Just trying to keep our thread on top. Have any of you started to gather information (pictures, evidence of relationship) for the interview?

Yes, most definitely! I'm probably driving John nuts with all the "notes" and reminders that I give him every day, like "get long copy of your birth certificate!", "request copies of police reports from age 16", etc. I've got SO much documentation of our relationship, it will be hard to not send him with too much stuff. I've kept everything for our scrap book, not realizing that it would come in handy for our fiance visa. cool.gif

Hi all! First post biggrin.gif (well ... second post now, because I posted in the wrong spot!) Scared to death that this whole process is going to take forever, but SO glad to have it underway! Has anyone besides me been brave enough to go ahead and pick a wedding date and start planning?!!! blink.gif

K-1 Fiance(e) Visa Case Filing and Progress ReportsNovember 2009 K1 CSC Filers
Thinking I'm going to end up hanging out over here with you guys! :) My NOA2 date is 10/29, but who knows which "box" it actually made it into ... the October(s) or the November(s).

Yep, tons of approvals over in the October CSC section, still a good handful or more September CSC ppl waiting on theirs, and tomorrow it will be 3 months for my fiance and I. ::sigh::

It sure is hard being patient isn't it

K-1 Fiance(e) Visa Case Filing and Progress Reportsmy 8months waiting at csc was yesterday

Sort of. Igor's list makes estimates based on its own sample data. And I think that can work over short time spans, but it gets wildly inaccurate over longer ones because the only real important variable--the number of completions per day--fluctuates wildly from month to month in ways that Igor's list data cannot really predict. My system is a bit simpler in most respects. It simply estimates the number of petitions pending at the time someone files, assumes a serial processing order based on filing date, and then counts down using the completions per day until all the applications that were pending when that someone filed have been completed. When everyone before you has been completed, it's your lucky day. It relies on the USCIS published data for pending, received, and completed petitions through January, 2013, and then I used hypothetical data sets to fill in the rest based on historic trends.

The only problem I am still having with it is that the USCIS historical data doesn't add up from month to month. You'd think that the number pending would be a simple function of the number pending in the previous month + receipts for the current month - completions for the current month. But you'd be wrong. It doesn't add up. Thus there is still a bit of a discrepancy between filers from different months because the baseline number of pending apps based on the USCIS data is inconsistent with their other data. Once I've figured a reasonable fix, I'll post the the spread sheet so everyone can play around with it.

Very complicated for sure. USCIS keeps worse online count/records than my daughter does spending her allowance (which is no records at all and wonders where it all went). Will be interested in seeing your spreadsheet when done. Will it be for K-1's only?

For what it's worth, I'm currently working on a model to predict completion dates based on different forecast scenarios. I'll have this up for everyone to use within a day or two. But, in the meantime, it's saying as a preliminary matter that--under the worst case scenario (i.e., the low completion rate of January has continued and will continue indefinitely)--you should be approved around April 22.

Anything similar to Igor's list?

K-1 Fiance(e) Visa Case Filing and Progress ReportsStupidest RFE in immigration history!

Somewhere in the guides or example forms it states that for any question that does not apply to you, mark it N/A. It also states, do not leave anything blank :)  It has been a reason for RFE's in the past, blanks that is. And to answer another question, yes, you can get more than one RFE. If they are not happy with the 1st RFE response, they can send another request for information. With that all said, do not panic because you might have answered a question wrong or left something blank ... you may or may NOT get a RFE. You will not know until you get a response from USCIS and if you do get a RFE, know that they are working on your case (that's a GOOD THING!) and that the next step is that much closer :)

Good luck to all of you guys still waiting for K-1 NOA2's. You've had an enormous wait recently.

IR-1 / CR-1 Spouse Visa Process & ProceduresNasty Surprises?!?!?!
Welcome!

Make sure you do a LOT of reading, especially the guides, and take advantage of the example forms.

Agree with the vaccinations information - if they are not up to date, inquire if your physician can give you the ones that are required for your age bracket. John did have to have an update, and the US will not accept the Canadian vaccination (TDaP is what was required). Take your vaccinations with you to your medical.

Depending on where you're moving in the U.S., a nasty surprise might be that you won't be able to get Tim Horton's!

teehee Carla :) I do see more and more of them cropping up now a days.

K-1 Fiance(e) Visa Process & ProceduresMet my love, wanting to move to the US.. not sure where to begin..
Welcome!!

I was the "... but she might be a serial killer!!! ..." girlfriend! Well, obviously I'm not ... I'm the fiancee! and I adore his family and I (like to think) they adore me as well! It was meant to be, and what is meant to be, will be!

You have options, as stated above, however it is ultimately you and your boyfriend's decision on what route you want to take. For us, we knew that we wanted to be together, to be married for the rest of our lives, and it wasn't logical for me to go to Canada as I have children. Moving to the US was the right option, so we then explored what type of Visa would be best for our situation. We wanted as fast as humanly possible, so we chose and are in the midst of doing a Fiance Visa. That might be your best route as well.

Good luck to you both on whatever route you decide! If you go with a K-1 ... be sure to check all the great guides, wiki's, VisaFAQ's and all the other good stuff here on VJ!

K-1 Fiance(e) Visa Process & ProceduresMultiple Entry K-1 ?

The K-1 Visa is a ONE TIME entry visa. At POE it is cancelled and REPLACED with a I-94. Your husband was given a multiple entry I-94.

Now this being true DOES NOT mean that he will be allowed to use it as that. Since he has not adjusted his status yet, the CBP at the POE could deny him to use it again and then he would be stuck outside the border with no way to re-enter and you would have to do the visa process all over again. Be very careful.

I would have him procure the proper documents and then arrange to have them sent to someone else who can bring his car over the border; I would be very leery about doing it myself without an AP or GC in hand.

Sorry, I mis-spoke a bit ... yes, it is a multiple entry 1-94, not a multiple entry K-1. my bad. Not planning to do another 2500+ mile trip to go back to the same POE to import the car.

mine says multiple entry as well, however, i personally wouldn't chance it.

I agree, and don't want to chance it. Would be the worst thing to happen, especially on our honeymoon! I know that the American side of Niagara Falls is not as pretty as the Canadian side, but it will be best to at least be TOGETHER during our honeymoon! :)

K-1 Fiance(e) Visa Process & ProceduresMultiple Entry K-1 ?
Um, yep, us as well, however his I-94 in his passport specifically says "MULTIPLE ENTRY" and he was told that it means exactly what it says, and after he asked 6 times, the officer started to get frustrated with him. I'm wondering if ANY one else has had this experience and received one?

K-1 Fiance(e) Visa Process & ProceduresMultiple Entry K-1 ?
When my fiance, John, entered the US last week, and attempted to import his car, it was realized at that time that Acura had given him a letter that states that his car complies with all Canadian requirements, NOT American requirements. ugh! At that time, he thought for sure that he was going to be denied entry, however he was given a "multiple entry K-1"/I-94 and told that once he receives the right letter from Acura, to go to Port Huron and import his car (within the time frame that the state of Michigan requires ones car to be registered). One of the officers kept telling John how lucky he was because they very rarely give out multiple entries. Has anyone ever heard of this or have you received one?

K-1 Fiance(e) Visa Process & ProceduresPost K1 Confusion...

Thank you very much. That is exactly what I was confused about.

My pleasure! It does get confusing after reading everything and hearing different things from different people. The guides here on VJ are exceptional as well as the wiki if you are confused about something in particular. Good luck on the rest of your journey!

K-1 Fiance(e) Visa Process & ProceduresPost K1 Confusion...

is she legally allowed to stay in the States until she is approved or denied for her AOS?

If she comes into the US on a K-1 visa and marries you within the United States within 90 days of activiating her K-1, she HAS to stay in the States while she is Adjusting her Status, or she receives Advanced Parole to travel, otherwise her application to adjust is considered abandoned and then you would have to start over with a CR-1/IR-1 visa application and she cannot be in the US while doing that.

K-1 Fiance(e) Visa Process & ProceduresRFE - I129F Request for primary evidence of meeting in person

It's interesting that they want evidence of you *meeting* and yet I assume you submitted photographs with both of you in them, together. You know, like... meeting. Silly folks.

My thought exactly. Do you have any additional photos, even though they said no to additional photos, of the two of you with a visible US or CA landmark in the background? If so, send those. Photos that are dated too.

Hi,

Just getting my documents in order to send into the London embassy. Do I need a an affidavit of support for a K3 (fiancé) visa?
What are people experiences? Have they been asked to produce one at the interview or send on in beforehand?

Many thanks,

K-1 Fiance(e) Visa Case Filing and Progress ReportsGot in through Detroit! Had a small bump to overcome...

Oh my goodness, I am so sorry to hear about these awful POEs at Detroit! I will be going entering through Detroit as well. I can't believe that they would ask such personal questions, or lay out your undergarments like the way they have. I'm so sorry for the way you were mistreated! sad.png

Also... I was surprised to read that the K1 is valid six months from the date of the medical, rather than of the visa issuance. I had never heard this until today. Can anyone explain why this is? Thank you!

K-1 Fiance(e) Visa Process & ProceduresYes, you can visit!

I am from Canada and I crossed the border (Windsor/Detroit tunnel) yesterday to visit my fiance. This was my first time crossing since we became engaged. The crossing was tough, as since I had a fiance and mentioned us going through the visa process and presenting a copy of our NOA2 after many questions, they almost didn't admit me. One officer said that since my fiance had filed a petition for the K1, that I am technically inadmissible because I have told them that I am an intending immigrant. I thought that having a copy of the NOA2 would be helpful, but the first officer I talked to said rather abrasively, "Who are you talking to? Are you talking to me? Do you know who we are? We ARE immigration" when I mentioned that I didn't have the original, that my fiance did, and that I would be getting it to bring to my visa interview, and that a copy wasn't enough. They asked many questions,  such as where we met, when we were getting married, if I was moving in today, and wanted the address of the place I would be staying at... it was really intimidating and when I thought it'd be an easy crossing, it was definitely the most difficult. I was told that I would now be under a lot of scrutiny because of us going through the visa process, even though I said I would NOT be moving until I cross with an approved visa. sad.png I am planning to visit again in December for the holidays and am afraid I won't be able to get in. So many of you had easy crossings, and it seemed to help many if you had a copy of the NOA2, but man... that was frightening to go through!

K-1 Fiance(e) Visa Case Filing and Progress ReportsWhat number were you on Igor's list...
#130 on VJ Igor's list.

I quit following the Berkley list because it wasn't accurate ... there were people that were receiving their NOA2's, updating their timeline, and not being updated in the Berkley list (remaining listed as unapproved - no NOA2). I even went so far as to email the guy that runs the Berkley list, as it appears that there are some broken links.

And to whomever asked why they disappeared off of Igor's list ... it just gathers the time frame between the filing and NOA2. After that, you "drop off". BUT you can still follow peoples time lines here which gives lots of detail from beginning to end of the K-1 process. Hope that is helpful.
