gif I have already gathered all supporting documents for the I-134 and completed the form. Should I go ahead and send this information to her or wait for further instructions? Thanks for all your help!! smile.gif smile.gif

Take a look in the embassy section and see what your specific consulate requires from you. The I-134 is optional at my consulate at this stage. She will receive a package with more information, the one thing she will need for sure is the NOA2.

Congratulations on your NOA2 kicking.gif The hard part is over!

Wish I had something in the mail besides bills. Im happy you got your noa-2 and keep us posted on your progress. Congrads for you two good.gif

K-1 Fiance(e) Visa Process & ProceduresI-864
At this time unfortunately im still jobless and looking for employment . I might be using a co-sponser when the NOA-2 is approved. But i hope it doesent come to that. My question is if I use a co-sponser I know we both have to fill out the I-134 form and send it in to the embassy in my fiances package. But do I need at this time to also send in the I-864 or does that come later ? Also how come there are two affidavit of support forms ?? the 134 and the 864 ??? Hope someone here can help us. Anyone with an answer would be great and thank you once again. good.gif

K-1 Fiance(e) Visa Process & Proceduresgetting laid off and affidavit of support
You will most likely need a co-sponser for 134 Affidavit of Support form. Thats what i will be doing to. Try to make it a family member if you can.
The US fiance is ALWAYS the primary sponsor, but may have a co-sponsor. If there is a co-sponsor, both the
US fiance and the co-sponsor will EACH have to fill out the affidavit I-134 or I-864 and EACH will have to provide
supporting documentation.

QUOTE (Otto und Karin @ Sep 4 2009, 08:47 PM) <{POST_SNAPBACK}>
Can't give you any odds but your chances are OK. Kind of depends on several things; i.e., work history, previous tax returns (I would certainly include additional years) and perhaps who the co-sponsor is (you didn't mention how they are related, a second cosine for example would not be the best choice). I've see folks on unemployment at the time of their interview be successful.

Thanks for your fast reply 'Otto und Karin' It will most likely be a brother or a sister. Successful even at the manila embassy ?? Ive heard some bad things like denials from there

K-1 Fiance(e) Visa Process & ProceduresWhat happens if ???
Has anyone here ever heard of anyone getting a visa with a petitioner that was collecting unemployment benefits ? I am the petitioner and im having a great deal of trouble finding a job at the moment. My question is, If i have a family member become a co-sponser and he makes well above the poverty level required and is willing to become a cosponser would you take a chance and file this petition to the philippine embassy? or would you postpone it until i get a job. What are my chances of having the visa denied ? Anyone out there , what are you thoughts ??

QUOTE (Old Dominion @ Oct 23 2009, 06:43 PM) <{POST_SNAPBACK}>
Perhaps a rephrased letter from your employer would suffice, i.e., to state that you began work on such and so date. I assume you are still in your probationary period as an employee, and that you had no prior job? You'd have only a month's pay to show as income? In that case, it would be hard for the CO to feel sure you can support your proposed family. Can you find a cosponsor quickly?

No I cannot find a co-sponser, But thanks for your input anyway. By the time her interview is here . I will have collected two months pay check stubs. I sure hope the co will be in a good mood that day. I do have a savings account also that has a decent amount in it. Would that help at all ? and last year I made over 50,000 maybe they will be ok with that ?

My fiance will be interviewing in the philippines for a K1 visa soon. I asked the company I work for, for a letter of employment. So I showed them a rought draft of the letter I needed. They said that they couldnt give me my annual pay on the letter because of what if my job would end or if I got laid off . I just started the job in september. I guess its there company policy, headbonk.gif Is it ok its just shows hourly wage on the letter proving im making over the poverty line ?? I get paid BI-weekly also . K-1 Fiance(e) Visa Process & ProceduresK1 being sent back to USCIS. Anybody..?
QUOTE (saaheb @ Jun 8 2009, 03:17 PM) <{POST_SNAPBACK}>
Okay, I guess I have not been as lucky as most of the folks here.
My fiancee was first given a 221(g) 2 months ago. We provided the documents promptly.
Now the Mumbai consulate emails me saying that my petition is being sent back to the USCIS
for re-examination and for possible revocation. I checked with some attorneys and looks like
I have no other option but to start the process all over again.
Checked with the DOS a couple days back and they did confirm that it was being sent
back. However, when I called back again today, I am told the case is in 'Admin Processing'.
So, I am not sure what to make out of it. Will appreciate if anybody has any idea..?

If i was you I would give it sometime and see how it plays out. Hang in there friend and good luck
