IR-1 / CR-1 Spouse Visa Case Filing and Progress Reports	May 2013 I-130 Filers	That's exactly what I am saying I am in usa i130 didn't approve yet but immigration officer said they may or may not set the interview with me first which is very unusual!   It happens from time to time for USCIS to schedule an interview prior to the approval of I-130. I've seen it couple of times here in VJ, but I have no idea about the way it went or what happened later about it. I would like to ask something, we have responded to our checklist re our civil docs to NVC, already received and logged in to their system. I asked our lawyer for a copy of my divorce decree translation (translated in the US). When I read it i saw a mistake, my ex husband's name is Suchai and not Surachai, would I get another checklist for that. I hope not. I think it's a minor thing, the translator just added "ra" to the name. I hope you both get an approval soon! Way overdue!   They say it is an "average" and not really the correct processing time, hence they continue to play the system (approving some after 2-3 months to average the 10 months to 5 months average). We had a  response from SCOPSSCATA that USCIS confirmed they had our cause with an officer today to be adjucated. IR-1 / CR-1 Spouse Visa Case Filing and Progress Reports	May 2013 I-130 Filers	This is what I got today from NBSC as a response to a service request:   "Thank you for your recent inquiry about your I-129F petition.   USCIS records show that this case was received by the National Benefits Center (NBC) on July 26, 2013.  The case was then transferred to the Nebraska Service Center (NSC) on January 6, 2014.   At this time the case is assigned to an officer.  Although assigned, we cannot predict the date the case may actually receive review.   If you have not received a decision or other notice of action on this case within 60 days from the date of this email, please contact us for an update."   I've been getting this "assigned to an officer" BS for almost two weeks now. IR-1 / CR-1 Spouse Visa Case Filing and Progress Reports	May 2013 I-130 Filers	We also got asked again for marriage certificate. Ours was in English, so it's not the language, but USCIS demanded a civil ceremony marriage certificate, which we cannot provide, since we were married in a church. We sent a copy of the marriage certificate to them again with an extract from the population system stamped by the civil registrar's office, showing that we are indeed married. So frustrating, if they don't accept normal and valid Finnish marriage certificates, why not say so on the embassy website? We got married according to the Finnish law and it sucks that USCIS can't respect that. Hoping our cover letter with the explanation and the evidence will do.   So they waited till the last day of teh 60-day after transfer and then they hit you with an RFE to buy themeselves more time and actually take your petition from their time average calculations. I don't know what they want yet, said the letter was mailed out yesterday. I've asked my lawyer but he is busy atm.   As a side note what else do they want other than marriage certificates, evidence of trips together, 10 of thousands of emails, evidence of me paying for her schooling, evidence of her visiting here, 100's of wedding photos... seriously just what do they want and please tell me we get an answer after sending more evidence back? Its not another 9 month wait I honestly don't know what I'll do. You hired a lawyer and you still got an RFE???? IR-1 / CR-1 Spouse Visa Case Filing and Progress Reports	May 2013 I-130 Filers	I think someone asked earlier how fast the RFE showed up. We got the email notice on Feb 10th and the paper version was in the in-laws' mailbox on the 14th.   We got the RFE because of our marriage certificate. Apparently it's not good enough, since it was not a civil ceremony. We got married in a church, which is completely normal and legal in Finland. We called USCIS and they told us to mail the marriage certificate again and explain that the said document is valid... If they deny us, I have no idea what to do anymore, since we can't get exactly married again in the civil registrar's office just to please NSC. We have been married for several years already. We did however, get a piece of paper from the civil registrar's that shows we are married, but it's not a marriage certificate. I guess now we wait again... We were transferred on Dec 5th to NSC and my wife called last week. As we were approaching the 60 day mark they agreed to look into it early for us and respond via letter.   ?Our records show that your petition is currently pending adjudication. We regret that we are unable to provide you with a completion date at this time. We apologize for the delay.?       Not really worth the paper it's written on. From Thursday my wife is going to call them more regularly; we're going to approach the Senator again and send letters/emails to numerous USCIS management and government officials.   Would I be right in making the rough calculation that there are 500,000 pending I130's nationally x $420.00 = $210,000,000 revenue?   I agree and have the same feeling that the "60 day" mark does not mean sh$#%.   We are at their mercy and there isn't a thing we can do about it!!!!	etrangais	Male	Morocco	2014-02-03 09:53:00
