Sorry guys, I moved into our new house last weekend and proceeded to get really sick (bronchitis) and haven't been around much. And John's mom had a massive stroke Wednesday evening. Please keep her in your thoughts/prayers/whatever you do. It doesn't look too good.

keydymenro: As far as the NVC saying that they don't have your case, are you actually speaking to a person or trying through the automated system? If you are trying the automated system, they do not log K-1's into that. You have to actually speak with a person. And when you are speaking with a person at NVC, use the magic words "is my case in AP (administrative processing)?"

krili - I believe that you get to include tips and such as income, but I think that it had to have been reported to the IRS as income, therefore be included in the tips section of his W-2. Yes, he has until April 15th to file his 2009 income tax, but I'm sure that the consulate may ask for his 2009 W-2's, as it is required for all employers to have them mailed out by January 31st of each year (actually this year it was Feb 1st). I agree with asking this same question in the portal for Lithuania.

Congrats to all the NOA 2's and packets received and returned, interviews scheduled and etc.

John just called me - he got through to DOS after 30 minutes :blink: and his interview is scheduled for April 12th at 1:00 pm. BOY would we ever have been cutting it close for a May 1st wedding!! HA! He may still try to get an earlier one, as there is some system I remember reading about, if you are willing to be very patient and call multiple times a day for $12 a call. We will see if that is what he wants to do, but at least we are on the home stretch now!

Carla - I hope for a speedy turn around for Ron's packet 3 and you guys have an interview date in hand soon! :)

Have you got a date yet, Beth?

We're not going to hear back from the consulate regarding changing the date until next week because of Carnaval. I'm hoping to get 6 April, but from what Bruna & Mitch told me, they may make us wait for a full month to reschedule. Since we're going for a July POE / August wedding, late April is fine, too, but I'd rather have it early April to get the whole thing over with!


Nothing yet. It was too late when John tried last night, so I'm hoping that he wakes up in time to try again today :lol:

I'm glad that you aren't in a rush and that if they do make you wait, it will still all turn out ok. We've changed our "wedding date" and are now shooting for a civil ceremony shortly after he gets to Michigan, then having a wedding ceremony/celebration some time in late August/early September. I'm really glad about that right now, after having done the move into our new home solo this past weekend, I can't imagine throwing wedding plans on top of all that right now. ugh.

He could call the Department of State and they can tell him if he has an interview date or not. Takes about 15 minutes of waiting through prompts that you have to listen to other wise it gives some nasty message "that is not a valid response you must listen to all the options".

I think we checked over the paperwork about 3 different times just to make sure we had everything that the Montreal Consulate needed and that everything was signed properly. Now the wait for the interview date.

Did John get his interview date before the Olympics started or do you have to wait until after the Olympics end to find out?


Haven't heard anything back from them as of yet, so I think that if he hasn't gotten that "packet 4" by Friday of this week, I will assume that he won't get anything until they are back from their Olympics-cation.... or is that vaca-lympics? :innocent:

My fiance' received packet 3! It was in his mailbox when he got home today from visiting me. Yeah! We decided to include a copy of the DS-160 questions and answers since it wasn't clear if the online submission was enough as long as the confirmation page was included. Yeah! I am so glad he got packet 3. Waiting for the Montreal consulate to respond would be torture. Now we just send the forms they request back to Montreal and get put in line for an interview date.

John's Packet 3 letter arrived today!!! He had the packet downloaded and filled out previously, so literally all he had to do was print, date and sign it, and he had it faxed back to them within 10 minutes! w00t!!! The Vancouver consulate is closed for the Olympics (2 weeks), but we are in the hopes that he MIGHT get his interview date assigned before their closing time tomorrow. Fingers crossed!!

Received my NOA2 hard copy today, and called the NVC automated system, but nothing about the case has been entered yet. Hope they turn it around quickly! But I understand they've got their hands full with the Haiti quake victims, so I don't mind waiting. My whole life's problems pretty much don't exist by comparison...


The NVC does not enter the case into their automated system. You have to talk to someone in person, unfortunately.

Hello all,

My fiance filed for K1 visa in late October 2009. The acceptance step is typically completed within 2 business days of when the application is received. USCIS issues a receipt number for the application and sens a receipt notice to the applicant. He said he mailed the form package to California Service Center and the check was cashed. With mail time it may take several weeks to get the receipt or rejection notice. It's been more than 3 months we have not heard from the USCIS, no receipt, nothing. Is there any one of you have similar situation ? Is there any one of you have the case number without receiving the NOA/the receipt number ?


If you have never received a receipt confirmation from USCIS California Service Center, I would call them immediately and make sure that they have received it AND request that they send you a new NOA1 (Notice of Action - will say that they received it and their other processing verbage). You can also look at the back of the cashed check and get your USCIS case number (mine began with a WAC, however I have seen others that began with EAC). With that number, you can check your case status online.

Don't wait ... call them today :)

This is a great read, long but good info, from a VJ member that used to be an Adjudicator for NCS. He had some VERY helpful information. It might help to understand why some cases get touched over and over, and some get nothing.

Kalay - your case just might have needed some additional information from another source and be sitting waiting on that info to come in. I highly recommend you read the post I was referring to.

I didn't know that until you said something about pressing 3 at some point. I experimented to find out where you pressed 3. If you go 2-1-3, you get a prerecorded message and have to re-call. If you go 2-3, it tells you that it doesn't understand what you're trying to do. If you just go 3, you get the operator. :P

We didn't send W-2's with any packet, and only got an RFE with this last one, ROC. If you by chance get a RFE, just send them a copy of your tax transcripts, which is what they really prefer anyways. Don't sweat the small stuff :)

I have a quick question, we have filled on July 6th and have not got any RFE or interview letters. On the internet case checker page, it still shows initial review. When a RFE or interview letter send out, do they usually put a note or any indication on the initial review page on their website that they have requested RFE or interview ?


Like I just said above :) , our case status has not changed since August 14th, 2012. So no, they do not always put a note on website on your case status that they have done anything. There are people who have received their 10-year GC and still no change on the website. I would imagine that they get around to it eventually :blink:

Hmm, seems you sent almost everything they request and still got an RFE. Are they sending them out to almost everyone recently? I read on these forums it was to "slow down" the incoming case load and give them time to clear the current case load. Dunno if there's any validity to that.

Haha, we thought about our dog's adoption cert. but unfortunately it includes only my name (we didn't think of "immigration" much during the last 2 years)


Same for us, our dog's adoption cert is only in my name too. John found out he was a "doggie dad" when he got home that day :blush: :innocent:

RFE's must be random and/or for a reason. I don't see a reason for ours, but maybe the adjudicator did? Or they have a quota that we just don't know about? Our RFE, and RFE's in general, don't bother me ... as I truly see them as a "we are working on your case and just want to hear from you". As far as everyone getting them recently, there were at least 3 August filers that got them within a few days of each other. Might be a way of buying more time? :unsure:

Thanks for the info - quick question: When you sent out the ROC originally, what did you send in regards to showing joint financial obligation/comingling of finances? We sent EVERY (joint) bank statement statement for the 2 years since AOS, joint ownership of one of our cars, W2's/Transcripts for 09-12 (all married, filing jointly), doc showing me as beneficiary on her insurance, deed to our home showing both of us as owners, joint credit cards, and shared responsibility of utilities/bills at same address. Basically we've got everything except a kid - so if they request more proof, I dunno what we can send besides affidavit's and newer statements and bill and even more pics (we sent a ton)

We sent everything in our possession as well. We were renters at the time, so we sent our lease(s), copy of tax returns, bank statements, proof of insurance showing one of us as subscriber the other as dependants, joint cards, utility bills, pictures, copies of letters and cards we received ... all from time of marriage to the date we filed. So there was nothing missing. Our RFE request was so short, it literally said "additional proof of good faith marriage and proof of residence showing we reside at the same address". So, our RFE packet held the same as before with the addition of the deed to our new home and proof that we live THERE, everything else just updated. And us too ... everything except a child. We could send them pictures of our dog I guess, but he didn't come with a birth certificate LOL! Best of luck to you too!

So, there are a couple of August 2012 ROC filers that moved AFTER filing their ROC that did not get RFE's .. so my theory is blown out of the water, and that is GOOD! It seems just random to me now. You never know. I just had a gut feeling though, and if you go with your gut, get your post filing evidence ready to send back. We had ours back out in the mail to USCIS in less than 24 hours after receiving it, and that includes working a 10-hour day and putting the entire packet together along with a cover letter (and MAKE A COPY!).

To clarify myself now that I have the paper in front of me, ours said:

Evidence of good faith marriage:

Then has 3 subheaders of:

  • Birth Certificate (of any children)
  • Financial Records (evidence of joint ownership of assets and joint responsibility for liabilities etc)
  • Residence (evidence of communal residence)

And then, of course, examples under all of those.


Ours just had the 2, evidence of communal residence, and birth certificate of any children born of our union (none and won't be any ... I've 3 girls and they are 22, 18, and 12. Despite John's pleas for twin boys, he just won't agree to carry the pregnancy, so I had to decline :rofl: ). I'm sending everything including finances with our communal residence address.

that is why i added ( what can i add or what has changed since filing ) as we all know even days after filling something almost comes up that could be added. also when we sent our rfe into uscis i also sent another page or two to make our case stronger that not on rfe and was accepted and just over month later we got both ap and ead at 59 day mark however imo i would not try add more then that

hello mug as to what to have ready for rfe's no one can say as rfe's are sent asking for countless of thing or just one someone filing with uscis shoud think about making 2 copies of everything sent to uscis as backup in my case each time i read the forms i sent i think what can i add or what has changed since filing and i place in a just in case folder


That would be true in the case of filling out a form incorrectly or omitting a form all together. Most of what I have seen for RFE's, for ROC after many months have past since the filing date, have been requests for more information regarding a bonafide marriage. The list(s) from USCIS have include such items as financial documentation of having a life together (comingled finances) and birth certificates of children. Therefore, if you are going to be proactive and prepare items IN CASE you get an RFE, the things you can put together are items that have accumulated in your financial life since the time you filed such as tax returns, bank statements, additional bills in joint names, insurance cards, etc and so on. If a birth has occured since you filed for ROC, include that child's birth certificate in the "just in case" file. Pictures as well, but they rarely influence an adjudicator at this point based on the information I have seen throughout the forums.

In addition, I would take all of the above with me to an interview including a copy of the original packet you sent in, as they will ask for it :)

That's what I've done each time we have filed for anything past the original fiance visa. It was a "just in case". This time, for ROC, I've got our 2012 tax return (no transcript yet as we just filed), more bank statements, a copy of our covenant deed when we purchased a house in October (we filed in August), pics of family get-togethers on holidays since filing, and copies of our newest insurance cards (renewed in January). I would love to see others lists as well :)

Has anyone submitted a check (other than the actual payment) or a copy of a check with both names on it as evidence?


We attached a voided check when we did AOS and ROC. I'm not sure it makes much of a difference, because if the account is in both names and a statement or letter from the bank proves that, the check is just fluff. We did it anyways :blush:

We filed our paper last October 19,2012. And Im done with my biometrics. I know the waiting starts from here.
What else do I need to do? How many months will it take? My service center is Vermont Service Center.
What is your experienced about ROC?Is there any October 2012 filer here? Is there any update in your case
Please let me know guys.So that I won't feel bad that Im the only person who has the same situation.

I know that the $680 isn't for a lawyer, BUT what I said was I would rather have that $680 to obtain a lawyer IF needed. Thanks for the advice!
