I totally agree with you. For being so familiar to RFEs, I too think there's no RFE.
BTW I only got things done when I called late at night and had a supervisor on the phone.
 



But both times we have called and spoke to a tier 2 officer they have said a RFE has been issued.

If you are the beneficiary, then you can't do anything.  The USC must be chasing all this down, and contacting her congressman.  You don't have a congressman...  A congressman isn't going to care about what a foreign national wants.  You've got this all mixed up.


My fiancée who is the USC is calling the congressmen and dealing with them not me. I've just been getting all the info and sending it to her as she is at work at moment.

Are you signed up for text/email commnication? Only asking because we were and when we got our RFE I got an email with a PDF attached explaining my RFE and I got an actuall same letter about a week later.


Yea I signed up to receive emails but never go one. My finance has got email from them but only NOA1 and email confirming she had called them on August 15th. We are going to call our congressmen tomorrow as I emailed his office and they said to call them. People may think I'm mad but I run 3 businesses in London and I am never one for sitting around and waiting. I know its a long process but to be made to wait a month for a letter is not on.

Okay, so that doesn't say RFE.  
 
It just says the online thing isn't working for your case (which is not a problem).
 
I really think you are chasing a phantom RFE.  ANyone else think so?
 
How did you come to believe you had one?  A Tier one person said this?






Both times we called and got calL back from a tier 2 officer they said we had been issued a RFE.

You online status "changed" but it didn't say RFE on it?  You needed to call and find out why?  I thought an RFE said "we send you a request for evidence."  What did your status change say?
 
I suspect there is no RFE.  3 months from start to RFE is not a realistic timeline.  Your case was probably transferred or something.

I know you have started many threads on this, but the details are scattered. Would you re-write a concise summary of the dates and all steps, if you spoke to a Tier 2 person or just the first level, if your name is on your mailbox, etc.


We filed in April and received NOA1 on April 25th
On July 30th my online status changed so we called USCIS on August 1st to find out why.
They said that on July 30th a RFE was sent out.
We did not receive RFE after 15 days so called again and they said they would resend again.
We received a letter in post saying about the phone call we had a few days before and a email saying the same.
No RFE arrives in post again.
On advice of a friend who is a lawyer we went online and booked a INFO PASS which is on Monday 24th.
We have spoke to tier 2 officers twice.

They have correct email address and correct address to send letters to as we have received everything else via them they just don't seem to be sending any RFEs in post like they said they would and no emails with regards to RFEs.

A lawyer can only either do exactly what you're already doing or sue them, but I doubt a few week's delay is really grounds for that (no matter how frustrating, stress-inducing, and aggravating it is for you - and I have no doubt it absolutely is).  Not to mention, there are so many stories on here of people whose lawyers only made things worse (whether on purpose to be able to charge more money or just out of ignorance or laziness).  
 
I'm assuming you double-checked your address with them... right?  Did you get your NOA1 with no issues?
 
I wouldn't discount the infopass appointment just yet.  People have had success with it.  Use the options available to you first.  If the problems keep happening, ask if there is a workaround.  If this gets ridiculously out of hand (as in, your file is held up for a very unreasonable amount of time) and USCIS will not work with you, then and only then perhaps consider getting an attorney.




They defo have correct address because we received our NOA1 straight away and we also received a letter from them after we called to ask what was happening and they said they would resend it. The letter basically just read what was said during telephone call.

Should i Get a lawyer involved because of RFE fiasco? RFE was issued on July 30th (which we only found out by calling the USCIS!) and still not received anything is post even tho its supposedly been sent twice now. Have a infopass meeting on Monday but got a feeling it will be waste of time and they will just give us the same "we will resend" rubbish they said before. This has turned it to a fiasco and has added a month to our overal wait time unnecessarily.

Is it necessary to include a separate page for question 18 (on explaining how you met and how you've sustained a relationship).  I feel like I summed it up in the box, I am just wondering how important or how much more detail is required.  Has anyone had success without the additional page?

 

Also, in terms of proof.  I have about 4 or 5 flight itineraries and pictures from each trip.  Is anything else necessary?

  • Coverletter
  • I-29F Form
  • Question 18 answered on how we met (no additional page)
  • Statements from both parties on the intent to mayy
  • Picture from each of our trips and flight itineraries
  • G325A and passport photo from both parties
  • Birth Certificate (my fiance claims his birth certificate doesn't have a backside from Iowa)

 

Am I missing anything else?

 

I could provide phone records, e-mails etc. But I have read and been told it is not necessary?

I just want peace of mind everything is in order and PROBLEM-FREE!

For evidence I just sent, boarding passes (the two i had), e-mail flight itineraries, pictures from each trip and 3 Long distance phone bills! I sent the bare minimum as well.  I thought the less they have to go through, the less complications there will be!!

Hi,anyone? My fiance's annual income is below minimum of 3 household, is the USEM accepts co sponsor? Our co sponsor is his mom. his mom has 3 PARTIALLY dependent on her since she and her husband are temporarily separated, her 3 sons (my fiance's siblings) are WHOLLY dependent on their dad. Is this a real problem on our k1 petition? Our scheduled interview is on September 10.

The only two that process the I-129F are Vermont and California.

Hello, I am now starting to prepare all the stuff for a K-1 visa. This is probably a simple matter but I don't want to do anything incorrectly. The instructions say make two copies of the entire packet. Does this mean I can copy the passport photos in a black and white copy machine or does it need to be a replica of the packet (Like I need to get 3 passport photos so I have one to send in and two for the copies).

Also for the proof that we met in the last two years, I can send a copy of the boarding passes and such? Do these need to be high quality color copies or can I just copy it in a normal copy machine?

hi,

yes you have to make a replica of the entire packet so that you have a personal copy of it whenever there's something wrong happened to the original one (hope there's none.) It's fine even if it's just a normal photo copying machine as long as the information in it is clear and readable, but I suggest if you'll just scan and print it. You may include photos of you together, just make sure to put captions and dates in each photo. Good luck!

Hey guys :)
We received our NOA2 yesterday and I am now working on gathering all the papers we will need in the future.
As for the affidativ of support...my USC fiancé started his new job about 2.5 months ago. He got back from his deployment in August 2012 and was in between jobs from October through January. His salary right now isnt above the 125% but it will go up in a couple of weeks (we would wait with the letter from his employer until then).
He did have a stable income over the last few years (above the 125%).
Do you think we will need a co sponsor because he has only been with the new job (and higher salary) for a short time?
I am worried :unsure: :help:

The consular officer may request additional evidence of income, such as an employment letter.

I have everything for our I-129F ready to mail but was thrown a curve ball last night and not sure what to do. My fiance informed me last night that she is finally going to quit her job that she hates so much. Here's the problem. On the G-325, it says list current and previous employers. The G-325 I have says that she currently works there. Will this be a problem if I submit as is and she quits? Any advice is greatly appreciated. Thank you.
