Don't worry about the G-1145 at this point. It is a voluntary form and all it does is tell USCIS to send you an email/text when they receive your packet; that's it.

 

Like Tandag1025 says, once you get your hard copy NOA1, you have to go to their website https://egov.uscis.g...d/CaseStatus.do (site currently down) and create an account with your NOA1 receipt number. Once you create an account, you can select to receive emails/texts every time there is an update to your case. People normally receive the hard copy NOA1 in 5-10 business days.

I did send them the employment letter, W2, and Transcript of 2011/2012/2013, Should I also send them the 1040?

Another thing, I did send them all 9 pages of I-864, and I don't understand if I have to fix everything or just the points with [x] and written words, Part 6 is what is confusing me at the moment as I filled up the Total Gross income, and I submitted W2 and pay stub and employment letter...

 

 

 

 

 

Good advice from other members. In addition, you are saying that you submitted tax transcripts for previous 3 years plus W2's? Not sure if that is also part of your checklist but if you are sending transcripts, then you do not normally need to send W2's.

If you were at TSC, then your status will probably update one more time saying your case file was sent to NVC. Give it two weeks after that and start calling NVC to see when they receive your file.

I see, thank you both for your responses.  So heres the plan. 

 

I am going to go online, pay both invoices, cancel lawyer, send in AOS and IV packages and wait for case complete.

 

What forms do I need to fill out?  Choice of Agent form?  Is there something else since I will be firing my lawyer?

 

Sounds like a good plan. Call NVC right away and tell them you want to remove your lawyer and appoint yourself or your spouse as the agent. I'm not sure exactly what you need to do but the NVC reps should be able to tell you if you need to send an email or other instructions to make this change.

You can definitely pay the fees yourself online, as long as you use a US bank account. You only need your case# and your IIN#. You DO NOT need to translate any of the civil documents if they are in either English or Spanish languages.

 

It already sounds like your lawyer is giving you bad information and slowing you down. I keep hearing of people complaining about their lawyers not moving at the pace desired. Sometimes it is understandable because a lawyer may be handling several cases at once, they also wait for written notifications from NVC instead of calling to find out; then other times it seems some lawyers just sit on the cases for no reason.  If your IR-1 case is pretty straight forward, then go ahead and do it yourself.

He is. My wife also had to take him to court for that, which happened right before I met her.

 

If I were you, I'd have that conversation ASAP... the process in the judicial system is long (if you go that route). We started it in September of last year and are just now having the hearing on 3/24. I'm hoping we'll have a decision for the consent before we have the interview for the visa.

 

Let me know if you need any info on that process. One of my best friend's dad is our lawyer, and he was a family judge for 20 years so he has a lot of experience in these types of cases.

 

Yeah, a common friend of ours who is a lawyer is also helping her with that. This friend got the court to order a wage garnishment some years ago for unpaid support. So my wife is willing to withdraw the order as a way to get the ex to sign the consent. Just hoping it doesn't get any further than that. My best wishes for a fast and favorable decision for you guys!

Hi VJers!

 

I am currently at the NVC stage of my petitions for both my wife and stepson. I am waiting to have my IV bill invoiced so I can pay and submit the DS-260 along with the IV packages.

 

However, my stepson's biological father does not want to sign consent for my stepson to leave the country, so we have asked the courts to make a decision for the consent. Our hearing is on March 24th.

 

I have searched the forums, and I can't seem to find a clear answer as to whether or not the NVC will require this consent as part of the IV package. I understand that it may be required at least by the consulate at the interview.

 

Does any one have any experience or insight for this scenario?

 

 

 

Ugh! I am also fearing the day my wife has to ask her ex-husband for the letter of consent, which will come pretty soon. Nobby, our cases are more similar than I thought.

 

Is the biological father currently paying child support?

Yes, it's the "new normal" to wait several days for your DS-261 and AOS invoice to appear after receiving your case# and IIN. Just keep checking once a day to see when they appear in the CEAC page.

 

The police/court/prison certificates in Peru are valid for 90 days, plus the US embassy in Lima still takes them as long as they are not older than a year and the person has not moved.

It sounds like your fiance is the victim rather than the offender in this case. I think he should be ok, specially if nothing negative will be on his records. If a question ever comes up during the visa process that will make him mention this case, either when you are completing forms or at the interview, then having supporting documentation is always a good idea. From what the judge and lawyer told your fiance, that should be no problem. Good luck!

Guys there is no need to go in and re-submit your DS-261 forms. It never says accepted, it will always just say completed. By re-submitting you might be delaying your IV fee. The only way you will know it is accepted is if you call to ask or when your IV fee is invoiced.

 

I also agree with CanGirl; do not resubmit the DS-261. There was a member a few months back that did the same thing and her IV fee was considerably delayed. Although I think she did make changes to her DS-261 before resubmitting. Not saying this will happen to those who have done it now but just wanted to warn everyone at the same stage.  :)

I am in the process of finalizing AOS packet. When you said include all schedules, does that include 1099s (for stock dividends & transactions) & 1099 INT (for bank interest)? I just don't want to overwhelm NVC with too much info if it is not required. Thanks in advance for the help.

 

Anyone else, who has this info, please feel free to jump in. Would really appreciate. :)

 

If you are submitting the actual 1040 form instead of a transcript, then you need to include all worksheets and schedules that you used to calculate the numbers in your tax return form. Basically, the same docs you submitted to the IRS.

I have been doing my research but I just want to get some opinions on the reality of my situation.  My NoA2 is May 14th.  Of course, I am still waiting for NVC to receive my case.  I called for the first time last night but they said it could be at least 5 weeks until they get anything (from what I have seen, it has been an average of about 3 weeks from looking at timelines, so I will call again next week.)  Given my NoA2, is there any chance I might be able to get an interview in late August or in early September?  The latest I can stay in Japan on this visa is October 29th, and I really want to be able to go to my wife?s interview with her at the Tokyo embassy and both of us return to the US together before then.  Is this a realistic scenario? 

 

I think it's possible if you have all your "docs" in a row (get it? :P ), no checklists and your case moves smoothly through this process. You are roughly looking at NVC receiving your case file end of this week or next week. Then give it 4 weeks to get a case#, plus 1 or 2 days for your 261 and AOS invoice to be available afterwards. This puts you on the last week of June. Your IV invoice should be available about a week after your DS-261 was completed, so you are on the second week of July. From there, another 2 weeks to 20 days for review and case complete in the last days of July. This would put you in line for September interviews scheduling, or July if you are really lucky. Again, this is an ideal case scenario.

Hi I have a quick and urgent question...

 

At the end of the DS-260 last question on sign and submit it says to fill in passport number, who's passport number are they asking for?? Beneficiary or Petitioner? I am the petitioner filling in the DS-260. 

 

 

And also, on the sign and submit page there a linked form for male 18-26 for selective service, my husband is 24, does he fill that and mail it when he comes here or from bring it with him when he comes here?????

 

It says...

This form should be printed on the reverse side in the vernacular of the country from which

the alien is leaving. Place the original in the alien's INS file. Give a copy to the alien.

Beneficiary's passport; as he is the one submitting the application, even though you're helping him complete it.

 

If he is 24, he has to register with the Selective Service. I think he has to do it once he is in the US, but I am not sure.

 

 

Do we have to send a copy of the DS-260 along the IV Package?

You already completed the DS-261, I think you meant the DS-260 to be available soon. Once you pay the IV fee, you can send the IV packet from your home country.

Just paid our AOS fee today.. Yahoo! I paid it using my husband's US banking account. My question is I printed out and saved the bar coded coversheet on my computer. Can I just send it to him thru email so he can print it our for his AOS packet.. Lol I know stupid question but I still wanna ask though.. And also when will our IV fee be available? I want to pay it awhile ago together with the AOS but its not available still :( TIA and Goodluck to all of us :)

 

You sure can send it to him, or he can login to CEAC and print it out himself. As for the IV fee, it depends on when you completed your DS-261. You can study the spreadsheet to see current wait times.

The wait had been long and tormenting but we like many have passed the test..
Luckily dint have any checklists but they did confirm june interviews are filled.

I called at 1140 EST thinking there's no way I'll get through before they drop all calls, but at 1208 (gosh I forget who she was now :huh: ), the rep answered!! :D  And they 'FOUND' my police certificate upon review by the supervisor, probably that 'piece of mail still listed in the mailroom' - which I assume fell off the package when they opened it to scan the barcoded sheet...

 

 

I asked her if they could possibly still be doing June interviews and she wasn't sure, but that's better than a definite 'NO' :lol:

Whats the two week count?  my IV documetns were received according to them on May 6th --  spoke to them today and they say still not reviewed--  that is the LAST thing for me to accomplish --  they tell me "up to" 30 days- where are you quoting two weeks from- I know it probably will not be 30 days abd two weeks sounds great to me...

It's not an exact science, unfortunately. We are all going by the timelines of other members ahead of us. Two weeks seems to be the current wait time, give or take a day or two. If your docs were received on May 6th, then you should hear something by this week.

So, I am the petioner, when I submitted I130 I was in student status, and all I had was 1098T , so since I didn't have any income last year, I didn't file tax...although I do have my tax receipts of prior years. Currently, I have a job and it's been 2 months since I've been employed. I am planning on having my dad as a joint petioner, and show his tax papers for the last 3 years and mine from last 2 years, copy of 1098T from school which shows that I didn't work but went to school and a letter from my current workplace stating my annual salary and proof of employment.

 

I'm filling out I864 and I'm stuck in many parts even though I'm using the instructions sheet, it seems to be very confusing to me. so please help me...I'd appreciate it a lot.

 

Part 1. Basis for filing affidavit of support

- Do I leave it blank? or am I suppose to write a name? if yes, who's petitioner's or beneficiary

 

Part 2. Mailing Address

- I believe it's beneficiary's mailing address, which I tried to type dashes as it appears in the actual address, but it the adobe does not allow me to type dashes or commas, and state, zip code, province etc. does not apply, and it doesn't let me type N/A either.

 

please suggest with these things for now...i'll have more questions as I'm filling out this form

Including transcripts for prior years and employment letter is very good. You do not need to submit your 1098T, just type $0 in the I-864 for that tax year and include a letter explaining you didn't file because you were a student and did not have any income.

 

Part 1 is about the sponsor. So it should include the sponsor's name and mark the applicable square (peititioner, joint sponsor, etc.)

 

You are correct that Part 2 is about the beneficiary. If you cannot type dashes, then just leave a space instead, or print the I-864 when you are done and hand write them. Same if you want to type N/A.

After countless tries, I finally got through to NVC, 50 mins on hold. Unfortunately no case complete yet. Got the same story, please wait 30 business days.

So, since I had waited so damn long to just be disappointed again, I ask the guy (didn't catch his name) why on the updated ceac website, on my summary page, does it show N/A under the supporting docs column if they already have my documents.

He had no clue what I was talking about. I had to literally explain to him how I access the summary page, and what the summary page now looked like. The only thing he has to say to me is why am I checking my summary page!  To which I replied, Im checking it because it was updated to provide more information, which apperently we still can't access! :bonk:

 

Sounds a lot like a company I used to work for. IT and upper management develop a new website or web tool, then they forget to inform/train the operations staff. Very embarrassing to find out about it from the customers.  :wacko:

I filed Married filing separately so I don't believe I have to worry about that piece? Also, don't have a joint sponsor as my income should be sufficient to 1 person. The only thing at this point that makes me nervous is how they are going to verify my total income if IRS hasn't processed my return. But then BOS_LHR mentioned earlier that many people's returns are not processed by IRS by the time NVC requires them and many people file for extention. So mine is not a unique case. Yet it worries me :P :D

 

Hello VNBC,

You should be ok. I submitted my AOS packet barely a week after I sent my 2013 tax return to the IRS via snail mail, and I had no issues. That's the reason why NVC asks for full tax return packet (W2's and schedules) if you do not submit transcripts.

Hmmm... Fascinating! And I hadn't realized ELIS is so new. On a side note, I do love the name, ELIS! It's an acronym, I know, but I can't help but think it was created on purpose to thoughtfully remind of Ellis Island :)

 

I thought the same thing when I first heard of ELIS and what it was. If there is one thing all governments are good at, is creating acronyms. They are even better at creating acronyms with puns! If we look at the logo for ELIS, it does have the Statue of Liberty next to it, so I think you are right.

 

Coincidentally, I went to NYC this weekend and took the ferry to both Liberty and Ellis islands. Very humbling to see what those immigrants went thru to live in the USA. I do not think we are anywhere near their struggles, but in a way our spouses are experiencing something of the like. A rite of passage, if you will.

I called NVC for the first time tonight. I only had to wait 20 minutes or so. Our case was received on May 12, 11 days after our NOA2. I will call back in early June for a case number.

I hope no one is facing major hiccups. Congratulations to the recent case completes and interview dates!

 

Your I-130 was adjudicated in 10 days? Cool! :thumbs:

Just got thru to NVC and apparently the place it "must" be sent for iv packet is to attn:dr no other address and she had no explanation as to the three options and if either one was fine no explanation just an attitude gotta love this process

 

I was one who called and asked about that, the guy said it doesn't matter.  And it seemed not to.  The package was received and reviewed in two weeks.

I'm feeling like that will be my plan for tomorrow a.m.

Thank goodness Wed is my one day off during this week!

 

Still, that caught me totally off-guard!  Out of the possible things I wondered about, that could possibly cause a checklist, this was something that never crossed my mind :rolleyes:

Ok, so now I'm officially sad... :cry:

 

NVC just told me that the only thing they're missing is... the Police Certificate... :girlwerewolf2xn:

 

It is the last page of my IV package!, has my NVC case number printed on it, the gal was very friendly and we discussed what I had sent/ what was on the certificate as I have a copy right here to refer to... she said that sounded right...

 

'So where do we go from here?' I asked.  She said she can have the file pulled and looked at again, but if they can't find it I'll have to provide another.

 

I asked about sending another copy and she said it's up to me.

 

Here in Canada, it's pretty simple, the RCMP/ police stations have the forms to fill out, listing that we need this for Immigration, the search is local and Canada-wide.

 

I'm now crushed, as I was hoping for CC tonight or at least this week.  So now I'm into believing there will be no interview until July for sure :crying:  :crying:  :crying:  

 

Should I send another copy??  If I send it and in the meantime they approve my case, will sending this cause a delay when they then try to match it up with my file? :clock:

 

Oh no! :( I always give NVC employees the benefit of the doubt, but they often seem to make extra efforts to clear said doubts. I would send another copy with the barcode sheet and a brief written explanation.

Hello Everyone,

 

So I came across another thing I want to be certain I do correctly. I noticed on my bar coded cover letter for IV packet it shows as the mailing address is

National Visa Center

Attn. CMR
31 Rochester Avenue Suite 100
Portsmouth, NH 03801-2914
 
After starting Ds260 it advises to  mail packet to
 National Visa Center
Attn: CMR/DR
31 Rochester Ave. Suite 100
Portsmouth, NH 03801-2914

 
Shall I assume that the bar-code sheet is a generic sheet sent out to everyone just with the specific case number and that I should mail it to the second address as directed on ds260? 

 

 

I remember this little detail was debated either on last month's thread or the one before. If this wasn't confusing enough, DOS website also tells you to send docs to "ATTN: DR". :wacko:  :wacko:  :wacko: 

 

If I remember correctly, someone asked which one is correct and NVC rep said it did not make any difference. I mailed my packet to the address shown in my bar-coded cover sheet without any issues. Other members might chime in as well.

I have a question that is probably silly but I would rather be safe than sorry...working on final steps of DS230 to input into DS260 packet. I know this is about the beneficiary so when it wants the divorce papers in the packet, is this JUST the beneficiary divorce papers or do they want the petitioners as well? (I already submitted them with the I-130 but want to make sure before mailing the packet  :( ). Congrats to those getting interviews!! Can't wait to get to that point. 

 

You are correct, IV packet is all about the beneficiary. Petitioner does not need to send divorce certificate again.

First, when everyone used to comment about how often they check the payment portal I was thinking why would anyone be checking it so many times a day! But now that I have a case number, I get it. Even though I know nothing is going to change in the span of 5 minutes, but I keep checking. Lol

I am looking over my AOS packet for the 100 time today and keep obsessing over not making a single mistake. I have a question about that. For my the sponsor part 6, question 5, it asks for current individual annual income, so do I just multiple how much she makes in 40 hours and multiple that total by 52 weeks? So do I just put that total because that's before taxes or anything is deducted.

Yes, it is how much your sponsor makes in a year at her current hourly wage, so hourly wage multiplied by 40 (full time worker), then multiplied by 52 sounds correct. You do not need to deduct for taxes.
