Hi there,

I've been following this post for a few weeks

My fiance and i are also having the same problem

Twice they've returned our application for a K1 Visa with the wording Classification Sought

We have no idea what is wrong with our paperwork, we used all the forms that were linked from the K1 Visa Flowchart

We've definitely put I-129F under Other on the G325A

My fiance rang them and they said they couldn't tell us what was wrong, as they didn't know what Classification Sought meant either...?? All they could tell us was that if a box was left blank that would throw the application back

The first time it was returned we found one small box left unticked. This time there is nothing...and no way of finding out what is wrong with our paperwork

Frustrating is not the word. This is the most stressful thing i have ever undertaken in my life (and i'm nearly 50) How can we fix it if they don't even know what it means???

 

The same thing happened to us "classification sought" 2X.  We looked it over and over. And to boot we had an immigration firm put it together.  Turns out on the G325A it was down the bottom left corner where it says what you are applying for we had put "K1"  We should have put 1-129F.  We submitted it a 3rd time and it was accepted.  We then decided to get married and withdrew our petition after all that trouble and filed a 1-130.  Now we are in an even bigger wait. Grrrr.

Hi I thought I'd post and update on my "Classification Sought" problem. Well we sent in the i-129F for the 3rd time and THEY ACCEPTED IT! Now we will wait for the NOA1. The only thing we changed in the package was beside OTHER on the G325A we had K1...We changed it to 1-129F. Thanks to those who suggested it. Although I know other people didn't have a problem with K1...at least we are on the road now! Thanks

Just to say: most people who got an attorney or someone else to fill their papers and still ended up on this board were not working with good poeple. All the people who get someone very good to help them with the process, well... we mostly don't hear about them. They have answers to their questions, advice, no problems with the forms... why would they come and hang around on VJ? So, yes, there are good attorneys, we just don't hear about them so much in here. We mostly hear about the one who screwed up.

I think using your experience to provide great service at a cheaper price is a very good thing, and this is reassuring to see that some people take this very seriously (and don't have self-esteem issues and are ready to come on a forum to get answers their experience didn't give them in order to help their clients. I totally admire that Posted Image)

I was googling your situation and came across the classification sought only when looking at the I-129 instructions. Make sure he has the right form: I-129F

Also on the "other" section of the G325a put what form you're sending it with, NOT the visa you're chasing. The USCIS does not deal with visas. It deals with forms and petitions. The correct answer would be "Other: Form I-129F" you can include petition for alien fiancé if you want as well.

Do this yourself, not with a lawyer or immigration service so that you KNOW the paperwork is correct!!!!! Obviously they are messing up!

Hmmm, I took a look at the Vermont, Texas, and NBC numbers as well. Texas has too few cases for statistical inference. Vermont CR1 process has a weird dip in approval percentages in July which lines up with the beginning of work in NBC. I do remember some news about cases being transferred to NBC. An alternative possibility explaining the K1 slowdown is that the CR1s from Vermont and the K1s from Vermont and California were all sent to NBC for processing and NBC is concentrating on the CR1s. I wish there was better information, but the bottom line is that right now I would be worried about how long the K1 process is taking.

It was sent to Dallas and came back from Dallas 2 X as Dallas is the centre for people applying from Las Vegas

That's awesome that you feel this way and are truly helping these people. You have to understand that on a DIY website, like this one, people come here occasionally BECAUSE they've used a service and feel they've been duped or its taken longer. Most of us feel that we're intelligent humans who don't need someone to fill out paperwork. I convinced my husband NOT to use a lawyer because I knew we could do it ourselves.

Of course there are also people here who really should NOT be doing it themselves in any way, shape, or form. But yet here they are too.

I hope the answer to the error can be found. I suggest perhaps the CR1 visa path over the K1 if the issue cannot be resolved? They are honestly taking the same amount of time, in fact many CR1 visa chasers are getting down there significantly faster. Either way it would be awesome if you, or the original poster, could let the community know what exactly went wrong if you do indeed get the problem solved. That way we can help each other avoid the same situation.

That poster is me 8699 I am the Canadian beneficiary (elaine) We are very happy with Las Vegas Immigration Authority and know it was nothing wrong on their part. They have actually been awesome..even answering phone and helping on weekends, following up, and having a heart! We chose to have someone prepare the documents as neither of us have time nor the inclination. I will definetly post what the outcome was....my fiancee(ricky) has an INFO PASS appointment on Thursday in Las Vegas, but feel it is simply a grumpy agent not liking "Classification K1" instead of I-129F. We also see many people put K1 and they were fine. There is no difference between the sample forms on here and ours!

What happened to the days when you could go over to the states get married and stay? Well just tells you we are old!! We should have gotten this right back in the 70's! Believe me we regret it!

What address did you send your package to, if you mailed it to the wrong address, it would be returned with the check not cashed; wrong classification could mean you sent it to an area of USCIS that does not adjudacate fiancee visas. Based on all the information you have written, this sounds like the most likely result.


There was no issue as to the office...it went to Texas which is the office for Las Vegas.

Doesn't USCIS suggest NOT to use an "immigration service" as they are often scams?

I would definitely fire whoever did your paperwork.

And no offense, but if it was "all complete" then you wouldn't have been rejected, so obviously something is missing. I know it's frustrating but I would go over it again piece by piece. You'll figure it out. Good luck.

What fee was sent? The fee for the I-129F is $340. Fee for the non-immigrant worker form, I-129 is $325.

I did some researches on "classification sought" and found some documents, if that can help you...
-classification seems to be the kind of visa you file for - I know...

For me, it's a problem of your visa classification, maybe they didn't understand that you filed for a K1.

Call back on Tuesday when uscis are open again, demand to talk to a tier 2 person and ask them what they mean with classification sought. The tier 2 will know.


To me classification sought sounds like they can't determine what visa you are applying for....but that makes no sense either since you sent along everything you needed.

All forms completed in full, and reviewed by an immigration document preparer and an Immigration lawyer!! OMG!! Guess this whole thing is a study in patience and perserverance! In the "old days" (my youth) you could go to the states and get married and it was ok.!! I do hear over and over it is really hard for Canadians!

i am confused, was your i129F PETITION denied, or he k-1 application denied? the i129f is isn't an application it's a petition, the k-1 is an application for a visa after the i129 petition has been approved. you post is very confusing, at what stage were you denied? and there is no such thing as an F129a, please clarify


We are right at the beginning...we sent in the I-129F...it was sent back 2X within 2 wks..(different eac#'s each time) It was sent back along with all documents and money order..due to missing "Classification Sought" Should we have just bit the bullet and hired an immigration attorney...we got an immigration document preparer to do it...but he had an Immigration Attorney look at the first rejection and he was in wonder...

Hi Everyone! I need some help! My American fiancee applied for the K1 (f129a)back Jan 22/12. I am Canadian and we have known each other for 46 years! We received a rejection of the application due to "CLASSIFICATION SOUGHT"? We called USCIS, called the firm which prepared our papers and had a consultation with an immigration attorney. USCIS could not provide us with any information told us to consult with someone???...If they don't know what it means WHO DOES? Clearly we provided all pertinent documentation including cover letter describing our intent along with the necessary forms. We redid the cover letter (to make it plainer than day) as there was NOTHING missing that we/document preparer/lawyer could see.. We resubmitted 10 days ago and BOOM! Rejected again....document says "missing" "Classification Sought" Wouldn't you think that the fact that there is the F129A, and all the other documents including the DHS documents it would be ok? ANY IDEAS?? My fiancee did get and INFO PASS appointment in Las Vegas for Feb 22 at the USCIS office...Will they know something different that the people on the phone? We have wasted a month already!! Are we missing the interpretation of this term? I even tried to think backwards ie..ok so perhaps you cannot apply if you are not eligible..we are both divorced and provided documents to prove same. ANYBODY have a thought? I would so appreciate it!! its like we all become lawyers eh?
