so update.
apparently while i was sitting here envying people who got approved and those who go through manilla embassy quicklike,we got approved.
our approval date is nov 17th.
now before you congratulate me ,keep it for when i get my noa2 hardcopy.the news is amazing and most certainly bee and both needed it,but im still worried about getting the hardcopy.
im guessing our case is either AT the embassy or on its way.here is what the email said:
The California Service Center (CSC) no longer has jurisdiction over this petition. The petition was approved and notification was mailed to the address of record on November 17, 2010. The petition has been forwarded to the National Visa Center . Please send any further correspondence to the following address: NVC, 31 Rochester Avenue , Portsmouth , NH 03801-2909 . Direct any telephone inquiries to (603) 334-0700.



NOTE: Always include any identifying information about the petition, including full names and dates of birth for petitioner and beneficiary, receipt numbers and the NVC case number.

Hi Thai, I am originally from Hailey Idaho, yes. Although I have lived for the past 20 years in Minnesota. When I was thinking of a screen name I put my original State (province) and my fiancées home province in the PI. I should say I'm from Minnesota as I lived here so long, but the Inter-mountain West will always be home....wish I could move back! Where do you live in Big Sky Country? They are finally working on the July petitions.
I just got an email from USCIS saying they mailed a notice for RFE on Dec 7th. Does anyone know how much time they give you for a deadline to respond.
It will take at least a week for there letter to get to Thailand and a week for a return letter.
Can I call the National customer service center ( 1-800 #) and find out what evidence they need so I can get a head start on collecting it ? If so where are they located or what time zone and what time they open so I can figure out the time difference,I can't find it on there site. Do I need any information other than my WAC # when I call?
Sorry for all the stupid questions, I'm not all that computer savvy.

Hi Thai. The letter will tell you how long it you have, I believe it is typically 90 days, so you should have plenty of time. Unfortunately the script readers in the call center will not be able to tell you the why. You should be fine, plan on 90days from date of notice.

I will be calling the embassy in a couple of days to see if i can get the official date of the interview cuz since i wanna go there for it ill wanna book my ticket soon and let work know whats going on.

Hi guys, I have been off our June forum for a bit, thought I would check in. Glad to see most everyone is approved and moving along. Sorry for those that are still having challenges (YGR). My fingers are crossed that everyone still waiting is approved soon, and those with medical/interview scheduling it goes smooth, and fast.

After much hell and lots of phone calls/time on hold, we were able to get our interview scheduled for December 20th. My fiancée is doing her Medical today and tomorrow. Wish us luck!

you could always try expediting the petition,i mean its not a 100% thing,but you might get lucky


You can try, but the odds are very very very slim, generally the only reason they will expedite for a pregnancy is if there is compelling health risk to the mother or child or if there is a compelling humanitarian reason to do so there definition of humanitarian, is basically the mother and child are in grave risk if they dont.. been there done that, My fiancée is 5 months pregnant, when we found out she was, I was still waiting for the NOA2. I tried a lot of angles for an expedite, and was denied.

Alright, all....Weird twist of things. On November 16th, the USCIS said that they were sending me an RFE. So yesterday I received (didn't pick up until today) an envelope marked 11/16 from the USCIS, but the only thing inside was the copy of my birth certificate that I sent.... :blink: WHAT DOES THIS MEAN????? There was no letter, no marking, no NOTHING with the birth certificate. Do you think more is coming? I just don't understand...I'm dumbfounded. :help: Why must they toy with us this way??

That sounds very odd and not right. Call them first thing in the AM.

Thanks, I'm hoping we can be strong and keep it together! Malawi is a long trip from the west coast of the states - usually go from San Francisco to Atlanta then allll the way to Johannesburg in one flight, overnight in Jo'burg and onto Malawi the next morning. Usually about 36 hours of traveling from beginning to end. Bleh! :blink:

OMG...36 hours. I will never complain about 17 hours to the PI again! Once upon a time I spent 6 months in Namibia, flew from JFK to Jo'burg and on to Windhoek. The 19 hours straight from JFK to Jo'burg was, bar none, the worst flight I have ever been on, Until the one coming back, we had hellish headwinds, and it was 22 hours. Had to stop in the middle of the night in the Cape Verde Islands to re-fuel....it was hell.

Hang tough guys. Everything happens for a reason. This is a sh$ty process that tests all of us emotionality, physically financially and even spiritualy. The distance is a nightmare. the time apart is a nightmare. The stress of the visa process is a nightmare. YOU ARE NOT ALONE! every couple here goes through rocky points, most make it through the other side, some do not, but remember everything happens for a reason. My Fiancee and I go through it, as matter of fact last night she told me she wasn't really happy about moving to the US...she would prefer to stay in the Philippines. At first I was pissed, but i see her side, and she told me, it didnt matter where we live as long as we where together. I mention this, because it would have been so easy to just get pissed and have a fight over this. Dont sweat the small things. You are important, you are loved, there is a plan for all of us. I truly hope you can work things out, if you cant, after honestly trying and coming to that conclusion...then it was never meant to be! I am thankful for all of your 'virtual' friendship and wish you all the best!

I grew up on a cattle ranch, tried to get her to eat glorious rare prime rib...she almost puked! hehehehehehe But if it swims....she will eat it! its funny our daughter born 3/17/2009 looks 100% American...no one would ever guess she is half Filipino but she is now almost two, speaks nothing but Tagalog, and eats nothing but Filipino food! hehehehehehe

Anyway! So um, I was thinking about this today. For those of us that were touched last week, while we're waiting for our (potential) hard copy approvals in the mail our case could be, at this very moment, on its way to the NVC. Maybe the mail truck headed to our the various beneficiary's places of residence with the Golden Ticket will pass the mail truck with our new and improved approved petitions headed to the NVC and the drivers will tip their hats, nod, flash a winning smile at one another and zoom off into the distance. It could happen, right?

uh oh...... so i dont have to wait for the embassy letter????? all the while, i thought i should...... thanks for that !!!!!! how many days from noa2 date do we call nvc(?) (because others said they got info not fr nvc but dept of state!!!) and nvc tells us the status of our case then they give us our mnl number thru phone? we dont have to wait for nvc's letter in the mail? and how would i know if manila has received my case already? i understand that manila has to receive our papers first before we can schedule my medical and interview, is that right? now now now...... am i in panic????? LOL !!!!

Dont Panic. 5 business days after you receive your NOA2, call the NVC(NVC IS the Dept of State) at 603-334-0700, give them your USCIS receipt number and they will give you your case number it will be MNLXXXXXXXXXXX, this will be your DOS case number going forward, ask them if they have sent your case to Manila yet, if they have not yet, call back everyday until they tell you they have. They send your case electronically same day, and it usually takes about 4 days for them to DHL the hard copy to the Embassy in Manila, however once they send it electronically, you can start calling for an interview appointment, as it will be in the system. Once you call into the call center and make an appt, you can go for your Medical, as the call center will send you an email verifying your interview appt print this out, along with a copy of your NOA2 to your interview. I have heard of people going to medical, and just giving there MNL case number...you can try, but I cant verify if this is accurate or not!

So the procedure is, wait 3-5 business days after your NOA2, call the NVC, get your MNL case number, then start calling to schedule your interview, once you have done this, they will send you an email with your interview appointment verification, then go for your Medical.

this maybe out of topic but i have a strong feeling members here have the right answer....
my noa2 was touched (and hopefully approved) on nov 17.....
my concern is...... by december, i have to move around for my volunteer work.....
and during that time US embassy manila might send me the letter.....
i have to do some steps to receive it the soonest....

would anybody here let me know what courier they use?????
that way, i will try to make arrangements with the concerned courier as i live alone....

this matters a lot to me.....

They use Air21. But DO NOT wait for the Embassy in Manila to deliver your letter. They often send these out after people have been interviewed or never. After your NOA2 is approved, and then goes through NVC and is forwarded to the Embassy, You need to call and schedule an interview. Manila uses a different procedure then most consulates. Also please note that as of Dec 1st the Embassy is switching contractors that it uses to handle the call center scheduling interviews, so the number will change. You should consider getting your Medical done if you have not already (you can do this once you recieve your NVC MNL case number).

I knew you'd be out in a few days!!! Can't believe I can say this twice in a row but... Told ya so! ;-)

Congrats, I can't imagine how relieved you are.


I will admit! you were right! :bonk: Guys, I seriously hope EVERYONE of you gets your NOA2...like today! And I really, really hope you are in and out of the NVC in a week. I can honestly tell you that being told I was in AP at the NVC was the worst part of this whole thing yet! It was like #######??? after almost 5 months at the USCIS you are telling me I now have to wait for an 'indefinite' amount of time?? The worst part was the having NO timeline...only thing that saved me was the others here on VJ who went through the same thing. In the grand scheme of things, it was nothing! 18 days total, 12 working days, well within the 4 weeks the letter said it could take. Was just a Mind F@#@ seeing everyone else go in and out in 3 days, and then hearing the dreaded "AP" and then franticly searching VJ and hearing, 7 weeks, 6 weeks, 3 months, etc etc. On to the next phase...Medical and then interview :) bring home the pink!

paranoia...may destroy ya! I am sure its an approval. Don't worry. As we all know there is no rhyme or reason to the updates on the site. Mine (still) says initial review, last touch of 11 June. With all these touches, I bet we see lots o approvals by Friday.

On May 29, we went to one of the desi grocers around DC--to buy some toor (last time at that store, we were able to get an 8-lb packet--but this time no packets over 4-lb), curry leaves and a box of "Marathon Brand" mangoes (not really that nice, product of Mexico), which runs about $9 there. On the counter, I noticed boxes of "Royal Mangoes" which were imported from India (which gave these a leg-up on the Marathon--we didn't yet know the price of it). When we asked, it was $35 for the box (3.5 kg/7.7 lb)--and we found out by further looking on the side the mangoes within to be...Banganapallis (with the fruit-count written on the side). Well, we took a 9-count box home with us--and have so far consumed 6! :D :) :dance:


Having lived in the Philippines...I can sympathize on the longing for good mango! We can get the most fantastic mango in the PI for about 90cents a kilo! Glad you are enjoying them God Bless!

First, I am out of AP!!! :dance: :dance: Our case was sent to Manila today! only 18 days, but it felt like 180. Second, thank you all for being here virtually! I read through this entire thread while waiting..and everyones wit, humor and positive attitudes really helped. I feel bad for whining so much when I only had 18 days at the NVC, and some of you good folks endured weeks. Anyway, thanks for this thread, its been my best consolation here on VJ! Most of you that started this thread are already with your loved ones in the US. May you all have pleasant and easy continuation of your journey and your life.

42.81 - Procedure in refusing individual visas.

(a) Issuance or refusal mandatory. When a visa application has been properly completed and executed before a consular officer in accordance with the provisions of INA and the implementing regulations, the consular officer must either issue or refuse the visa under INA 212(a) or INA 221(g) or other applicable law. Every refusal must be in conformance with the provisions of 22 CFR 40.6.

(b) Refusal procedure. A consular officer may not refuse an immigrant visa until Form OF230, Application for Immigrant Visa and Alien Registration, has been executed by the applicant. When an immigrant visa is refused, an appropriate record shall be made in duplicate on a form prescribed by the Department. The form shall be signed and dated by the consular officer. The consular officer shall inform the applicant of the provision of law or implementing regulation on which the refusal is based and of any statutory provisions under which administrative relief is available. Each document related to the refusal shall then be attached to Form OF230 for retention in the refusal files. Any documents not related to the refusal shall be returned to the applicant. If the grounds of ineligibility may be overcome by the presentation of additional evidence and the applicant indicates an intention to submit such evidence, all documents may, with the consent of the alien, be retained in the consular files for a period not to exceed one year. If the refusal has not been overcome within one year, any documents not relating to the refusal shall be removed from the file and returned to the alien.

© Review of refusal at consular office. If the grounds of ineligibility upon which the visa was refused cannot be overcome by the presentation of additional evidence, the principal consular officer at a post, or a specifically designated alternate, shall review the case without delay, record the review decision, and sign and date the prescribed form. If the grounds of ineligibility may be overcome by the presentation of additional evidence and the applicant indicates the intention to submit such evidence, a review of the refusal may be deferred. If the principal consular officer or alternate does not concur in the refusal, that officer shall either (1) refer the case to the Department for an advisory opinion, or (2) assume responsibility for final action on the case.

(d) Review of refusal by Department. The Department may request a consular officer in an individual case or in specified classes of cases to submit a report if an immigrant visa has been refused. The Department will review each report and may furnish an advisory opinion to the consular officer for assistance in considering the case further. If the officer believes that action contrary to an advisory opinion should be taken, the case shall be resubmitted to the Department with an explanation of the proposed action. Rulings of the Department concerning an interpretation of law, as distinguished from an application of the law to the facts, are binding upon consular officers.

(e) Reconsideration of refusal. If a visa is refused, and the applicant within one year from the date of refusal adduces further evidence tending to overcome the ground of ineligibility on which the refusal was based, the case shall be reconsidered. In such circumstance, an additional application fee shall not be required.

B-) Here it is, I am not an immigration lawyer, but I interpret Section C above to be that the consular officer must at least consider the additional evidence, to wit; the I-134 now we could drag this out forever and say that the above only applies to immigrant visa's, is tough to interpret or could be interpreted differently. Now, you, I and everyone else knows that the CO has the omnipotent power to issue the Visa or not. I suppose that the only way that this could be really be tested is to file suit. But then again the CO, could just say, yeah, I considered it and I determined the applicant is ineligible. So in the end, does it really matter if they HAVE TO CONSIDER it or not? NO. We all know this. I think boiler said it best..."there are no certainties in Immigration"

Many consulates will NOT accept co-sponsors for fiance visas.. many will only allow them for spouses... CR1's


It is United States Code, law of the land, that they have to consider it. While it may be true that they will not accept to issue a Visa, they are required by law to at least consider it. thats what I meant, I should have been more specific.

As you can see from the replies of other Posters, Consulates make up their own rules. Manilla has its own variant.

I self sponsored my K1, an option I had but not one that I believe is applicable in Manila.

I believe marriage would be the only route, then go with the I 864 which is not adjudicated by the Consulate.

I am sorry to hear that. I am afraid that in this case, they may have indeed denied the co-sponsor. I am not sure what his next steps could be. Maybe others here have some pointers.

My brother used our dad as the co-sponsor. My brother's fiancee had her interview on may 21, when the consular asked for her fiance's I-134 she give them my brothers I-134 but not my dads I-134. The interviewer asked her for more info concerning my brothers income. She must have mistakenly forgot to hand them my fathers I-134 at that time. The following week she went back to the embassy to give them the additional information the consular requested and my dads I-134. The interviewer said she now had all the necessary paperwork and that she could go home and wait for her visa. well last week she got a letter in the mail from the embassy stating... "we are unable to issue you an immigrant visa because you have been found ineligible under the following section of the Immigration and Nationality Act, you are likely to become a public charge". When she submitted the additional information i think the embassy may have overlooked my dad's I-134. My brother emailed the embassy a letter stating what happened, that they may have overlooked the co-sponsor I-134 when she went back the second time to give them the additional information.


Well, this sounds like they did indeed deny the co-sponsor. I am not sure what your brother's situation is. Is your brother between jobs? Is is financial situation likely to change? as in get better?

Manila Embassy seems to prefer co-sponsors for USC who are either college students or recent college graduates. They have been known to be rather picky on the whole co-sponsor issue.

I agree with this, they are picky, but I am not sure if its anymore so then any other consulate. They look at the future ability of the petitioner to support the beneficiary. If this is not the case, well then I could see that the co-sponsor would not be accepted. I do think however that its unfair to categorically say that the Manila consulate has problems with co-sponsors.

to the OP, Nate, don't listen to this trivel. Try to ascertain exactly why the co-sponsor was not accepted. My feeling is that something was probably not completed correctly or documents (w-2, 1040's etc etc) were missing. Search the Philippines forum, or the k-1 forum for 'co-sponsor' and you will find many many people who have received their Visa using a co-sponsor. I did several searches and could not find one visa in Manila that was denied because they did 'accept' the co-sponsor. In every case there were other mitigating circumstances.

hi Boiler, I know 3 people now in the US who came over on K1's in which their beneficiary had a Co-sponsor. In each case, a parent. Is your experience different? Can you elaborate?

Every consulate accepts co-sponsors Manila included. Ryna is correct if its Fiancée on K1 then you need the I-134. I can only assume that the CO either did not see your dads I-134 (unlikely but possible) or it was not completed/documented correctly. Did the CO mention anything?
