If you are using assets vs income, yes. But if you work, and have filed taxes, you use tax transcripts and current paystubs. I submitted transcripts for 3 years and pay stubs for, I think 6 months. Hope that helps! Good luck

Yes, the NVC process can be drawn out. They give 1 year from last contact. So if you wait and submit AOS, then give it close to a year and submit IV papers, it can take 2 years. I'm not explaining it well, but Saylin might explain it better in the monthly NVC thread.

For what it's worth... I don't think he is guilty. I just asked my husband about the situation and he said that in Morocco, since he was found innocent, it would not be shown on either record anyway. I say give it a try. If it would make you feel more secure, consult with some lawyers. Just answer honestly to the question, and give the explanation that he was found innocent of wrong-doing.

If you don't put it on the form, and our government finds out about it.... that would be misrepresentation and look like he's guilty of a crime whereas I'm sure the persons death was not the intention when he fought to defend himself and his family. Things happen. If misrepresentation is discovered, that could result in a ban from entering the US. Truth is the only way to go when dealing with our government in these matters. Best of luck. It's best to disclose the truth. If it was deemed self-defense, that should not be an issue. What would be is not disclosing it, and the government finding out about it during background checks.

At the NVC stage, he will submit both the police record and court record.

As hetty&said stated, they expire in 3 months. My husbands expired while at NVC. He brought new ones to the interview, just in case, but they did not ask for them. I would recommend having them at interview in case they do ask. Good luck!

You will need a lot of supporting evidence front-loaded with your petition. It's not impossible, but it will be difficult. Read through alll of the interview experiences on VJ for Morocco, if you haven't already. Also, do an advanced search on here. If you are only going for a couple of month like I am to Brazil. I not going to deal with them at all enjoy your time with your love one. Your co sponsor will be the one who has to do most the paperwork. You will first have to pay them before anything will happen. Good luck

I received my NOA 2 but my wife now wants a divorce how do I cancel the visa. I have not payed any thing for the AOS or the DS260. This just turned out to be a big waste of my money. I won't go into the who story but I spend over 20K helping her build a Apartment. I hope all I have to do is call do I have to send letter I have three visa to cancel her and the two daughters. To cover the minimum requirement for AoS I need to file with a household member so my questions are:
1. How much do I need to show?
2. And is that a combination of my income and the household member income or the household member has to cover the full amount?

This might be a stupid question but I was reading the instructions and I know for sure that if it is a joint sponsor they need to show the full amount.

"A joint sponsor must be able to meet the income requirements for all the persons he or she is sponsoring without combining resources with the petitioning sponsor or a second joint sponsor"

OK i talked with the NVC and they said that I can only pay the $70 fee as the $400 has not been generated yet. How would I know if it has been generated will the automatic system tell me this information once I call them. The only thing is telling me right now is that they have recieved my approval notice and that the lawyer will get the rest. I talked to the lady at NVC and was told only to pay the $70 as the $400 has not yet been generated. I wanted to know if someone has done this before. How would I know that the $400 has been generated. Please help. thanks.


Of course you cannot pay if the bill has not been generated. they won't know how or where to post the payment. My understanding is the automatic system is updated as things change. So when the IV fee is generated the system should indicate such.


Thanks for the reply...i am seriously looking for any help bcz the lawyer is saying it might take another 6-7months for my wife to be here...its already been long thanks to VSC.

Anyways, what happens if I pay the AOS fee...will the case be forwarded to the benficary country. Also if the IV Bill has not been generated then why is showing up under my NOT PAID at NVC payment website.

Your I-130 case does not go forward to the consulate until all steps that NVC performs are complete.


So how long does it take for the NVC to send the AOS & IV Fee Bill to my lawyer does it take week or longer.The automatic system says about 6-8weeks for lawyer to recieve the paper. By paying the bill online does it make the process faster or just the same. I was reading on one of the post here at VJ that paying the bill makes the process quicker as the case is completed and forwarded to the beneficary. Do you know why the IV Bill is showing under NVC website to pay if it has not been generated has this happen to you or anyone else reading this please reply.

In regards to your plan, the bigger challenge that you'll face is in the next stage of the application: filing the I-864 (Affidavit of Support)

 

How are you going to prove domicile if you moved out of the country. 

Are you planning to quit your job (assuming you are working right now)? 

If so, who will be sponsoring your husband? Do you have a joint sponsor? 

 

The latter 2 questions can be overcome if you have enough savings but the domicile question is a bit more tricky.

Unless you are using a courier service like FedEx or UPS, I would highly suggest that you mail the I-130 package from within the US. 

 

They do not take credit card for the fee payment. Check or money order only. If it's a choice between sending a check from a Canadian or US bank, I would go with US.

Re-read Saylin's guide for Montreal beneficiaries again and if you are still confused or unsure, then you are probably overthinking it.

 

Enrolling in EP (Electronic Processing) for Canadian beneficiaries is still optional but highly recommended and sending the email requesting to be enrolled is just a standard procedure. I do not see any scenario where someone would get denied for EP but strange things do happen from time to time. Once the opt-in email is sent, you just have to wait for a confirmation of enrollment email from NVC and then you can email both the AOS (I-864) and IV ((civil documents) packages  to NVC.

We filed in my previous name (im the beneficiary) as we filed right after we got married and I hadn't returned home yet to change my passport. We will change it when it gets to NVC by providing my "cancelled" passport in my previous name and supplying my new passport in my married name. I hope that works. I have heard here that is the way to do it.

i was reading the consulate info about the visa... i lived in the US ilegally when i was a teenager left the country almost 4 years ago when i was 17 and married to my USC husband... i asked immigration lawyers before i started the whole thing if since i was underage i dont have to wait the 10 year bar and they all said i dont have to, but u guys are saying u r having a tough time with ur lawyers and the consulate doesnt say "unless u left the country when u were underage..." ive sent this question to the consulate a long time ago to USCIS a long time ago never got an email back... what do i do?

Yes.

 

So I'm trying to fill out my mom's I-864a to send to my wife to keep for interview if it is asked as recommended, but I am not sure on several parts since most things are either 0 or don't apply since she does not work and is stay at home.

 

-Relationship to sponsor,  (would this be relationship to joint sponsor (my father? or me)

 

-Employment. my mom doesn't work she is stay at home so should I just put unemployed (she has a pension from another country but it is not necessary to report so I'd rather not)

 

-Tax info, I would copy from my father's (the joint sponsor) I-864 and i guess also attach a letter why they didn't file taxes like I did for my father's I864 since its married filling jointly right?

 

-Finally at the end of the form would the housemember signing be my father at the end of the form?

 

Also is there any modifications that would have to be made to my father's I864 because of this? (if so I guess I would modify that and then send both to my wife incase they request it)

I did add the attached letter explaining taxes as sugested for both me and sponsor along with w2 and an employment letter and a pension letter.

 

i did not do an i864a for my mom but to be safe as you said ill have my wife have one ready to present if requested at interview.

Understood, So I filled out I864 for myself and one for my father. Then I drafted letters for myself stating I didnt earn anything and didnt file taxes at all last 3 years because i didnt meet threshold and I also wrote one for my father for 2011 stating he didnt earn any income that year and was "out of the country."

I also didn't check the checkbox asking if I filed for all last 3 years on either form.

 

My I864 is basically all zeroes except for bank account but my father's is def above the threshold. My only concern right now is household size, 

In my I864 put 2 (me and wife (immigrant)) and for my father I864 I put (dad, mom, me(im dependant so must be listed), and my wife (immigrant),

So between both it makes it seem as its a total of 6 people, is that right?

 

I think that's it and I am ready to send the AOS as long as all of the above is right.

I appreciate everyone's help very much! Maybe I can contribute by posting here my 'did not file taxes letter' I wrote since i couldn't find a nicely formatted sample one in the forums. but ill wait until It's accepted ofcourse :)

I am siding towards doing what dwheels76 said since it seems to cover all my bases regardless of residence (each file I-864), but the advantage of doing it with an I-864A for my father is that in my I-864 I can add his income and it makes it look better than my I-864 being all in O's (no income, no assets) and my father providing the full sponsorship. Basically I want interviewer to see I am living with parents and not magically surviving on my own without any income at all. That way I think there is a lower chance of asking for another sponsor based on my father's income not being so much higher than the required income.

What do you guys think? I just want to do the right thing and not merit a delay.
