If I worked at the Consulate, I would read this website, and particularly this thread. I might even be tempted to give advice from time to time, as it would make my job smoother. After all, these guys have to put up with a lot of #######... a chance to lessen that would be welcomed.


These Visa's are a very very small percentage of the Visa's they process at the embassy. These guys don't have to put up with any #######. They can just deny your visa and boot you out of the embassy. There is no reason to make this process smooth, it is up to the individual that is filing to make their trip to the embassy smooth. Gather all the necessary paperwork, read all the guides, and then double and triple check your paperwork. That is about as smooth as it is going to get.

Should be enough we, had about 30 photos, scattered from my different trips. We did have a ton of chat logs and phone logs. When we interviewed the guy was more interested in our phone logs, emails and phone records then the pictures. I think it all depends on the day and what mood they are in. It is best to have a good cross section of evidence, and don't rely on just one set of items.

I would actually guess as a professional and being a woman, they would most likely scrutinize more so. Main reason being there will most likely be more opportunities for a professional (depending on the profession) woman in the US then in Thailand, and if she is earning more money, it would be more likely she could buy her way into a fake marriage, to get a visa a make more money in the states. Just a thought.

But for the most part being able to speak perfect english does nothing except make it easier for her to answer the CO's at the interview, of course this may lead to the CO asking more questions then they normally would cause they don't need a translator.

It can be used up to age 30.


I didn't think it could be started for someone over the age of 18. I had looked into this quite a few years ago for my nephews, but in the end decided it wasn't really a good way to save for future educations, there was some sever limitations on the use of the money.

Not exactly sure why you would open an educational IRA for your SO. They are for a child under 18.

As for the ROTH Ira, once she gets a SSN your SO should be able to open an IRA, however I would suggest talking to a tax advisor and see if it advisable to put your money in that account opposed to some other investment vehicle. The ROTH IRA is for retirement, not to be used for educational purposes. Best to consult with financial professionals on these matters.

My wife was told so many times that she had to marry me and only me by the embassy, by the piece of paper they gave her when she picked up the visa, even by the POE officer. So I doubt you went through the entire process and didn't hear it at least once.

If I had to guess you didn't tell the attorney you were here on a K1. If I had to take another guess with the little bit of knowledge I have by your post, the plan was to do exactly what you have done.

Please pack up your things and head back to your country and go through the process the proper way.

She's from Cambodia. I hope it's not another year until she's approved.


My guess is being young and from a poor country she is most likely not going to get a tourist visa. If Cambodia is anything like Thailand consulate (which it most likely is), to get a tourist visa they have to show strong ties to the country to assure their return, and I doubt at 20 in Cambodia she has strong enough ties to convince the embassy she will return.

Watch the date on the NOA2, because it is only good for a fixed period of time. I was approved on Dec 19th and my NOA2 expires on 4/18.

My attorney has given me copies of everything they have done. Most likely they don't want to give you the file because they expect you to use them for AOS, and they don't want you using what they have done.

Best thing to do is send a certified letter requesting a copy of all the documents by such and such date.

The certified letter is so you know they received the letter.
The letter is your proof, that you have requested a copy of your file.

If they don't hand it over by the date in the letter, then file a complaint with the state bar, and you will have the proof they received the letter and did not comply.

I only recently learned to save the history of the chat session but she doesn't write much says it takes a long time. I TOLD HER 6 MONTHS AGO TO START EMAILING ME but maybe it's inherent do minimal culture? I'm vvery frustrated here trying to think what I can do differently to show enough evidence.

We have stamped passports we went to Cambodia together, some emails early on, my money transfers but only emails and pictures about business but not related to relationship as much.

My Fiancee even mentioned that she needed to email me for the embassy, but of course she only sent about 1 every other week, cause we spent so much time on the phone. I had 200 pages of call details report from my calling card, but he said that was me contacting her, not the other way around. Everybody has been baffled by needing more evidence, and completely baffled that they want to read our conversations. I would have thought being here for the past 2 months with her, would be evidence enough, but hey what do I know.

I have been dwelling on this all day and I am sure I will be until Monday when we go back to give the info they requested. Most likely no sleep for me all weekend.



by the "rules" one needs to only see the fiancee once. i don't have any 1500 emails but I will have 3 trips there by the time I'm done. Did you have a lot of pictures? that's one thing i'll have.

still, all those emails... I jsut don't have that many. VERY FRUSTRATING. I don't know how to get a call log...then again, she rings me, I hang up and I call her back. I think everyone knows that.

I feel like I'm walking into a losing situation here. Very frustrating.... So what if they want more evidence from me? I have what I have. Maybe he should come over and stay with us in her apartment....damn slug needs an attitude adjustment!

Mary K., u stayd here for 6 months? Really? First of all how old is your son because my daughter is 13 and school is a huge factor for me. I think all the time about how I'd go about doing that one.... if it came down to it. And also, dont you haave to file some type of documentation if u stay in Maroc longer than 3 months. I plan on staying all summer.

We were talking last night, and Abdel sked me... If I knew this would happen with the visa and the 221 g would I have still married him. It was just one of those I have moments I dont want to forget, it is just something about his yes that I can NOT explain, mmm-mmmm-mmmmmm!!!

I told him of course I would have and that we just have to do what we have to do, pretty much what we are doing anyway. Eventually we will be posting our news that we are together. Whether its thats he is in the USA, or that I am here for good in Morocco. He told me that in 1 year I would be ready to go back home. I said, if you're willing to give up your way of living, being around your friends and family, I would do it too. It'd probably be easier for me anyway, I have 2 people that I consider "true" friends, and I don't really see anyone in my family anyway. So an occasional visit, blah, blah, blah... yall get the picture.

So when thy review the case, they're going to interview me? I think thats what I read and it said to make sure the dowry is justifible. I beelieve it was Babybunny, is she still around? Anybody know? I also think she went thru pakistan, thats why I'd pointed out that geographical location spcifically, I have to go back between pgs 10 n 11 I believe thats about the area I saw that post referring to what I was talking about.

I feel you on the picture taking...... Abdel isn't so bad about takin pictures. While Im here anyway. While I was at home I would beg him to get pictures and send them to me. He would send like 3 or 4, and when I send him pics of the goings on at home I send like 30 pictures, online n actual photos. We've taken close to 300 I believe, and theres room for more. We're putting them in on monday tho. I may have to leave early, my daughter is begging me to come home, and my little sister has the house in disarray (spelling?). So I'm going in, kicking the door down and get my house back in order! :angry: Abdel agrees that I should go, both of our mothers are deceased and we talked about that, and of course he understands. I'm still mad at lil sis and I do miss my daughter.

I'm gonna try not to go off TOO bad! :angry:

I have again just read this entire post again and I'm gld that I did. It just reminded me of a couple more thigs I need to do while I am here in Morocco.

I have the paperwork for the tax amendment I will do when I get home. My sister mentioned something about a 1040X, but I need to talk to her again because Im not sure if I need that along with the 1040 or the 1040A, or do I need either of those forms at all? As far as Abdel having to sign the actual tax return, a fax is sufficient, yes? I'll probably do my name change first, though, and then amend the taxes.

We went to Citigroup here in Morocco and we cant open an account there, I think they said its not for individual accounts like the ones in the states. So we went to BMCE, and I can open one there. We can't have a joint account there because we have different nationalities, and he can only withdraw dirhams from his account and I would be able to withdraw both dollars and dirhams while here in morocco. So I will just transfer money from my account to that one and he can make deposits as well, into it. She said I woud have to live here for 5 years for us to be able to share an account . So Im going in there with my passport and $50 and open my own account.

We were also concerned with the fact that if I put money into his account, will it look like he is using me for money. Let me clarify something.... I have never sent him money. He will not let me. Even while I am here now, he doesnt want me to spend my money. I wanted to sneak :innocent: and get him something while we were in the store. Besides, the salesperson and I couldn't understand each other! He ended up buying it himself! :angry: I wanted it to be a gift from ME! :blush:

Do we need to be worried about that? I think I read somewhere before that a wife was sending her husband money very frequently thru western union and it turned out to not be good thing, for them anyway.

But the main purpose of the bank account is for evidence, blah, blah, blah! Of course we'll use it for our financial purposes, but the main thig we are focused on is "proof".

I also remember reading in this thread, something about the dowry? I dont know if that was just for Pakistan or a part of the return process or what but she said that, she, the USC, had an interview and they grilled her for 2 hours? Whats that about?

Thanks 100000000000000! To kiya and all of the others that are putting information in here to help us. I have done osm eof the things that youve posted here. I know you can understand how helpful it all is. There is not a day that goes by where I am thinking to myself, is there something more I should be doing.

I emailed the DOS, or composed the letter for the FOIA, and they told emailed me back saying that it is a 3rd party request since it was about my husband. So he wrote a letter, mailed it to me giving me consent to request any infromation about his case. Am I missing something with this? I havent heard anything back yet.

I gotta say, that diplomatic pouch thing is for the birds!!!!!!!!!!!!!! No wonder it takes so long! :angry:

Hello all, I have a question and I would really like as much information as possible, especially from those of you who are"old school". (F) (L)

My husband had his K-3 interview in Morocco and they are sending it back for "further review". :crying: I read somewhere the AP and the AR is good, well, better than havng it sent back. This can cause more ridiculous waiting.

My husband and I both recevied the Choice of Agent form in the mail foor the CR-1. Should we follow up with this process or should we just wait until we herar something back about the I-129? I am at a loss right now and I have contacted so many people on this issue and I am getting so many different responses. Everywhere from the senators representatives, to emailing casablanca and NVC. I have gotten replies but it does nothing for the waiting I have to do, still.......... Nor has my inquiry on the best thing to do in regards to the CR-1. I have even gotten good responses from VJ.

I just want to go withthe majority..... please respond. :help:

The beneficiary pays the IV bill?

I thought that the choice of agent form was so the beneficiary chooses who gets the mail. If the beneficiary chose her husband/petitioner in the USA, as her choice of agent, he will ge the IV bill, right?

Petitioner usually pays it, right? I don't know....... just what I thought. For my husband to come up with $380 in US money.... I dont know about the conversions from where u are.....

I am really sorry to hear that. My husband was issued a "sort denial" as other members of VJ have informed me about. I wish I was knowledgable enuff about this to where I could give u some advice. The attorney sounds like the best thing for you, tho. I have one waiting in the wings just incase there is an issus e with my husbands CR-1.

I feel u and how devatating it is. The difference between u and myself, is that my husband wasn't banned. This is the first time I have ever heard of someone being "BANNED". I never thought about that possibility and again I am truy sorry for u and your husband.

There have been restless nights for me too. But again I am not technically in the same boat as you are.

Has your husband ever applied for a visa before? As long as you have some idea as to why the decision was made.......

I have a question about how would someone report their income if they are self employed? I called NVC today and she let me know that right now, I will be reporting the income for 2005, (of course). I made well over the poverty lines according to the guidelines.

So for part 6, I will put my current status? Self employed.. is this the same as an independant contractor? Filing with a 1099? Hmmm, I dont know...... this is my first time using one of these forms. :blush: Pretty much check box b, right?

For the current individual income, is this inclusive of the job I had until 8/06 and what I make now, or only from self employment?

I will be sending in tax transcripts for the last 3 years, pretty much that same as with the I-134.

We didn't get the I-129, and it hasnt been "officially denied" either, so I am riding the horse until the legs fall off....... :lol:

Hello All,

I mailed in the I-864 a little over a month ago. I havent heard anything back about it. Can this part of the process have a negative outcome? By that, I mean more than an RFE. What are some of the worst case scenarios? I may be more that likely scarred by the 221 (g) my husband received for the K-3. I just feel like "they" have it out for us. Can the I-864 be denied? Is it too soon?

I meet the income requirements and sent in the documents that go with that form.. I am just saying........ :unsure:

Until an adjudicator looks at your evidence when your petition is processed there is no way to say if what you have supplied will be accepted or not as proof of having met within the past 2 years. I have seen some that have submitted similar to what you have and beeb approved.....and some that have submitted similiar and have been sent an RFE for more evidence.

Photos are a tricky thing as some have received RFE's clearly stating that photos do not prove that one has met. They are looked on as secondary evidence in support of primary evidence such as passport stamps, boarding passes, rental receipts (if have lived together) etc. Evidence should create an entire picture in the minds eye of an adjudicator and each adjudicator is going to see evidence differently...hence why some will get an RFE and others dont.

Its normal to second guess but try to relax about it and see what happens. If you get an RFE you will just need to supply the further evidence. I know thats not what you want, no one does, but little one can do about it.

Hey all.

I don't know if I should be nervous or what here. I got an RFE but it was for the I-130, so I'll probably be getting one for the I-129f, too. It looks like most people are gettin em 4 the 129f. It also looks like, and this may just be me, but the majority of the RFE's are for stuff we've sent already. What is this madness about? They wanted from me, the marriage certificate in arabic, english, and the translators authenticity, if you will. I looked through the copies I made of the I-130 packet the whole weekend before I received it in the mail, and you betta believe they were in there. When I got it, I called my husband so I could open with him and my jaw hit the floor. He had to call me I don't know how many times before I actually answered him. I couldn't believe it, and he couldn't believe it either.

Like ready4one said, at least you know someone is working on your case. Thats the same way I felt about my RFE. Some action is better than none,you know. They should be gettin mine this week or the beginin of next week.

From the looks of it, people are approved in less than 2 weeks after. Then we have the pleasure of waiting some more, but now with the gratification of knowing that we are one step closer to being with our husbands and wives. You can start invisioning the day you see em at the airport and running up to em in the airport and huggin and kissin and spinnin around in circles and looking into each others eyes and crying and huggin and kissin some more..... OH SORRY! Does that only happen in the movies? :ot2: I was totally in another world for a minute. Thats what RFE spells for me... :P

If you are legally allowed to remain in Canada, working or not, until May07, the Consulates in Canada should still take your case. Did you indicate in the petition that you'd like to interview in Canada?

We did a 3rd country interview.

All the information you need to file is on the Petitioner. Unless you have been married before. If you have everything listed in the Guide you should be good to go. There will be more stuff to gather later in Consulate stage that will be help in the Philippines

Your country of permanent legal residence will have jurisdiction....



Let me clarify my answer... you can request the consulate/embassy where you currently reside but there is no guaranty and therefore no obligation for that consulate/embassy to accept your case. No harm in requesting on your i-129f form.

my USC fiance & i is almost done gathering all documents needed for our I-129F. we have a lot of concerns here...

i'm gonna start by telling you a bit of our history... :yes:

russell is born in the united states but studied in the philippines. he goes to the US every now & then but for just months. after studying... he managed to start up a business & it is still on going right now.

our relationship started back in 2004...we were engaged in 2005. & then...on may 2006 - my working visa as a LIVE-IN CAREGIVER to ontario,canada was approved. so i have to come here to canada to work. he accompanied me & then went straight to the US. he is now working but only for months..

after a month...my work back in ontario was a disaster so i opted to go here in vancouver in search for a job. but until now...3 months of searching...i don't have any luck but still trying to find one. several interviews was conducted but still...no work!

and because of all the hardships that we are going through - of being apart, we are now in the process of filing an I-129F petition. he went here last september'06 to visit me & let me sign documents for his petition.

we gathered all the documents listed on the GUIDE here... very nervous because we might have forgotten somethings or it may not be approved...

Your having a job is not an issue for the K-1 petition. USCIS could care less if you're working or not. The USCIS is trying to make certain what happens when you move here to the states is good for all involved. And that falls into the lap of your Fiancee, not you.

Maybe there's something here that I don't understand. The USC filed the K-1 petition and they are responsible for your welfare when you arrive here to live. If you want to get a job, then go ahead. It's OK!
