Can I just say how much I absolutely LOVE Todd at the NVC? I was so happy to hear his voice on the line. He recognized my name and was all chatty, and took his time in looking up my case information.

 

Oh, so YOU were the reason why I waited on hold for 30 minutes this morning! LOL! Just kidding!!

 

He also said they were catching up at the NVC and processing faster due to being on mandatory overtime working sat and sun for the past 2 weeks.

 

I can just imagine Todd's supervisor:  "Hey Todd, what's happening? I'm gonna need you to go ahead and come to work on Saturday and Sunday. So if you could be here around 9 that would be great, mmmk?"

I would like to ask anyone who hired a lawyer to process your papers. my husband paid 4,000 US$ to our attorney and I want to know if it is a normal fee. I feel sorry for my husband coz he worked hard for that money. They don't do their job well, I was the one who always make a way to get information from USCIS and NVC. And I was the one who first to know that we got approved and also the NVC (thanks to VJ members) then informed our lawyer. I work more than them What should we do?

 

I initially thought of the lawyer that helped my brother with a very complicated case. This person was awesome; always on the ball and proactive with all the steps. However, I got discouraged when he told me his services were $800 for the USCIS stage and then $1500 for the NVC stage, per person (I have my wife and daughter) and not including the fees I had to pay to Uncle Sam. He did offer to lower his NVC charge if I was willing to fill out all the paperwork and use him only as a consultant. I figured my case was pretty straightforward, so I ventured to do the entire process on my own without lawyer or consultant. Then what do you know, during my web research I came to find out about this wonderful site.

 

Not sure you can do much at this point about your lawyer. Just feel fortunate that you were able to help your lawyer help you. Every so often we read some bad stories about lawyers not fully knowing the shortcuts and them being the cause of the delays.

 

If later you need to adjust your permanent status or decide to go the citizenship route, then now you know where else to come, other than to a lawyer.

That's the rule of the game. We are trying to beat the system as fast as we can!

 

 

 

I did the I-864 but used 1040 and not 1040EZ so I realize I should have put the total income instead of adjusted gross income. Yup, I am going to send a corrected form again before I get a checklist.

I just think he put the wrong figure because I remembered him mentioning the AGI he got from 1040. Though, I will talk to my husband and ask him if the total income and the adjusted gross income are the same. (Hoping!) But anyway, thank you so much for your smart advise! :)

Just in case, I was able to find the post from Nobby7 back in February where he explained what the NVC rep. told him. Good Luck!

 

[...] I just called the NVC to see if my original AOS package was scanned, still has not been. I asked him also about how I realized I made a mistake by using "adjusted gross income" instead of "total income", and I got the "answer I wanted to hear".

 

This guy was pretty detailed... he told me that I could either wait for a checklist or go ahead and submit the I-864 alone. He told me that they would first review my initial AOS package, and if I indeed entered the wrong info, they would send me an email with a checklist. THEN, they would review my next submission and find that I had already corrected it, and they then would send me an updated email confirming my package (if there is no additional checklist needed). He also reminded me to send the bar-coded cover sheet if I were to send the I-864 again.

 

His response gave me peace of mind, so I've decided to go ahead and resend my I-864, understanding that there could be anything else that could be checklisted. I figure that if for any reason I have something else that will be checklisted, then it would've happened whether I sent another I-864 or not smile.png

 

I wanted to share because I realize I'm not the only who has made this mistake, or maybe I can help others avoid stressing themselves out like I'm doing to myself!! content.gif

Sorry to hear that. Did you check your tax forms to see if maybe your total income and adjusted gross income are the same amount? In my case, I filed 1040A because I needed to declare some credits but I had no deductions, so for me both lines were the same.

 

If they are different and you did put the wrong amount then call NVC and see if they can give you some guidelines. I know of one member that had the same error and realized it after he sent his AOS packet. He called NVC and then sent an updated 864 right away without waiting for a checklist. His delay was minimal.

We got a checklist for an unmatched amount coz we used the amount from W2. So per IRS, Adjusted Gross Income is defined as gross income minus adjustments to income. Refer to the federal income tax return:

Line 4 - if you filed a Form 1040EZ
Line 21 - if you filed a Form 1040A
Line 37 - if you filed a Form 1040.

Careful, AOS requires the "adjusted gross income" only if you filed IRS Form 1040EZ. If tax return was filed with either form 1040 or 1040A, then the "total income" amount should be reported for AOS purposes.

Finally able to pay IV for wifey and daughter. Best use ever of my tax refund money!

 

Unfortunately, I wasn't expecting the IV to be invoiced that quickly, so now I have to wait for IV docs to come to me by mid next week. Darn!

NIce!! You are the second person with a similar NVC timeline to get the IV invoice. I'm not seeing anything yet on my case but something tells me I won't be too productive at work today (checking the portal every 10min). NVC better not leave me behind!

Just paid IV fee! That was quick- yellow triangle this morning, email 30 minutes ago and IV fee paid minutes right after!

 

Holy cow, that IS fast! We have similar NVC timelines, so I hope it's not an exception and I get mine soon!
