Since its been over 6 months contact your loacal congress person and they will call the service center for you and find out what the status is. I know someone that had the same issue and the congress person called the service center and found the case was left on someones desk.

US Citizen has a 10 year IMBRA hold that will need a waiver filed in order to file I-129F for another person.

Foreign citizen does not have such a limitation.

I know how you feel and think its BS. We filed at the CSC in October and still waiting. They raised the fees in July then said it was to hire 1500 new employees but it didnt make it any faster. They dont care about us and the ones we love. Our country spends 100's billions od dollars on a war that should have never been started. The housing market has crashed (I lost 90,000 on my house already) and the American dollar is worth less then Canada for the first time in 50 years. We have a stupid president to top it off. Point is our country is screwed in so many ways. We see approvals in less then 2 months at the NVC and over 6 months at the CSC. They need to open the Texas again to help with CSC. Anyway like everyone says we have no choice.

Every little bit helps. I try to send as much as possible each time to make it last lonegr. I also called Citibank and requested a card with her name on it. I am actually in the Philippines now visiting her for the 3rd time so I just brought the card with me. You can also mail it just dont activate the card until she receives it. Just need to make sure you are giving the credit card to someone you trust very much. My fiance is a nurse in the Philippines so she doesnt need to much but I do help with things. I paid 600.00 U.S. dollars for her to take a 3 month United States Kapland nursing class to help her get ready for the test needed to work as a nurse in the United States. You have to look at the big picture in the long run when your fiance is in the United States she will be helping you alot more then you will for just a few months. Just make sure you both agree on when and how much you will be sending back home when she gets there and starts working. Some will think they need to send everything they make. Another good thing to try in just get a bank account to put money in that you want her to have. get a ATM card for that account and send it to her. Doesnt need her name on it because she can go to a ATM and get the money out when you put it in the account.

I sent an email to the embassy cause if you go they don't answer your questions unless you an appointment, they sent me an email back saying: "The package received from DOMESA contains a smaller envelope, your passport and instruction sheet" but they didn't tell me if I can open it and get my passport...

It really looks like a normal regular manila envelope...

We have been together for 4 years, he made the petition for my K1 visa last year, last Friday (04/04/08) finally my visa got approved!! (after a long process) we are very excited, but we had plans to go on a trip before going to USA, but we realize that my passport in inside of the manila envelope that the embassy sent to my house yesterday....
What can I do? I don't want to open it and ruin everything, but I really need to travel before?
Is that a problem? or I can not travel before going to the USA??

hi, it doesnt matter if your fiance did not sent your BC and pasport copies because it did not ask at the application form, just dont worry much just wait if u have FRE then thats the time u send it at uscis, BC and pasport will be needed on the interview, just be patience your noa2 will be there soon....goodluck.....

What do you mean NO? YESSSS - of course you do.
My husband and I submitted 5 e-mails with translations. USCIS says you cannot do it because you're biased, so ask a friend. Some people say that USCIS allows someone in the relationship to translate - but do not take the chance. I was allowed to be my hubby's translator at the AOS interview (for examples). But we brought a friend just in case.
Anyway, EVERYTHING that you send to USCIS needs to be in English. For the interview it's different because you're in Brazil. Good luck.

Ok, i was being patient, i mailed my K-1 packet in to USCIS (cali) March 5, they received it, I received my NOA1 with receipt WACxxxxxxxxxx
I waited and waited, ok, no problem, i know it takes a while. Then today, I check USCIS site (which i registered on and checked with my login data many times before) to see if any change or maybe a
touch, this is what I get.....

however there is a guy on theworldoffilipinas.com who just receved his NOA2 approval from CSC, and he has never met his filipina fiance. he has mental fatigue and financial hardships he says and got a lawyer to say he cant travel. he got approved yesterday. it will be interesting to see if his fiance is approved in manila. and he is not wheelchair bound etc. he looks fine to me. i dont know how me will afford her expenses there for the visa or the AOS here in the states. im not even sure how he afforded a lawyer. he seems to still live at home. his posts said he asked his dad if he could marry the girl. they have chatted online since 2004. He did get a RFE for more on the relationship, so he wrote them a letter telling them it. he posted his letter back in may. he filed in march but the way.
in the end, he did get approved. he posted the email stating the approval.

like said above, you will be denied. you must have met in the last 2 years physically. webcams and chat logs and phone are not evidence of meeting, only evidence of a relationship. two entirely different things. And you have lost your filing fee. You will have to meet first, then file your I-129f. when did you file? they will probably send you a RFE right away which you cant respond to. So you should wait until you get the request for evidence. then cancel this petition so its not pending and messing up your next one with all the correct requirements met including meeting. you will pay the newly increased fee as well of $455. but you havent met yet so thats a moot point. but your current petition is doomed to be denied.

If you filed in july here and you dont get any RFE's you can figure she will have her interview in feb or march 08. I wouldnt hold your breath for anything sooner. even april is a possibility for her interview. We filed also in July. I have look at hundreds of timelines from july 06 onward, specificially philippines immigration to the USA. all were 6 to 8 months. Most were 8 months. your nov date for being approved here in the USA is on par. its 4 months here and 4 months there to run its course. it might be slower for us since the fees increased and there was already a backlog of sorts. 2 months after noa2 to get an interview is too quick for manila. it will take a month just for manila to recieve the packet from NVC here in the usa.

if you have time and nothing to do you can read thru all the threads on theworldoffilipinas.com since those are all philippines based immigrations. you can look at everyones timelines and calculate your own average. only immigration from canada seems fast. but the phils is 8 months average.

Tim daisy was quoting the USCIS and Visa journey guidelines. For the I-129f pictures are "secondary" evidence. boarding passes, visa stamps and airline ticket copies are "primary" evidence. the important aspect of the I129f is that you met in the last 2 years. pictures dont always prove that. they just prove you were together at some point in the past and dates on pictures can be faked etc. i wonder what proof you didnt submit that caused you to have a RFE and that they requested more "pictures" from you. i bet they requested more "evidence" from you and you chose to send more pictures.
you say your I-129f was denied because of lack of pictures. but then you say you needed snail mails, emails and phone bills. so im confused on what you were denied for and what you resubmitted.

either way, timDaisy is quoting official guidelines and thats what they deem primary evidence and secondary evidence
and it would help beckypua if you filled out a timeline so we could place your comments in context. you are removing conditions so you are now in AOS process?

actually right now its easy to prove you've met in the last 2 years. take a picture of you and your other holding the last harry potter book. dont even have to buy it, just go to book store and take the picture. the whole world knows that just came out in july 07. we happened to go to the newest potter film ( order of the phoenix) on my visit. we had a picture of the movie poster showing date of release with the words now showing on top, had our pic in front with it, and submitted the movie tickets and receipts. it had the same effect. pretty much everybody know all the hoopla surrounding the book and movie release. no way me met anytime earlier than july 07 since we have picts with that.

of course i have all the plane tickets, boarding passes, visa stamps etc in addition. but the pictures place us at a specific time.

you dont have to use Harry potter but similiar things work. holding a copy of rolling stone or newsweek with date on it and then submit the cover. etc etc.

If you com here on K1 visa, you will only be able to work for the first 90 days while your I-94 is current. then you will lose that privilege until you get work authorization. it will not come fast, 6 months to 2 years i believe. That is why you fiance ( if she is that) has to support you. if you must have a job here before marrying then the K1 visa is not for you. as stated in other posts, you should marry first, do the CR-1 visa and when you get here you can get your green card and work fairly quickly.

if she comes here on a tourist visa intending to marry you and stay, that is visa fraud. it will be alittle hard to explain if she comes with everything she owns. If you are planning to marry, its best to have her visit and do the K1 but she will have to go back to the UK for her interview.K1 would be the fastest for you. If you are getting married and she is coming on a tourist visa, you're better off to do the K1 or CR1 visa. Still she will have to go back to the UK. She cant just come here in Oct with all her things planning to get married and stay with you. Immigration doesnt work that way even from the UK to USA. be very careful here and read the guides. if they find you committed visa fraud your girl will get a 10 year ban and be deported. Either way, she CANT stay for good when she comes. We all wish it was so easy. If she was here on a student visa or work visa then she could marry you while here and stay. but any other visa and you're busted when you try to adjust her status, and you cant claim you didnt intend to marry if she has brought all her things and come to stay.

2. she came to the USA on a "RARELY given tourist visa. that alone puts her in the 1% top of all filipinos

3. her aunt somehow married her off while she was here and forged her name on the marriage certificate. no info is given on who attended or if you fiance was there. If that is the case, why did she leave? why didnt she adjust status and stay in the usa? If she went back was the guy doing K1? why would the guy marry her and then do nothing to get his wife to stay with him?
4. it doesnt show up on the Cenomar. is she married? is she single?

5. her "husband in the USA" grants her a divorce and pays for it though they have never really been married or together?

all this piled together says either you havent posted all the pertinent facts or your fiance isnt telling the complete story to you and is thus not being honest. And i can tell you for sure, the embassy will ask much harder questions then were asked here. i hope you have a very good attorney. ive seen many tell the filers that their girl will be in the usa in 2 months tops. Some of them give bad advice. i hope the one you have is on the mark and you get thru everything with no problems. No one here wishes you bad things. in fact most are concerned for you getting taken. maybe you could step back and look at it and then see why people here are seeing red flags everywhere.

Are you kidding Melody? that is some very bad advice. read what i kept in his quotes. their whole relationship will be questioned and her motive for coming to the USA. they need a very good attorney and immigration lawyer. your case and theirs have nothing to do with each other. did you marry your ex at the same time you met you current husband and started your current relationship???????

they dont give you a touch just because you called them. it was just good luck that you got a touch the day after you called. your second touch is confirming they are working on your petition now.

If you are married to your husband, then you have to file a I 129 and a I 130. You cant file a petition for your husband using the fiance visa. you have to file a K3 spouse visa and thats the I130. Sounds like you need a new lawyer and get your money back from that one since they dont know what they are doing. If your info is correct.

well i'll see how you feel when your timeline is at 140 days with no NOA2 like a few posters on here. in the last 30 days there have been 32 NOA2s from CSC. thats averaging one a day

theres currently 334 waiting for approval on here. that begs a timeline of 334 days for approvals on those.
I'll let you know where the stats show they are working hard and diligently. until then, i think my snipe is fairly accurate.


but i would love for them to prove me wrong. please have them prove me wrong.

i read on here one month that 2000 ( i forget the exact number) petitions were filed with USCIS, and a few weeks later someone posted that 210 (again i forget the exact number) or so filed petitions on VJ that same month, so i just figured it was a 10 percent ratio. nothing scientific or even accurate really. just a guess based on those two things. no matter what the % is, we have had so few NOA2s in the last 4 weeks, yet theres so many petitions pending, and we all know it only takes 15 minutes to approve the standard petition. And there are more than one person working there at the 2 centers. so are they really busting out NOAs and its just the luck that none are here on VJ?
you think VJ is 1% of the petitions?

we are left to wonder......

I'd have to say that the good news is they are actually open for business, though im not sure anyone is actually in since they arent giving NOA2's with any kind of frequency. especially when it only takes 15 minutes to approve a petition whistling.gif . no way the 10 % of all filers that happen to be on VJ arent getting more approvals or the unlikely event that every one who isnt on VJ is getting approved. If they are so backed up, you would think they would be going a little faster than normal to try and clear out the backlog and increase the daily quotas for each adjucator. helpsmilie.gif

the other good news is there is no cap on K1 and K3 visas per year , so eventually we will all get our petition approved. course it may actually be next year when that happens. mad.gif

lastly the good news is they seem to have good job security there at the centers. if i was as inefficent at my job, i'd be fired before long. I think they have surpased the US postal service for the slowest government agency. I could be wrong, blink.gif
