The documents may have to be translated.  In Morocco they ask for them to be (I forgot where I located that info, sorry, I tried looking).  

 

There are a several differences on the cover sheets with the barcodes.  One is to Atn CMR, the other is Atn CMR AOS (or something close to that).  You need to make sure, when you are in the payment portal that you have selected the AOS or IV receipt page and print accordingly.  Another is the instructions.  Also, where they print the beneficiaries name is, yet another.

My insurance also includes the move of the foreign spouse to the states as a "life-changing" event. They just require his "A" number/visa number. Had I added him right after we were married it would have added $200 per check and increased the annual deductable to $10,000. I was not ready for that. I'll wait until he's here then add him hoping he'll find some kind of work to offset that $200 increase every 2 weeks. They did let me add him as beneficiary as early as when we had gotten engaged.

You can send extra proof in with the IV package.  I am not familiar with the Indian Consulates, so I can not speak from experience for them, but I sent new evidence with my husband's IV package.  My husband's consulate does not take proofs or much of anything else at the interview, but some consulates do.

Just trying to understand the I130 stand alone process.  Not sure what forum to post in.  Not applying for AOS/EAD/AP or consular visa yet.  Just questions on getting 130 processed/approved.

Not sure what you mean by "I130 stage".... There could be an interview for the US petitioner at the USCIS stage, but that is rare.  There will always be an interview for the beneficiary after USCIS and after NVC, when the file is transferred to the embassy or consulate

 

How does one find out if their case is transferred from NBC to a local field office?  Any case updates one sees on their files/online?  Do you get a notice to let you know.  How long before do they usually transfer?

What's the likelihood of getting RFE/Approval if only minimal docs were submitted...like just marriage certificate as supporting documents?

 

According to the officer I spoke to at my local office, they are requiring proof such as chat logs, pictures, passport stamps.  When they first started getting transferred they would send a NOID or NOIR rather than an RFE request... I think that may still be happening from time-to-time

 

I've read some people say you get interviewed and some say it can be straight approval/denial based on initial submission....

 

Occasionally, there is a denial at the USCIS stage based on original submission but usually they will give time to correct what is missing.  Do an advanced Search for "USCIS stage denials" or something like that.  Many, not all, questions can be answered with that advanced search option as they have been asked many times before  

 

Just trying to understand the process for a stand alone I130 submitted with petitioner (US Citizen) living in US.

So far, I know we have to bring pictures (of us together) with other evidence (skype logs, etc) and police report but I'm still not clear on the affidavit of support you guys ! sad.png please help me with clarification on that and whether my hubby has to bring that or not? and how will he, do I just scan the form to him that my friend filled out (who used his tax papers ) 

 

Ok you guys so you can have a better idea of what I got in the mail. This is it, please look at the attached pics and help me figure out what to tell my husband to bring to the interview, pleasee sad.png the interview is about a little over a week away now. :\ It is a total of 4 PAGES

 

 

Document Code Status definitions is the key to telling if you need a document.

For example - "correspondence instructions" has a "C" under "document status".  If you look under "document code status definitions" "C" = "you must bring this entire interview letter to interview."  

Another example is the status "Y" which translates to "the NVC sent this form or document to the US Embassy or Consulate" meaning they have the document therefor you do not need to bring it. 

 

Hope that helps you decipher the rest of it.  Most of what you posted, they are stating they have. not all pages are in your post.

thank you all for your suggestions. I have a lot of research to do. What are your thoughts on hiring an immigration lawyer, i'm not too keen on this as i'm sure it will be quite expensive, however, i'm afraid that i will make mistakes and delay this seemingly lengthy process even further. I'm really not quite sure where to even start yet.

 

I recommend starting with one of the Egyptian consulates/embassies and finding out if there is a way to register the wedding with you here and her there.... If they can assist you, then that takes a lot of troubles away.  If you are unable to contact them, have your wife take the men and register the wedding that way, as Darnell Recommended.  You need the marriage to be official.  If you can get the official document, you can start the process on your own.  A lawyer will not speed things up, in most cases and in some cases they do slow it down.  Unless there is a waiver or criminal background... If you have any documentation of the nuptials, you could start the process with that and hopefully have the official document in time for the RFE or if it gets to the NVC.  

 

This is a DIY site.... in many instances, the process can be handled on your own.  Most lawyers just collect the needed info from you and have someone plug it in to the right spot on a form.... Now, it should be noted that if the date on the official document will be different from what you can show now... then wait for the official document, as they could reject the case if you file before things are official.

 

With all of that being said.  I am not a lawyer.   I don't play one on TV.  Many lawyers will do free consultations.  Put together a bunch of questions, set-up an appointments, and see what you're thinking then.  But start with getting the marriage certified.  Ask about it over in the MENA forum....how to do that with you here and her there.

The only problem with that is the US may say that they are "too married" to file the K-1, and not "married enough" to file the CR-1.  You should contact the Egyptian Embassy to see if you can get the marriage certificate from them somehow.  See what they say.  There is one in DC, New York, and Houston.  Take your pick.  I have read they can be difficult to reach, but it's worth the effort.

Paloma&Ziko ..... I wish you good luck in your process, My husband and I were married last November and are awaiting the immigration process. We were married in Kenitra, Morocco and it took a month and a half. Be prepared to do a lot of travel. Back and forth from office to office. I would advise you to get your birth certificate translation notarized at the Consulate while you are there to get your certificate to marry. My original Birth Certificate was issued at my birth in the USA, and the Justice Department needed confirmation that it was valid. ( since Moroccan Birth Certificate's are good only for 3 months.) Good luck

 

Question for Happytobe, I noticed our case's are similar. Have you been assigned an interview date yet?

https://www.vitalche...th-certificates that is the site I was able to obtain my BC from.  It's relatively inexpensive and Illinois processes with them.  I got 3 for $30-40 with shipping.  The FBI check, I ordered 2 certified copies.  you pay for each copy.  There are instructions on how to request them to certify it on the FBI site. http://www.fbi.gov/a...-summary-checks    We had to argue with some people about them using it, but in the end they took it.  I know Abbi627 used a local background check and had no problems.  It really will depend on who you speak to.  That's why I recommend getting an Adoul involved before hand to get the list of documents needed in Marrakech, and go over it again once you have them.  I say get both local and FBI and have your butt covered as little or as much as you like.  ...... With the rare exception of Ghana birth certificates, Consular officers are not concerned with arbitrary expiration dates of birth or police certificates.  They only care when the police certificate was issued.  What possible meaning could the expiration date on a birth certificate have? Is the information going to "change".  Often police certificates are accepted up to a year after issue but it's best they be as current as practical.  If you no longer live in a country, you can go ahead and obtain the police certificate as soon as it is convenient to do so.
 

 

Thank you for the clarification, pushbrk.  I thought the NVC would only take non-expired docs for Moroccans.  I've seen some people asked to get current ones for processing, that's why I had brought it up.  My husband says that the BC expires to help prevent fraud and identity theft.  We had some issues when I went there to marry, as some of my documents were not within the Moroccan government's time of validity, even though they were US documents (i.e. the FBI background check and my BC's).  I realize that we are concerned with the US government, but, as I stated, I have seen the US ask for "current" documents from Moroccans..  And just to clarify for the OP, there is the Police Clearance and the Court record that your future spouse will need from Morocco at the NVC stage. Most countries only have the Police Clearance Certificate (PCC).  Your fiance would know them by "Fiche Anthropometrique and a Casier Judiciaire."

It's not quite the "big mess" that it first appears.... Relax and breathe, and it will all come together.  I know when I was searching the much older posts on VJ, I would get so confused with all the offices and people talking about "getting stamps" for documents in Morocco... What you are wanting to do, is do-able.  As some one mentioned a few posts up, keep in mind with your fiance interviewing in another country, that he will have to travel back to Morocco when you get to the NVC stage to obtain the Police Clearance and Court Documents needed, not to mention a current Birth Certificate.  I do not believe they can be obtained without him there.  Not to mention, I wouldn't trust them in the post anyway.  They do expire after 3 months.  With that being said, he may have to go back to obtain newer ones around interview time.... However, I am not 100% positive that the Consulate in Dubai would know that they expire in that time-frame...Hopefully some one will come around that has done this before with a Moroccan Spouse in Dubai.

ok..... first things first.... When you have a time-frame of when you want to be married you can start planning some of the documentation that you need.  When I went in December, we had no idea what day we were going to be married on.  It's not a matter of, "oh, I want to be married on Sunday, the 9th." like we do here in the states.  The time varies from city-to-city and couple to couple.  Since you are marrying in Marrakech, it shouldn't take more than a month, as they are familiar with mixed marriages, and it could be as little as 2 weeks. 

 

The document needed stating you are single is obtained from the Consulate in Casa.  Read here: http://morocco.usemb...nformation.html You must set up an appointment via the website to be able to go in and get these 2 documents.

 

Then, you need to have them translated and you go to Rabat.  First you have the documents "certified" at one "foreign affairs" office, then you go to another "Foreign Affairs" (or ministry or something) office to have them run a Moroccan police check on you.  A birth certificate is needed of yours, and they keep it.  I recommend bringing at least 2 or 3 BC's with you, as they are needed by various offices and they want to keep them.  FYI - Moroccan BC's are only valid for 3 months and that is the average amount of time that most of their documents are valid for... Check with the Adoul.

 

I highly recommend your fiance or his family speak to the Adoul they plan to go through to get a list of documents needed by you and by your fiance.  Some things they will need from that list, other things they may request after you are there that are not on the list they give you.  That is why I tried to compile a list of documents that should cover most of the bases that I have seen over the years in past Moroccan Marriage threads (there are a few of these threads here on VJ).  

 

I apologize for not answering your PM, but if the information is in one of the forums, others can find it and use the information as well.  Perhaps I need to revisit that thread to give one last post on the steps that we did.  I guess they are not very clear.  Also use the search tool and look for Abbi627's post on what she and her husband went through.  Some things that do not make sense to us, will make sense to our SO's.  

 

I hope I covered all of your questions so far... If your fiance or his family knows people in the Family Court or Police department, things will go faster for you.  For example, When we took the necessary documents to the local police headquarters for their investigation, it took 3 business days, whereas the average wait is at least a full week, as a long-time friend of the family took the report from office to office himself rather than waiting for the file to "get" to them on it's own.  There are still many people there that do not approve of mixed marriages and will delay things if given the opportunity.

That's good that you are planning to marry in Marrakech!  It would be easier than attempting to marry in Dubai.  The process in Morocco, can take anywhere from 9 days to a month from obtaining the first document/ visiting the first office until signing the marriage contract.  It took my husband and I 9 days, but we were constantly on the go from the time my plane landed until we signed the contract. since you are posting in the IR-1/CR-1 Spouse area, I have to assume you are planning to get married and file going that route.  Where are you planning on marrying?  In Dubai or Morocco?  I ask because the laws and requirements for marriage do vary.  I know some countries have very difficult laws for foreigners to follow.  In Morocco it takes anywhere from 9 days (7 was the shortest I had seen) and the better part of a month.  I don't know about Dubai, but I know some countries wont allow it.... If they ask for X,Y,Z documents, I highly recommend bringing documents A-through-Zzz.....Start having him ask!  Good luck!

         My husband and I were just married in September. I am preparing all of the paperwork to send off our IR-1/CR-1 visa petition. We filed for K-1f visa twice once it was denied and the second it was abandoned, because they gave us a hard time with paperwork and we wanted to get married and go this route instead.

         I have gotten most of the paperwork together:

1. I-130,

2. G-325As with passport pictures for both of us

3. Birth certificate and passport (I sent only birth for k-1 and they requested my passport) better safe than sorry

4. Marriage certificate

5. Photos, messages, and phone records

 

Here is where I am confused: They want something like a bank account, lease, car with both our names. Sadly we live apart hense the visa lol

So it also has the option to send three affidavits. Now I can get these, however one will be from his mom my mom and a friend. I am going to feel a little dumb sending them signed from our mothers. However, I work and go to school both full-time therefore no time for friends really. 

 

My question has anyone been sent a RFE because they didnt have one of these things? And if so what exactly should the affidavits say?

The process of this visa. I could tell you the K-1f process as if I worked in the office. I am trying to understand for the IR-1/CR-1 visa, but I am just absolutely lost. Please some one help me!

Then it gets transferred to NVC........... and thats where I am lost!

 

What happens when it is there? Will I be contacted and given paperwork will my husband receive the paperwork? Is it all done electronically? What paperwork is sent? I see people give them money what is is for exactly?(paperwork wise) When do I send my I-864 Affidavit of support? 

 

I am so confused if someone could please take the time and help me out it would be greatly appreciated. Please dont link me to the step-bystep page I have been there.

Read the first 2 post in the NVC filers thread (there's a new one every month) http://www.visajourn...s-october-2013/   The September thread would be useful to read, as well http://www.visajourn...september-2013/  That is when the online forms started

 

In short - at NVC you will file the financials (affidavit of Support) for a fee of $88

             - you will pay the IV package for $230, this used to be the DS-230 but now I think it's the DS-261

             - to trigger the IV package invoice, your spouse needs to submit the DS-260 online

             - you should call the NVC after your case is closed at USCIS to get your case numbers so you can log into the payment portal to pay for these items

 

As far as evidence, as much as you can.  They do understand that many couples involved internationally do not have joint assets.  You will also have a chance to send evidence accumulated between filing the petition and your time at NVC when you send in the supporting documents for the DS-261.  Keep in mind, at that stage you will need the Birth certificate document from his city of birth, the police record, and his court record and they all expire in 3 months time, so they are not something that you can get too far in advance.  The file may take a few days to a couple of months to reach NVC.

I guess I am ignorant to the DCF option as it is not available in Morocco, but.... wouldn't it make sense to file by DCF and withdraw the petition that was sent in June?  Sure it's a loss on the filing fee, but it would be much faster...

If you have a lot of photos I had over 300. I printed them in a postage stamp format with one full page of our wedding photo. I did not identify all the people and events. I should have use a cover page that list them. I did put all the other things that were suggested. Also put email logs and selected emails. I also had posted my marriage on facebook and people who commented. I put copies of the pages from facebook into the application. I still waiting for my NOA2 so I will see if this was enough.
