Hi! I checked on this forum for Processing times for the field office in Las Vegas. We are considering switching from K1. It DOES NOT mention CR1. It does mention 1-485 (sepT 27/12) N -400 (5 months) N-600 (Aug 25/12) DOES ANYONE SEE ANY BENEFIT IN CHANGING FROM K1? Is it true that CR1 goes to field offices or do you still have to do those months and months of waiting at CSC Also? Please advise guys. Btw we are only newly into NOA1 for K1 (1 mth)

Hi all! It seems to me that K1 is running at about 8 months a CSC. That is until NOA2 I assume...then you need NVC and then your respective Embassy..which in my case is running 2-3 mths to get an appointment.(Montreal) That brings my situation to February 2014!!

Here is my questions:

1) Could I assume (since AP and EAD) are very important to me...that if we got married (next week) and the local field office (Las Vegas) is running at about 4-5 months...That if we start over doing CR1 I have a better chance of getting the Visa sooner than K1? (MUST BE LESS THAN 1 YEAR?) We don't have a lot of time in K1.

2) Do you still have the same wait times for CR1 at USCIS as with K1?

3) Do they consider length of marriage ie: petitioning 1 week after being married?

4) Are CR1's sent to Chicago? or do they go to Chicago and then directly to your local USCIS?

5) We are only 1 month into K1 and are willing to absorb the fee..Would you gamble that CR1 would be faster?

6) How can you prove the marriage if you just got married and are living separate..for items like mutual lease, ownership of property, ongoing banking etc?
Does the short time being married impact your CR1 (i do realize they look at over 2 years a bit differently) I mean for granting it!

They're asking for your legal residences, so I wouldn't include it in that part of your application. You weren't "living" in the US, even though you rented a flat. I would, however, include that holiday as proof of a bonafide relationship. Four months of face time is great evidence. Posted Image

Did you change your mailing address to that address? Did you receive other bills there? Change your driver's license?

I'd not I would say it was a vacation not a residence.

But you can include proof that you were there and stayed together for 4 months.


Yes we have bills from there, a lease. I wasn't a resident so no DL. For me it was just proving time living together. And the lease was in my name with Ricky as the other occupant. When our 1-130 goes in we will only be married a few days (next week) so I want to show on going relationship. Thanks so much for your advise.

Hi I am doing my G325A for my 1-130...It says to list "RESIDENCES FOR THE LAST 5 YEARS" I went to Las Vegas last summer and rented an apartment where my honey and I lived together.( we were not married) (I am allowed to stay in the states for 6 mths no visa) The lease was in my name (I'm not the USC). I also had a house back in Canada at the time. Should I include this 4 month rental to show "We lived together"? As in the petition it asks in Question 21 "IF FILING FOR YOUR SPOUSE GIVE THE LAST ADDRESS IN WHICH YOU LIVED TOGETHER" Or should we leave it out? (because i still had a house back home) I thought it was good to include it to show we were living together. What do you think?

Put other: form i-130

In multiple threads you've been informed that the csc and vsc will not be involved in your Cr1 visa process. The petition is sent to the National Benefits Center. From there the NBC sends it to the local office of the US Spouse.



thanks for your response. The reason for the question re what to put ie OTHER 1-130 is because our 1-129F package was returned 2X and we lost 6 wks because we had put on that one OTHER - k1.... when we finally changed it thanks to people here it was accepted. Now we are abandoning K1 and getting married next week. BTW is a thread a topic or comments from certain people? All the best!

On the USCIS site it says to send your 1-130 petition to the Phoenix Lockbox if you live in Nevada..(as he does) DOES THIS MEAN I WILL BYPASS CSC? After the Phoenix Lockbox it will be sent to the local field office which is Las Vegas?

Am I mistaken or the only Government forms I need to send are the 1-130,G325A,G-1145? Along with the other supporting letters/documents

On the G325A do I check off "OTHER" and fill in 1-130 or put CR1?

My hubby already has his MNL# case no since August of 2012. Now I have to call him & tell him about this so he can have his schedule done for his medical at St. Lukes. Regarding to your question, Did you received an email stating that they will inform us? I just received mine last January 3.


Ohh, I just learned at this website http://manila.usemba...v/wwwh3218.html that you need an Appointment Letter for us to have our medical done. We need to wait for our interview date. :-/

I already got my MNL#, and honestly it may look stupid to others, i just recently learned that once you got the MNL#, you can already apply for the medical...but since my hometown is far from Manila where the medical is going to be, I would have like to do it at least a week before my interview in US Embassy in Manila, that way i could just wait for my interview then and would not need to go back and forth...my question is, who does the scheduling for the interview, are they going to send us notice as to the date of our interview or we can call the embassy and request for a schedule....sorry the question may sound simple to others but with all the information and the processing,im confuse and just want to hear feed backs.

the reason why I am unemployed and I included it on my I-864 which I submitted to them

Hello everyone! This forum has been really helpful with our I-130 petition package. I just want to get your opinion on what we currently have.


Quick background:

We met online. Met in person 5-6 times. Got married in my country (Philippines) 2 years after meeting each other.
I currently live with him near a military base outside the US. I have been here as his dependent for almost 7 months now.
We have no kids. We have a joint bank account with a US bank.


What we intend to send as proof of relationship + some questions I have:

2-3 photos from our wedding day, with dates and some explanation
1-2 photos each from the 5 countries we have traveled in together (or will boarding passes weigh more?)
Joint bank account statement
Photocopies of 2-3 cards & their envelopes which has our names on it
Marriage certificate
2 or 3 contracts from our wedding suppliers (caterer's, photographer's, my gownmaker's)
Copy of our marriage license (from Manila)
Boarding passes/itinerary emails of his flights to and from Manila for our wedding
Entry and exit stamps to the Philippines on his passport
My letter from their military command regarding my stay here near their base
My entry stamps to Japan (where we currently live)
My boarding pass/itinerary email to Japan


Questions:

We are already married and living together. Do I have to send proof of how we met? Like maybe his receipt from the dating site where we met? Or pictures from when we first saw each other in person? Or does that not matter since we are already living together?

Should I ask for affidavits attesting to our relationship? Like from our best man (who's his best friend) or from my mother-in-law (who was at the wedding)? Or we don't really need it anymore?

Really hope to get more info... We don't wanna get an RFE. :(


Hi there! Don't forget to submit also your AFFIDAVITS of WITNESS/WITNESSES affirmed by two parties. It could be your so-called NINONG or NINANG at your wedding ;) And don't forget to submit your G-325A forms. You can download these at the USCIS website.

This is a standard email. The CO will make the decision. NVC is just telling you that. If you're confident you qualify, then relax. Your AOS has been sent on to the Consulate. If you were short of income and had a million in cash, you would have received the exact same email.

Unfortunately I don't have anyone who I would feel comfortable asking to be a joint sponsor since it is a serious matter. The only people I would rely on would be my own parents, and they are now both deceased. I thought assets would more than make up for income...


Honestly, im "unemployed". But got approved at NVC because of a joint sponsor. :) I guess, that's the thing you really need. just too bad you can't find one :(

I know right.. They are a bit unfair.. hmft.. Well dont worry.. why dont you call uscis.. coz before we got our case number husband called the uscis hotline.. (i think..) to know the status of our case.. The op said that they will update us on or before june 12.. and they did..:)

NOA1 is the priority date on the first acknowledgenment letter you received from USCIS, NOA2 is the date your I-130 was approved.

Unfortunately if the baby was born before the father became a US citizen, then the baby cannot be qualified for CRBA... Yes, you need to file a separate petition for the baby... I'm not sure but there's a certain criteria on applying for an expedite case... I,m sure some VJ members can shed some light about this issue... Goodluck on your journey... If the USC is the father of the baby you have to apply for CRBA and a US passport for the baby.


My daughter was born here in the Philippines.. Yes hubby became a USC a year ago... Is my daughter still eligble for a CRBA and a US passport? Do we need to apply a different petition for the baby? If so, How? How to expedite it? Hubby filed I-130 but i think its only CR1 because we just got married a yr a go.. pls help

So if you are the beneficiary, did you put your husband's name in #17? Do you have any children, even adult children? If so their names should have gone in #17 as well. Or did you just write n/a for the whole question?

Basically you, the beneficiary, filled out the petition for your husband to sign and mail. Is this correct?


No, I didn't notice the question that much that's why I put N/A on it. I don't have any children and my husband as well. And yes I was the one who did the whole packet, except for his signature and his G325A.

If your husband is the petitioner, HE is the foreign relative's spouse. YOU are the foreign relative. It is HIS name as your spouse and the names of YOUR children that belong in section 17. Putting your name there instead of his is not a problem. Whether N/A below that is a problem, depends on whether YOU have children. Do you?

The I-130 is the US Citizen's petition in behalf of their foreign relative. It is not the foreign relative's petition. When the I-130 uses the word "your" in means "the petitioner's". When filing for a spouse, the foreign relative's spouse IS the PETITIONER. and the foreign relative's children are just that. In your case YOUR children.
