Yeah agreed. But I am concernned that when I file the petition, and put our daughters name on it, when it works through the system, they will assume she is not a US citizen, and try to issue a k2..(which may delay cause confusion etc toher mothers k1) Im probably being paranoid....but I dont want anything to delay the process good.gif Im wondering if I should include a letter of explanation that describes that our daughter is US citizen???

(I filed the report of birth abroad in Manila and legitimaized our baby even though we are not married) So, my question is this since our daughter is a US a citizen, is there any special way I should handle this? She doesn't need a K2, but will accompany her mother to the US....any one else have a similar situation? would love to hear how it was handled?

hahaha yes my fiance knows all, I don't think I would have asked her to marry me if I couldn't have open dialogue about me making some less than intelligent choices in my life, but she understands that I'm a knuckle head. I do worry too much, I just read all of these horror stories in some of the forums and then get a lot of anxiety. I (just like everyone here) just want to be with the person whom I love the most. Send it USPS delivery confirmation. Send a check for the $28 you save to me instead.


I get a huge corporate discount on Fedex....its actually the same price as USPS...and anything that shaves days off the process (in theory) even if its one day is worth any price, to me. I sent the Packet via Fedex last night, it just arrived at the CA service center...

Here's the situation of a friend. She came to the US on a K1 Visa last June 2006. They did not get married with her fiance but stayed in the US at some relative's house until February 2007. Some issues include age gap, the guy being in his 50's and my friend was only 19 yrs old and she was not ready at all to get married then. But obviously, she overstayed because legally, you only have 90 days to be in the US unless you got married.

Now it's 2010. The communication is back between the two of them. To make it short, the love and care is still there, the guy is visiting her again in the Philippines and wants to file another K1 petition for her. I know this road does not look smooth at all considering the issues mentioned. But on the other hand, there MIGHT still be hope. That's why I'm posting this message to seek advice and suggestions on the best approach to do. For sure with the issues they've had, it'll be more than a red flag for the embassy and for the US immigration team.

I have seen this quite a bit, having lived in the Philippines. My advice would be to have the guy hire a reputable Immigration attorney. He certainly will raise all sorts of red flags with this situation, and having an attorney to author good explanation letters and advise in the situation can be helpful. That said, this is still going to be a tough sell to USCIS. The other option is to just go it alone and write a very Detailed and very sincere letter of explanation. I dont think this is an impossible situation, but I think its going to be a rough row to hoe.

I think the confusion came because people were actually trying to read into your question to determine what exactly you were asking for. My reading of your question came out as if you were asking a question like "I'm 18 now. When do I have tell the government that I'm not joining the Army?", or "I just lost my job. When do I tell the unemployment office that I'm not applying for unemployment benefits?". The answer to these questions, of course, is that you DON'T tell the government about something that you're NOT applying for. When people ask questions like these, the natural assumption is that they don't understand the process so they respond with "You don't do that". It gets more confusing when you respond with "I know I don't do that. WHEN don't I do that?". :blush:

Just for your future knowledge...

You list the beneficiary's children on the I-129F because the form requires this information, and not because any of the children may be applying for a K2 visa. The only effect this has on the K2 is that USCIS and the consulate will at least be aware that you knew about the children when you submitted the petition. Some consulates get picky about issuing a K2 to a child who wasn't listed on the I-129F, implying that the beneficiary is bringing a child the petitioner doesn't know about.

When the petition is approved by USCIS then the beneficiary becomes eligible to apply for the K1 visa. At the same time, any of her children who are unmarried and under 21 years old also become eligible to apply for a K2 visa. You, the petitioner, don't have to do anything in particular to make them eligible - they derive their eligibility from your fiancee's approved petition (which is why the K2 is called a 'derivative visa'). A K2 visa application is submitted to the consulate in the same way as a K1 visa application, using the same forms (with some exceptions). If the K1 visa is approved, then the K2 visas are also approved. Alternatively, the K2 visa application can be submitted up to one year after the K1 visa is issued.

However, there is no requirement that a K2 visa application be submitted just because a child is eligible to apply for one. If the child isn't going to apply, then the K1 beneficiary simply won't submit a visa application for them. You don't ever have to notify anyone that you aren't going to submit a K2 visa application for an eligible child, nor do you have to explain to anyone why a K2 visa application was not submitted for a child who appears to be eligible.

No the answer is IF THE CHILD NEEDS IT THEY APPLY FOR K-2 AT THE EMBASSY.

Your child doesn't need ot therefore will not apply. Only your Fiancée will apply for a Visa at the Embassy. If the IO asks about the child she will simpyl reply that no Visa is required as the baby is a USC and already has a US Passport.

Maybe it's confusing because you're doing a lousy job of phrasing the question... :whistle:

You don't EVER have to tell USCIS, the NVC, or the consulate whether or not the child is a US citizen, or whether or not the child will be applying for a K2. You have to list the child on the I-129F because it's required. You have to list EVERY child, whether or not they are eligible or intend to apply for a K2. If the child never applies for a K2, so be it. The K2 only becomes a factor when the child actually APPLIES for a K2 at the consulate.



Do you have the same situation? and the answer the child applies for the K2 at the consulate is what I was looking for. Would be nice if the USCIS would document or explain this somewhere. Perhaps you work for them, as you appear to be an expert? Could you pass that along :)

If you're asking about the child being able to travel to the US then there is nothing to be handled as the child is a USC with a passport and can come to the US without a Visa.

Handled in what sense? The child is US citizen so any consular processing will be done for your fiancee - ie her fiancee visa.


handled in the sense....they see the child on the application....does the NVC do an RFE?? do they try to approve a K2 at the USCIS or NVC? etc etc, there is NO where they actually ask the citizenship of the dependent child (only where they are living) nor do they ask explicitly if you are applying or not applying for an associative K2.... If it is all handled at the embassy great...then the situation can just be explained there. However, since the dependent child (our daughter) was listed on the i129f...does this affect any of the process prior to consulate receiving the approved app. Again, as I mentioned, there is NO where to specify the child is also applying for a k2 or not, or what the childs citizenship is..

Again, I know there are lots of people who had to have had this situation... would LOVE to hear from you..

Ok so I asked this question a while back and never really got a good answer, so I am asking again. I am hoping to hear from somebody who has the same situation. My Fiancée and I have a baby born last year. I filed for and she was approved US derivative Citizenship. She has a CRBA, and a US passport, she is an American Cit/Filipino Cit. I filed my fiancées i129F last week, of course I listed our daughter as a dependent child on the form, I also included copies of her CRBA as additional information to prove we have met in the last two years. So my question is (and it would be awesome if someone who as actually done it answers) How is this handled? Does it affect the adjudication of the application? or is it simply something that is handled during the Interview? Any tips or advice on how this is typically handled would be great. Thanks!

Immediately. remember that the Visa is good for 6 months after its issued. You don't want to take a chance on your wedding. While some cases are complete in 4-5 months most take 7 or 8 (or longer) Check the timelines here to get an idea. I would file ASAP. If you do win the lottery and get it done quick you can always file for an extension....much better than still waiting for approval as your wedding day comes and goes....best of luck!

While I agree with you that it is a bad idea to do this, I don't think this statement is true. Generally speaking, Thanks to the principle of comity, the United States recognizes the laws of foreign countries. Thus if the marriage was not 'legal' in the Ukraine, The US would not recognize it. i.e. if there was no marriage certificate, license etc, then the US would not consider it a legal marriage.

to the OP, I still think this is a risky idea...why chance it?

Sorry if this is answered elsewhere in the forum, but I couldn't find it. We Just found out that my fiancee is 5 weeks pregnant with our 2nd child. :D . Timing is a little off, but we are very happy about it. We are still waiting for our NOA2>NVC>INTERVIEW, but hoping all this is going to transpire in the next 2-3 months. So, my question is, I know that I will need to sign a statement, for her to present at the interview, that in affect, says Yes, I know she is pregnant, and yes, I will still marry her. So, my question is, should this be a sworn affidavit; notarized? Our does a simple letter with my signature suffice? I am hoping to be at the interview, but can't guarantee at this point since we don't have the date yet.

Hi, I am sorry for your trials, best of luck for your fiancé to find a new job quickly. I think the quickest and best way for this is to have him find a co-sponsor ASAP, maybe a parent. This is probably the easiest to document and causes the least stress to prove for your interview. This way he can look for a new job and you can prepare for your interview.

I filed a petition for my fiancee on Feb 16th,2010 and since then I have only received a receiving notice.
It been about 7 months and normal processing time for these type of cases are about 5 months. I have been
inquiring about the case for last 6 weeks through the various sources, such as congressman's office, Senator's
office and also calling the National customer center for the USCIS. My case is pending at California Service Center.

All the responses came back to me as a background check is not complete. And once response came back as that
my case require extensive background review and USCIS can not render the decision until it is complete.

But today I got a response to my inquiry from USCIS and it said the following

Your case is currently being adjudicated. You should receive a notice of action* within 90 days.

What dose this mean. Are they done with the background check? Please tell me and clear this for me
if anyone know the answer. Thanks



My guess, they have received the required background information, and are reviewing your petition. I have heard of others, who received similar notices, and were approved/RFE'ed in well under 90 days.

Who gave her the letter? Are you sure its not a recommendation for a follow-up? (as in, negative now, but check-up again) Is it an actual mandate to have one? more info please. I have never heard of a follow-up sputum test for AOS, (doesn't mean its not the case) but I would be surprised if they issued the visa with a questionable chest xray/sputum test.

I have either lost or misplaced the boarding passes for my outgoing flight to Manila. I do have my boarding pass from Manila to Bacolod. I also have the boarding passes from Bacolod back to the USA. Do you think this is going to be a problem? I do have plenty of pictures of us together. I do not have a hotel receipt because I stayed at her house. Although I do have a receipt from the hotel for the one night I spent in Manila on the way back to the USA. I also have 11 pages of skype call records. Are the outgoing boarding passes necessary ? Any advice would be appreciated


Passport stamps and bag tags if you have them, should be ok. When I fly to to the PI I usually dont check a bag (lived there for 2 years, and have a lot of clothes at our house there). The more stuff you have the better, so I would print out the Airline receipts too.

also please, pretty please update your timeline, when you send in your packet, or do so now if you already have.

Don't worry, the U.S. Embassy Manila (USEM) still accepts cosponsors. Many VJerz in the Philippines forum have used cosponsors. A friend of mine used a cosponsor in August at the USEM.

My friend used his brother as his cosponsor. Instead of submitting an I-134 from the cosponsor, my friend submitted an I-864 (plus the accompanying documentation). It worked fine. His Pinay fiancée arrived here in September and they will be married soon.

Everyone has AP at NVC. Then you'll get AP while at the Embassy. It's all normal. We were there for three weeks.


Im Just concerned because people with NOA2's around mine have already been forwarded to the Embassy.

I was in AP at the NVC no need to worry it will only be no more than 30days including the weekends. They wont request any additional info. It is more than likely going through more background checks that is all. when I was there they did not request anything else just more random checks and according to them it was done in 15days (they dont count the weekends) so no worries you will be fine....Once it is out of there it will move fast and you will forget you were even in AP......... :thumbs:

everytime either me or my fiance calls the line is busy. we've called during their operator hours and also at other times as they are supposed to have a 24/7 information line. yet no matter what time we call the number is always busy. we are dialing this number (603) 334-0700 is that right?

Number is correct. Just keep trying. I call them every other day as my case is in AP. I just keep hitting redial (record for me is 151 times) then you get through, then you are on hold. I have tried calling at various times, always seems the same. But yeah, just keeping trying...eventually you will get through.

I am concerned because i had planned to go back over there in March and i'd heard that you can't enter the USA while the visa is pending.

You can travel to and enter the US while your k1 is pending. I would be careful about mentioning anything to the immigration officer about having a USC Fiancée' or getting married or anything like that. Do not lie, just do not volunteer information, when asked, your reason for visiting, you are here to visit your friend, tourism, etc. The Immigration officer can and will deny you entry into the USA of they believe your purpose is immigration. also UNDER NO circumstances Overstay your VISA!!!! this will most certainly jeopardize/delay your k1.

As my Fiancée is now 4 months pregnant, and we are still waiting for our NOA2, I have researched this quite a bit. You will need to provide a notarized letter that states that you are aware of her pregnancy, and intend to marry her when she arrives in the US She will need this at the interview. Also, make sure you call the airline you intend to travel, and double check their policy, it varies greatly. It would also be prudent to get a letter from her Doc that states her due date, and also that she is in good health, the airline may require this.

Hello I am from the philippines and my Fiance is from florida, his income does not meet the requirement for K1 visa so he used his uncle to be his co -sponsor who had been his guardian since his mom died. i have all the papers and all the documents needed. I am just scared that I might get denied, also my fiance included all his letters from school that he got a scholarship. He is entering in a university. please help me out on this. I just heard that US embassy in manila does not accept co - sponsors. My interview is this monday and I can't focus because of this problem.


Search the forums here, particularly the Philippines forum. There is a lot of discussion on co-sponsers and Manila.

Not having sufficient income and using a co-sponser is a problem with K'1s in Manila, most are denied.

I assume your fiance is a full time student? This a very tough case unless he can prove he has assets to support you in the USA.

Dont mean to be harsh, but maybe you should wait a bit until he finish's School?

Hi Tahoma!....hope you (2) are well. We are in AOS fun now....Filed AOS on 5/21 NOA's on AP EAD and 485 5/24. Checked the case status today and saw Floricel's I-485 was transfered to CSC on 7/7. Which is awesome, as that probably means NO INTERVIEW. Bad news, the ASC here in St Paul is WAAYYYYY back-logged, we have yet to recieve the Biometrics appointment letter :(. The local ASC is at 8+months for I-485's so I am extroplating that the bio's are probably running 2-3 months...uggghhhhh. Oh well this is a breeze compared to the K1. : )

Thx for the reply. Just to clarify, she pays the medical fees at St. Lukes correct?? That is not part of the fee she pays at BPI, which is for the interview only? If so, she will go ASAP for the medical.

I received notice that NVC sent the paperwork to the Manila Embassy last week. My fiance' has completed all the paperwork (CENOMAR, security, BC, etcc.. and she has all of the petition paperwork already in her possession (I134, photos, emails, letter of intent, etc..) She has the money for her medical and interview. NVC gave me the MNL numbers which I gave to her so she can go to BPI and pay the fees. My question is, does she have to wait for the embassy to actually recieve and put the paperwork in their system before she can pay the fees? Reading the posts here has me a bit confused. One says she can schedule interview 4 hours after paying fees and only mentions needing the MNL number. The embassy web site also mentions the 4 hours but does not really indicate if there is an internal process that must be completed prior to paying the fees. I'm just a bit confused if there is some internal processing at the embassy before she is allowed to pay fees and schedule interview or is just having the case number is enough?? DO they have to "LOG" our case into their system before the fees can be paid and interview scheduling be completed, or is it enough to have just the MNL number?

It appears either she or I will have to register on the site after the fees are paid so she or I can complete and print out 3 forms in duplicate (the visa applications) to be taken for the medical and interview. I am guessing that the processing that is referred to in the posts is when the bank notifies the embassy the fees have been paid and that is what is entered in the system after 4 hours so she can register and schedule the interview?? any help is appreciated.

Another question, should I scan and email to her the NOA1 and NOA2 for her to have for the interview and medical?

Yes, she will need to wait until the embassy recieves the packet and enters the data into the system before she can pay the fees and schedule the interview, at least that was our experience. Yes for sure scan the NOA2 and get her three copies. That and the MNL case number are all that are needed for the medical. Encourage to do the Medical ASAP in case there is some issue with her chest x-ray and you need to under-go a sputem test.

PhilippinesMedical without interview letter

Hey guys! I'm just wondering, is it true that St. Luke's do medicals even without the interview letter from NVC/Embassy? How soon can my husband go for his medical? I paid the AOS and IV fee bill, and still waiting for them to be cleared. So technically, they haven't reviewed AOS and DS-230 (IV) documents yet. Can he go do his medical now? What does he need to bring with him?
