I know that the $680 isn't for a lawyer, BUT what I said was I would rather have that $680 to obtain a lawyer IF needed. Thanks for the advice!

Is there any reason you think that you might need a lawyer?

Removing Conditions on Residency General DiscussionWhere are the approve letter and card from?

Up to 60 days for your card to arrive, Ashbey. It should say that right on your letter. You've asked this in other threads, and it's been answered multiple times. It takes up to 60 days for the production of your card and the arrival of it. Based on the search that I just did, it appears that Green Card's are produced at the Service Center from which you were approved. So, either CSC or VSC. Hope yours comes soon so you can stop stressing over it :)

Removing Conditions on Residency General DiscussionRFE questions

Life insurance etc doesn't actually show someone that you trust them with money. You don't deal with that insurance every day, and you can't get money from it.

Absolutely disagree with you here. This shows that you are willing to give every penny that you put into a life insurance policy to the person or persons named. Would you want to give, oh, say $100,000 to just anyone? Um, no. Also, at most employers, BIG employers, you can only put your direct relatives, such as spouse, children, grand-children as the benefactors.

Removing Conditions on Residency General DiscussionRFE questions
No need to pay an attorney to tell you what you need to send in for your RFE. In my opinion, don't waste your money. That's what VISA JOURNEY is for ... help without an attorney (I also feel that they can slow your case down ... who is better at making sure everything is done quickly and in a timely matter than yourself?!) If what you have isn't enough, you might get called in for an interview. Send in every piece of info you have from the time you were married up until now, i.e. financial and that shows you have comingled your finances. Also, anything else you have that shows you have comingled your life. THAT is what they are looking for. Life insurance policies = good. Having both of your names on the deed is not a must, in my opinion. Sometimes, it just doesn't work out that way ... just like another poster said above ... wasn't logical for them to refinance at a higher rate just to add her spouse. There are definitely other proofs that you live together, and have a good faith marriage.

Removing Conditions on Residency General DiscussionHow long does it take for USCIS to respond after I send the RFE?

We received a RFE and responded. The Fedex package i sent was received on 5/22. This coming wednesday it will be 3 weeks since USCIS received our package and i have not heard anything yet. Still waiting. I am out of the country on vacation now but i have someone checking my mail everyday and still nothing....

Took just about 3 weeks for us as well. Right about the time I started to get anxious about the reply, an approval showed up :)  Good luck!

Removing Conditions on Residency General DiscussionI-751 May 2012 Filers

We got an RFE back in February....sent in more evidence.... now the beginning of April we get a letter saying that our case has been "randomly" selected for an interview and that we have to wait until they make an appointment which could take god knows how long.

There is nothing random about being selected for an interview and it is soo crazy because we have sooo much evidence!

August '12 ROC filer here and just a quick question. When did you send your RFE response back? I'm just curious because we got one too (absolute no reason other than we moved .. ), sent everything to them the next day and it has been 3 weeks. Our case status has never changed on the USCIS website. Did yours? I told my hubs that I bet we get "randomly selected" for an interview next. I hope your interview goes well and you get an immediate approval right there!

I got an RFE and I am from Germany.

LOL!

Exactly. They are definitely not country of origin driven. They are "you forgot something that we really want to see before we make a decision" driven.

I am convinced the part of what drives RFEs are the beneficiaries national origins. But that's just me.

Received e-mail and text this morning @4:30 am that my card was mailed today 4/9/2013.Does USCIS work early like that or is a glich?

Removing Conditions on Residency General DiscussionI-751 July 2012 filers

We have received the NOA letter on July 6th and till then still waiting to be approved. No RFE, no interview letter, the internet page still shows initial review.

The strange part is even for August 2012 fillers for the VSC have started to be approved. People who got their NOA on August 26th from VSC got approved but not us ? Logically , they suppose to work on our case before August fillers aren't they ? Can someone explain me why they are working on August before to complete all July applications ?

No one can explain it, but we all wonder and worry about it. July '12 had a filer approved in December '12, no expedite, not military, just a plain ole filer like you and me (they happen to be friends of mine and I am thrilled they got approved so quickly!), so explain that one. Can't. USCIS probably couldn't either.

You are aware that when petitions are received, they are logged in, a received letter is mailed (or a RFE if something is wrong) and the petition is put in a box with many other petitions (not all the same time mind you). When that box gets pulled, hopefully in a specific order but it seems not, the petitions in that box get worked, hopefully in order but probably not. If the adjudicators are like most people, they probably do the easy ones first OR the ones they enjoy the most.

And also consider this, if I mail my petition on Monday from California TO the California Service Center and you mail your petition on Monday from New York TO the California Service Center, one will get there before the other. If you Fed Ex your packet, I UPS my packet, and another mailed via USPS their packet, one will be quicker than the other. It's just a bunch of factors all put together that determine when your petition gets worked on.

The wait is frustrating, for sure. Just remember how difficult the wait was when it was waiting on your fiance(e)/spouse to be able to be with you IN the US. Now its just that 10-year "ok, you can stay for longer stamp" aka green card.

You will hear from them .. one way or another :) (L)
Beth and JohnFemaleCanada2013-04-03 07:03:00
Removing Conditions on Residency General DiscussionI-751 July 2012 filers

Just FYI, a lot of adjudicators do not work "on site". Lots of them work from home. At least that's my knowledge of it.

However, you might be right in a sense that those files that they work on at home won't (most likely) be put in the system until the adjudicator is on site.

I've heard the same, about working from home. They check out a box (or boxes), take it home, work on it. Sometimes they "touch"/log into the case in the USCIS database which causes a touch/date change on your case, and sometimes they don't.

Wow, I just said the same thing Martyshk said ... sorry! I should read more carefully :) That's why I just lurk and don't post ... back to lurk mode :)

Deys, they are unfortunately mistaken to prohibit you from continuing your interview and they can get in big trouble for that.

And everyone else, I hope your approvals come quickly, interviews go well (INTERVIEW? I can't believe they called you in for an interview! GOOD LUCK!), and that the green cards show up post haste!

BTW: John's greencard has been here for almost a month now, and TODAY is the first day I received any text messages about his status update on the USCIS website. I guess once 60 days have passed, I can give them a call.  But I'm assuming they aren't going to do anything until then, so there's no point bothering just yet.  I'll be sure to post an update if/when my greencard arrives!

It's been over 3 weeks since I received my approval notice.  But I still haven't received my greencard.  I'm getting worried.  I want to visit my family in August, but I daren't make plans until I have the greencard in hand.  Has anyone else been waiting this long?  Judging by the timelines of others here, I fear something might have gone wrong with my greencard being issued.

John's ROC was approved on April 22 and we still haven't gotten his card. Apparently CSC takes forever to get theirs processed ClockWatch2.gif

Our status has never changed from Initial Review. The only way we even know there was an approval is the letter with no tracking number. Woo hoo! Congrats!

Latest update in the saga of the wrong address:

Today, May 9th we received a letter from USCIS dated April 30th stating that the green card was shipped to the wrong address due to a clerical error on the part of USCIS (No kidding Sherlock!!!).  We are welcome to apply for a free replacement card by filing an I-90.  We can request expedited processing, which may or may not be granted.  headbonk.gif

We have one more service request number out there which should be answered by the 21st.  Hopefully we will get a better answer from the second service request or will get a response from the Ombudsman's Office.

Congrats to everyone else who has been approved and actually received their cards.

Oh good grief! Why can't they get this right?  I hope the card comes quickly!

Ah, thanks for letting me know when you sent yours. Adman, let us know when you send yours too, that way we can compare notes :) I've looked at others timelines/signatures that received RFE's, but they were all over the board from hearing back within a week to waiting months. Removing Conditions on Residency General DiscussionI-751 Aug 2012 filers

Haven't sent ours yet! Might be a few weeks. Trying to be as meticulous as possible in what we're sending because we really have no idea what they want, and trying to think of something else that we might be able to include. Ever since you mentioned they only asked you for those 2 categories of things (and we got asked for 3), we're really stumped as to what the problem is, or what they didn't think was enough proof, so we're trying to cover every base. I figure if anything, that's what we sent the most of in the first place, so I just can't understand why they're asking for more.

I've started with a letter explaining what all is being sent-- going item by item on their list, and responding line by line with "we already sent this, but they are included again in case they were lost" or "we already sent 3 years, here's 1 more" and so forth. I hope they don't think I'm being a smartass about it, but I mean, they asked us for nearly everything we already sent, so...

As of now, the only new stuff we've got is:
-The new apartment rental agreement
-Renters Insurance evidence of insurance that is addressed to us both (paperless, though, so it's just a printout of a fax)
-Print-out of our account info for internet/cable that shows me as an account "partner" and shows Adman logged in. We always just used the same login before... *shrug*
-print-out of account info for cell phone showing account managers (this includes me (bill in my name), Adman, and also my mother (family plan), so I'm hoping it doesn't confuse them)
-2012 tax transcript - Not sure if I need to include w2s-- they had it listed on the RFE but I thought transcripts meant you didn't have to send w2s?
-Utility Bills in his name + cell phone bill in my name-- both show same address, but neither have both of us on the mailing address
-Itinerary of a flight we have booked together in May to visit his family back in the UK. Gonna highlight the price of the tickets coming out of our joint bank account in hopes that means something to them...

The old/updated stuff we're resending/updating is:
-ALL our bank statements from back to 2007 when we got married (only sent quarterly before)-- We plan on putting sticky note flags on anything that was a bill paid on the shared account-- again, no idea if this is overkill, but...
-print-out of new car insurance with just Adman and I as "Drivers" at the new address (previously sent one in my mother's name as we were on her policy at her house, now in my name since we moved, I am listed as the primary insured, Adman listed as "Driver - spouse")
-2009-2011 tax transcripts-- sent 2008-2011 last time. For some reason when we called for transcripts it wouldn't let us access 2008 this time, so I'm hoping that isn't an issue. We didn't file in 2007 because neither of us worked, if memory serves...
-Re-print of health/dental/rx/vision insurance card showing both of us + a recent invoice showing him and I as patient/responsible party + a letter from his workplace confirming shared insurance + life insurance with each other as beneficiary (they had all this before minus the invoice...).
-And I'm considering sending copies of the USPS confirmations of change of address for us both, just in case they're still not sold on the "we still live together" thing.

It just feels like it's all "meh" proof. If they want more confirmation from when we first got married, I don't know what to tell them-- we sent all we had, so I guess they'll have to call us for an interview if that's the case (I presume they go to interview stage, and not just rejecting us?!). If they want more recent stuff, well, hopefully this is enough, because it's all we've got as far as I can tell. I wish they'd just come out and say what they want in the RFE. Argh.

I think you will be fine :)

We sent everything we had first go round and everything we had accumulated since the packet as our second go round the day after we received the RFE in the mail. Haven't heard anything, so who knows. I guess if June rolls around and haven't heard anything (because that was when the RFE was due) we will make an infopass appointment and figure out what is going on. I know it has only been two weeks, but our case status never changed to "request for evidence" and it still says initial review. Again, I know that sometimes status never changes even after green card received ... guess I am antsy at this point. I dunno .. it's just been an "ugh" week!

You know what, my file was very meh too.
I sent a lot less than that, but we have never moved.
I thought my "key" proof was the copy of the renewal of our lease where our owner added a friendly written note with both of our first name.

I think it's all down to :
-The new apartment rental agreement

I'm pretty sure this is the key.
A joint lease will show you have moved together and this it.
Well in your case, it's the only thing that makes sense.

I'm 200% sure everything will be fine if you send what you have put on this list.

I agree :)

I'm wondering why these applications were selectively treated rather random when everyone filed at the same time....This raise a flag of discrimination as my own view......

It's always random in appearance. No one can say why they adjudicate someone's petition before someone elses. Could be the placement in the box, could be the adjudicator wants to do the easy ones first, could be they have a filing method at CSC and VSC that they have not divulged to the public and that dictates which files get worked first. It could be because the background checks on one came back before another. Who knows.

Thanks Yurika & Jim. Greencard was received (at the wrong address) on 4/5. Approval must have been sometime before 4/1 - just don't know exactly when. Thanks for the sympathy. I'm afraid its going to get uglier with USCIS before it gets better.

Have you talked with USCIS? You can notify them that the green card was lost and they can issue a new one. As far as identify fraud, USCIS knows what address they sent it to and can begin an investigation on their own. Do you have a reason as to why you feel it will get ugly? You can look up your case on the USCIS website and see when it was approved. Or when you talk to them.

How do they know you move? you filed AR13 change of address after submit or before submit? thank you.

You are required to inform USCIS if you move, and you are required to do it within 10 days of that move. Both the petitioner (green card holder) and the sponsor (most often their spouse) have to inform USCIS of their address.

We moved 2 months after filing for ROC so we filed change of address "after submit".

So we got an RFE!!! : ( I am away in conference but my husband said we got an RFE and it says they noticed we moved and they want updated evidence. I am wondering those who received an RFE -- what information they sent along...?

Thanks!

We sent everything that we had accumulated since the date we sent the original ROC packet, such as updated bank statements, the deed to our new home which we purchased in October, new pics from holidays, new bills with both our names, updated medical cards with the entire family listed, new/updated car insurance, everything that showed us listed jointly with our new address, cards and letters received since we moved to our new house with both of our names on them. It was a pretty big packet with lots of evidence :) Those are just ideas ... go with your gut and send everything you think you should plus more :)

Also, in reference to the moving and RFE thing. We moved into our new house in December after filing in August. We didnt get an RFE.

I also flubbed up and didnt do a change of address form for me (the USC). Like ever. We moved to fort Wayne in 2011 and I never submitted one for me but I did for my husband. When we moved in December I realized that I should have filed one all along, and did so, but I was almost certain it was going to cause us an rfe because at the time of filing USCIS had two separate addresses for us in their system.

And when I say two different addresses I mean that my husbands address was in Indiana and mine was in Kentucky. If that didnt throw up even enough of a red flag to get us an interview, I doubt it will be enough to cause someone an RFE. I could be wrong, but mine would have sounded more red-flagy than just simply changing your address after filing (which I also did) .

Best of luck!!

Got our email at 9pm. Stupid phone wont let me quote.

That's GOOD news that moving doesn't automatically generate a RFE! I'm so glad. It has GOT to be just a random thing. Our ROC packet was as big if not bigger than the K-1 fiance petition packet and the AOS packet, so there was plenty of proof for them :) We mailed the RFE evidence back yesterday, so we are hoping it goes quickly once they receive it, but who knows :)
