If you have a lot of photos I had over 300. I printed them in a postage stamp format with one full page of our wedding photo. I did not identify all the people and events. I should have use a cover page that list them. I did put all the other things that were suggested. Also put email logs and selected emails. I also had posted my marriage on facebook and people who commented. I put copies of the pages from facebook into the application. I still waiting for my NOA2 so I will see if this was enough.

I would recommend calling USCIS and ask to speak to a Tier 2 to see if your file was transferred to a field office. If you received a NOA1 then your petition has been received. Now you just need to wait and see what happens. Can you check the status of your petitions online

 

 

 

I have received my NOA1 in March but there is no way online to check if it has been transferred. I sent  a email over two week ago no response. I worked in a state government and know one thing. We all responded faster when someone would make personal visits. It like in politics if you write a personal letter to them it represents about 100 people. If you visit them personally it represent 1000 people. Why we have lazy society and they know if someone make this type of effort. If you show you are serious and could represent a problem. You have show you are committed to make things happen. You have to be respectful but can show you are serious. I would be interesting to see how many people who have done a infopass. If they have had faster results.

I went to the Brazilian Consulate website to get a list of what I would need for Documents. I am confused now they ask you to bring the originals not to send them with the DS-230. They also ask for the petitioner original Birth Certificate and divorce document. If someone who has done this recently been approved with interview in Brazil. Could you tell me what you sent with your DS-230 and brought with you to the Consulate. I have two girls application with there mothers. There is not a lot of information about what document they need. Thanks

If you are applying for a Spouse Visa for a green card. The I-130 is the visa you will need to get. How long will it take is now a guess since I am already six month since my NOA1 and waiting. I thinking of stretching to 2 year I will be married 2 year and will not have to deal with this mess after our approval. See my wife will get 10 year green card at the first interview. If you are married less then 2 years after you get the first approve visa to the US you will be able to live in the US together. You will have to go through another interview gather more paper and deal with the same system and pay more fees. This will be in the second year you are here in the US. If the government shut down this will be delayed cause more stress. Welcome to our great government system. lol

Agree with @NLR. There have been many cases where USCs with Canadian spouses have been denied entry into Canada - if they cannot convince the IO that they are only visiting their spouses. 

Your husband can, however, say to the IO that he has filed the I-130 for you to immigrate to the US and is currently in the process. Canadians are more sympathetic and understanding in that way (zing!). cool.png

You definitely included more than the usual amount of documents or evidence needed for the initial I-130 and especially for a Canadian beneficiary (assuming that's the case since you listed Montreal as the Consulate for the interview). 

 

Depending on the duration of your marriage, living arrangement, or any other factor(s) that you think might affect the application, I would not worry about these items (but that's just me):

  • Copy of online profiles from BLANK for Petitioner (BLANK) and Beneficiary (BLANK)
  • Logs of BLANK (International calling service) calls
  • Copy of Email correspondence-
  • Copy of Partial Transcripts of chat logs
  • Copy of receipt for ring, diamond certification, insurance policy on diamond ring
  • Copy of  Engagement Ceremony Invitation

I think these items carry more weight for K-1 visa petitions than for C/IR-1, with the exception that you did not marry your wife a week or 2 after meeting her for the first time. The joint lease, joint bank account, spouse as beneficiary for your 401k, sworn affidavits and supported by photos and itineraries/boarding passes should be enough evidence to prove that the relationship is bonafide, so to speak. Again, I think this can be true for Canadian beneficiaries - can't speak for other countries. 

 

Alas, your I-130 has already been sent so I wish you all the best and good luck!

Perhaps I was unclear.

 

We don't intend to "game" the system, but to begin the I-130 process shortly with me still legally living in Canada while I visit (staying with her in the US) for the maximum of six months the way we did with her visiting in Canada.

 

I do appreciate your response.

 

 

Once the I-130 is filed, the only way you can continue to visit your wife in the US would be for you to prove to the border agent that you still have "strong ties" to Canada. It can be anything from having a full-time job, property in Canada, and any other ties that would compel you to return to Canada after each visit. If you are going to stay in the US for 6 months, then you can no longer be considered visiting but actually living in the US. 

 

Personally, I would suggest for you to continue to live in Canada and your wife can move to the US to establish a domicile. She should then file the I-130 and, depending on your situation in Canada, you can try to make a few shorter trips to visit her in the US within the 8 - 9 months for you get the IR-1 visa.

Have you actually checked out the forum before posting your question?

If you did, you'll see that this very particular situation/question is being discussed almost on a regular basis.

 

No one is allowed to enter the US with the intention of becoming an immigrant unless you have the appropriate visa. In your case, the IR-1 (I-130 form). 

 

It's a certainty that they will deny you entry at the border and ask your wife to file the I-130 while you wait in Canada. Worst case scenario is that they will flag your passport/file for attempting to game the system and adding difficulties along the immigration process for you. 

 

Please don't take this as an intimidation but that is just how the US immigration system works.

I almost laughed when I read the comment, "They are legal documents that carry a lot more weight that some of the items you listed such as online communication history and receipts for things you purchased for the wedding."  That is pure BALONEY.  Evidence of time spent together and communication will always supersede what a 3rd party writes on a piece of paper, always (at both the USCIS and Embassy/Consulate levels).

 

 

But do you disagree with the definition of affidavit and that they are legal documents? And do you agree that they are useless?

 

Why then does the I-130 instructions specifically list that as a document that can prove family/spousal relationship? Why don't they list "communication history or evidence of time spent together" specifically in the instructions? Aren't photos enough prove to time spent together? 

 

You also made the wrong comparison that affidavits equal "piece of paper". Affidavits are regularly used in legal courts. 

The person who makes the affidavit is held accountable under the laws for their statements. Who in the right mind would put themselves in a such a position if they are not entirely confident about what they are attesting to (your relationship). 

 

I'm just saying that you are entitled to have your opinion on the matter but to say that other people's opinions are baloney is plain rude, moderator or not.

Sworn/notarized affidavits are not useless and they are specifically listed in the I-130 filing instructions. (refer link - Item 1(I) under 'What Documents Do You Need to Prove Family Relationship?')  http://www.uscis.gov.../i-130instr.pdf

 

Definition of affidavit : 'A written declaration made under oath before a notary public or other authorized officer.'

I'm surprised that they would RFE the beneficiary's BC at the USCIS stage. 

 

As per the I-130 instructions, petitioners only need to send in 1 passport photo of petitioner and 1 of beneficiary, and they don't require the BC of the beneficiary (at this stage) ..

I said nothing about exact dates.. I said exact addresses... you still  give them  month/year but they do not qualify it like the DS-230 with anything over 6 months...  so that means to me at least, any place you have lived for any period of time, since the age of 16.

You are really need to study this wiki... Canada is eligible for electronic processing so that you can email a PDF containing all the information.  But you need to OPTIN and have it accepted before you can email anything.

DS-260 is different than the DS-230.  You will need the exact address for every place he's lived for any period of time since age 16.  You will only need the last 5 visits to the USA. 

 

Actually the DS-260 has changed and does not require exact dates for all the places that the beneficiary has lived since the age of 16. Just month and year. Exact dates are still required for employment and education history. I completed the form a few days ago. 

 

Another thing is about the OPTIN. My spoused and I called NVC several times this week to inquire about whether they have received the OPTIN email and when can we expect the confirmation so that we can start emailing them the AOS and IV packages to them.

The rep we spoke with on the phone told us that we did not have to wait for the confirmation/acceptance email and told us to email the packages as soon as both the AOS and IV fees are posted as 'PAID' and completed the DS-260. 

We were weary of the answer at first and tried calling back a couple more times but got similar answer.

 

Can we get a confirmation/clarification on this info? They seem to be constantly changing/updating the process and it might be true that they have eliminated that waiting period for the acceptance email.

We recently changed from K1 to CR1 got married 2 wks ago.  Because my husband lives in Nevada we sent the 1-130 to Phoenix...was accepted..and money order cashed and we received a NOA1 saying it has been sent to Lee's Summit. MO......Hello...I have never heard of this service centre.  Any thoughts?

 

BTW.  I went through Pearson Airport (Toronto) April 9/13  and did tell American Immigration I was going to visit my fiance..he only asked if I was planning to work, and how long I was staying. (17 days) He did stamp my passport.  It was no problem. I brought extensive "proof of ties to Canada" but was never asked! I am back in Canada now.

Hi!  I don't know what the risk was?  You are allowed to file a K1 and then decide to marry.  You simple withdraw the K1, and refile the appropriate documents.  I was straight up about everything.  But we are both almost 60 and are close to retirement, and have known each other for 46 years, Canadian and we are low fraud.  Please advise what the risk was? I'm curious.

Hi! We recently changed from K1-CR1.  We were married 3 wks ago.  When I crossed the border into the US they asked "where I was going"  I said "to visit my fiance" asked "how long are you staying"? i said "17 days". asked are you going to work "I said no".  No problem.  This was at Pearson Airport Toronto.  They did stamp my passport but since you don't go thru immigration (US) again (Canadians) when leaving the US. I kept my boarding pass etc as proof I left the country.

 

We submitted our 1-130 within 5 days of marrying, explained we had changed routes and why.  We filed to Phoenix as that was our office for Nevada petitioners and we received an NOA1 within 1 week saying we had been transferred to Missouri Benefits Center.  (not California)  We included in our 1-130 a copy of our letter to CSC withdrawing our 1-129f.  We are not too worried about the quick petition as we have known each other 46 years.

 

We felt the K1's were going to move way to slow for us and it looked like 2014 since we filed k1 in Feb 2013.

 

If you look at the Canadian portal for CR1 you will see many people are moving quite quickly.  Some even having NOA2 in 2 months or less.  Especially if sent to the benefits centre.

 

It was a gamble but we wanted to marry now anyway.  We believe we did the right thing.  We also didn't want to wait for Advanced Parole, Green Card,  etc after optaining a k1.  We obviously lost the fee for the 1-129F but time is money also.

Oh my dear! You seem to be facing the same thing as I.  We are doing it by the book.  and still we are faced with long wait times.  We have bona fide marriages and still it is odd.  I do so wish you the best.  Hopefully the kids will be in school in the US in the fall.  If you look at Canadian timelines for CR1 you can see that some are quite quick..  I am not sure what is the criteria they use or perhaps its the service center it has been sent to.  I wish you a speedy approval.  Btw,  I have not had any trouble crossing the border.  Brought ties to Canada and was straight up with immigration.  All the best!

Hi Everyone.  I just wanted to confirm something.  We filed our 1-130 days after we got married.  The passport and supporting documents I had were all in my previous name.  Now after returning to Canada I have gotten all my documents changed over to my married name.  We have NOT received our NOA2.  I believe I should just wait until it gets to NVC and then supply them with my old "cancelled" passport along with my new one in my married name...(and drivers license etc)

 

Is this true?  I question if sending all that in now will slow down process.  As if it isn't slow enough!

 

Any thoughts?

Hi. We filed in my previous name (im the beneficiary) as we did it days after our marriage and I hadn't changed my passport or other documents yet. We understand that when it gets to NVC we will supply a copy of my cancelled passport in old name and my new passport in my married name. I certainly hope that works.

The USCIS stage is where you are at.  

 

Your Service Center: National Benefits Center (acronym is NBC - will show up on your NOA1 as your MSC###############)  You are NOT adjusting status unless you are already in the USA so change your profile to say : IR1/CR1 Visa (like mine.)

 

You are waiting for NOA2... Notice of action 2.  The notification that says you're approved or denied the petition.  You have to wait for this.  It normally takes 6 months.  After 6 months, then your husband can call the USCIS and ask what is going on. 

 

 

 

If you want to, you can get ready for the next stage after the NOA2  if it says approved.

See you are at the USCIS and then the next stage is the NVC (National Visa Center). This is when you apply for your visa!  Get together the documents you need to to send to the NVC.   Yours is the "IV packet" (IV - Immigrant Visa).   I know there is a lot of acronyms. sad.png

oops - he sent the I-485 ?   You might want to engage with yer spouse to call into USCIS, get a Tier 2 Human, and let the Tier 2 human know that the I-485 was sent by mistake, as you're not in the country.

What do you mean with 2 offices? There are two main packages of documents involved, one is sent to USCIS, one to NVC at a later stage. 

 

Why did he send both? On I-485 instruction it says "this form is used by a person who is in the US to apply to adjust to permanent resident status or register for permanent residence" - but are you? And it looks like the person does it for him/herself?

I dont think i have a document sent to the NVC and its been almost 5 months was i supposed to all the info i got never said i should have...

 We are filling by ourseves and my husband is in the US i am in Brazil with our daughter and we sent the i-130 and i-485 if i sent too much will it mess up me process?? i mean they can just throw the extra info away no?

 

Is waiting 5 months with no other email or letter other then the NOA normal?????

if you study your timeline, all timeticks for what to do are in there. 

if you don't have a timeline, make one. 

Study my timeline.... hmm.. the USCIS website says my process will be done in 6.3 months i dont even know what the .3 means 3 days? 3 weeks?

 

And it doesnt seem like I can make my own timeline since it all depends on the US governament....
