My fiance will have her interview in Rio in a couple of days and I have a couple of last minute questions and or concerns. We had a non legal wedding ceremony in Brasil 2 weeks ago, should she mention it and take proof (photos etc.) or just keep quiet about it. Also I have a list of the order to present the documents for the interview but I am curios as to how they should be presented. (stapled, clipped, etc). I hole punched the I129F paperwork and used folders fasteners and tabs, just wondering if it would be advisable to do the same for the interview paperwork.

Just send them what they need once you receive the RFE - your case will be approved shortly after they receive it and process it. . . that's how it usually goes.

I just checked on the USCIS page for my case status and it has changed. They mailed me a request for additional evidence and or information sometime today. I can't imagine what it might be. I was very thorough with the paperwok i sent them and neither my fiance nor I have anything shady in our past. Whatever it is they are requesting I hope it does not delay the process another 3 months. Anyone have a similar experience they can share which will give me a clue as to how this is going to proceed. Every case is different and each service enter works at different paces. Comparing your timeline to someone else's does no good. Viewing the averaging time lines here on VJ is just an average and is dependent on people correctly filling out the information which doesn't always happen. If you are beyond processing times for your service center posted on the USCIS site, you should contact them. Otherwise it would be a waste of your time and there is no reason to worry.

If you have received your NOA1 and you can see case status online, it's extremely unlikely they lost their case. More likely, they are backlogged and lost some time due to the holidays.

You have posted this in the K-1 forum and your profiles indicates K-3. Are the I-129F petitions approvals that you have noticed processed ahead of yours for K-1 or K-3?

it took around 7 days for us to get our rfe in the mail, though bear in mind we were at the beginning of the holidays. However it hasnt been that long yet for you though trust me I know ow each day feels like forever, I would give it till the end of this week.

Hi, see my signature. I got the email about RFE on the 16th. I finally got the RFE via snail mail on the 26th. I was really bugged and started an upset thread. It doesn't make sense but... see my other thread.

When they sent the RFEs for IMBRA, they gave one date i.e. Jan. 16, and the letters were not postmarked until about 2 weeks later. It's normal, try to relax.

On the USCIS site there is a notice that they mailed me a RFE on 1/24/2007. I have not received it yet and was wondering if this is normal. I live in Las Vegas and submitted my petition to the California Service Center. I thought I would have receuved the RFE in the mail by now. Should I be concerned or is it normal for it to take some days to arrive? Am I worryina a bit to much about this?

Can anyone who is well versed in English and the alternate language translate the documents and as long as they are Notarized it's all good, or does it have to be done by someone who is an officlal document translator, if there is such a thing? The documents I am referring to are receipts and such being sent as proof of having met my fiance.

Adding the additional stuff you already said sounds good, if you dont mind the extra wait I would go ahead and wait and get more evidence from next trip. Not sure as you said if they want only proof preceeding the application, but the extra can never hurt.


I agree with you that the extra cannot hurt. However I am leaning toward just sending copies of my airline tickets and captions indicating I am going back in 9 days and not waiting to burn the almost 4 weeks it will take for the trip. It seems pretty clear that they want evidence prior to the 129F being sent, so I don't think waiting makes sense at this point. Thanks for the suggestion though, it is appreciated.

Remember photos are secondary evidence and do not carry the same weight as primary evidence. Your passport stmp is the most importnt new information you can send it.

Did you highlight the dates on the evidence you did send it? Make notations on it o the ajudicator can make sense of everything they are looking at? Sometmes it looks like it makes sense to us, but from a stranger's point of view, it does not tell a complete story.

What did you write in your Question 18 about how you met? Did you offer evidence from that , if it was a meeting in person?

I really think that the passport stamp will be enough to add strong primary evidence.

No I did not highlight the dates or make notations. Both were probably huge mistakes on my part. I will make sure I do both this time around. I did offer evidence of meeting in person but I gues you are correct in stating that it made sense to me but might not have been clear to the person handling my case. Why would they care if a pic has a time stamp. They are probably one of the easiest things to fake on a pic. It seems that they wouldn't care since they are not reliable at all. There are even crime documentaries on Discovery Channel that show how some criminals try to create an alibi by manipulating the time stamp. Are the people at the service centers that out of the technological times?


I agree 100% with what you just stated, the whole tiem stamp thing seems absurd but I do have the EXIF files for all the pictures with the date and will print them with them time stamp.

Sorry for th RFE, send the evidence they ask for, dont worry about the birth certificate. He/she should obtain one if she doesnt already have it and send you a photocopy, in case they ask for it but it shouldnt be a prob cos its usually not needed until the consulate stage.


Thanks that is what I intend to do. I am just a bit frustrated because the request is so vague, I've already sent a lot of the things on the request. I am thinking it was just the fact that i did not have the receipts transalated.

Do you not have passport stamps for your visit?

I do have passport stamps for my VISA, that's about the only thing I did not send in. The request for evidence is very vague, does not realy specify any one thing.I am going to resend everything I sent the first time around plus photcopies of the passport. This includes and itinerary for my trip from yahoo travel. 2 boarding pass stubs from my return trip with my name and dates on them. A corresponding baggage calim ticket with date including year. Credit card statements and receipts from my hotel stay.( This time I am having the Portuguese ones translated.) Copies of both my fiance and my hotel registry sheets (transalated) and the fotographs of us together with handwritten dates location and names on back. I also have a hotel receipt with the name, date and location of hotel, made out to my fiance under her name. This all seems like pretty solid eveidence to me. Am I missing something?

Hi,

I'm not an expert at this but I have gone through the process you're going through now. If your pictures don't have the date imprinted you can download a free program that will do it for you, http://snipclik.com/. The program will use the time stamp in the pictures as the date. If you have the pictures in digital format you're set (if not then I'm not sure how you can do it.) Finally print the pictures at Walgreens or Costco or wherever they take digital prints. I believe any pictures up to 2 years old will be ok.

I was just wondering. I sent a reply to an RFE and it was received by CSC on 2/14/2007 but since then has not has a single touch. I have noticed that others have received NOA2 within days of sending their RFE reply. Should I be worried and is it advisable for me to schedule and interview which I have not yet done.

yes it needs to be translated for the interview as well, the document as well as translation will be placed in the large sealed brown envelope carried back to the USA and given to the officer at the POE and they send it on to USCIS where persons will still need to be able to read the document, most people working at USCIS only understand English.

This might seem like a silly question, but I need to ask anyway. When my fiance goes to her interview she is going to be required to bring a copy of her birht certificate. Will it need to be transalated into English even though she is going to the consulkate in her own Country?

From what I understand, all official documents they require need to be translated into English. The translation can be done by anyone who is proficient in both the native language which the document is written and also in the English language. I am sure you will hear more from others on this subject :D


I know that all official documents they require for the I-129F to be approved required translation I just was not certain whether that would be the case for the interview as well.

K-1 filers are at NVC for a very short time, we are sort of stuck in limbo between non-immigrant and immigrant visa's. We have to give proof for relationship with the I-129F, but we don't have to fulfull all that is required for full immigration...yet. That is why we don't file those things at NVC.
The embassy in Brazil will require a I-134 or something similar (some variation from one Embassy to the next) for evidence of support, but the I-864 won't have to be submittted until after you two are in the states, married and filing for AOS (Adjustment of Status).
You will not need to 'do' anything while at NVC except wait. I have only heard of one case where additionnal information was needed at NVC and it was just that one location...can't even remember which one.

It has been exxactly 2 weeks since I received the NOA2 from the CSC and I still get a have record of this case or has not been received message from NVC, should I follow up with CSC to make sure it has been sent or should I just be patient? How long does this take. I see other filers getting confirmation from NVC in less time.
