I know that getting married here in the USA is okay for my fiance but I can tell that she really wants a wedding in the Philippines. I will be going back to visit her in September. Can we have a civil wedding in the Philippines that will not affect the visa process that we've already started? Any and all feedback is greatly appreciated...smile.png

My fiancé doesn't have her birth Cert. Her parents lost it in a fire and we called the hospital she was born at and they said they don't keep the records going back that far. She was born 1979. She has her ID's, Passport up to date, her college diploma, college transcripts and other documents to show she is who she is. She is from Chiang Mai thailand was born Jomthong Hospital Chiang Mia.. I called the consulate in BKK they are pretty much useless so i emailed them same thing useless information. Does anyone here know if its ok without a birth cert. for her to be approved for K-1 visa. I am asking this question for anyone else that has had this issue in thailand. And also can she do her police clearance before the NOA2 arrives and can she do it in Chiang Mia or does she have to go to BKK and wait for the NOA2.

Any info would be appreciated.

Called nvc to check on k1 status...I've already check it on ceac website with a case # but nvc said that they can't give me a status update because I'm giving them the wrong birthdate of my fiance(benificiary) which I double check it with the I29f I sent and it's the right birthdate so nvc was saying that they prolly input the wrong birthdate on they're system...now they want me to send my fiancé passport to correct her birtdate....my question is why can't they correct it themselves coZ they're the one who input the wrong date and shouldn't they check my i29f form from uscis which I check it a million times and I am giving them the right birthdate same as the one on i29f.

Most of the members on VisaJourney have opted to do the paperwork themselves. There are forums available which discuss the pluses and minuses of hiring an attorney. As you can tell from the EasyVisaWeb video, you will still be doing all the work of collecting the information and making sure it is accurate. I don't know what kind of support they provide but personally I was concerned to see that in their video they were filling out some information incorrectly and listing an address as 'stupid drive' doesn't engender confidence. I am also not sure what an embassy attorney is or which embassy the attorney is with. I do hope your experience is a good one. There are plenty of friendly and helpful members on the VJ forums who collectively have a lot of experience. Please browse the forums and ask questions. You will find that you are not alone in this process. Best wishes to you.

I think if you were to file your I-129F by January 1 2013, you will have time to get K-1 and K-2 visa before your fiancée's son's 21st birthday. We filed on January 3, 2013, and my fiancée's son will turn 21 in mid November 2013. We are now waiting for an interview. It will be close, but I feel confident that we will make it before his 21st birthday.
As to your medical issues, I think that does not fit one of the criteria for expediting.

I am not sure if my original post above was not clear at all. I don't think I said anything about k1 already filed. I also mentioned that my fiancee's annulment was still in the process of being finalized. I also mentioned I am putting together the petition right now. I did not ask anything at all about annulment so I was taken aback for being lectured about the process I have full knowledge of and sounded like I will file for a k1 petition knowing full well that my fiancee is still married. Come on now.

At what stage is the annulment process?  You are aware that without the annulment decree your fiancé does not have legal capacity to remarry.  
 
An annulment is a lengthy process that takes at least 2 years to complete.  It is adversarial in the Philippines, hence, even when neither of the parties contest the dissolution of the marriage the state (through the solicitor general) takes it upon itself to oppose the petition consistent with its policy to promote the "sanctity of marriage".  
 
Before considering your options on expediting your K1 process, think about your fiance's annulment first.  It will be a pain to rush into the process and be denied later on. 






First I would not have posted the question if I have no knowledge of the process. I am aware that it is bigamy to marry someone else while you are still married. Your answers and questions are condescending. I was told this site is a friendly site. As far as the answer to your question we already spent almost $5000 into the annulment and I dont want to get into the detail of where we are at in the annulment process. I will just have my lawyer handle my petition and answer my questions. I posted an honest questions and I don't need anyone lecturing me about the whole process like I am stupid.

Well that's the consul told me when i presented the co-sponsor affdvit... And she told me that they are not accepting co-sponsor for k1 visa.. Lucky for those k1 visa filer that the consul who interviewed them is considerate.. Mine is not.

That's all.. I'm so tired right now and feel devastated...

Let me share u our love story....


You know what my fiance and I have known each other since gradeschool.. We are schoolmates from gradeschool up to highschool.. We started liking each other when i was in 3rd yr highschool and he was 4th yr back then but decided to kept our feelngs for each other.. The last time i saw him was yr. 2001 before he graduated then go back to USA in 2003 (he was born in Maryland thats why he is american citizen but pure filipino)

i am the one who was half american blood and half pinay my biological american dad abandoned me wen i was 4 mos old and never met him .. But he left an affidavit to prove that he is my father but didint use that bec it is useless since my surname changed bec my stepdad adopted me..

Anyways enough about me.. As i was saying he went back to U.S after 17 yrs over staying here in philippines and after that i didnt hear anything about him..


Then after 10yrs.... Feb. 14, 2011 he found me in facebook finally! :) then we constantly talk to each other tru chat every day.. Until he confessed what he feels about me since highschool i was really happy bec i also feels the same then feb. 18, 2011 we bacame offcially in a relationship with each other..

Then sept 27 2011 he arrived here in manila that night he proposed and ask me to marry him. We stayed together for 59 days..

Then he went back back to u.s on nov.24 2011
Still everyday we constantly communicate to each other then last april 2012 he filed petition for fiance visa and sept 2012 the petition is approved then nov. 19, 2012 got a letter from USEM that i am eligible to apply for k1 visa.

Jan. 15-16 2013-- medical exam/vaccination
jan 24 , 2013- interview @ USEM and got the 211g form :,(


We are wanted our wedding to be on march 18 2012 our 25th month as couple but it will not happen anymore..... :,(

Hi everyone
i just wanna ask if there's a little chance that i will get approved after i receive the 221g form?

Is there any deadline for me to submit the doc they're asking which is evidence of current sustaining income? They're actually asking to submit some payslips.. Anyways.. Here's the story:


During the interview i have proved the genuity of our relationships but what caught the consulate attention is the ITR and W2 form that my fiancr gave them it was from his prev. Job last 2010-2011


But his current job is lic. Tattoo artist and shop manager and his kind of work falls under self employed that's why he doesnt have a paystub to prove that he is earning.. But the consul insisted during interview that i he should have a paystub or else his work is illegal. I told her how can he have that if his customer pays him directly?

Then the consul told me that is illegal but i told her how come its illegal when he is a lic. Tattoo artist and he has a business licenced as well

The consul just told me that my fiance should find another job that issues payslips and said sorry she will hold my visa until i submitted those payslips..


Is there any deadline for that? Bec. There's no written deadline on the form and they didnt advice me when should i submit those docs that she is askng?

We are planning to comply all payslips on May. How many payslips should i give them? 3 is good enough? My fiance had applied for one more job aside from tattooing and he will start on first week of feb thats why im askng if theres a deadline so we can save atleast 3 payslips until May..

Aside from the payslips we would like to add his 2012 ITR as self employed
Waiver from his previous customer which indicates how much they have paid him
A copy of tattoo shop bussiness licence and his licence to prove that his nature of work is not illegal
Copy of the deeds that he own a house bec the consul ask me if he has property then when i ask her if i cud also send a co-sponsor affdvit of support which her mom since she was also lives under one roof she didnt accept it and again

she ask me why my fiance is living with his parents i told her no.. They are the ones who is living with him.. He owns the house but again the consul doubted my fiance's capacity to support me. Then she told me that the house cannot feed me etc.. She insisted that my fiance finds a descent job and hav his payslips submitted to them..

I was so hurt that she is tryng to say that being a tattoo artist is not a descent job.. :(((((

Spsguy you seem very knowledgeable on the subject matter and just like yourself im a naturalized US citizen of Cambodian ancestry also. Now i myself will be starting the process of petitioning my fiance where the first step which will be a Cambodian marriage license which is getting very overwhelming. As Americanize as i am but still holding strong Cambodian values and customs i met my future wife through the introduction of my parents on my first trip to Cambodia (arranged marriage) now is this illegal no is it real yes. There seems to be a stigma on arrange marriages i personally want to say in my interview yes this is arranged so what but that's my arrogant American side now how do you show 1,2, and 3 in my case since this is arranged but very real in the intentions of a happily ever after oh i do however disagree with you on the fact that most marriages end in divorce due to the fact of parents pushing for marriage hey i was engaged just a few days after meeting her which is probably one of my most sane and thoughtout decision.

Hey everyone! I've got a few questions regarding the K-1 Visa (who doesn't!), and I hope someone could clarify some things for me and my partner. I'll start with a summary of our background, because this is probably required information!

 

I am 4 years older than my partner, we met when she was 15 and I was 19. I live in the UK, and she is in Nevada. She's currently 19 and I'm 23.

 

We met online on a website I ran a few years ago, but never started considering a relationship until we'd known each other for a couple of years. I made my first trip to visit her in November 2011, when she was 17 and I was 21. It was a completely platonic visit, and kind of a test to see how well we were around each other in person. After this trip we decided that we did want to proceed, and I have visited her twice since.

 

She's planning on coming here in August, and then I want to visit her again in April. We're planning on filing for the K-1 Visa in October, which will hopefully be approved by October the following year. We're hoping to get married on January 11th 2015.

 

She's currently in college with a part-time job. She made $9,000 last year. I work full time in the UK, and make around $20,000 per year here. We're saving our butts off and hoping to get $15-$20k saved between us by the time everything's sorted. We're aware that her income is significantly below the US poverty line, but we're planning on asking one (or both) of her parents to co-sponsor us. 

 

She is planning on taking the 2014/2015 year out of school to work full time to up her income before she goes to Uni to finish her degree.

 

And onto my questions, finally!

 

1/ I've seen some people say that some consulates will refuse an application with a co-sponsor, basically because they have a co-sponsor. Is this true? If so it seems deceiving to allow the option.

2/ Are there any benefits for a co-sponsor? Tax breaks etc. I ask this because it will help us to decide which of her parents to approach.

3/ Can there only be one co-sponsor? For a number of reasons I'd like us to be able to ask both her parents to sponsor us. They have both been really supportive of us when I have visited her, and gone out of their way to make sure we have a good time.

4/ Does the country the alien spouse is immigrating from have a positive/negative impact on the application? For example, would a first world country have a better chance than a third world country, or is it all equal?

 

I did have a lot more questions but they keep coming and going from my head, it's a lot of information to take in.

You are clearly not understanding the seriousness of your offense. This isnt just "oh you lied, well file again". You lied on Government documents that are clearly marked as sworn statements. Not only can your fiancee be denied for life, but your future filings could be in jeopardy. This is not a minor issue.

English as a second language is not an excuse you can use. You knowingly lied to the government when under oath to tell the truth.

What in the world possessed you to lie in a sworn statement? You lied under oath. This isnt just misunderstanding the requirements when you decided to lie on your application. Even people who dont speak english know a lie from the truth.

You need a very good immigration attorney. Your lie could have given your fiancee a lifetime ban. Think about that.

Just because you marry someone doesnt give you rights to stay in that country for any undetermined length of time. It is different per country. Common sense has nothing to do with immigration and there are many couples that are married and separated due to immigration laws etc. Being citizens of different countries and being married doesnt give you any rights to be together in the same country.

First, its next to impossible to get a tourist visa even for a spouse. they will look at it as being used to immigrate. secondly using a tourist visa to immigrate is illegal. I would be very wary of anyone giving you advice on how to break the law especially concerning Federal immigration laws.

once you marry in manila, you will have to file a K3 visa. That is about the same or alittle longer than a K1 visa. either way there is no legal way to circumvent the immigration process.

did you actually talk to a real person when you called NVC? if you used the automated system you will not show up. K visas are NOT entered into the automated system and will say not in system forever. You have to speak to a real human to see if you are there. If you did that and a real person told you they dont show anything yet, then you are in a bind and will have to wait.

Hi, write any name you have used or been called by. Any name on a birth cert, used for school, previous married names or maiden names etc. That way if they get paperwork on you under a name different from the one you use today, they can cross reference it.
