I still stand by my post. They will look into his naturalization ( which is via K1) and they will look at the timelines in his past. I think his previous K1 naturalization will certainly cause extra scrutiny. Of course, RebeccaJ0 is always correct and i am always wrong. We are never with the same opinion.

He came here on K1, got divorced but was able to stay to get his citizenship and now is wanting to bring his previous lover from Thailand here to the USA. That is a classic description of visa fraud. Hope things work out.

I wouldnt worry about it. once you have your NOA2 in hand, look to the next hurdle.

oh gosh, don't scare me like that! first i was holding back my expectations thinking it would be 8-10 months, but now i'm fantasizing about summer vacation together!!!



Back when i filed in July there was a june cuban filer who got his NOA1 to NOA2 approval in one month. They have an interview in Feb 08 and from filing to interview it was 247 days, so the one month NOA2 only gave them a normal 8 to 10 month timeline. You should search on here for other cuban filers timelines. You will see the average time from filing to interview is 8 months. Maybe you will get lucky and it will be about 6 months.

Once the visa is issued it is good for 6 months. if hers was issued 4 months ago, then in 2 months it will expire. Once its used if you dont marry within 90 days then the visa also expires. It is only good if she marries YOU. she cant come here and then meet someone else and marry them and adjust. So even if she comes here within the 2 months left on the visa, she cant stay if you dont marry her. After 90 days she has to return.

Actually you are incorrect on this one. There was a K1 visa petition just in the last 6 months that got a hardship waiver. They had never met, the guy had some mental problems and was on disability. He had letters from his doctor, and his pastor. He was approved and his fiancee came to the USA last november or December.

She was from the Philippines and couldnt get a tourist visa, and he had physical disabilities and couldnt fly and he had financial hardship. They used a co sponsor ( the guy's dad) and on his last post on another website, they were very happy to be united and getting married. Their timeline was as normal as anyone elses. They had never met and used the hardship waiver.


I will admit its a long shot for most petitioners but they did it and recently.

Then she said my fiancee's adjusted gross income is not enough:( the she gave me a green form and said ''You have two options, you can have a co-sponsor or instead of a new sponsor, my fiancee's 1040 and W2 2006 showing adjusted gross income at least 16.500'' I was confused and asked to officer ''Did I get approved or get denied'' Officer replied ''Actually you are not denied but your fiancee must meet finacial requirements '' I was so sad. Now we are planning to send my fiancee's 1040 and W2 for the year 2006. We dont want to ask my fiancee's dad for to get me there my fiancee wants to this with her possibilities. We want to try first to use 1040 and W2 for 2006 option, I wonder If We fail this option then will Embassy deny me or will they ask for co-sponsor?

by the way, interview isnt scary thing, just be self-confident, honest, calm then you will be ok good.gif

If you havent filed yet, yahoo chats arent goign to prove anything for the I-129f. You need aitline ticket receipts, hotel receipts, visa stamos etc. They are only concerned have you MET in the last 2 years. Not that you have a relationship per se.

Once you get to the interview stage, Then you prove on-going relationship with emails, letters, phone records, chat logs, etc, and you only need the first page showing the date of chat and a few for each month. You dont need hundreds, just a sampling over a period of time.

I didnt submit ANY chat logs with my I-129F and we were approved. Save that stuff for the interview. Dont put too much stuff in your petition for the USA side.

You didnt tell your guy until WAY after the papers were filed and everything scheduled. You created this mess. You should have told your guy and straightened it out before he ever filed for you. You will now probably be in AR for an extended time and your guy is caught up in your mess now. what were you thinking hiding this part of your past???

This will be caught when you go to interview. Its why they now do the document verification. Women there will get a new name, birth certificate and passport to circumvent having to get an anullment. It is widespread enough they now verify every document to make sure its not forged and its really registered with the NSO. They will check her and if they find she is fraudulent they can deny her and put a flag that she is trying to get a visa fraudulently. That carries a ban with it. Be very careful here.

Your I-129 F is not valid and you cant put it on hold.You both were not free to marry when you filed so its not any good period. You will have to start it again after her anullment. Secondly the G-325A has information on it that is fraudulent now since she was not truthful on hers. You send in the I 129F under penalty of perjury that the information is true and correct. They will not take this omission lightly or that she has 2 birth certificates and has a prior marriage.

Thirdly why did she wait all this time to tell you when clearly this needed to be dealt with before you filed. That would be a MAJOR red flag on her.

You have a mess on your hands and its not going to clean up easily. My advice is to cancel the K1 before its process in manila and verified. Get her anullment and then reapply, possible with a K3 since you will have IMBRA to deal with filing 2 petitions within 2 years.

What you have here is serious and you need to stop the K1 before it gets worse.
Get her anullment, then reapply.

Anullments there cost and take time. Good luck...

from USCIS point of view , it will be on them to prove they are NOT married for the K1 visa. That is no easy task when you send them wedding photos. How do you prove you are NOT registered??? try that one. It is not for USCIS to prove they are married.


They have an uphill battle and it would be easier to cancel the k1 which will in all likely hood be denied after how many months. They may as well get married again in april. The time to research and find the quickest way for her to come here was before they filed and included the wedding info.

Now they are stuck in damage control and its not going to be quick. The damage is done. Unfortunately she will not be entering the USA asap. They will get a notice of denial, or a RFE, or be put in AR for awhile. And in the end after all that if they get to an interview, the interviewing consul will probably deny based on the wedding photos and him admitting they got married. The non legal non binding wedding with K1 works when you dont mention it. If they see anything that looks like a marriage, the K1 is off and the burden is on the petitioner to prove they arent married.

Well, if you sent pictures of your wedding in with your K1 application and told them you got married, then they will probably deny you even if its not recorded anywhere. Its not for them to go digging to see if it was a legal marriage or not. Your pictures and admission will be enough for them to deny the fiance visa. You will have to file a Spousal visa K3 or CR1.
An attorney i think will be a waste of time and money. from the view of CSC you have filed the wrong petition.

You might even save some time and have them cancel the K1 and then file the K3 or Cr1. It will save you several months.


Fiance visa means just that, Fiance. If you married her then she is no longer your fiance.

I have to ask did you research any of this before you started? You might have been ok since your wedding wasnt legal, by just not mentioning this "quasi just among friends with a priest" ceremony, but to send CSC pictures of it and tell them you got married, that is asking for a denial.

If you are going there to marry her again, you have to file a K3 or CR1 visa petition. Your K1 wont be valid.

If you gave them 2007 tax return, they will want to see the W2 associated with it. If you gave ITRs then they wont.

If she worked in another country they will want the police clearance, even if she only worked there 180 days.

I am 44 and my fiancee is 21. Our age gap was not questioned but i was at the interview with her. We had tons of evidence too. Did you have alot of evidence of your relationship? we had 4 or 5 sample chats and emails from each month for over a year, 40 pictures, about 30 cards and letters, ATM receipts, trip receipts, webcam screen shots, a year of phone bills etc. They could not doubt our relationship and age gap was not an issue. Sounds like you didnt have much to show if they are questioning your age difference, thus questioning your relationship.

The US embassy can ask for anything they feel is warranted to help them process a visa application.

We filed in july also and had no problems.

I did it, and so did many others, and its her "homework" and they are wanting someone else to give them all the data. There's nothing hidden in the fees. And if she already did the process then she knows all the fees.

When the petition gets to NVC, the beneficiary is investigated.

Then when the petition gets to the embassy, the relationship is scrutinized to make sure its real.

Hi, if you will search on here for this topic you will find alot of info on it and numerous threads. CSC ships once a month to NVC. They do that because its cross country shipping and they have a crate that they wait to fill up before sending. A lot of us waited about a month to get to NVC from CSC.

Vermont however is very close to NVC so they send every few days.

Honestly, I don't know if a lawyer would be able to help out too much at this point (though it couldn't hurt - unless it delays things). One thing you might try would be to go into the US citizen services section (so that you can make it past the front door), and ask to speak with someone - it's not going to be easy, but if you keep asking to talk with someone, it may work - don't get angry, don't get offensive, but keep pushing. You want to undo that withdrawal - you want to talk with someone - you want to talk with a supervisor - you want to talk with the Consul. Keep at it, and you may get somewhere.

Oh, and another thought is to contact your Congressional representative, a senator or representative can do amazing things when it comes to the consulates. They're helpless with USCIS, but DOS is responsive. In fact, I'd email them this weekend, before I went back to the consulate. That way, if things don't look good, I'd sort of let that slip into your conversation - you may find that it encourages them to listen to you more closely.

Good luck - sorry to hear of how things have gone for you. I sure hope that doesn't happen to us!

Hi, while i feel really bad for you, how do you feel its the consuls responsibility to be an expert on Indian law? He is responsible to research and process Visa's to the USA. You applied for a Fiance visa, that means you are not married. Then you show him pictures of your wedding. Its not his job to research the legality of your wedding. He will go off the information you submit. You doomed yourself.

there are so many topics on VJ about non legal ceremonies and the K1 visa. How did you miss them saying to keep mum on any non legal ceremony, and it was dangerous ground? It is up to you to now prove you are NOT married and its very hard to do.

There are numerous couples who have a ceremony that is non legal while on K1. They dont blab about it to immigration and they certainly dont show the consul pictures of it. You will be stuck getting married legally and then applying for a K3. If immigration gets any wiff of a wedding on a K1 its over.

They wont accept a CD.

They want hard copies of what you are submitting. The workers deal with file folders and most of the government computers will be locked down and they cant put in disks etc to copy things. think about it.

Also they wont include the CD in your file because they can get broken easily with all the shipping it will go thru to get to DC. You should submit in the format they ask for. Just follow the guides here.

I would call the embassy or sevice center to get more info. I would try to cancel it just to be safe incase you need a K1 later they might hold it against you if you dont

I did the same just to get things ready but may need to ask for the letter again later because the process is taking so long to get approved. My employer just put the date I was hired, current position, total anaual salary and the location I work at. I would rather have to much info then not enough info. How did you get approved so fast? we filed in october and still waiting. My fiancee is in Manila

If there is no father named on the birth certificate, then everything about "father" is "unknown". If the father's name is there and you just don't know where he lives or was born etc., then you put the correct name and write "unknown" for anything else that is unknown.

I would find a way to get that logo. It ask for it and from what I have seen in the past you want to always give what they ask for so they have no reason to ask for more info. I would just get a piece of paper and print the logo on it then have your boss enter the info then sign. Remember to much info is always better then not enough.
