QUOTE (crs @ Sep 18 2008, 01:14 PM) <{POST_SNAPBACK}>
I am wondering now if I wrote the correct thing. In other names used I wrote my name Middle and Last names as other names used because some of my school reports and my bank account have my name on it but without the First name. I wasnt sure if it counted so I put it. Did I only have to write "significant" other names such as name on passport or IDs? Or also "not official" other names used count (as I thought)? Thank you.

Hi, write any name you have used or been called by. Any name on a birth cert, used for school, previous married names or maiden names etc. That way if they get paperwork on you under a name different from the one you use today, they can cross reference it.

Puskbrk is correct. You were not free to marry when the petition was filed. you cant save this filing. You will have to file again and start all over after this one is denied. You could speed up things by having this one cancelled.
Too bad your honey couldnt have told you about her previous marriage before you filed so you could get it annulled. Now it will cost again the filing fee and the time.

K-1 Fiance(e) Visa Process & ProceduresI need advice
I find it interesting that posters here can deduce that someone is looking for a ticket to the USA based on filings from years ago and years apart. The woman didnt file, and she states the Men werent successful. Obviously the "MEN" didnt want to move to China for "the love of their life" whom they proposed to and filed for. So what is she supposed to do? Give up on finding a married life with someone?

There are many cases on Visajourney that have previous filings or serious LDR's in their past that werent successful. For the posters spouting their opinion on the woman, i am glad you got lucky on your first filing and first LDR. Many are not that lucky.

K-1 Fiance(e) Visa Process & ProceduresHow was the chances of having NOA2?
Hi, NOA2 means that you the petitioner has been approved to petition the foreigner. You have survived name checks and background checks etc. You get this permission on the USA side of the process here in the states.

Then the case is sent to the respective country and the US embassy there focuses on the foreigner. At that stage the petitionee can be approved or denied or just placed in a limbo fro awhile so the US embassy can sort thru things.

its entirely possible to be approved with NOA2 and then be denied at interview or after overseas.
however an extremely small percentage is denied under the K1.

And most are denied either from overstays and bans to the US or from the medical, drug history, criminal history, etc. or they werent legally free to marry at time of filing ( previous marriage not annulled or divorced).

If you have any specific questions, feel free to PM me. My wife is from the Phils so i did the route you are going.

in regards to her tourist visa, your income and financial means will have no bearing. They will only look at her job/ finances / ties/ proof she would return. I have heard of people having alot of money in the bank and still being denied. But others have been approved with almost no means. If she was ever given a tourist visa as a child to visit a relative when young she would have a better chance.

I was thinking an attorney would be able to help with specific answers as to the legality of entering the US on a tourist visa when the ultimate goal was marriage.

ok, here is it in a nutshell. It is virtually impossible for a normal filipino to get a tourist visa to the USA. In fact last year 2 filipino congressmen were denied tourist visas. they were coming to Washington for a big seminar. Some people do get them, but its very rare. If your girl is a celebrity there or is very rich then she can probably get one. If she is not, her chances are about 1% success.

Secondly the legality of entering the USA on a tourist visa with the intention or goal marriage is not legal at all and is visa fraud and a felony. Attempting it and getting caught will result in a ten year ban. Do people do it, sure, a few get away with it.

Unfortunately there is no short cut to the immigration process if your girl is from the Philippines. They normally cant even visit here and are not part of the visa waiver program that most of Europe is on. You will have to file for her and wait the time. You can visit her.

I can tell you for a fact that Davao have nice filipinas. I married one and she is the best. That is not the only place to meet nice filipinas, but it is a great place to start.

and i am still not sure she really has an annullment since they usually take 8 months to a year and are expensive, yet your lady got one in a month, unless she started it along time ago and just didnt tell you and was hoping it would be final by when you filed. And then of course it wasnt.

K-1 Fiance(e) Visa Process & ProceduresStupid Question
If she got on a plane she would be refused entry in the US at whatever port of entry she hit. Then they would have her book a flight back to the Philippines on the next available flight and she would have to pay the return flight and change flight fees etc. She would be held prisoner in customs until she left on her flight back.

thats if she can get on the flight to the USA. They also have rules about first time travelers and they might require her to have a CFO seminar and stamp, and could refuse to let her on the plane there in the Philippines with no visa or CFO stamp. Either way it goes she cant enter the USA unless she has a visa and they will check her passport when she tries to leave the Philippines and when she lands in the USA.

my fiance is in a bad living situation - she recently lost her job and health insurance and is living in a room with three other women, a shared bathroom and limited kitchen facilities, and above all there is mold in the apartment and bathroom.

Last week, my fiance got very sick with a fever of 103. She went to a doctor (we're obviously paying for all doctor's visits out of pocket) who confirmed and wrote a letter stating that she was 17 weeks pregnant and her living situation was causing "allergic crisis" and was "impossible in her state of pregnancy." the place my fiance lives is supposed to be for single women with no children and I'm concerned with what will happen if she doesn't get here before the birth.

Why dont you provide for your fiance and get her a better place to live. Surely you send her support? You cant rent her a place there that is safer? With your baby at stake, that seems to be the proper course, and something that can be done within a week or less.

nothing personal, but try paying all the medical expenses for a pregnant wife here in the USA "out of pocket".

The effect would be to have 6 months of living together to plan our wedding as opposed to only the 3 months the K-1 allows.

Her visa is good for 6 months. You and she can take that long before you have her come to the USA on the K1. Once she enters the USA on the K1 visa, you have 90 days to get married. So take up to 6 months planning your wedding with her in Russia, then once you have it all planned , have her enter and then get married within the 90 days.

And the denial on her using the B2, will probably come from her "moving to USA" while processign the K1. That will be frowned upon and could result in her denial to enter until the K1 is approved. She will need to look like she is not moving here permanently with a quick trip back to russia for a medical and interview formality.

FAQ: http://www.visajourn...cation.html#4.6 4.6)...Can my fiance(e) come to the US to visit me once the visa process is started?

PITFALL: the POE CAN deny entry. Having a visa is no guarantee of entry.

Thanks for the link. As for the other pitfall, it's a given any person can be denied entry to the U.S. whether they have a visa or not. Heck, customs could refuse my own entry back in to the country if they didn't like my passport. But as it is, she's already been in an out of the U.S. a couple of times on her B-2, so there's no reason they would suddenly refuse her.

actually after you file the K1, they could refuse her B2 since they will both be in the system. And it has happened numerous times. You should be ok as long as she has good proof of ties to her country.

K-1 Fiance(e) Visa Process & Proceduresright to deny because of age
I have read before that there is more scrutiny if the USC woman is older and the beneficary man is younger in Morocco and surrounding countries. I am not sure why unless there is a high level of fraud. In the philippines it is normal for there to be age gaps and theres not much scrutiny there over that. I happen to be 23 years older than my fiancee and it wont be a concern at our interview. I have no experience with the Moroccan embassy, and i wish you good luck. I think as long as your relationship is real it will prevail.

You might want to check on the mena board for that specific consulate.

K-1 Fiance(e) Visa Process & ProceduresCultural misunderstanding or fraud?
Just because you surprise someone with a visit doesnt mean you dont trust them. I am in the Philippines for the 3rd time to see my fiance and she didnt know I was coming. I even called her from my US cell phone after I arrived and told her I had called a local gift store and ordered something for her and she had to go pick it up. When she arrived at the gift store I had worked everything out with the store and when she was receiving the gift I had bought for her I walked up behind her and kissed the back of her neck. She was so happy to see me. I think anyone that doesnt like a surprise visit from someone they love then they might have something to hide, it doesnt always have to be about trust just because you surprise someone.

K-1 Fiance(e) Visa Process & ProceduresFilling and dating forms,K2?

My fiance and I are waiting final stage of her phillipino annulment process(non opposed, one final doc from registrar office requested at last hearing Aug.2),its been almost 1yr since she started(her court jurisdiction lost a judge, only one to hear all cases hence taking long long time). On 129 and 325 forms when asks her name then previous names? With annulment does her name automatically return to "previous"/birth name or remain as her ex's last name and her birth name is her previous name? Not sure which is considered her "previous" name. Also, she has one child, immigration lawyers wanted to charge an addtional$500-$1200 if preparing K1 for us for the k2 but we're not seeing anything here about a K2,just seeing area to fill in child name, she is 18mths old.Hard to believe they would charge so much for simply filling in childs name then after interview we get a passport for her?Lastly, while awaiting annulment we'd like to fill out forms, save them to files and print, sign, date when close to mailing packet-is it acceptable to hand write the date when signing it or should date be in typed form?Any and all info appreciated.

A separate form must be filed for the child, that's why they are asking for more money

#7. Annual income,

If I worked a full year I would make $72,000. In 2011 I only made $50,000 due to 3 surgeries. In 2012 I only made $65,000 due to 3 visits to my girl in Cebu (L). Should I average the last two years for my annual income or use what I’m scheduled to make in 2013 at $72,000?

#8. The following persons are dependent upon me for support.

#10 I have submitted a visa on behalf of the following person.

Date submitted? Is that the date I submit the I-129F?

#11. Intend to make specific contributions to the support of...
