you each need a letter of intent to marry signed by each of you and also your proof of meeting in he last 2 years. your visa stamp is a part of it, but you need hotel receipts, boarding passes etc.

you can prove you went to her country with the boarding passes and visa stamp. your pictures together are secondary since they could have been taken 4 years ago. you need something that shows you were with her at a specific time or place in the last 2 years. hotel receipts in both your names, your picture in front of something that has a date on it, like a money exchange board.

here is the reason for K visas hitting the backside. thsi article says 2.5 million petitions were filed by immigrants for immigrant benefits to beat the fee increase. Everything from International adoptions to naturalization and other benefits. all these get priority over family based visas.

its so backed up they they are sayign its a year wait for them now.

dont remember the post or if it was even on this site, but a year or so ago there was a post about a couple going thru their AOS interview to prove ongoing relationship and adjust her status. she was also pregnant and showing and the couple thought it would be a shoo in. after the interview the guy was very irate posting that the interviewer claimed his wife being pregnant only showed SOMEONE had gotten her pregnant, but it didnt prove the Husband fathered the baby or prove they had a legit relationship. most of the post was the guy ranting about the interview and how rude they were. I think he also didnt have much other evidence to show they were a married couple.

while i think you being pregnant is proof enough, i think you should get other evidence also just in case.

you only have to prove you met in the last 2 years at the filing stage. any bills or receipts with both your names on it. also pictures that show a date( not one from your camera) are freat evidence. go to a bank currency converter and have you picture taken in front of it, they always show todays date and the currency rates.

we also had pictures taken opening night of the last harry potter movie. it opened in july 07 and we have pictures in front of the now playing movie poster with copies of our tickets. dates from a camera on the photo dont mean much, you can program them to show any date.

you can also have your picture taken holding a current Newsweek and then submit that cover with your picture, it would show the date. most of your living together things will prove ongoing relationship at the interview stage. they just want concrete proof you have met within the last 2 years.

ok, first you cant transfer a K1 to K3. either you are doing a FIANCE visa or you are doing a SPOUSAL visa. You have to abandon the K1 if you get legally married.


Now they need to find out from india, is their marriage binding. is it legal. does everyone there including the family think they are married? Does India tradional and culture say they are married. In some Indian cultures, it doesnt have to be registered to be legal and binding. this is very treacherous to be messing with. IF they are married and continue with the K1 fiancee visa, the beneficary can be deported and banned if found out. and it happens.

the married couple need to find out there if their marriage is legal if it isnt registered. Are they living there as married? to all including family and government officials, priests etc ?? they need to find out. you wont find your answer here except you cant transfer the K visa. you have to start over if you marry.
if they are married they will need to cancel the K1 visa and apply for a Spousal VIsa. CR-1 or K3 and they will have to do the medical and interview again.

since you just submitted your petition, your touches are for NOA1 notice being printed and the second one is probably for it being mailed out. most of us got a touch or two when first recieved. then you sit and wait for 4 months or so hoping for the next touch. the system updates at 2am in the morning so you would have a sunday touch when its really a saturday working and it updated on sunday.

Do you even know for sure you are divorced? you will have to give them certified copies of your divorce decree. you will be denied if you dont have that. first you will get a RFE for the papers. you also cant file unless you are divorced. so if you happen to only be separated, you will get denied also on those grounds. i think you should try to find her via her family etc and see if she ever filed for divorce from you. that is something major that should have been taken care of before ever filing the I 129 f. i think you just wasted you filing fee unfortunately. you have to get that resolved and quickly. you only have so many days to respond to the RFE when they ask you for the certified divorce decree.

that is more than just a pondering, its a major stumbling block and a garaunteed denial if you dont get those papers. they look closely. every petition has a checklist of papers they must include. if you listed you were married previously, as you should since they will find that out then you have to include that divorce decree.

costly mistake and time consuming now. before it cost you $170 and your NOA2 in 56 days, total to interview was 140 days.


Now it will be $455 and your NOA2 will come in 140 days. your interview over 200 days. hope you can get it re-issued. if not you are back to square one. wow, what a blunder. thats like the couples that get their interview scheduled for K1 and then go and get married.

no you are incorrect. here is the instruction from the I-129F form,

your filing of this petition
unless:


it says have MET in last 2 years,. doesnt say anything about on-going relationship. that is proven at the interview stage.

No need to go back to HK. Just dont tell them your intent was to marry prior to your arrival in the US. You already in the US so why would you fild a K1 visa in HK when you will have to go back to do it?

The reason i'm concerned is that i spoke with an officer a few weeks ago and he claimed their rules regarding the NOA1 are suspended. They will NOT investigate after 90 days. You are STILL accountable for the application even if they process it 5 months later...ie he told me "dont you dare cancel your check after 90 days because you'll owe the US gov even if they they find it well down the line" ...........and most importantly he told me if the 90 days is up I'm tough out of luck. My only choice is to send another application ie. get back in the December line and risk that they'll cash both checks if they ever find my old application. There is no cut off like there used to be. (ie. wait 4 weeks then wait for a 30day investigation then your safe to reapply)


Call again. Some those people dont give the correct info. Sometimes you will get a different amswer each time you call. Ask to talk with a immigration officer when you call not just a customer service rep. You can also contact your local Congrees reps office and ask for help. Make sure to tell them what you were told.

My 129F was received on 10/23/2007 and I get the same generic update also. I started a online account account the day I received the NOA1 and nothing has every changed for the update status so not sure how this happens

At 75 days, no difference. Letters will only will only help you if you get past 6 months of waiting. Current wait times are about 4-5 months.

If you are from the US going to Canada then you have nothing to worry about. Before I moved to Las Vegas I lived in Michigan and drove to Canada many times with no problem. They just asked to see my DL or passport. It should be very easy for her to visit you also.

We used a lawyer in Las Vegas and it only cost 1000.00 US dollars. But I did do research before. I found a lawyer that is talked about and one of the best in Las Vegas for immigration. His office is actually in the imigration building so he knows alot of the people there. My point is make sure to talk to people in your area and get facts before. I used this lawyer because of his status in the area and know he will make big things happen if needed.

I have a lawyer and I signed up on the USCIS site. Its not anything your lawyer will be doing because the lawyer gets a copy of everything mailed to them.

if this is in fact needed, of course I will take steps to get it sent to me, but then this should also be added to the checklists here because it seems to be missing... perhaps this is less of a big deal for most, who will attend interviews in their home countries, but I know I'm not the only one living abroad, so this would be useful information to more than just me : )
or perhaps I've misunderstood the guides, and they only show what the petitioner needs to send the beneficiary before the interview, but then in that case perhaps a more comprehensive list could be published?

The Petitioner (US Citizen) usually sends a copy of his BC or Passport when the petition is filed in the USA. the Benificiary has their BC at the interview with all the other forms, proofs etc. At the interview the embassy can ask for the originals of both BC if they feel its needed. if your girl cant produce it, then there will be a delay. like was posted before most just get a certified copy online. the embassy might not ask for it.

and thats "IF" he can get a tourist visa for his thia fiance. my understanding is philippines, thailand, malaysa, Indonesia, china, etc have almost nil chance to come to the USA on a tourist visa. I could be wrong but id be very surprised if she got a tourist visa. and then she'd be overstaying the visa waiting for the K1 to process and if they married in the usa while she was there its visa fraud also. Too many bad things to go wrong there.

his best bet is to get his US citizenship and then petition her.

and telling you to commit visa fraud and lie to the US government doesnt bode well for her moral character.
its simple, if marrying in the US then you can do fiancee visa. If marrying in the phils, then K3 Spouse visa. you can always go back to phils and have a wedding after the USA one, of have a big engagement party there in the phils before.
