#######. I want to know why my interview date is going to take nearly twice as long as people who just went through this a month ago. As soon as my stuff gets there, we're going to call/email them and see if we can request an earlier date. It's not like Amsterdam is a super busy consulate where IR visas are concerned.

My spouse interview is 5/28

On, the interview guideline sheet, part of it say's

 

"If the relative who filed the petition has become a U.S. citizen, bring a notarized copy of the naturalization certificate or official notification from the U.S. Department of Homeland Security (DHS) indicating that your relative is now a U.S. citizen."

 

Anyone know what does that mean?

Is that something for me?

 

I was a green card holder, when we first met, (2010) then i went and got my citzenship in 2011 & we got married in 2012.

I was a citzen before i filed my petition.

I believe that only applies when someone started the petition as a LPR and then became a USC while the case was still in process. I am sure you already provided proof of citizenship when you submitted your I-130.

Hi everyone!

 

Ok, so this is my first post in here, late bloomer, I guess!

 

Anyway, just wondering how long the NVC stage seems to be taking for others...I am a USC and my husband is French.  NVC received our case in March and it was finally entered into their system on April 11, 2014.  Soon after they entered it into their system, they started sending the payments requests, which we immediately paid.  We have filled in all of the forms for the NVC stage and sent in our AOS docs and civil docs - as of April 30th, they have everything.  How long should we guess that this stage will take?  When I call the NVC, they tell me 30 business days - is anyone finding this to be accurate?

 

Also, is there any way to get this thing expedited?  And what is considered a good enough reason for it to be expedited?  I have seen people on here that were able to get the entire process (USCIS and NVC) expedited and had their cases completely finished in about 5 months.  We are at about 10 1/2 months at the moment (which I know is short compared to what some people are going through - seriously, I don't understand how it can take so long for this - although I always find it "funny" how our payments are immediately cashed and then we have to wait months for anything to actually get done).

Ok so I got the hard copy of the RFE today and they are asking for an English translation of my marriage certificate which, dumb on my part didn't send in, but I did send an original copy of our marriage certificate in Spanish and I was wondering if I have to send in another original or if a copy of the original and a translation and a page of the translator certifying that it is an accurate translation. It will be pretty hard for me to send in another original so will a copy be fine?

A copy of the marriage certificate is fine. USCIS only requests a legible photocopy of documents (unless an original is specifically required per I-130 instructions). Include the translation page with the translator's cert. statement.

 

You should obtain another original copy of your marriage certificate anyway; you will need one later for the NVC phase.

Okay, so we got the letter.

They want a photocopy of the original marriage certificate together with the translation if not in English.

We sent them a photocopy of an international wedding certificate which is translated in several languages at the back AND we highlighted the English part.

So they are asking for something they already have. Urgh!

We will send it... Again. This time I will include another translation, written by me, but I will feel very dumb translating it to English ... from English.









 

Sorry to hear that was your RFE. I guess they were looking at your docs like every other case and expecting a separate translation page.

 

Don't forget to include the translator's certification statement on your second translation and it is best if this certification is done by someone other than yourself or your spouse. Gotta be redundant since they already missed your first one! headbonk.gif

You know Iqbal, there is a forum somewhere here in VJ (can't find it right now) where someone interviewed a gentleman that used to work as an adjudicator. This person explained that getting a RFE means your file was reviewed and the adjudicator keeps your file jacket on his/her desk until you send the info they requested. If the info satisfies what they are looking for, then your case is approved. Also, several other past VJ members that received RFEs claimed they received their approvals 1-2 weeks after they sent a response to their RFE. So like BOS said, it's still good news for you.

 

Expect your RFE notice in the mail and follow its instructions carefully. If something is not clear, I am positive the more experienced folks on this site will be ready to guide you.

Hi, everyone!
We are approved this morning! Our PD 6/24/2013, on 11/12/2013 transferred to NSC. However, we did request for an expedite review two weeks ago and on 1/13/2014, we were mailed a letter saying that we are under expedited review. As a matter of fact, my mother in law just got the mail yesterday and today we received an email that we are approved!

Sorry, guys, I know this won't bring anything to your hope.

But we do have our reason to expedite it. We are expecting our second child and we are in China, which is against their one child policy and Chinese government won't actually acknowledge our choice of making our baby a US citizen if the baby is born in China. We are facing fines for having another child and have to go thru renouncing citizenship for the baby according to the law, even tho our baby will hold an American passport no matter what. It's pretty ridiculous. And we will not be able to take the baby out of China unless we get a police permit. Our first one was born in Japan while her mother was residing there, so according to the law, she can be acknowledged having an US citizenship. But not for our 2nd if he/she is born in China.
Sorry it's a lot. But you see, we are in a messed up situation. I am feeling every little bit of pain with everybody else here, having waited for this approval over 7 months. Wish all the best for all of you!

I-130 Approved! I guess today was finally my turn.

 

It feels bittersweet to post this after reading from fellow filers still waiting for news sad.png . If anything, I sincerely hope this gives more comfort that USCIS is moving along, at whatever slow pace, but moving. Now to wait for my case to ship out to NVC.

Guys!

 

I've been pulling this site up and checking it occasionally but had not created an account yet (sorry).. until today!

 

I want to take this opportunity to give a little bit of hope to my fellow Texans! Or at least to my fellow TSC filers. I had been reading the posts about the NSC/TSC and beginning to despair, until today at 8:15 pm (CST) I checked my email and lo and behold, WE'VE BEEN APPROVED!!!

 

I am in the same time zone, and so this makes me think that our homeboys/girls are putting in the long hours to get our cases through. My utmost thanks goes out to all of them for their hard work during this heavy processing period.

 

Our PD is June 11th, 2013

We were transferred to the TSC from the NBC on Dec. 19th, 2013

Today (Jan. 13th) we received emailed notification of our approval!

 

My husband is a Mexican citizen and I am a U.S. Citizen. No expedite. No immigration lawyer following our case. No U.S. representative following up.

 

There is a light at the end of the tunnel! You'll be there soon. We are seeing movement for June filers with no expedites/extra help for the TSC!

 

We will keep praying for all of you with the same fervency and hope that you all receive good news soon. Hang in there, and see you on the other side soon. Now on to the next step!!!!!!

 

I recommend that all June fillers have all of our NVC documents together now, so whenever the ball is in our court we can immediately kick it out into the NVC's, so we don't even wait one single day that we don't have to, or that's within our power to avoid. Be ready for when they ask for the affidavit of support, etc.

Our case was filed from US through a lawyer on June 14, 2013 and on December 26, our case was transferred to California Service Center.

 

Today we received the below update: 

 

Case Status: Post Decision Activity

we mailed you a notice that we have approved this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN. 

 

So can someone kindly update me about what's the next process?

I got my second transfer notice today - dated December 30.

 

I have a theory.  Every time they pick up one of our files, they have to scan the file number in, and key in SOME sort of notice to be generated.  I think my first transfer notice (December 27) was when my file was picked up at Overland Park, and put into a box to be shipped somewhere.

 

I think my SECOND transfer notice (December 30) was when my file was unloaded at whatever service center I got transferred to.  They scanned the file number in, and keyed in a notice.

 

For those of you who got third and fourth transfers, I'm betting that your file was picked up from one place (say, the main receiving desk) and moved to another section of the USCIS service center (which might be in a totally different building within the complex).  This sending and receiving triggered notices 3 and 4.

 

It certainly doesn't mean they've LOOKED at the file - it's just that they have to track the files from building to building.

Your theory is very much on the money Sukie. They have to scan the barcode on each file every time it moves from one place to another. They have to scan the barcode even if the file moves from one officer's desk to another in the same office. That is an organization's best practice to never lose a file. It looks like they are using some supply-chain management software (like UPS, Fedex) that also automatically sends alerts when a file is scanned, hence the "last updated" alerts we get via email/text and on the USCIS website.

 

I see Customs officers at the airports always carrying firearms and then I imagine the people at the service centers carrying barcode readers in their holsters laughing.gif

I have been reading from IRS , that if SSN/ITIN # is available, you can do what I said.

 

However, the Foreign Earned Income Exclusion will not apply if the foreign income is earned by the spouse who is not a USC or a LPR (yet) and has never lived in the US.

There is foreign income exclusion upto 95000. So you include your spouse's income and then exclude it which mean you get a bigger refund.
 

 

Hello science, I don't think that is how the Foreign Earned Income Exclusion works. My understanding is you have to be a USC or LPR living abroad due to business while still keeping domicile in the US; but I could be wrong. Nonetheless, the foreign income still needs to be reported to the IRS.

 

The more the reason to consult a real tax attorney for each specific situation. Cheers!

I see this topic often in VJ and it can really get confusing. What I gathered from the experience of a close friend that went thru the process and from multiple posts in these forums is the following: During the NVC process, the manner in which you report your status in your income tax returns makes no difference. You will present your tax forms as part of your Affidavit of Support and that is all NVC will look at; the dollar figures to make sure it substantiates your ability to support your spouse. Case in point, the post above from Memphis, as well as posts from many other VJ members saying NVC did not give them any issues.

 

However, your marital status WILL matter on subsequent tax returns once your spouse is in the US and you are working on the Adjustment of Status. This time, you may present your tax returns, not as proof of income, but as proof of commingling finances with your spouse. My advice is leave your last year's tax return as is and if you wish, file 2013 as married filing separately.

 

Also, everyone careful with some of the tips about redoing previous taxes in order to get a bigger refund. If you decide to amend previous tax declarations to include your spouse in a joint return, then legally you need to also report any foreign income your spouse received during that particular year (from my close friend's case). This last part is a complicated topic that should be discussed with a real tax attorney, and not just any tax preparer.

Correct. I only sent one copy of G325a for myself and one for my wife. One passport-style photo for myself, and one for my wife, no photo for my stepdaughter. Just to remark, you are aware that you have to submit separate I-130 packets for your wife and daughter, right?

You have to refer back to the I-130 instructions and read it carefully. For your wife's case, you have to submit one G325a for your wife and one G325a for yourself. Your stepdaughter does not need a G325a for her case.
