IR-1 / CR-1 Spouse Visa Process & ProceduresApplication for Imm Visa

If anyone can help.  It says complete this form for yourself and each member of your family who will immigrate with you.  I am a US citizen, so is this form for only my husband (whom I am sponsoring) to fill out?  My children are US citizens (we are currently living in Canada til July 10, then we move to US).  Do we need to fill out this form for each child and myself (or are they not considered immigrating).

Thank you

The source need not be US based.  For example a retired UK government worker on pension has an income that will continue from the same source after immigrating.  (in bold is the actual wording)

When using either income or assets or a combination from the intending immigrant SPOUSE no I-864a is used UNLESS children are immigrating with the spouse.

You've been a lot of help.  Thank you.  Blessings :)

Likely the answer is yes.

Do you have a joint sponsor otherwise?

Yes, my husbands pension will continue 56k yr.  We do not have a joint sponsor.  I do have a home there (30yrs, pd off and taxes to show) only worth on paper 60,000usd.

Yes.  You do the I-864

Your husband, who makes the income which will continue once he moves to the USA (he will need to provide PROOF of this) will do the I-864A to go with your I-864.

Your children DO NOT go into Part 2 of your I-864.  They are counted as dependent children in Part 5.

I was just reading the I-864A is only for permanent residents or people with continued finances in the US.  My husband whom I am sponsoring, income is a Canadian pension, we can prove.  Not sure if we fill out the I-864A or not?

Yes your husband would do an I-864A.

No you would not put your children in Part 2 because they are not immigrating.   You do count them in Part 5 however.

Sorry to ask this, but "I'm a little sloooooow...lol, I filled out a I-864, and thought only me the sponsor is to fill it out, my husband the $ guy the I-864A...am I to fill out a regular I-864 on my husband and attach a I-864A..."I am reading, just trying to sort it out in my mind"....thanks, hugs.

Sorry, read back all the other responses.  So, I thought my husband "had to" fill out the above because we are relying on his "continued" income.  On my I864, I have $0, how do I show my husbands income and prove his continued income without the "A version".  Thanks.

So on the I-864A (spouse financial supporter) I don't have to list the dependants under Part 2, just my husband?  Thanks...V

Hi, I am the sponsor, my husband is filling out the I-864A to support us in the US.  He is technically the only one immigrating.  On #13 of part 2 (I the sponsor) do I put his name and my two children (because they are dependants, NOT immigrants (US status children,NOT immigrants) or just his name?

Thank you.

Cool i appreciate it that man. Makes me feel a whole lot better. We were just gonna wait in juarez which would have sucked with the interview being this friday and monday is a holiday so we wouldnt get the visa untill at the earliest that following tuesday. Thats 4 more days or more just waiting around in juarez and spending more and more money. I think i feel confident now that if we just went back to her hometown in hidalgo after interview it will be at the dhl before i have to be back to work. Im praying anyways!!! Lol thanks man

Mexico, Latin & South Americaneed help choosing DHL location!!!!!! juarez

Ok here is the deal. My fiancee's interview is October 11th which is a friday and that following Monday is a holiday so if we was to wait in juarez for the k-1 visa to arrive once approved (God willing) thats a possible 4 or 5 more days we will be waiting there paying all that money for the hotel and just waiting in Juarez like idoits for it to arrive. I know it takes 2-4 business days to arrive if we choose a DHL location in Juarez.  We dont really want to wait around there but we are scared if we choose a DHL location near her hometown in hidalgo that it wont arrive on time. I am in the military and will be on leave during all this but have to be back in the U.S and at work by Oct. 24th. i have researched that if having it mailed to another dhl location then it could take up to 2 or 3 weeks max but i have also seen people on VJ who have said they recieved it in like 5 days or a lil over a week. So basically i dont no what to do, time is running out and we want to plan it so we have the visa and we leave together to come to the states by the 24th. So would that be enough time to just pick a dhl in her hometown if the interview is oct.11 and i dont have to be back till oct 24th. will that be enough time for the visa to arrive? Or should we just play it safe and wait in juarez for it to come. But either way we have to go back to her hometown for a few family events and so she can pack. Advice please???

Thanks in advance

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsUpdate on Spousal Visa...F**K*** Furious

I totally understand your frustation. However take a look again at the NVC website. They are changing the whole process. You can send both pkgs in at the same time. My advice is not to listen to everything the NVC operators tell you, half of them don't have a clue about this process. I wish you and all of us the best.

Hey when does this.new.process take effect is it now. I'm still reading about people saying that they have to wait 60 days for each packet to be sent. Can u post the link with this new information I can't find.it.

We've waited six months to see this:

On June 13, 2013, we mailed you a notice that we have approved this I129F PETITION FOR FIANCE(E).

K-1 Fiance(e) Visa Process & Procedureshelp misspelled name on fiancee's birth certificate
Ok here is the story we were planning on filing for a K-1 visa so she started getting all her documents in order she went and got a copy of her birth certificate cause she had lost her old one they misspelled her first name on it by one letter then she took that to go get a new paassport and they spelled it wrong on her passport cause it was wrong on her birth certificate. She still never noticed then while we were filing our K-1 petitiin we got a consultant to help us and he spelled her first name the wrong way on the forms.again we didnt notice. In her name its now a i when it should have been the letter L. We then mailed it off. We realized that her name was spelled wrong on everything after we submitted the k-1. We recently got approved from uscis so i guess there wasnt any red flags with the background check. We thought about trying to fix this then realized that would delay everything alot longer so we decided to just go with it.all of her documents will match up at the interview with the same spelling all her identification documents and the forms on the petition are the same spelling Should we run into any problems i mean its just 1 letter and the main point of interciew is to make sure relationship is genune. Will they find out her first name was spelled a different way. I doubt it cause everything matches but im no expert. Does anybody have any input on our situation? Will we be fine? Thank guys

K-1 Fiance(e) Visa Process & ProceduresI-134, K-1, Proof..

You do not need to show a bank account at all. Hopefully you also have taxes to back up your claims. You need 125% the poverty line for two people, you and her, which is about $19K, not 12K as you cite.

How many years back would I have to show for tax returns for this?

I honestly think in your situation, I would go the CR-1 route. Meaning, get married in China, and then file for a spousal visa using your co-sponsor. Since the I-864 Contract is binding vs the non-binding I-134, you may have a better chance getting approved than if you go the K1 visa route! Good luck! :)

And I'd need to show them 3 years of past tax returns for the CR-1 though, correct?

K-1 Fiance(e) Visa Process & ProceduresI-134, K-1, Proof..
So I am 24 years old, my girlfriend is Chinese and we've known each other for right at 1 year, 2 days ago I came back from a 7 months visit to China to meet her/live with her/fall in love with her. I couldnt stay in China because I don't have a University degree, so I want to get her here ASAP.

There are a couple ways I can do it, but right now I would like to know what you guys think of my situation before I even start the K-1 process.

I have a job making 11$ an hour, 5 days a week, and 9 hours a day. I also do some extra work during the weekends, mowing lawns and misc things like that. I make about 24k per year before taxes, and some play money on the weekends I don't keep track of. Here comes the difficult situation.. I don't have a bank account. I don't want to get into it really, I just don't have one. I've never filed for any government anything because I don't believe in that. My employer can co-sponsor if necessary the business I work for is having record sales, I believe last year we earned 2million in revenue.

Basically I want to know what you guys think of my chances of a successful K-1 process for my Chinese girlfriend with no bank statements. I can provide the employer letter, proof of work, (he pays me with company checks, which I cash at his bank) so I can use those as proof of pay? Seeing as how I just got back from a 7 month trip in China I would end up having about 4-5 months of pay proof when they would request me to prove my financial solvency? I don't know, I just arrived home 2 days ago. I checked the poverty line, it says for a single individual poverty is 12k per year, I make double that, so I would just need to show the employer letter and recent pay stubs since I started working again 2 days ago? If the bank situation is a real deal breaker, could my boss help me co-sponsor and move it along that way?

He has never sponsored anyone before to my knowledge, and neither have I. My girlfriend is 22 so she has no children, and neither do I.

Let me know what your opinions are about this. I have yet to start the process because if the bank situation is a very large problem and I will be declined because of it I'd rather pursue other avenues of getting back together with her, even if that means being together with her in a third country. ( I have such plans, but would really like to get her a green card and for my family to attend our wedding in my friends house in Vermont, it's beautiful little farm house!!)

Sorry for the long sporadic post, I just don't know how much info you guys need to give me an opinion, if you have any questions feel free to ask.
