Hello all,

I will be getting married in November, 28, through the church in Colombia. I have all of the necessary paperwork and evidence needed to submit for a k-1 Visa this week. My fiancee and i got to thinking if it was maybe easier if we got married this upcoming May civilly as far as the Visa goes.

November is 8 months away if I start the K-1 now, and would be 6 months if I start the k-3 in May.

What do you guys suggest? is a k-3 more certain than a k-1 to get?

I lost my job three weeks ago. I just received NOA 2 yesterday. Should I wait to fill out the I134 untill I find a new job or should I just send in a copy of my tax returns for the last couple of years? Is it even possible to fill out the form with no job listed? I work construction as an Electrician. So job loss does happen on occasion. "Construction the only job you work yourself out of!"

After the Visa is approved she needs to pay to have the Visa delivered.
How much is the Visa delivery fee?

When do we need top pay for the Visa? Before or after the interview. On the guide it says to bring a "BPI Validated receipt of payment of Visa fee (DS 157)" As one of the required forms.

Now I also read that you need to pay for the Visa AFTER the interview? So I am confused as to what is correct.

Awww I know how you feel. Had to do the same thing while waiting for my K-1 last year. I got through it by talking to him on Skype so I could see him everyday, and we would email and phone (A LOT) as well so there would be something to look forward to when we woke up. I talked to him him so often through the computer and on the phone that it didnt seem like he was really that far away. Once in awhile we would send an unexpected card or package, and he would have flowers sent to me too. Planning and counting down days for the next trip would make it easier, and then there is always the VJ forums!

I know it seems like forever, but it will pass. Ryan and I talk about how we cant believe all that we went through last year - and now we are married! Its still not all perfect as he misses his family in the UK and is stuck for awhile, but now at least we have each other. Find comfort in knowing that no matter how hard it is, you know that you have someone in your life that will go the distance for you. If you can get through this you can get through anything. My husband and I tell each other that all the time.

In the meanwhile maybe you could help him with the K-1 application fees? Sitting on his desk doesnt get it processes any faster! At least with yours USCIS should be processing alot faster then when I put mine through smile.gif

We now have the option to start the AOS here in the US (Las Vegas) or to continue with the immigrant visa processing (ir/cr-1) in Thailand. I have been looking for a topic that is more related to K-3 visa's and Thailand but have only found this one. Does anyone have any input as to which process is faster/cheaper/easier to pursue?

If someone could point me to a more appropriate thread for discussing this, that would be most appreciated.

So my wife and I just arrived here from Thailand and she entered on her K-3 visa. Our POE to the US was in Canada and the US immigration officials said that she was being issued her "green card". They did the fingerprinting on some form and had her sign it and said she would receive her temp card in the mail.

I am totally confused now. I thought we had to file AOS before she could get her "green card". They also said that she was cleared to work she just had to get a SSN card. Once again, I thought we had to file I-175 for Employment Authorization.

Would someone be so kind as to clarify what we should be doing next. Can we just apply for a SSN? Does she have to have a EAD to get a SSN?

Should I start the filing of her AOS or wait to see if the green card shows up in the mail? I am totally confused as I have been getting a different story from everyone I ask.

Any help would be greatly appreciated.

[size="3"]So silly me, for some reason when I sent in my petition for the k1 visa, I only sent in pictures of our meeting in Egypt. I never sent any emails or chat messages. It was accepted and sent to the California center and is being reviewed. Does anyone know if they will likely ask me for more proof, or will they just leave that up to my fiance when he interviews? I know, stupid mistake, but any thoughts will be helpful. Thank you :)

The I-129F petition is valid for four months from the date of approval by USCIS. A Consular Officer can extend the validity of the petition if it expires before visa processing is completed.

So my petition will expire after 4 months. It takes 5 months to process the petition at the CSC. So at my 4 month mark, I just call USCIS, and ask them to extend my petition? Or do I wait until after 5 months to check the status. At that point my petition would expire, right?

Salams (Hello) to all! It has almost been 4 months since me and the honey's visa has been at the california service center. Our time is almost coming up to get our visa adjudicated, however, I'm not sure who to contact at the CSC. The travel.state.gov website says you will need to ask the counselor officer to extended your visa application. Does anyone know who to contact, how do we know who the counselor officer is? Any help will be greatly appreciated!

Thank you both for your responses. My fiance is from.Yemen, but he lives in Saudi. I checked on our status online and it says our case was last updated on 12/02/11. Does this mean it hasn't been touched since 2 days after they received it? I'm kind of going into a nervous panic. Makes me think they saw he was from Yemen and just tossed our case to the side. Hello all,

My fiance's application has been at the CSC for 7 months now. We haven't received any RFE's or a NOA2. I spoke with someone at USCIS and they advised they would put a service request in. I haven't heard back and that was to only take 15 days. I'm not sure what more I can do to speed this process along. I'm afraid it's lost somewhere in paperwork. Does anyone have ANY suggestions of what I could do next? We know that the country he's from could be an issue, but he doesn't live there anymore so really we're just confused. Any help from any one would be nice. thank you :)

Also, we're interviewing in Montreal. And everything has been going quickly so far. But when you say "a few weeks" is that 3 or more? Or just one or two?

For the PI the IO can refuse the K-1 visa due to using a co-sponsor or at least that is what I've been reading here on VJ. YMMV. So I would wait until you can afford to be the only sponsor.

When you're planning on the i-129f petition, it would be a good idea to research ALL the fees at the different stages; petition stage, interview stage(interview fee, visa fee, medical, AOS stage). Your journey won't be completed for quite a long time, and the fees don't include travelling to/from embassy/medical, sending documents through mail, visiting each other/plane tickets after visa in hand, acquiring documents and other misc factors.
The first stage is by far the cheapest.


Yes right now I'm still just researching since I'm not ready yet financially :( But anyway, about the interview part you're saying that I'll get interviewed too? Not just my fiance when the petition is approved?

generally for a business visa you have to show the business is over $100,000 per year and that you will employ more than 10 workers. its not a work around to come here while waiting for K1 or CR 1 etc.

ok, you lived with her for 18 months and you have nothing to show in both your names? nothing to show for your time there aside from your bank statements which by the way only show someone withdrew money from your account. that could be yoru fiancee. not you. so that doesnt prove you were there. you are in serious trouble here proving you went there since you lost your passport with the visa stamps AND threw away the boarding passes etc.

photos are secondary proof, and you writing a letter isnt proof either. you seem to be paraphrasing alot and your paperwork needs to be VERY detailed to USCIS. if they ask you how you met, you tell the the website, when it was, if it was a paid site, Imbra site etc. i think you are going to be denied and you will have to go again on a trip and this time save everything. all your plane boarding passes, your hotel receipts showing BOTH your names, take pictures together in front of things with a date on it like a currency exchange board etc. And dont lose your passport. that is really hurting your case.

i remember alot of people not getting their NOA1 for a month or so in sept. there was a problem generating the paper. so my questions are this,

Did you send your petition with any kind of tracking? if so it will show they received it.

did you use a check and has it been cashed? if cashed it has been received

did you get your number off the back of the check? if you can log on to USCIS and see info on your case, they received it.

the date April 12th means that is the oldest case they are currently working on. they are also currently processing may and june filers. Also one july filer has been approved. currently it is taking about 5 months to get NOA2 and about 10 months to get visa be united.

fill out your timeline that would help on some of your time questions.

If you sent your petition in Oct you can expect your NOA2 in March and an interview in june or so.

No way you can marry her in Scotland and then bring her in within a week unless she is also a dual US citizen. You will have to make your plans according to USA immigration law as pushbrk stated.


you have 2 choices for her immigration, Fiance or Spouse.

K1(Fiance)- you are engaged and the visa process takes 6 to 10 months. you marry in the USA when she comes to the USA. Not before.

K3- CR1 (Spouse) you marry first whereever you wish, and then file the papers. process can take 10 mnths to 18 months. after that time then she comes to usa.

I still stand by my post. They will look into his naturalization ( which is via K1) and they will look at the timelines in his past. I think his previous K1 naturalization will certainly cause extra scrutiny. Of course, RebeccaJ0 is always correct and i am always wrong. We are never with the same opinion.
